[4. Approval of Minutes]
COMMISSIONER MAYERSOHN? COMMISSIONER CUTLER?>> THE MINUTES. SO MOVED. >> ALL IN FAVOR? IT PASSES
[5. Comments from the Public on Non-Agenda Items]
UNANIMOUSLY. >> COMMENTS FROM THE PUBLIC.
ANYONE FROM THE PUBLIC WISH TO SPEAK ON A NON-AGENDA ITEM? NOBODY SIGNED. ALL RIGHT. COMMENTS FROM THE COMMISSION.
HE HAS GOT HIS PAPER OUT. WE WILL START WITH COMMISSIONER
CUTLER. >> THANK YOU, MAYOR PETE I WANT TO WELCOME EVERYONE HERE TONIGHT. THANK YOU FOR SHOWING UP. SINCE OUR LAST MEETING, WE HAD TWO SUCCESSFUL FISHING DERBIES, ONE OF THE 13TH OF JULY AND ONE ON AUGUST 10TH.
ALL THROWN BACK FOR US TO CATCH AGAIN NEXT YEAR. ON JULY 15TH, MR. JETER, THE ASTRONOMY TEACHER AT MSD AND THE WONDERFUL ADDITION TO OUR LIBRARY STAFF BROUGHT THE PLANETARIUM TO PARKLAND WITH AN ASTRONOMY LESSON FOR KIDS AND ADULTS. IT WAS A WONDERFUL EVENT AND VERY WELL ATTENDED.
WE HAD TWO GREAT EVENTS. WANT TO SAY THANK YOU TO THE STAFF ARE REALLY PUTTING TOGETHER SOME FABULOUSSTUFF. AUGUST 5TH WAS PARKLAND NIGHT OUT, WHICH WAS A GREAT EVENT FOR EVERYONE IN THE LEAD UP TO THE START OF. ON AUGUST 6TH, WE HAD A SUPER ONLINE RESUME A QUESTION-AND-AN SWER MEETING WITH THE SUPERINTENDENT, HOWARD HEPBURN AND THE IN SCHOOL PRINCIPALS, FOLLOWED BY AUGUST 7TH MAYORS BACK TO SCHOOL BREAKFAST. I KNOW THIS WEEK THAT EVERYONE STARTED BACK TO SCHOOL AND I HOPE THAT EVERYONE IS GOING TO HAVE A GREAT YEAR. I WANT TO SAY THANK YOU TO THE MANY PEOPLE ON SOCIAL MEDIA WHO RESPONDED FAVORABLY TO THE NEW SYSTEM WITH METAL DETECTORS BUT I KNOW THE START WAS A BIT ROCKY, BUT THINGS ARE ALREADY GETTING BETTER AND SOON, THINGS WILL BE MOVING SMOOTHLY. I CAN TELL YOU THAT MY WIFE ENTER FELLOW TEACHERS ARE HAPPY FOR THE ADDITIONAL LAYERS OF SECURITY. I WANT TO SAY CONGRATULATIONS BUT ON AUGUST 10, THE U.S. WOMEN'S SOCCER TEAM DEFEATED BRAZIL FOR THE GOLD. I KNOW SOME BRAZILIANS THAT ARE NOT HAPPY WITH THAT. BUT, GOING USA. THE BASKETBALL TEAM WON, AS WELL. THAT WAS GREAT. I HAD A LOT OF TV WATCHING THAT DAY. TODAY, THE PARKLAND CHAMBER SHARED SOME GREAT INSIGHTS ON BUSINESS PLANS FOR BROWARD'S AIRPORT, CONVENTION CENTER IN SEAPORT. THEY WERE TREATED TO SOME WONDERFUL INSIGHT INTO OUR WONDERFUL PARKLAND RESIDENT BUSINESSES. THAT WAS GREAT AND VERY WELL ATTENDED. IF YOU ARE NOT A MEMBER OF THE CHAMBER, YOU SHOULD BE. WE FINISHED OUR BUDGET WORKSHOP AND I WANT TO COMMEND NANCY AND CHRIS JOHNSON AND THE STAFF ARE PUTTING TOGETHER A WELL THOUGHT OUT AND INSIGHTFUL LOOK INTO THE LOOK AT THE CITY'S COFFERS. DID NOT HAVE A WHOLE LOT OF THE PUBLIC INPUT ON THE BUDGET, WHICH MEANS EVERYONE IN PARKLAND MUST BE HAPPY ABOUT IT, WHICH IS GREAT. I STOLE THAT FROM MICHAEL. I WANT TO GIVE A SHOUT OUT TO FORMER COMMISSIONER AND FORMER BOARD MEMBER, DAVE OSTEEN WHO HAD A BIRTHDAY. AND HIS WIFE, FOR HERS ON AUGUST
31ST. >> SINCE THERE IS NOTHING LEFT TO SAY. WE CAN MOVE ON, RIGHT?
>> COMMISSIONER MAYERSOHN? >> THANK YOU, MAYOR. JUST A COUPLE OF THINGS THAT I WANTED TO REITERATE WITH WHAT COMMISSIONER CUTLER SAID THAT I WANT TO SAY THANK YOU TO COMMISSIONER CUTLER. HE REALLY MAKES -- HE IS OUT THERE INSTRUCTING THE KIDS, HOW TO WORK A LINE, HOW TO BE A HOAX.
HAS A LOT OF PATIENCE. I PUT IT IN AND NOTHING HAPPENS. SO, I REALLY WANT TO SAY THANK YOU FOR THAT. THE KIDS LOVE IT. YOU HAVE ELEVATED THE FISHING DERBY. YOU ARE STILL GOING TO
CONTINUE? >> OKAY. JUST CHECKING.
>> I DO WANT TO CONGRATULATE THE PINETREE WATER CONTROL
[00:05:07]
DISTRICT. SOME OTHER STUFF. SO, I DO WANT TO SAY THANK YOU TO SANDRA. SHE WOULD BE A GREAT ADDITION. OBVIOUSLY, EVERY STATE OF SCHOOL AT RIVER GLADES. I DO WANT TO SAY, I SEE SOME OF THE OTHER PRINCIPALS OVER THERE. WE DO HAVE AN AMAZING GROUP OF PRINCIPALS WITH BROWARD COUNTY SCHOOLS IN THE CITY OF PARKLAND. WE DO HAVE AN AMAZING SRO STAFF THAT WE HAD MAKING SURE OUR KIDS ARE SAFE. SO I JUST WANT TO SAY THANK YOU FOR YOUR HARD EFFORTS KNOW THAT WE ARE HONORING THE FORMER SRO SERGEANT TODAY. AND I WANT YOU TO FOR HIS WORK, HIS LEADERSHIP, AND A GREAT RIDE THAT I HAD WITH HIM. SO, THANK YOU FOR THAT. AGAIN, COMMISSIONER CUTLER MENTIONED THE CHAMBER , THE ONLY OTHER THING THAT I WANTED TO ADD ON THE CONSENT AGENDA, I JUST WANT TO PULL THE FEE SCHEDULE TO AT LEAST DISCUSS THE CONVENIENCE TRANSACTION FEE THAT IS NOT IN HERE BUT POTENTIALLY COULD BE.>> OKAY. SOUNDS GOOD. >> COMMISSIONER BRIER?
>> THANK YOU, MAYOR. FIRST OF ALL, THEY ARE IN THE STAFF PUT TOGETHER A BACK TO SCHOOL BREAKFAST. THAT IS ALWAYS A WONDERFUL OPPORTUNITY TO MEET WITH THE PRINCIPALS AND VICE PRINCIPALS AND INITIATIVE STAFF AND FACULTY WITH SCHOOL BOARD MEMBERS. WILL BOARD STAFF AND ADMINISTRATORS, AS WELL AS A LOT OF THE PTA, PTO, PTS OH, WHATEVER THEY CALL IT. THERE ARE SO MANY ACRONYMS. IT WAS A WONDERFUL OPPORTUNITY. I HAD THE OPPORTUNITY TO GO TO HERON HEIGHTS WITH VICE MAYOR ISROW AND OUR CONGRESSMEN. WE WERE BLESSED WITH THE AMAZING FOLKS.
I KNOW THE MAYOR GOES TO MULTIPLE SCHOOLS THAT DAY SO, I WANT TO SAY THANK YOU TO ALL OF OUR FRIENDS FOR DOING THAT. IT IS A GREAT SHOWING FOR OUR FAMILIES AND OUR KIDS GETTING BACK TO SCHOOL. I KNOW THE MAYOR TALKED ABOUT THE LAST BACK-TO-SCHOOL AND PATIENCE DURING THIS PROCESS OF GOING BACK TO SCHOOL. WE SAW SOME OF THAT TO COMMISSIONERS CUTLER POINT TWO THE METAL DETECTORS. BY THE SECOND DAY, IT WAS MUCH BETTER THAN IT WAS THE FIRST DAY. SO, CONTINUE TO BE PATIENT. WHETHER THERE ARE ACTIVE SCHOOL ZONES OR DURING THE SCHOOL DAY, THERE COULD BE PEOPLE COMING OUT. WE ARE TRYING TO CONTINUE TO IMPROVE THE SAFETY FOR OUR RESIDENTS AND OUR CHILDREN. CONTINUE TO DRIVE SO -- SLOW AND BE MINDFUL OF THOSE SCHOOL BOARDS. WE ALWAYS LOOK FORWARD TO THOSE, THANK YOU FOR BEING THERE. PARKLAND NIGHT OUT, WE DID HAVE READ THIS YEAR, BUT THAT IS GOING TO BE A BETTER AND BETTER EVENT EACH YEAR. I CAN TELL YOU THE FEEDBACK FROM THE PRESIDENTS BEING OUT THERE, ALL OF THE DIFFERENT AGENCIES AND LAW ENFORCEMENT FOLKS AND FISH AND WILDLIFE AND EVERYTHING.
HAVING THEM THERE WITH ALL OF OUR PTAS, IT IS JUST A PHENOMENAL EVENT. I ENCOURAGE PARENTS EVERY YEAR TO CONTINUE TO ATTEND THAT. I ALSO WANT TO ECHO COMMISSIONER CUTLER'S COMMENTS ABOUT OUR BUDGET. WE CONTINUE TO BE A FISCALLY RESPONSIBLE CITY EVEN THOUGH WE HAVE GRAND PLANS FOR OUR CITY.
THAT TESTAMENT TO NANCY AND CHRIS AND OUR OTHER FINANCE FOLKS OF THE CITY. WITH THAT, MAYOR, THOSE ARE MY COMMENTS.
>> THANK YOU, COMMISSIONER. VICE MAYOR ISROW?
>> IN QUEUE, THEY ARE WELCOME BACK FROM EVERYONE. IT IS GREAT TO BE BACK FROM SUMMER. SUMMER IS ALWAYS A GREAT TIME TO GET AWAY, BUT IT IS EVEN BETTER WHEN YOU HAVE THAT FIRST DAY OF SCHOOL AND YOU ARE DRIVING THROUGH OUR CITY AND IT BRINGS IT BACK TO LIFE. OBVIOUSLY, TRAFFIC AND COMPLICATIONS. I THINK IT WAS AN AMAZING FIRST DAY. I SAW LOTS OF SMILES. THAT IS WHAT OUR CITY IS ABOUT. THE VIBRANCY OF EVERYONE DOING THINGS THAT I DID MAKE OUR COMMUNITY BETTER. A LOT OF THAT IS OUR SCHOOLS. IN Q2 THE PRINCIPLES OF THE MINISTRATION AND THE STAFF. ALSO, OUR SCHOOL BOARD. THE METAL DETECTORS, I THINK IT IS A TESTAMENT TO THE REAL COMMITMENT TO SAFETY OF OUR STUDENTS. YES, IT HAS SOME LEARNING PAINS THAT ARE UPHILL, BUT IN THE GRAND SCHEME OF THINGS, IT IS A VERY, VERY IMPORTANT ADDITION. A LOT OF STUFF IS ALREADY BEEN SAID, SO I WILL NOT GO OVER TOO MUCH BEER BUT FISHING DERBY, THE ONE THING THAT HAS NOT BEEN SAID, YOU TALKED ABOUT COMMISSIONER CUTLER'S PATIENCE WITH THE KIDS. YOU ALSO TALKED ABOUT THE ADULTS. HE HAS HELPED ME TREMENDOUSLY, TREMENDOUSLY WITH MY FISHING. BUT, FOR HIM. I WOULD PROBABLY STILL BE PUTTING
[00:10:03]
DEBATE ON MY HOOK FOR MY KID THAT WOULD BE SCREAMING AT ME.WHEN WE GO TO THE FISHING DERBY, THEY ASK IF CUTLER WILL
BE THERE. >> OUR CHAMBER, WHOEVER IS NOT A MEMBER THAT OWNS A BUSINESS IN PARKLAND OR A PART AND RESIDENT THAT OWNS A BUSINESS IN THE SURROUNDING CITY, I DON'T KNOW WHAT YOU ARE WAITING FOR. IT IS AN INCREDIBLE COMMUNITY. EVERYONE IS LEARNING FROM EACH OTHER, THEY ARE SUPPORTING EACH OTHER. YOU KNOW, COMMISSIONER EUGENE, IT IS ALWAYS GOOD TO SEE HIM TO GET UPDATES ABOUT BROWARD COUNTY FROM A MICROECONOMIC LEVEL FROM THE AIRPORT OR THE PORT ITSELF. THERE IS REALLY A LOT GOING ON IN BROWARD THAT WILL BENEFIT OUR LOCAL RESIDENTS. I HIGHLY THEM IN THE CHAMBER. THE BUDGET, ASIDE FROM WHAT IS ALREADY BEING SAID, FOR THOSE THAT HAVEN'T BEEN PAYING ATTENTION OR REVIEWING IT, THERE IS A CHART IN THIS BUDGET THAT IS SO POIGNANT IN ONE PAGE, IT IS A CHART OF THE SURROUNDING MILLAGE RATES OF THE CITIES AROUND PARKLAND. YOU WILL SEE THAT IT IS A DECLINING CHART THAT GETS TO THE END APARTMENT AT THE LOWEST MILLAGE RATE OUT OF ALL OF THEM. WHAT IS SO IMPRESSIVE ABOUT THAT, NOT ONLY DO WE HAVE THE LOWEST MILLAGE RATE, BUT IT HAS STAYED THE SAME SINCE LAST YEAR, AND IN THE BUDGET, IT SHOWS ALL OF THE IMPROVEMENTS AND ALL THE CAPITAL PROJECTS THAT ARE COMING DOWN THE PIKE. IT IS ALMOST LIKE MAGIC. I STILL QUESTION HOW WE DO IT. IT IS A TESTAMENT TO OUR STAFF AND THEIR FINANCIAL ACUITY AND HOW RESPONSIBLE WE ARE WITH OUR RESIDENTS TAX MONEY . YOU KNOW, AS A TAXPAYER MYSELF, I VERY MUCH APPRECIATE IT. THANK YOU AGAIN. ON THE GET UP TO BE SAID. NANCY, CHRIS, THE TEAM. WE HAVE A LOT OF EXCITING STUFF GOING ON, ESPECIALLY WITH THE CONVERSATION ABOUT THE HERON BAY PROJECT. I KNOW THERE WILL BE SOME DISCUSSION TONIGHT.
BUT, THERE WERE 70 GREAT THINGS GOING ON TO A CITY THAT IS ALREADY AMAZING, SOMETIMES I HAVE TO STOP AND ASK MYSELF, HOW DID I END UP HERE? I AM GLAD I DID. THANK YOU ALL FOR BEING HERE. I KNOW WE HAVE GOT A LOT OF RECOGNITIONS AND AWARDS TONIGHT. SO, I WILL KEEP IT SHORTER THAN USUAL. BUT, THINK YOU GUYS. IT IS GOOD TO SEE EVERYONE. REMINDING YOU VERY MUCH, VICE MAYOR. PRETTY MUCH EVERYTHING HAS BEEN SAID.
BUT TO TOUCH A LITTLE BIT ON THE BUDGET, YOU KNOW, NANCY, EVEN BEFORE SHE BECAME CITY MANAGER, WAS THE DIRECTOR OF FINANCE AND DID A GREAT JOB. CHRIS KEEPS THINGS GOING EXACTLY HOW IT SHOULD BE. SO, DAY AFTER DAY, YOU KEEP IT ON THE BEST SHAPE POSSIBLE WITH ALL ASPECTS. BUT MOST IMPORTANTLY, FINANCIAL, WHICH I THINK IS GREAT. WE DON'T HAVE TO WORRY ABOUT HAVING TO EVER RAISE TAXES, YOU KNOW, BECAUSE YOU KEEP DOING EVERYTHING RIGHT. AS LONG AS WE KEEP DOING THAT, BEING FISCALLY RESPONSIBLE, WE WILL BE ABLE TO CONTINUE DOING GOOD THINGS. ONE OF THE THINGS, ONE OF THE OTHER THINGS, THERE ARE SOME THINGS THAT MAKE PARKLAND GREAT, OUR SCHOOLS. I LOVE GOING OUT ON THE FIRST DAY AND SEEING THE KIDS, GREETING THE CAR LINES. ALL OF THOSE DIFFERENT THINGS, IT IS A LOT OF FUN. 70 PEOPLE YOU SPEAK TO THAT MOVIE PARKLAND, THEY COME HERE BECAUSE OF THE SCHOOLS. THAT IS BECAUSE OF THE MINISTER TO SOME OF THE PRINCIPLES, THE TEACHERS, THE PARENTS. IT IS REALLY SPECIAL. THE POINT BEING, MSD, DAY ONE, WAS ROUGH WITH THE METAL DETECTORS. LET ME TELL YOU WHAT COMMITTEE TWO, SNAPPED RIGHT INTO SHAPE. KUDOS TO HER. IT IS NOT EASY TO DO. THAT IS 3600 KIDS. TO HAVE A BIRTHDAY THAT WAS ROUGH, BUT MOST FIRST DATES ARE. JUST TO COME BACK THE VERY NEXT DAY I CAN'T FORGET TO MENTION THAT OUR CHAIR WAS AT THE SCHOOL. THAT IS A BIG PLUS FOR THE CITY OF PARKLAND TO THE SCHOOL BOARD CHAIR THIS MORNING, THE COMMISSIONER, YOU HAVE CHRISTINE, WHO IS THE STATE REPRESENTATIVE. JARED MOSKOWITZ, WHO IS OUR CONGRESSMAN. SO, THE CITY OF PARKLAND HAS SUCH TREMENDOUS LEADERSHIP. IT IS A TESTAMENT TO THE CITY. RIGHT? ALL GOOD LEADERS AND PEOPLE WANT TO BE HERE. PEOPLE WANT TO BE HERE FOR A LOT OF DIFFERENT REASONS, BUT SCHOOLS ARE ALWAYS NUMBER ONE. I THINK YOU FOR THAT. THERE'S ALSO REALLY VOTING, YOU KNOW, ALL ARE GOING TO SAY IS TIMES ARE INTERESTING. WE HAVE TO IN -- REMEMBER THAT EVERYONE MAKES THEIR DECISIONS FOR THEIR OWN FAMILIES, FOR THEIR OWN PERSONS. RIGHT? SO, YOU HAVE TO ALWAYS RESPECT PEOPLE. NOT EVERYBODY IS GOING
[00:15:04]
TO AGREE ON EVERYTHING ALL THE TIME. IT IS HOW YOU DISAGREE THAT MAKES IT IMPORTANT. THAT IS ONE OF THE THINGS THAT CAUGHT OUR COMMUNITY. OUR COMPANY IS PERFECT. BUT OUTSIDE OF PARKLAND, THERE IS JUST TOO MUCH DIVISION, THERE IS TOO MANY PEOPLE. YOUR THIS COMING OR THAT, WHATEVER. LET'S REMEMBER. WE ALL WANT TO LIVE A GOOD LIFE, WE WANT TO BE SAFE,[6. Proclamations and Recognitions]
WE WANT TO SEE OUR FAMILY AND CHILDREN AND EVERYBODY PROSPER.THE MORE WE STAY FOCUSED ON KINDNESS, THE HIGHER THAT WILL GO. WITH THAT, WE ARE GOING TO DO SOME RECOGNITIONS.
>> ALL RIGHT, SERGEANT MARCO RIZZA, COME ON DOWN. I MEAN, REALLY, MARCO NEEDS NO INTRODUCTION, WHATSOEVER.
EVERYBODY KNOWS SERGEANT MARCO. HE OVERSAW OUR SCHOOL RESOURCE OFFICER UNIT FOR 6 YEARS. HE REALLY WAS INVALUABLE WHEN HE WAS HERE. I WILL TELL YOU THAT HE CAME IN AND WAS ASSIGNED TO THE CITY, RIGHT AFTER THE TRAGIC SHOOTING AT MSD. HE WAS TASKED WITH OVERSEEING THAT UNIT, REBUILDING THAT UNIT, AND BASICALLY PUTTING TOGETHER A TEAM THAT WAS GOING TO MOVE FORWARD AND BE SUCCESSFUL. SO, HE CAME IN AT THE RIGHT TIME, HE REALLY TURNED THAT WHOLE PROGRAM AROUND. MADE GREAT STRIDES WITH HIS UNIT. HE OVERSEES 12 SROS AT OUR SIX SCHOOLS. I AM JUST HONORED, THEY ARE, TO BE ABLE TO RECOGNIZE HIM DURING THIS COMMISSION MEETING. I ASKED TO DO SO AND NOBODY HESITATED. WHICH, IS REALLY A TESTAMENT TO MARCO. I INVITED THE PRINCIPLES OF THE SCHOOL. THEY ARE ALL HERE. THEY ALL CAME. WHEN I SEE THEM TO THIS DAY, THEY ASKED ME, YOU KNOW, ABOUT YOU. WHICH, IT REALLY SAYS A LOT ABOUT NOT ONLY THE TOP OF LAW ENFORCEMENT OFFICER THAT YOU ARE AND THAT YOU ENSURED THAT THEY WERE SAFE EVERY DAY AND HAD EVERYTHING THAT THEY NEEDED. THEY WERE ABLE TO COUNT ON YOU, DAY AND NIGHT, RIGHT? THEY OFTEN CALLED YOU LATE AT NIGHT. RIGHT? SO, YOU ARE AVAILABLE TO THEM AND YOU WERE SO RESPONSIVE TO THEM, NO MATTER WHAT TIME OF DAY. IT WASN'T JUST SCHOOL HOURS.
THAT'S A LOT ABOUT YOU AND YOUR CHARACTER AND YOUR WORD -- WORK ETHIC AND THE TYPE OF MAN THAT YOU ARE. SO, THAT IS WHY I WANTED TO BRING YOU OUT HERE AND JUST RECOGNIZE YOU. GET YOU A LITTLE SOMETHING FOR YOUR TIME HERE. THIS SAYS HERE, LET ME SEE IF I CAN READ IT. THERE WE GO. IT IS KIND OF TRANSPARENT. SERGEANT MARCO RIZZA AND APPRECIATION FOR YOUR DEDICATED SERVICE IN YOUR PROFESSIONAL THEM TO THE BROWARD SHERIFF'S OFFICE PARKLAND DISTRICT. THE DATE IS APRIL 2018 THROUGH APRIL 2024.
CONGRATULATIONS. >> MARCO IS A SCIENCE NOW TO THE AIRPORT, AND HE IS MAKING GREAT STRIDES AT THE AIRPORT BUT I CAN TELL YOU I SPOKE TO HIS EXECUTIVE LIEUTENANT TODAY WHO SAID LISTEN, YOU REALLY SENT ME A ROCKSTAR. I SAID I KNOW. I KNOW. I KNOW THAT WAS A DECISION THAT YOU MADE FOR YOUR RETIREMENT, TO GET EVERYTHING SITUATED AND YOU ARE NEARING THAT GOAL, WHICH WE ALL WORK SO HARD FOR, YOU KNOW? TO GET TO RETIREMENT IN AND BE ABLE TO ENJOY THE RETIREMENT. I KNOW YOUR FAMILY IS HERE. I AM SO GLAD THAT THEY NEED IT. YOUR WIFE, YOUR SON, YOUR DAUGHTER. YOU KNOW, YOU MAKE A LOT OF SACRIFICES AWAY FROM THEM, WHEN WE HAVE THINGS GOING ON IN THE CITY. HE DID SO FOR 6 YEARS. I CANNOT THANK YOU ENOUGH FOR ALLOWING US TO HAVE HIM AND SUPPORTING HIM SO THAT HE CAN DO ALL OF THE THINGS THAT HE DID FOR OUR RESIDENTS AND OUR COMMUNITY. HIS CAPTAIN IS HERE, SO I CAN ALREADY TELL THAT YOU ARE MAKING A GREAT IMPRESSION AT THE AIRPORT AND THEY ARE SO LUCKY TO HAVE YOU. SO AGAIN, CONGRATULATIONS. I WISH YOU NOTHING BUT THE BEST AND THANK YOU FOR EVERYTHING YOU HAVE DONE.
[00:20:13]
IF THE PRINCIPLES CAN COME DOWN SO WE CAN TAKE A PICTURE OF IT AT THE NEW CAPTAIN WANTS TO COME DOWN WITH ANYBODY ELSE WANTS TO COME DOWN. MAJOR? COME ON, MAJOR. THIS WAS YOUR SHOW.ANYTHING FROM THE PRINCIPLES? YOU DON'T HAVE TO, BUT IF YOU WANT TO. MICHELLE? THE HIGH SCHOOL PRINCIPAL IS GOING TO
SPEAK FOR EVERYONE. >> SO, MARCO KNOWS IT IS A TESTAMENT OF HOW MUCH EFFORT YOU HAVE MADE JUST ON OUR COMMITTEES. WE WOULD CALL HIM VERY EARLY IN THE MORNING AND VERY LATE AND I BECAUSE THERE'S ALWAYS SOMETHING GOING ON AT MSD. YOU ARE ONE-OF-A-KIND, IRREPLACEABLE. I AM GLAD COMMISSIONER MAYERSOHN IS HERE BECAUSE I WANT TO MAKE A MOTION TO BRING MARCO BACK. I KNOW HE WILL SECOND THAT. IN ALL SERIOUSNESS, YOU ALWAYS ENSURE THAT YOU WERE SAFE. YOU ALWAYS ENSURE THAT WE HAVE THE FORESIGHT BE NEEDED TO MAKE GOOD, SOLID DECISIONS. YOU TAUGHT ME A LOT OF A LAW-ENFORCEMENT LINGO AND I AM-48 A LOT OF STUFF NOW. WORDS CAN'T EXPRESS HOW MUCH YOU MEAN TO US MARCO, TRULY. THANK
YOU. >> WHERE YOU WANT US TO TAKE A PICTURE? OKAY.
SCHOLARS. IS KEVIN HERE? KEVIN? COME ON. JESSICA? IS SHE HERE? JESSICA? NO? OKAY. WELL, SHE'S GOING TO MISS OUT. IF YOU ARE NOT HERE, YOU DON'T GET IT. WHAT ARE YOU DOING? THEY GET ENVELOPES TOO? ALL RIGHT. COME OVER HERE.
>> COME HERE, GUYS. CONGRATULATIONS. NICE JOB. ALL
RIGHT. >> CONGRATS. LOOK AT THAT.
IMAGINE YOU ARE IN THE OLYMPICS. THINK ABOUT YOUR SPORT AND HOW HARD YOU WORKED TO GET THERE., REPLACE THAT SPORT WITH THE HIGHEST LEVEL OF GEOMETRY, PROBABILITY, NUMBER THEORY AND GRAPH THEORY. ADD IT TO A TEAM OF MATHEMATICIANS, A TIME ELEMENT IN A NATIONAL STAGE AND YOU HAVE A GLIMPSE OF WHAT IT TAKES TO BE KEVIN LOU, DORIS PATEL, AND JESSICA JUAN.
ALL THREE OF THESE MATHEMATICIANS HAVE COMPETED AT THE HIGHEST LEVELS OF MATH COMPETITIONS AT THE REGIONAL AND STATE LEVELS. WE ARE MOST PROUD OF TODAY IS THAT THESE THREE STUDENTS ARE PARKLAND RESIDENTS AND ON A REGULAR BASIS, THEY ARE AMONG A HANDFUL OF MATHEMATICIANS IN THE STATE AND COUNTRY TO REACH THE LEVELS IN WHICH THEY HAVE COMPETED AND CONTINUE TO COMPETE. JESSICA JUAN, WHO GRADUATED FROM FLORIDA VIRTUAL SCHOOL RECENTLY WON GOLD AT THE 65TH INTERNATIONAL MATHEMATICAL OLYMPIAD WITH THE HIGHEST RANK IN THE USA WOMEN'S HISTORY. WOW. JESSICA IS NOT HERE. SHE
[00:25:01]
IS NOT HERE BECAUSE SHE IS STUDYING AND TRAVELING WITH HER FAMILY BECAUSE SHE IS GOING TO BE DIRECTLY GOING TO M.I.T.THIS FALL. SO, GOOD FOR HER. THAT IS PRETTY AMAZING. KEVIN, A JUNIOR AT MARJORY STONEMAN DOUGLAS AND MARSH PATEL AT AMERICAN HERITAGE WERE RECENTLY SELECTED TO PRESTIGIOUS MATH HERITAGE PROGRAM FOR CARNEGIE MELLON UNIVERSITY TO THE USA JUNIOR MATHEMATICAL BEYOND AMERICAN MATHEMATICS. THE COUNTRY'S HIGHEST LEVEL MATH COMPETITION BUT I'M GOING TO NEED TO GET LONGER ARMS. AFTER ACCOLADES IN THE DENSE MATHEMATIC, THEY RECENTLY QUALIFIED FOR SELECTION FOR USA INTERNATIONAL MATHEMATICAL OLYMPIAD TEAM FOR 2025. TWO BUT THIS ACHIEVEMENT INTO PERSPECTIVE, THE STATE OF FLORIDA HAS ONLY EIGHT STUDENTS WHO QUALIFY FOR THIS COMPETITION OVER THE LAST 15 YEARS. THIS YEAR, THREE FLORIDA STUDENTS QUALIFIED AND ALL THREE ARE FROM PARKLAND.
APPLAUSE ] LOOK, THE PRINCIPALS JUST LEFT. ON BEHALF OF THE CITY OF PARKLAND, CITY COMMISSION, WE ARE INFINITELY PROUD OF THE THREE OF PARKLAND RESIDENTS, JESSICA, KEVIN, DORIS. THANK YOU FOR PUTTING US ON THE NATIONAL LEVEL AND WE WISH YOU THE BEST LUCK AT M.I.T., MSD, AND AMERICAN HERITAGE THIS FALL.
WEIMAR, YOU ARE GOING TO TAKE OVER. IF WE CAN BRING UP THE COMMUNITY ADVISORY BOARD. EVERYONE IS HERE, ALMOST. COME ON OUT, THE COMMUNITY ADVISORY BOARD. COME ON, GUYS.
>> THIS WAY. >> I CANNOT BELIEVE THAT WE ARE ACTUALLY ABOUT TO INTRODUCE OUR THIRD YOUTH AMBASSADOR PROGRAM GROUP. TIME HAS REALLY BLOWN. IT HAS BEEN A FEW YEARS SINCE THIS WAS DISCUSSED IN STRATEGIC PLANNING AND CAME TO REALITY. I GOT TO TELL YOU, WE CONTINUE TO HAVE PARKLAND'S BEST AND BRIGHTET GET TO WORK WITH US AND SHARE WITH US WHILE WE SHARE WITH THEM ALL ABOUT THE INS AND OUTS OF LOCAL GOVERNMENT. ONE THING THAT HAS REALLY BEEN NEAT IS SEEING THEM GROW AND SEEING WHAT THEY LEARN. IN OUR FIRST GROUP, THEY JUST LEFT FOR COLLEGE BUT I KNOW MARCEL AND I FEEL LIKE THOSE ARE OUR KIDS THAT ARE LEAVING FOR COLLEGE. YOU SEE SOME OF THEM COME BACK THIS SUMMER AND TELL US HOW EXCITING COLLEGE IS, IT IS SO HEARTWARMING. BUT, AGAIN, THIS YEAR, WE HAD A GREAT GROUP OF PARKLAND STUDENTS THAT APPLIED.
FOR OUR COMMUNITY ADVISORY BOARD, WHO GET TO DECIDE OUR GROUP OF YOUTH AMBASSADORS, IT IS ALWAYS REALLY DIFFICULT. YOU KNOW, EVERYONE IS WONDERFUL AND YOU HAVE TO TRY TO DECIDE BETWEEN ALL OF THEM. SO, THIS YEAR WE HAVE ANOTHER GREAT GROUP OF FIVE STUDENTS. ONE IS NOT HERE TONIGHT BECAUSE SHE IS STILL IN CHINA AND HAS NOT STARTED SCHOOL YET FOR THE SEMESTER. I AM GOING TO HAVE THAT EACH COME UP AND INTRODUCE THEMSELVES AND TELL YOU WHAT SCHOOL THEY GO TO. IT IS THEIR FIRST OPPORTUNITY TO GET IN FRONT OF YOU AND THERE WILL BE MANY AS THEY LEARN ABOUT THE INSIDE AND OUTSIDE THE GOVERNMENT, GETTING TO MAKE PRESENTATIONS TO YOU. GETTING TO WORK ON PROJECTS RE ABOUT GO. SO, COME ON UP.
>> I AM ALEXANDER PADNIS, I GO TO NORTH BRIAR PREP AND I AM IN
11TH GRADE. >> I AM NIDHI BHARAMBE, I GO TO
[00:30:04]
MARJORY STONEMAN DOUGLAS I'M ALSO IN 11TH GRADE.>> MY NAME IS VICTORIA DAMASO, I AM A JUNIOR AT MARJORY STONEMAN DOUGLAS AND I AM SO THANKFUL AND HONORED THAT I GET TO SERVE AS A LIAISON BETWEEN THE CITY OF PARKLAND IN MY PEERS. I WANT TO SAY THANK YOU FOR THIS OPPORTUNITY SO THAT I CAN HELP OUT AND ACCRUE PARKLAND FOR FUTURE GENERATIONS TO COME.
ALSO GO TO MARJORY STONEMAN DOUGLAS AND I AM A JUNIOR.
APPLAUSE ] BUT TO LET YOU KNOW, OUR ONE MISSING MEMBER IS ANGELA HARRAH, AND SHE GOES TO PINECREST.
>> LET ME EXPLAIN SOMETHING TO YOU, THIS IS A PROCESS. I AM BILL KENNEDY. HOW'S IT GOING? I AM THE CHAIR FOR THE COMMUNITY ADVISORY BOARD. I AM HERE WITH MY COLLEAGUES. EACH YEAR THAT I HAVE BEEN DOING THIS FOR MANY YEARS, BUT WE JUST PUT THIS TOGETHER A FEW YEARS AGO. IT IS PRETTY SPECTACULAR TO SEE WHAT THESE KIDS ARE CAPABLE OF. WHEN WE SEE THEM AT THE BEGINNING PHASE WE GET TO SEE THEM AT THE END, WE COULD SEE THEIR GROWTH. WHAT IS EXCITING ABOUT IT, WORK WITH THE MAYOR, THE COMMISSIONER, THE CITY MANAGER, AND THE REST OF THE STAFF HERE. JACKIE, AND EVERYBODY. IT IS JUST AMAZING THE PROCESS THEY HAD TO GO THROUGH, WE GET TO ACTUALLY START WITH THEIR APPLICATIONS. THESE OTHER APPLICATIONS, YOU WOULD NOT BE QUESTIONING WHY THESE KIDS ARE HERE. I NEVER RECEIVED THE GRADES THAT THESE KIDS GET. I HAVE NEVER HEARD OF A 5.0 WHEN WE WERE IN SCHOOL. I DON'T THINK THAT EXISTED.
ANYTHING BEYOND THAT WITH THESE KIDS. SO, IT IS PRETTY AMAZING WHAT THESE KIDS ARE CAPABLE OF, BUT WATCHING THIS AND WATCHING THE PROCESS, IT IS REALLY EXCITED -- EXCITING TO BE CANNOT TO SEE WAIT TO SEE THIS AT THE END.
[7. Approval of the Agenda]
>> WHAT ARE WE DOING? APPROVAL OF THE AGENDA.
>> MOTION TO APPROVE AND PULLING ITEM 9-E.
>> ALL RIGHT. DO I HAVE A SECOND?
>> I WILL SECOND. >> WE HAVE A MOTION BY COMMISSIONER MAYERSOHN, SECOND BY VICE MAYOR ISROW. ALL IN FAVOR? ANY OPPOSED? PLEASE SHOW IT PASSES UNANIMOUSLY. CONSENT AGENDA MINUS 9-E. MOTION TO APPROVE.
>> SECOND. >> TO APPROVE OF THE AGENDA.
[8. Presentation]
>> PRESENTATION? OH YEAH. I DID NOT EVEN SEE THAT. IT IS RIGHT
[00:35:01]
THERE. I GUESS I AM NOTHING ATTENTION. YES.>> GOOD EVENING, MAYOR. VICE MAYOR, MISSIONERS. SHERRY TOUPS, THE BUDGET AND GRANTS MANAGER FROM THE FINANCE DEPARTMENT TO GIVE YOU SOME BACKGROUND AND EXPLAIN THE OBJECTIVE OF TONIGHT'S PRESENTATION. ABOUT TWO YEARS AGO, SUMMER OF 22, WE APPLIED FOR A PLANNING GRANT FROM THE RESILIENT FLORIDA PROGRAM WHICH IS PART OF FLORIDA'S DEP. THIS PLANNING GRANT WAS MEANT TO FUND A STUDY CALLED THE VULNERABILITY ASSESSMENT WHICH WOULD LOOK AT THE FUTURE RISKS THAT THE CITY FACES AND HELP PLAN FOR WAYS TO PREPARE FOR THE FUTURE IMPACTS OF CLIMATE CHANGE. THE VULNERABILITY ASSESSMENT REQUIRES THE FIRST STEP BEFORE WE CAN APPLY FOR FUTURE FUNDING FROM THE RESILIENT FLORIDA PROGRAM. WE WERE AWARDED $75,000 GRANT, NO MATCH REQUIRED . WE HIRED KEITH AND ASSOCIATES TO DO THE VULNERABILITY ASSESSMENT. AS PART OF THE PLANNING GRANT, WE WERE REQUIRED TO DO A PUBLIC OUTREACH AND HOLD A DISCUSSION ABOUT THE ASSESSMENT. SO, TONIGHT, I WANT TO INTRODUCE TOM GREENE FROM KEITH AND ASSOCIATES. HE WILL PRESENT THE FINDINGS AND LEAD THE
DISCUSSION. >> ALL RIGHT. THANK YOU, SHERRY. GOOD EVENING. MAYOR, VICE MAYOR, COMMISSIONERS AND STAFF, THANK YOU SO MUCH FOR THIS OPPORTUNITY. MY NAME IS TOM GREENE. I WORK FOR KEITH. WE ARE ONE OF THE ON-CALL ENGINEERING CONSULTANTS. LIKE SHERRY MENTIONED, WE ASSISTED THE CITY OF PARKLAND WITH THE VULNERABILITY ASSESSMENT I WOULD LIKE TO WALK YOU THROUGH A BRIEF PRESENTATION OF WHAT WE HOPE TO ACCOMPLISH WITH THIS STUDY AND TRY TO EXPLAIN SOME OF THE FINDINGS. BEFORE WE GET INTO IT, A LITTLE BIT OF A BACKGROUND. LIKE SHERRY DID MENTION, THIS VULNERABILITY ASSESSMENT AS PART OF THE RESILIENT FLORIDA PROGRAM. YOU CAN SEE IN 2021, THIS WAS SIGNED INTO ACTION. IT IS ADMINISTERED BY THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION. WHAT IS REALLY IMPORTANT IS THE STATE STATUTE 380093 LAYS OUT A ROAD MAP OF WHAT YOU NEED TO ACCOMPLISH AND HOW YOU NEED TO ACCOMPLISH IT. THE OTHER BIG TAKE AWAY FROM THIS LIGHT IS THAT BEGINNING IN 2024, FOR ANY FUTURE GRANT DOLLARS ON THE CAPITAL IMPLEMENTATION SIDE, LIKE SHERRY MENTIONED, IT IS STEP ONE IN THAT PROCESS. SO DEFINITELY CRITICAL TO GET IT DONE AND MAKE SURE THAT YOU ARE COMPLIANT WITH ALL OF THE STATUTES. SO, WHAT IS A VULNERABILITY ASSESSMENT? REALLY, IT IS LAID OUT BY THE STATE AND BE GOAL IS TO IDENTIFY THE CITIES CRITICAL ASSETS, THOSE CAN BE YOUR ROADWAY NETWORKS, YOUR EMERGENCY FACILITIES, YOUR INFRASTRUCTURE, IT CAN BE YOUR CULTURAL RESOURCES OR PARKS. THESE ARE ALL LAID OUT BY THE STATUTE AND WORKING WITH STAFF, WE KIND OF WORKED WITH THEM TO FIND THE CRITICAL ASSETS WITHIN THE CITY. IT IS NOW LOOKING AT DETERMINING IF THEY ARE SUSCEPTIBLE TO BE SPORTING EVENTS. IT IS DETERMINING THE ASSETS IN THE FLOODING EVENT.
THE STATUTE LAYS OUT THE ROAD MAP AND THE ROLES NEEDED TO COMPILE IT AND WHAT YOU NEED TO FILL OUT AND COMPLY WITH IT WITH THE FORM CORRECTLY. AGAIN, LIKE SHERRY MENTIONED, YOU DID ÚRECEIVE A GRANT WITH NO MATCH REQUIREMENT. SO, IT IS LAID OUT INTO FOUR TASKS. WE WILL WALK THROUGH EACH OF THESE. IT IS BACK ON ON YOUR DATA ACQUISITION EXPOSURE. SO, LOOKING AT THE RAINFALL EVENTS, LOOK AT HOW SENSITIVE THEY ARE IN COMBINING EVERYTHING INTO THIS FINAL REPORT. SO, THIS SLIDE IS A LITTLE BIT BUSY, BUT THIS BACKGROUND DATA ACQUISITION IS REALLY LOOKING AT WHAT ARE YOUR ASSETS, WHERE ARE THEY LOCATED WITHIN THE CITY, WHAT IS THAT EXISTING ELEVATION OF THOSE ASSETS, WHAT IS THE GROUND AROUND THAT ASSET. YOUR EXISTING TOPOGRAPHICAL ELEVATION. WHAT ARE YOUR PROJECTED FUTURE LAND USES FOR THE AREA AND THEN ALSO LOOKING AT THE PRECIPITATION AND FLOOD ELEVATIONS. SO, YOU TAKE THIS INFORMATION AND REALLY CHUNK IT OUT INTO FIVE CATEGORIES. THIS IS JUST A SNIPPET OF WHAT WE PREPARED IN THE REPORT. BUT THE MAIN TAKE AWAY IS THAT IT IS LAID OUT INTO FIVE DIFFERENT BUCKETS. EITHER YOUR TRANSPORTATION ASSETS, YOUR CRIMINAL INFRASTRUCTURE, YOUR GOVERNMENT FACILITIES, NATURAL CULTURE, HISTORIC RESOURCES, IN THIS CASE, THOSE WERE YOUR PARKS. WE TAKE ALL OF THOSE RESOURCES AND WE CREATE THIS MAP. IT IS PUT ON GIS, PINS GET POPULATED ONTO THE MAP AND THEY IDENTIFY WHERE YOUR CRITICAL ASSET IS LOCATED.
WHAT TYPE OF ASSET IS LOCATED, THE CRITICAL LOCATION OF THAT
[00:40:03]
ASSET. GETTING TO A STANDARD FORMAT IN AND GIS TO BE TRANSFERRED OVER TO THE STATE. DEP'S GOAL IS TO HAVE EVERY MUNICIPALITY IN THE STATE PERFORM THE STUDY SO THAT ALL THIS INFORMATION IS STANDARDIZED AND THAT A STATEWIDE LEVEL THEY CAN SEE IT EACH COUNTY, MUNICIPALITY, CRITICAL ASSETS AND HOW CRITICAL ARE THOSE ASSETS.THESE ARE YOUR EXPOSURE ASSETS. WHAT ARE GOING TO BE THE FLOOD EVENTS? WE LOOK AT WHAT IS CURRENTLY MODELED FOR YOUR AREA. WE LOOK AT FUTURE CONDITIONS. IN THIS CASE, THE MAIN EVENT WE ARE LOOKING AT IS YOUR RAINFALL INDUCED FLOODING.
SO, THE RIGHT-HAND SIDE, YOU CAN SEE THAT LOOKING AT THE 100 YEAR, 500 YEAR, FEMA PROJECTIONS, LOOKING AT FUTURE GROUNDWATER. WE TAKE THIS INFORMATION AND WE MODEL IT.
SO, NOW WE ARE LOOKING AT WHERE IS YOUR ASSET LOCATED HOW HIGH IS IT LOCATED? WITH THESE RAINFALL EVENTS, WHAT IS THAT WATER DOING IN RELATION TO WHERE THAT ASSET IS LOCATED.
SO, AGAIN, THE BIGGEST RAINFALL EVENT WE ARE LOOKING AT IS GOING TO BE THE RAINFALL INDUCED FLOODING. WE ARE LOOKING AT YOUR HUNDRED YEAR, 500 YEAR. WE ARE LOOKING AT THESE FUTURE 2070 PROJECTIONS AND SEEING WHAT DOES THIS REALLY LOOK LIKE WITHIN THE CITY? THIS IS JUST A ZOOMED IN SNIP TO GET YOUR BEARINGS A LITTLE BIT. THAT IS UNIVERSITY ON THE LEFT. THAT IS HOMEWARD DOWN ON THE LEFT. TO TAKE AWAY FROM EACH ONE OF THESE SLIDES IS WORKING FROM LEFT TO RIGHT.
YOU ARE SEEING A 100 YEAR ONE DAY FLOOD EVENT. TO THE RIGHT IS A FUTURE 500 THREE DAY RAINFALL EVENT. AS YOU SEE MORE BLUE, THAT IS INDICATING A GREATER FLOOD DEPTH. SO, JUST SAYING THAT IN THE FUTURE WITH THESE HIGHER PREVALENT RAINFALL EVENTS. ERASING AN INCREASE IN FLOODING. THE NEXT STEP WE LOOK AT IS TO DETERMINE WHERE IS IT, HOW HIGH HAS THE FLOODING OCCURRED AND HOW SENSITIVE IS THIS ASSET TO FLOODING? YOU'RE LOOKING AT WAS IT EXPOSED TO FLOODING, IT IS A HIGH CONSEQUENCE IF IT DOES FLOOD AND HOW SENSITIVE IS IT? SO, AS AN EXAMPLE, A HURRICANE EVACUATION ROUTE WOULD BE AN ASSET THAT IS HIGH CONSEQUENCE WHEN IT FLOODS . YOU CANNOT USE THE ROADS DURING THE RAINFALL EVENT BUT LOW SENSITIVITY. ONCE THE RAINFALL RECEIPTS, THAT ASSET STILL GOES BACK TO BEING A ROAD AND IT IS USEFUL AND FUNCTIONAL. A HIGH SENSITIVE IN HIGH CONSEQUENCE WOULD BE AN EMERGENCY OPERATION ENTER OR FIRE STATION THAT FLOOD OUT. AFTER THE WATERS RECEDE, THERE IS DAMAGE TO FLOORING, THERE IS DAMAGE TO DRYWALL. THERE IS POTENTIAL DAMAGE TO YOUR ELECTRICAL SYSTEM. THAT IS SOMETHING THAT WOULD BE HIGHLY SENSITIVE TO A FLOODING EVENT.
SO, WE CREATED SCORING METRICS -- MATRIX THAT DOES IS IT HIGHLY SENSITIVE IF IT FLOODS? WHAT IS THE EXPOSURE TO FLOODING? THEN THE DIFFERENT BUCKETS WITH THE TRANSPORTATION NETWORK. IS IT YOUR COMMITTEE CENTER? YOUR EMERGENCY FACILITY? AND THEN WE COMBINE A SCORE TO IT. LOOKING AT THESE DIFFERENT CATEGORIES, IT IS RISK OF EXPOSURE, HOW MUCH FLOODING IS EXPECTED TO OCCUR. HOW SENSITIVE IS IT TO A FLOODING EVENT, WHAT IS THE CONSEQUENCE OF IT DOES FLOOD, AND THEN WE LOOK AT WHAT IS THE COMBINED SCORE? WHAT DOES ALL OF THIS MEAN? SO, THE VULNERABILITY, IT IS REALLY A GREAT PLANNING DOCUMENT. IT IS LAID OUT FOR THE CITY, WHERE YOUR ASSET LOCATED? YOU KNOW, HOW VULNERABLE TO THE POTENTIAL RAINFALL EVENTS AND CLIMATE CHANGE AND HIGHER PRECIPITATION VALUES FROM THESE RAINFALL EVENTS. THE NEXT STEP FOR THIS IS BRING IT BACK OVER TO DEP AND GET A COPY OF THE REPORT.
ONCE THE REPORT IS ACCEPTED, THAT UNLOCKS THE CAPABILITY FOR THE CITY TO IMPLEMENT GRANTS. THESE ARE CAPITAL PROJECTS THAT YOU CAN NOW LOOK AT WITH AN ADAPTATION PLAN. YOU CAN LOOK AT IDENTIFYING CAPITAL PROJECTS THAT ADDRESS THESE VULNERABILITIES. YOU CANNOT PRIORITIZE A PROJECT BASED ON THE SCORING MATRIX. YOU CAN ANALYZE WHAT FUNDING PARKLAND HAS AND HOW THEY ADDRESS THESE. THE BIG THING WITH THIS PROGRAM IS THROUGH RESILIENT FLORIDA AND THROUGH THE IMPLEMENTATION GRANT PROGRAM, IT IS A 50-50 MATCH. THERE IS SKIN IN THE GAME FROM THE CITY BUT THERE IS ALSO SKIN IN THE GAME FROM THE STATE. SINCE 2021, ONE POINT $3 BILLION HAS GONE INTO THIS PROGRAM. INITIALLY IT STARTED WITH FEDERAL DOLLARS, HALF A BILLION THROUGH HER BUT FUNDS. LARGE CAPITAL PROJECTS DO GET AWARDED. SOME, AS IF EXAMPLE, THE CITY OF OAKLAND PARK IS GETTING $2.5 MILLION WITH A FIRE STATION. IT IS NOT JUST
[00:45:02]
DRAINAGE PROJECTS, IT IS NOT JUST SMALL DOLLAR CATCH BASIN AND INLETS. IT CAN BE YOUR EMERGENCY OPERATION CENTERS, YOUR FIRE STATIONS. IT CAN BE POTENTIAL ROAD RAISING LAKE MIAMI BEACH OVER $20 MILLION. SO, THERE ARE LARGE DOLLARS THAT GO INTO THIS PROGRAM. THERE ARE COMPETITIVE GRANTS AND THERE IS THE 50-50 MATCH YOU DO WITH A THREE YEAR WAIT CYCLE ONCE YOU DO GET APPROVED FOR AN IMPLEMENTATION GRANT, BUT IT IS REALLY GREAT DOLLARS I CAN DO GOOD THINGS FOR THE CITY. THE LAST PIECE THAT WE WANT TO TOUCH ON, WE KNOW THAT THE CITY PARTICIPATES WITH HOWARD COUNTY AND THE LOCAL MITIGATION STRATEGY. THIS IS SOMETHING THROUGH FEMA. BY GETTING THIS MOTOR ABILITY ASSESSMENT ADOPTED THROUGH BROWARD COUNTY, IT UNLOCKS YOUR POTENTIAL FOR OTHER FEMA HAZARDOUS MITIGATION GRANT DOLLARS AND IT WILL HELP YOU GET CAPITAL DOLLARS FOR PARKLAND. THAT IS THE REALLY BIG TAKE AWAY. THIS GREAT PLANNING DOCUMENT AND GREAT OPPORTUNITY FOR FUTURE GRANTS FOR THE CITY. WE ARE OPEN TO ANSWER ANY QUESTIONS IF YOU HAVE ANY. THANK YOU VERY MUCH.IT WAS VERY INFORMATIVE. DOES ANYONE HAVE ANY QUESTIONS?
>> I JUST WANT TO SAY THANK YOU. THIS WAS VERY IMPRESSIVE.
GREAT PRESENTATION. IT IS LIKE A DOUBLE EDGED THING. YOU DON'T WANT TO HAVE THINGS YOU WILL NEED GRANTS FOR. IT IS GOOD TO KNOW THAT IF WE HAVE SOMETHING TO ADDRESS, THERE IS
MONEY TO FUND IT. >> THANK YOU VERY MUCH.

TONIGHT, WITH ME AND AVAILABLE TO ANSWER QUESTIONS AT THE END OF OUR PRESENTATION THE CITY SEE THE RP AND THE CITIES LANDSCAPE ARBORIST AND THE ENGINEERING DEPARTMENT. IF YOU HAVE ANY SPECIFIC QUESTIONS FOR THEM THEY WILL ALSO BE AVAILABLE. WE ARE COMING TO THE CLOSE OF EVERY SERIES OF PUBLIC HEARINGS FOR THE TOLL BROTHERS SALT GRASS PROJECT, WHICH IS GENERALLY LOCATED ON THE FORMER HEREIN BIG GOLF COURSE. THE CITY ATTORNEY JUST READ INTO THE RECORD, WE WILL THE -- BE DISCUSSING SEVERAL APPLICATIONS NIGHT FOR THE ZONING APPLICATION TO REZONE THE SUBJECT SITE FROM A-1 TO RS-3.
THE PLAT, THE SITE PLAN, THREE VARIANCE REQUEST IN A COMMUNITY APPEARANCE BOARD APPLICATION. SO, GENERALLY, THE SUBJECT SITE IS LOCATED ON THE MAP ON THE SCREEN HERE WITH THE GREAT PARCEL NORTH OF THE PROPOSED COMMERCIAL DEVELOPMENT. THE INCLUDES APPROXIMATELY 21 ACRES GENERATED LEFT OF NOB HILL ROAD. SOUTH OF TRAILS AND. THE SITE HISTORY, OF COURSE, THIS WAS THE FORMER HEREIN BIG GOLF COURSE. OPERATED AS A GOLF COURSE UNTIL 2019 AT WHICH THE PROPERTY WAS BOUGHT AND PURCHASED BY NSID. IT WAS SUBSEQUENTLY PURCHASED BY THE CITY. SO, THE REZONING, OF COURSE, IS THE SECOND READING I WILL GO THROUGH THIS SOMEWHAT QUICKLY. THE APPLICANT DID RECEIVE FAVORABLE VOTES FOR THE FIRST READING OF THE REZONING.
THE REQUEST IS TO REZONE THE ENTIRETY OF THE PROPERTY TO RS THREE, WHICH IS CONSISTENT WITH THE LAND-USE. THEY ARE PROPOSING A DENSITY OF APPROXIMATELY 2.49 DWELLING UNITS PER ACRE. THE SURROUNDING ZONING DISTRICTS ARE EITHER CONSISTENT OR INTENSIVE THAN RS THREE. WE CAN GET INTO THE SPECIFIC NEIGHBORHOODS, AGAIN. THERE ARE QUESTIONS. FITTED THE MEETING, I CAN GO THROUGH THIS A LITTLE BIT MORE QUICKLY. AS WE NOTED AT THE LAST MEETING, THE PROPOSED DEVELOPMENT WOULD HAVE ACCESS TO THE EXISTING HERON BAY AMENITIES, INCLUDING THE RECREATION FACILITIES. THERE IS A TRAFFIC IMPACT OF THE PROPOSED 52 HOMES. HERE IS THE ZONING MAP THE LOCATION GENERALLY UNDER THE RED STAR . AS PART OF THE ANALYSIS, THE ENGINEERING DEPARTMENT REVIEWED THE CONCURRENCY ANALYSIS AND FOUND THAT THE CONCURRENCY REQUIREMENTS WERE MET. THE PHASE ONE ENVIRONMENTAL STUDY IT WAS MET BY THE CITY AND THE APPLICANT FOR THE STAFF AND THAT THE PROPOSED REZONING IS CONSISTENT WITH THE ADOPTED CONFERENCE A PLAN. SOME OF THE ADJACENT COMMUNITIES ARE SHOWN ON THE NEXT TWO SLIDES HERE.
WACO HASN'T RS-6 ZONING. IN NOTE TO KEEP IN THE BACK OF OUR MIND AS WE THINK ABOUT THE OTHER APPLICATIONS, THE LOT WITH, LOT SIZE, LOT COVERAGE. BEING APPROXIMATELY 50 FEET THE LOT SIZE IS RANGING ON THE LOWER END FROM APPROXIMATELY 7000 SQUARE FEET IN THE LOT COVERAGE DOES EXCEED 40%. IN OLD BRICK, THIS IS THE SAME RS AND REZONING. ONE THING TO NOTE WAS IN THE YEAR 2000, THE ZONING REQUIREMENTS SPECIFICALLY FOR SIDE YARD SETBACKS WERE INCREASED FROM 10 FEET TO 12.5 FEET AND THERE IS A VARIANCE REQUEST RELATING TO THE SIDE YARD SETBACK ACCORDINGLY. HERE THE LOT WIDTH LOCATE THE SMALLER SIZE. THE LOT SIZES AND RANGE FROM APPROXIMATELY 12 TO 13,000 SQUARE FEET AND THE LOT COVERAGE DOES EXCEED 40%. THE PLAT, AS YOU PROBABLY HEARD US TALK ABOUT BEFORE, IS GENERALLY A FUNCTION OF THE COUNTY, BUT IT DOES REQUIRE CITY APPROVAL BEFORE THEY CAN MOVE ON TO THE COUNTY APPROVAL PROCESS. THIS PLAT SPECIFICALLY IS WHAT WE CALL A LOT SPECIFIC PLAT. AS OPPOSED TO A BOUNDARY PLAT, WHICH IS THE OUTERMOST BOUNDARY OF THE PROPERTY. THERE IS WHAT
[00:55:06]
WE CALL A RESTRICTED NOTE ON THE PLAT, WHICH WILL LIMIT THE TYPE AND AMOUNT OF DEVELOPMENT THAT CAN OCCUR WITHIN THE SUBJECT SITE, SO THE RESTRICTIVE NIGHT -- NOTE REFLECTS THE SITE PLAN. 52 SINGLE-FAMILY DWELLING UNITS BUT AS REQUIRED FOR COUNTY APPROVAL AND RECORDED APPROVAL.WE DO ZOOM IN ON A COUPLE OTHER OF THE KEY AMONG THE PIECES HERE ON THE FOLLOWING SLIDES. THIS IS A LITTLE BIT HARD TO READ, BUT I WANTED TO GIVE YOU AN OVERALL VIEW OF THE SITE PLAN. SO, GENERALLY, THE APPLICANT PROPOSES 52 INDIVIDUAL LOTS WITH ACCESS FROM THE EXISTING HERE IN RUN DRIVE AND THE EXISTING HERON BAY ENTRANCES. THIS ENTRANCE THAT IS PROPOSED OFF OF HERE IN RUN DRIVE WILL NOT BE GATED.
THERE IS ONE SINGULAR SEAT -- STREET WITH HERE IN RUN DRIVE CONTINUING TO THE EAST AND THEN TURNING SOUTH THROUGH A SERIES OF TWO DIFFERENT ROUNDABOUTS OR CUL-DE-SAC TYPE FEATURES. THE APPLICANT DOES INCLUDE SIDEWALKS ON BOTH SIDES OF THE STREET WITH APPROXIMATELY A 50 FOOT WIDE STREET SEGMENT.
IMPORTANTLY, THEY DO INCLUDE APPROXIMATELY 2.5 ACRES OF OPEN SPACE IN THE FORM OF TWO PARK SPACES. ONE GENERALLY LOCATED WHERE THE STREET TURNED OUT THAT AND ONE THAT IS FURTHER SOUTH TOWARD THE BOTTOM PORTION OF THE PLAN DRAWING THAT IS ON THE BOTTOM HERE. THIS CHART DELINEATES THREE DIFFERENT COMPONENTS. WHAT IS THE RS-3 DISTRICT STANDARDS. SO, THE STANDARD ZONING REQUIREMENTS FOR AN RS-3 PROPOSAL AS WELL AS THE NEXT LINE BEING THE PROPOSED DEVELOPMENT. THE FINAL ROW BEING WHETHER THEY COMPLY OR HAVE REQUESTED A VARIANCE FOR THAT PACIFIC REQUIREMENT OF THE RS-3 DISTRICT. SO, YOU WILL SEE IN TERMS OF THE DENSITY AND MINIMAL LOT AREA, THE APPLICANT COMPLIES. THERE IS A VARIANCE REQUESTED FOR LOT WITH TWO -- TO 80 TO 70 PEOPLE THERE IS A VARIANCE REQUESTED FOR THE LOT COVERAGE. THE RS-3 DISTRICT PERMITS UP TO 35% LOT COVERAGE FOR THE APPLICANT IS REQUESTING THE VARIANCE TO OPPOSE 40% LOT COVERAGE FOR 2 STORY MODELS AND 42% COVERAGE FOR ONE STORY MODELS FOR THEY DID COMPLY WITH THE MAXIMUM HEIGHT. THE SETBACKS , THEY COMPLY WITH THE FRONT AND REAR AND ARE REQUESTING A VARIANCE FOR THE SIDE YARD SETBACKS TO REDUCE THE SETBACK FROM 12.5 TO 10 FEET. CAN NOTICE THAT WAS THE SUBJECT OF THE CHANGE BACK IN THE 2000 ORDINANCE. THAT WAS ADOPTED AND APPROVED. THEY DO COMPLY WITH THE MINIMUM FLOOR AREA. HERE IS A ZOOMED IN SCREENSHOT OF THE ENTRANCE AREA. AS WE NOTED, IT IS CONSIDERED CONCEPTUAL. THEY WILL COME BACK THERE WITH MORE SPECIFIC REGARDING THE ACTUAL TOWER FUTURE DESIGN IN THE ENTRANCE WHILE IN THE EXACT SIGNAGE TO MAKE SURE THAT IT COMPLIES WITH THE SIGN STANDARDS. THEY DO PROPOSE CONCEPTUALLY, ONE OF THESE ENTRANCE WALL FEATURES ON EITHER SIDE OF THE ENTRANCE AND THAT IS SHOWN ON THE PLAN. THEY ARE ALSO PRESERVING TWO LARGE SPECIMEN OR FEATURE TREES AT THE ENTRANCE AS AN ENTRANCE HIGHLIGHT. HERE IS THAT FIRST OPEN SPACE AREA. IT IS JUST OVER ONE ACRE. THE MAIL KIOSK WITH WALKING PATHS AND VENGEANCE. THE OTHER OPEN SPACES IN THE DEVELOPMENT. THAT IS APPROXIMATELY ONE ACRE AT THIS PARK SPACE WITH SIMILAR, PASSIVE RECREATION OPTIONS WALKING PATHS AND BENCHES. THE NEXT COUPLE FLIGHTS WILL GO THROUGH THE TYPICAL BUFFERS.
SO, WHAT THE CONDITIONS ARE ALONG THE PROPERTY LINE. THIS IS YOUR TYPICAL BUFFER, MEANING THAT IT IS NOT ONE OF THE KEY AREAS WHERE WE ARE PROPOSING ADDITIONAL LAND OR WALLS. YOU WILL SEE A 15 FOOT LAKE EASEMENT ENTRIES ON THE REAR PROPERTY LINE. THE NORTHERN PROPERTY LINE WHERE THE PROPERTY ABUTS THE ADJACENT BSG SITE WHICH IS CALLED OUT ON THE BOTTOM LEFT CORNER, THE APPLICANT DOES PROPOSE A SPECIAL BUFFER CONDITION HERE JUST TO PROVIDE A LITTLE BIT OF THE ENHANCED DESIGN. THAT IS A SIX FOOT FENCE AS WELL AS SOME ADDITIONAL LANDSCAPE MATERIAL. THERE IS A CROSS ACTION THAT IS SHOWN ON THE RIGHT. YOU CAN SEE THE FENCE, THE SHRUB OR MATERIAL IN THE LARGER TREE MATERIAL THAT IS PLANTED ALONG
[01:00:06]
THAT EASEMENT. THE SOUTHERN PROPERTY LINE. THIS WAS THE TOPIC OF MUCH DISCUSSION 3 P.M. THE -- THROUGH PNC IN THE FIRST. FORMALLY PROPOSED A SIX FOOT MASONRY WALL. THE PRESENTATION WILL INCLUDE SOME DISCUSSION ON THE CANAL THAT WAS DISCUSSED TO CONNECT BOTH SIDES OF THE EXISTING WATERWAYS TO CREATE MORE OF A BUFFER BETWEEN THE PROPOSED SITE AND THE ADJACENT COMMERCIAL SITE. BUT, THESE ARE THE PROPOSED PLANS THAT WE HAVE CEMENTED CURRENTLY. THEY ARE WORKING THROUGH THE PROCESS TO DETERMINE THE FEASIBILITY OF THAT CANAL, AS I NOTED. SO, THE PLAN VIEW IS LOCATED ON THE TOP OF THE SLIDE HERE. YOU CAN SEE SIGNIFICANTLY MORE LANDSCAPING IN THE EIGHT MASONRY WALL WITH THE DECORATIVE GAP WITH PLANTINGS ON BOTH SIDES OF THE BERM. ONE THING THAT WE DID DISCUSS WITH THE APPLICANT AND IS INCLUDED IN THE CONDITIONS OF APPROVAL, IT IS ALLOWING FOR A FUTURE TIE IN OF THE BERM, IF THE CANAL RENTS TO BE APPROVED, THE LANGUAGE THAT WOULD ALLOW US TO TIE INTO THAT BERM TO MAKE SURE IT IS ONE CONTINUOUS BERM. MAKING SURE THAT WE ARE ON THE RIGHT TRACK AND THAT CANAL IMPROVEMENT AS AN ALTERNATIVE. THE VARIANCE IS, AS I NOTED, WILL GO THROUGH EACH OF THE THREE THAT ARE SUMMARIZED ON THE TABLE FROM THE OTHER SIDE. IT IS IMPORTANT TO NOTE THAT THE NUMBER AND/OR TYPE OF VARIANCES WERE PRE-IDENTIFIED BY THE APPLICANT AND THEY HAVE REMAINED THE SAME. NOT ONLY HAVE THEY REMAIN THE SAME, THEY WERE TO REDUCE THE NUMBER OF LOT THAT ARE IMPACTED BY THESE VARIANCE REQUESTS, AS WELL AS REDUCE THE REQUESTS THEMSELVES. THE SETBACK REQUEST INITIALLY WAS TO REDUCE THE SIDE YARD SETBACK TO THE 7.5. THEY HAVE INCREASED THAT TO 10 FEET. AS I NOTED A NUMBER OF LOTS THAT ARE AFFECTED BY THE OTHER TYPE OF VARIANCES HAVE ALSO BEEN REDUCED THROUGH THE PROCESS.THEY ARE WORKING THROUGH THE PROCESS WITH STAFF TO MINIMIZE THEIR REQUEST FOR THOSE VARIANCES. GENERALLY, THIS IS A FORMER GOLF COURSE, -- THAT IS THE GENESIS FOR MOST OF THE VARIANCE REQUEST AND NEEDS THAT ARE PROPOSED AS THIS APPLICATION. SO, THE FIRST VARIANCE THAT WE WILL DISCUSS IS THE MINIMUM LOT WIDTH FOR NECESSARY TO REDUCE THE LOT WITH -- NOB HILL -- WIDTH. THE APPLICANT DOES MAINTAIN THE MINIMUM LOT AREA. A MINIMUM OF 10,000 SQUARE FEET. SO IT DOES HAVE DEEPER LOTS TO MAKE UP FOR THE MORE NARROW LOT WIDTH. IN THIS VARIANCE REQUEST, IS APPLICABLE TO APPROXIMATELY 3152 LOTS. GENERALLY THESE LOTS ARE LOCATED ALONG THE NORTHERN PROPERTY LINE. THERE IS A SEGMENT THAT IS SHOWN HERE THAT SHOWS YOU THE MAIN CLUSTERING. THE NEXT VARIANCE IS RELATED, OF COURSE, AS YOU GET NARROW LOTS, THEY WILL START IMPACTING THE SIDE YARD SETBACK REQUEST AS YOU START TO CONSIDER SOME OF THE BILTMORE -- BUILDABLE TYPOLOGIES AND THE REQUIREMENTS FOR THESE LARGER HOME STYLES. THE COMPANY SIDE YARD SETBACK REQUEST IS TO REDUCE THE SIDE YARD SETBACK FROM 12.5 FEET TO 10 FEET. AS I NOTED, THEY WORKED WITH STAFF TO INCREASE THAT FROM THE FORMER 7.5 FOOT REQUEST. THIS VARIANCE REQUEST IS APPLIED TO LOTS THAT ARE LESS THAN 75 FEET IN WIDTH.
ONCE THEY GET A LITTLE BIT LONGER, THEY CAN MEET THE SETBACKS. SO, THIS PROVIDES APPROXIMATELY 16 OF THE LOTS OUT OF THE 52. THE LAST VARIANCE REQUEST IS A VARIANCE REQUEST TO INCREASE THE MAXIMUM LOT COVERAGE. THE REQUEST IS TO INCREASE THE MAXIMUM LOT COVERAGE FROM 35%, WHICH IS THE ARE THREE STANDARD TO 40% FOR A TWO STORY MODEL AND 42% FOR A ONE-STORY MODEL. THE APPLICANT, AGAIN, DID WORK WITH THE CITY TO PROVIDE A ONE-STORY MODEL, AS YOU CAN IMAGINE, A ONE-STORY MODEL REQUIRES MORE OF A FOOTPRINT TO MEET THE EXPECTATIONS IN THE MARKET DEMANDS FOR THE APARTMENT. SO, THEY DID ADD THE 42% REQUEST AS PART OF THE MORE RECENT SUBMITTALS, JUST FOR THE ONE-STORY MODEL. THIS GENERALLY AFFECTS THE SMALLER LOTS THAT ARE SIZED BETWEEN 10 AND 11,000 SQUARE FEET AND AFFECTS APPROXIMATELY 16 OF THE 52 LOTS. REMEMBERING BACK TO THE FORMER SLIDES AND SOME OF OUR ANALYSIS, SOME OF THE OTHER SURROUNDING COMMUNITIES SIMILAR IN THE LOT COVERAGE, AS IT EXCEEDS 35% AND HOVERS AROUND 40 TO 45%. FOR THE SURROUNDING COMMUNITIES IN TERMS OF WHAT THEY HAD BUILT OUT FOR THEIR LOT COVERAGE. ONE THING TO NOTE, WITH THIS VARIANCE REQUEST, ALL THE TWO STORY-BASED MODELS COMPLY WITH THE 35% LOT COVERAGE. SO, THE REQUEST HERE, SPECIFICALLY FOR THE TWO STORY MODELS IS TO
[01:05:04]
ALLOW ALL PROPERTY OWNERS OR FUTURE PURCHASES TO HAVE THE SAME OPPORTUNITY TO BUILD OUT WITH THE VARIANCE OPTIONS, IF THAT IS THE ADDTIONAL CABANA, OR THE ADDITIONAL FEATURES .THE APPLICANT EXPRESSED AN INTEREST IN MAKING SURE THAT EVERYONE HAD AN EQUITABLE CHANCE OF BUILDING THOSE FEATURES OUT, AND ON THE LINE, BRINGING IN SOME OF THEIR OWN IMPROVEMENT THAT THEY WANTED TO HAVE SOME SORT OF ADDITIONAL BACKYARD AMENITY. THE COMMUNITY APPEARANCE APPLICATION IS THE FINAL APPLICATION HERE. THE APPLICANT, AS PART OF THEIR PACKAGE, DOES PROPOSE TWO STORY MODELS AND THE ONE ONE-STORY MODEL OPTION THAT WAS BROUGHT FORWARD AFTER RECOMMENDATION FROM THE PLANNING AND ZONING BOARD. EACH MODEL HAS THREE ELEVATION OPTIONS TO MEET THE ANTI-MONOTONY STANDARDS. SO THERE ARE CONTEMPORARY, TRANSITIONAL AND MODERN ELEVATION OPTIONS. GENERALLY THE COLORS FALL WITHIN THE CODE REQUIREMENT NEUTRAL AND EARTH TONE SCHEME. THE ELEVATIONS USE A MIX OF STUCCO, BRICK, AND BLOCK ACCENTS. THEY DO INCLUDE THE TYPICAL PARKLAND STYLE OF TILE ROOFS AND PAVED DRIVEWAYS.
I WILL CLICK THROUGH A COUPLE OF PICTURES HERE. IF YOU HAVE QUESTIONS AT THE BEGINNING, OUR DDR P IS THE ANSWER TO THOSE QUESTIONS. THIS IS THE ONE-STORY MODEL THAT WAS ADDED IN THE THREE DIFFERENT ELEVATION MODELS THAT WERE ADDED. THE 42 STORY OPTIONS. HERE IS THE INLET, THE LAGUNA, THE NAUTILUS, AND THE AISLE. AS I NOTED, THE GENESIS OF THE LOT COVERAGE VARIANCE, THERE ARE VARIOUS OPTIONS HERE. I INCLUDED A COUPLE HERE. THE APPLICANT WANTED TO PROVIDE SOME FLEXIBILITY, OF COURSE, AS MOST DEVELOPERS DO TO CHANGE SOME OF THE FOUR PLAN OPTIONS AROUND. ADDITIONAL BEDROOMS, YOU CAN CHANGE THE OFFICE OUT , THINGS LIKE THAT. ONE THING THAT IS ALWAYS GOOD IN TODAY'S MARKET IS THE OPTION FOR A MULTI-GENERATION SUITE. SO, OVERALL, STAFF DOES RECOMMEND APPROVAL OF THE VARIOUS APPLICATIONS, INCLUDING THE REZONING, PLAT, SITE PLAN VARIANCES IN COMMITTEE APPEARANCE APPLICATION. SUBJECT TO THE CONDITIONS THAT ARE NOTED IN THE STAFF REPORT AND THE ORDINANCES AND RESOLUTIONS THAT ARE INCLUDED IN THE AGENDA BACKUP. SO, WITH THAT, I WILL TURN INTO THE APPLICANT TO MAKE THE PRESENTATION AND WE WILL BE
AVAILABLE FOR QUESTIONS. >> OKAY. MAYBE YOU WILL ANSWER ALL THE QUESTIONS WE HAVE. PRINT ONE THAT ONE RIGHT THERE.
>> NOT ONE. -- THAT ONE. WE WILL FIGURE IT OUT. ALL RIGHT.
GOOD EVENING . SCOTT BACKMAN ON BEHALF OF THE APPLICANT. GOOD TO BE BACK IN FRONT OF YOU AGAIN. AS ALWAYS, CAITLIN MAKES MY JOB VERY EASY. TO GIVE YOU ALL OF THE BACKGROUND, EVERYTHING THAT WE HAVE BEEN THROUGH ON THIS PROJECT, ALL OF THE SPECIFIC CRITERIA ASSOCIATED WITH EACH APPLICATION BUT I'M GOING TO GO THROUGH MY PRESENTATION A LITTLE BIT QUICKER. SOME OF MY GRAPHICS ARE A LITTLE BIT DIFFERENT. THERE ARE A HANDFUL OF ITEMS THAT I WANT TO ADDRESS A LITTLE BIT MORE SPECIFICALLY IN THAT HOUSEKEEPING MANNERS AT THE END WITH THE NEW DEVELOPMENTS IN THE LAST FEW
DAYS. >> OKAY. APPLICATIONS , HISTORY, WE TALKED ABOUT ALL OF THIS. THE ONLY POINT I WANT TO MAKE YOUR WITH THE AERIAL THING. KATELYN IS ON THIS ON HER PRESENTATIONS, AS WELL. JUST TO POINT OUT THE PROXIMITY BETWEEN THE DOGLEG AND BIG HOOK TO THE NORTH AND TO THE SOUTH.
AS YOU WILL SEE A LITTLE BIT LATER IN THE PRESENTATION, VERY CONSISTENT WITH THE CANAL WIDTH . IT IS UPWARDS OF A LOT LARGER THAN THAT. THIS IS A VERY TYPICAL CONDITION THAT YOU WILL SEE THROUGHOUT THE ENTIRETY OF THE COMMUNITY. THIS IS A DIFFERENT VERSION OF THE SITE PLAN THAT SHARED WITH YOU. IT IS SLIGHTLY UPDATED FROM WHAT YOU ALL SAW LAST MONTH AND WHAT THE PLANNING AND ZONING BOARD SAW, AS WELL. JUST FURTHER ENHANCES THE LANDSCAPING PACKAGES, WHICH IS SOMETHING THAT WAS DISCUSSED AT THE PLANNING AND ZONING BOARD THAT I WILL SHOW YOU THE DETAIL A LITTLE BIT LATER IN THE PRESENTATION, AS WELL AS EACH OF THE LOTS WITH THE ACCOMMODATING POOLS AND IT ACTUALLY SHOWS THE TOPIC OF DISCUSSION THIS EVENING. THE DISTANCE AND THE SPACE BETWEEN THE HOMES. SO, I THINK ALL OF THAT IS VERY RELEVANT IN REGARD TO THIS UPGRADED LANDSCAPE AND SITE PLAN RENDERING THAT WE ARE SHARING WITH YOU AS WE WORK OUR WAY THROUGH THE PRESENTATION.
KATELYN MENTIONED THE TWO OPEN SPACES, IT JUST KIND OF SHOWS THEM TO YOU IN A LITTLE BIT MORE DETAIL. ONE ON THE NORTH
[01:10:02]
SIDE, ONE ON THE SOUTHEAST SIDE OF THE PROPERTY. JUST AS IMPORTANTLY, THE TWO SIGNIFICANT BUFFERS ASSOCIATED WITH THE PROPERTY ON THE NORTH SIDE ADJACENT TO THE GST PROPERTY. YOU CAN SEE THE BUFFER COVERED UP ON THE RIGHT-HAND SIDE AND ON THE SOUTH SIDE, WE SPENT QUITE A BIT OF TIME THROUGH OUR PLANNING AND ZONING BOARD MEETING, AT THE TIME, IT WAS A SIX-FOOT WALL. THE PLAN SHOWS THAT IT HAS BEEN INCREASED TO AN EIGHT FOOT WALL WITH ENHANCED LANDSCAPING JUST TO PROVIDE MORE HEIGHT, MORE SECURITY. IT IS SOMETHING OTHER PEOPLE TALK ABOUT WHEN WE DISCUSSED THE CANAL CONDITION A LITTLE BIT LATER. JUST A DIFFERENT VERSION OF THE TABLE THAT YOU SAW FROM KATELYN. WE HAVE KNOWN FROM THE BEGINNING THAT WE WERE WORKING TOWARDS THE RS THREE. WE BUILT QUITE A BIT OF TIME TALKING ABOUT THE DIFFERENT ZONING DESIGNATION THAT WE HAD TO CHOOSE FROM AT THE LAST INNING. THE ARTISTRY ULTIMATELY WAS CHOSEN FOR A VARIETY OF REASONS, MOST TYPICALLY, THAT IT WAS MOST COMPLIMENTARY WITH THE DEVELOPMENT STANDARDS AND OLD BROOKE. REALLY, WHAT THE CITY WANTED TO SEE FOR PURPOSES OF THIS PROJECT. UPSCALE, LUXURY DEVELOPING BEING ADDED INTO THE HERON BAY COMMUNITY. THE LOT SIZE IS DENSITY, HEIGHT, THINGS OF THAT NATURE. THINGS REALLY FIT IN COMPARISON TO THE OTHER ZONING DESIGNATION THAT WE ARE LOOKING AT. THE VARIANCES THEMSELVES, CAITLIN COVERED THEM IN PRETTY GOOD DETAIL. THE TABLE ON THIS SLIDE JUST SHOWS YOU AT OUR FIRST PLANNING AND ZONING MEETING, THE VARIANCES WERE SLIGHTLY HIGHER IN TERMS OF WHAT WE WERE ASKING FOR. UNDER NO CIRCUMSTANCES ARE WE ASKING FOR ABE LINCOLN VARIANCES FOR ANY OF THESE THREE ITEMS FOR THE ENTIRETY OF THE PROJECT. ALWAYS SPECIFIC TO A HANDFUL OF LOTS WHERE WE CAN MEET CERTAIN DESIGN STANDARDS GIVEN THE CONSTRAINTS OF THE SITE. WITH THE GOLF COURSE DOGLEG AND FIGURING OUT HOW TO STILL ACCOMMODATE THE 52 LOTS THAT WERE CONTEMPLATED UNDER THE ORIGINAL PURCHASE AND SALE AGREEMENT FROM LAST YEAR. AS YOU CAN SEE, THE VARIANCES FOR LOT WITH HAVE REDUCED BY SIX. LOT COVERAGE BY FIVE. LOT COVERAGE IS AN INTERESTING ONE, AS KATELYN MENTIONED THAT I WILL DISCUSS SHORTLY. WE DON'T REALLY NECESSARILY NEEDED. IT IS REALLY SOMETHING WHERE IT IS PROACTIVE. THIS IS A LUXURY COMMUNITY. WE WANT TO BE ABLE TO PROVIDE OPTIONS AND UPGRADES TO THE CUSTOMERS. IF THEY DO CHOOSE TO ADD AN EXTENDED CABANA OR PATIO, WE DON'T WANT THEM TO NECESSARILY HAVE TO CHOOSE A DIFFERENT LOT, CHOOSE A DIFFERENT UNITY, OR IF THEY CHOOSE TO DO IT AFTER THEY BUY THEIR HOME IN MOVE IN, TO HAVE TO COME TO THE VARIANCE PRODUCT -- PROCESS. WE HAVE BROKEN IT DOWN FOR YOU IN A LITTLE BIT MORE DETAIL. 80 FEET OR LARGER, THEY MEET CODE. 15 LOTS HUNDRED 75 FEET. THEY ARE ALL IN REFERENCE WITH A RED CIRCLE. FIFTH YACHT -- -- 15 LOTS WITH THE EXCEPTION OF THE TWO THE VERY BOTTOM END OF THE SCREEN, ALL OF THE LOTS ARE ON THE NORTH OR THE EAST SIDE. EAST SIDE WOULD BE ADJACENT TO WIDTH -- NOB HILL. TRYING TO TAKE THIS BALL OF CLAY THAT WE HAVE AND MOLD IT AND PUT A PLAN TOGETHER. WE HAVE THE PROXIMITY TO THE COVE ON THE NORTH AND NOB HILL ON THE EAST. TRYING TO RESPECT THE OLD BROOKE COMMUNITY TO OUR SOUTH. APPLY THE MOST COMPLIMENTARY LOTS. AS KATELYN MENTIONED, THE SIDE SETBACK VARIANCE IS INCREDIBLY RELEVANT AND WE HAVE ADDED A COUPLE OF TABLES TO THE SLIDE THAT I THINK ARE WORTHY OF CONSIDERATION. THE FIRST ON THE LEFT-HAND SIDE. IT SHOWS YOU THE MINIMUM SETBACK REQUIREMENTS FOR A NUMBER OF COMMUNITY IS AN HERON BAY, THEY THINK YOU ALL AGREE, WOULD BE AKIN TO WHAT THEY ARE PROPOSING TO DEVELOP HERE. IF THIS COMMUNITY IS NOT ABOVE AND BEYOND THAT GIVEN THE LARGER SETBACKS AND LOT WITH -- WIDTH IN THE LARGER COMMUNITY IS. THEY ALWAYS HAD THE 10 FOOT MINIMUM THAT WE ARE REQUESTING ON SOME OF OUR LOTS. THAT WAS CHANGE THE NUMBER OF YEARS AGO FOR A WIDE VARIETY OF REASONS.ALL OF WHICH I BELIEVE THEY ARE CERTAINLY CONTEMPLATED IN THE ACCOUNTING FOR WITH REGARD TO THE TECHNICAL DESIGN OF THIS PROJECT. ON THE RIGHT-HAND SIDE, I WANT TO POINT OUT THAT THE LOTS THAT ARE DENOTED WITH THE YELLOW CIRCLE AND THE YELLOW HIGHLIGHTS. THOSE ARE ALL PIE SHAPED LOTS. WE HAVEN'T DISCUSSED THIS PREVIOUSLY. INTERESTINGLY ENOUGH. THE WAY THE CITY MEASURES LOT WIDTH, THEY ARE 70, 72 FOOT LOTS. BECAUSE THEY ARE PIE SHAPED, THEY ACTUALLY
[01:15:05]
PIE OUT. THE SETBACKS FOR THOSE LOTS ARE ALMOST IN EVERY INSTANCE, LARGER THAN THE MINIMAL SETBACK REQUIREMENT, AS WELL. HOWEVER, THERE MAY BE PORTIONS OF THE HOME TOWARDS THE FRONT OF THE LOT NOT FOR A VERY SMALL PORTION STILL REQUIRE THAT 10 FOOT SETBACK. SO, BETWEEN THE LAST SLIDE WITH THE LOT WIDTH AND THIS SLIDE. WE HAVE DONE EVERYTHING THAT WE CAN TO TRY AND MINIMIZE THE VARIANCES THAT WERE REQUESTED.WE ARE TRYING TO WORK WITHIN, A LOT OF PROPERTIES THAT HAVE BEEN DEVELOPMENT THROUGHOUT PARKLAND THAT YOU BEEN ABLE TO START FROM SCRATCH AND DESIGN A PROJECT, TAKING IN THOSE GOLF COURSE THAT THE CITY HA A LOT OF FORETHOUGHT IN ACQUIRING AND TRYING TO MOVE FORWARD IN DEVELOPING PROJECTS OF THIS NATURE. NOW WE ARE TRYING TO DO IT IN COMPLIANCE WITH THE CODE AS POSSIBLE. BUT, GIVEN THE UNIQUE NATURE OF THIS PARTICULAR PIECE OF PROPERTY, THERE ARE SOME VARIANCES THAT RESULTED. WE TALKED ABOUT THE LOT COVERAGE COMPONENT. AGAIN, THE LOTS, THERE ARE 16 OF THEM THAT MAY REQUIRE THE VARIANCE.
IT IS NOT GUARANTEED THAT THEY WOULD. ARE THE 16 LOTS THAT YOU SEE HERE, I WILL SAY WITH ONE EXCEPTION, WHICH IS NOT BEEN UPDATED ON MY SLIDE, BUT THE INTRODUCTION OF THE ONE-STORY MODEL WHICH IS A REQUEST FROM THE PLANNING AND ZONING BOARD WITH A REQUEST FROM THIS COMMISSION BECAUSE OF THE ONE-STORY HOME, DOES NECESSITATE A 42% LOT COVERAGE FOR ANY LOTS . IF THEY ARE ON THE PIE SHAPED LOTS OR LARGER LOTS THAT WOULD NECESSARILY NOT BE THE CASE. THE OTHER UPDATE I WANTED TO PROVIDE MY MENTIONED TWO OR THREE OF THEM. THERE WERE A NUMBER OF THEM THEY CAME UP IN OUR PLANNING BOARD MEETING IN THE SECOND BOARD THAT CONSIDERED THE APPLICATION. THE REDUCTION OF THE VARIANCES THAT THEY TOUCH ABOUT. THE BUFFERING. I TALKED ABOUT IT LAST WEEK. UPDATE ON THOSE DISCUSSIONS. THE ENTRANCE WORK CONCEPT RENDERING THAT KATELYN SHOWED YOU. ONE OF THE ELEVATIONS OF WHAT ONE OF THE SLIDES WOULD LOOK LIKE. WE HAVE A MUCH NICER BOWL CONCEPT RENDERING THAT WE WILL SHARE WITH YOU. THEN THE ONE-STORY MODEL. I MENTIONED THE AVERAGES OF THE CANAL WITH -- WIDTH HERON BAY. ONE OF THE REASONS THAT CAME UP, I THINK SOMEONE FROM ALDRICH MAY HAVE BEEN AT ONE OF THE MEETINGS. TALKING ABOUT WITH THE PROXIMITY OF THE ROOM, LOOKING ACROSS THE CANAL AT OUR HOMES. THERE WAS A REQUEST AT THE PLANNING AND ZONING BOARD MEETING TO LOOK AT OUR REAR YARD LANDSCAPE PACKAGE. WITHIN TWO DAYS, OUR DESIGN TEAM HAD A CONVERSATION WITH THE CITIES AND WE DID PROVIDE ADDITIONAL REAL -- REAR YARD LANDSCAPING. FIVE OR SIX TREES THAT ARE ADDED TO THE REAR YARD. IT LOOKS LIKE A FEW TREES HERE. BUT AS HE MATURES ON THE NEXT PLAN, IT IS ONE OF THE REASONS WHY THIS PLAN WAS UPDATED. THEY WERE STRATEGICALLY IDENTIFIED AND LOCATED IN A PLACE THAT IS NOT GOING TO BLOCK THE ACCESS AND VISIBILITY TO THE CANAL, BUT IT IS A HUGE AMENITY FOR THE LOTS.
BUT TO PROVIDE THAT HEIGHT AND PRIVACY THAT WILL APPLY BOTH WAYS. SORRY, THIS IS ALSO JUST INTENDED TO REITERATE FOR YOU, THE ADDITIONAL WALL HEIGHT. SO, THE CONCEPT RENDERING THAT WE CAME UP WITH AND WHAT IS IMPORTANT ABOUT THIS, I THINK THIS LOOKS GREAT. WE HAVE HEARD A LOT OF REALLY POSITIVE COMMENTS ON IT. BUT WHAT STANDS OUT THE MOST THAT I WANT TO HIGHLIGHT, THE TREE IN THE MIDDLE. THAT IS AN EXISTING TREE. IT IS BEING PRESERVED. IF YOU LOOK BACK AT THE SITE LINE ALL THE WAY OVER ON THE LEFT-HAND SIDE. ANY OTHER ACCESS CONFIGURATION TO THE SITE IS PROBABLY GOING TO DAMAGE OR POTENTIALLY REQUIRE REMOVAL OF THAT TREE. IT IS A GORGEOUS TREE. IF YOU HAVE DRIVEN OUT THERE OFF OF HERE AND RUN. WE MADE EVERY EFFORT THAT WE COULD TO KEEP IT. THEN, THE ONE-STORY MODEL WHICH IS BEEN INTRODUCED. I'M GOING TO VERY QUICKLY NOW JUST SLIDE THROUGH OUR RENDERINGS, OUR ARCHITECTURE, OUR TEAM IS HERE TO DISCUSS THAT WITH ALL OF YOU FURTHER. FIVE MODELS, THREE ELEVATION OPTIONS FOR EACH MODEL AND I BELIEVE 16 DIFFERENT PAINT COLORS AND DESIGN PACKAGES THAT CAN GO TO EACH OF THEM. I DO WANT TO HIGHLIGHT FOR ALL OF YOU, THIS GOES BACK TO THAT LOT COVERAGE DISCUSSION. LOTS OF TIME FOCUSED ON THE QUALITY OF LIVING, THE QUALITY OF THE LIFESTYLE. ABOVE AND BEYOND HOUSE. YOU CAN SEE ON THE RIGHT-HAND SIDE. A LOT OF THE REAR GUIDES OR EXISTING PHOTOS. IT HAS BEEN IN THOSE BACKYARDS.
AN EXTRA SPECIAL TOUCH THAT THEY PUT ON THE HOMES. IT IS A THREE CAR GARAGE, AS YOU CAN SEE. WITH THE SIDE GARAGE THE
[01:20:07]
LAGOON IS THE SAME GARAGE CONFIGURATION. AGAIN, THE SQUARE FOOTAGE IS INCREASED WITH EACH OF THESE MODELS. THIS IS ACTUALLY A FOUR CLUB -- CAR GARAGE FOR THE NAUTILUS. THREE ON ONE SIDE AND ONE ON THE OTHER. IT IS A LARGER HOME, BUT IT HAS A THREE CAR GARAGE, AS WELL. DESIGN COLOR PACKAGES, THIS IS ALL PART OF THE HERON BAY IMPROVED PACKAGE, AS WELL.THEN THE SCHEDULE. I WANT TO TOUCH ON THE TWO HOUSEKEEPING MATTERS THAT I TOUCHED ON EARLIER. SO, WE ARE IN THE APPROVAL PROCESS WITH THE CITY. HOPEFULLY IF ALL GOES WELL, WE WILL HAVE AN APPROVAL THIS EVENING. THE MISSING PART IS AUGUST OF 2024 IN MAY OF 2025. KATELYN TOUCHED ON THE PLAT. IT IS THE COUNTY PROCESS BUT WE CANNOT FIGURE THAT PROCESS AND TO BE FIGURED -- FINISH THIS PROJECT. THEY WILL DO A DETAILED REVIEW. PROBABLY A FOUR TO FIVE MONTH PROJECT ONCE.CLOSES. WE WILL BE CONCURRENTLY A PROCESSING PERMIT , OTHER APPLICATIONS AS NEEDED WITH THE IDEA THAT WE WOULD BE STARTING SOMETHING RELEVANT IN MAY. CONSTRUCTION HOPEFULLY IN SEPTEMBER. SALES IN THE FALL OF NEXT YEAR. SO, PROBABLY RIGHT AROUND A YEAR FROM NOW WITH OPENINGS, SIX, SEVEN MONTH LATER IN THE SPRING. FINAL CONSTRUCTION CLOSEOUT SOMETIME IN 2028. SO, THE OTHER TWO ITEMS THAT I JUST WANTED TO TOUCH ON. FIRST I MENTIONED BACK ON JULY 31ST, THERE WAS A MEETING THAT I ATTENDED AND LISTENED. ADAM RULED WITH TOLL BROTHERS IS HERE THIS EVENING. HE MADE A PRESENTATION TO THE A BOARD. THERE WERE 60 TO 70 RESINS THAT WERE PART OF THAT DISCUSSION, AS WELL. COUPLE OF BOARD MEMBERS, AS WELL. THEY CAN REPRESENT IN MORE DETAIL IF THEY PLAN ON SPEAKING. ALL IN ALL, THE MEETING AND THE PROJECT AS IT WAS PRESENTED WAS VERY WELL-RECEIVED. THERE WAS CERTAINLY SOME DISCUSSION IN PARTICULAR ABOUT THE CANAL COMPONENT ASSOCIATED WITH THE PROJECT. SO, THAT IS THE LAST THING I WANT TO TOUCH ON. I WANT TO SHOW YOU A GRAPHIC THAT I WILL SAY THIS IS SOMETHING THAT OUR CIVIL ENGINEER PUT TOGETHER. WE HAVE BEEN WORKING VERY CLOSELY WITH THE CITY STAFF. I KNOW THAT YOUR STAFF HAS BEEN WORKING WITH NSID IN BROWARD COUNTY. THERE ARE A LOT OF THINGS THAT NEED TO FALL IN PLACE TO MAKE THIS HAPPEN. TOLL BROTHERS WANTS TO PLAY ITS PART, AS WELL. THERE IS ALSO A COMPONENT OF THIS EMISSARY, THESE ARE A COUPLE OF RENDERINGS THAT OUR CIVIL ENGINEER PUT TOGETHER. THEY MAY NOT LOOK THIS WAY. THERE WAS A LITTLE BIT MORE OF A CLOSE-UP. JUST TO EXPLAIN THIS, WHAT YOU SEE, THE REDLINE IS THE PROPERTY THAT WE ARE ACQUIRING FROM THE CITY. OUR CIVIL ENGINEER DREW THIS IN A WAY.
THERE IS ANOTHER TREE THAT IF YOU DREW THIS STREET ACROSS COULD BE AN ISSUE OR WOULD CAUSE A WHOLE LOT OF MONEY TO MITIGATE FOR. WE HAVE EXPLORED A DESIGN OPTION, IT IS NOT NEARLY THE DIRECTION WE THOUGHT IT WAS GOING TO GO. WE ARE SHOWING IT FOR A FEW DIFFERENT REASONS. MOST IMPORTANTLY, WITH REGARD TO COMMISSION APPROVAL THAT WE WOULD LIKE TO OFFER, WORKING WITH THE CITY ATTORNEY FOR THE BETTER PART OF THE DAY TODAY TO TRY AND FIGURE IT OUT. TOLL BROTHERS IS WANT TO PLAY ITS PART. WE WANT TO GO BACK FOR A SECOND AND SHOW THIS SLIDE. ONE OF THE ISSUES, WHO KNOWS , WITH THE DESIGN, IT MAY NOT OCCUR. ON THE RIGHT-HAND SIDE OF THE SCREEN, USE THE PARKLAND AISLE, OBVIOUSLY THE PLANS THAT HAVE BEEN PRESENTED TO YOU ALL THAT WE SEE FOR THE VILLAGES HAVE SOME FORM OF IMPROVEMENT, AND A BRIDGE THAT WILL HAVE TO COME OVER THE CANAL THAT EXISTS. THE LAST THING TOLL BROTHERS WANTS TO DO IS GET INVOLVED OR INTERFERE IN ANY WAY WITH THE CANAL THAT POTENTIALLY CREATES OTHER ISSUES FOR WHAT NEEDS TO HAPPEN IN ORDER TO MAKE THE ACCESS TO THE COMMERCIAL COMPONENT AVAILABLE IN THE FUTURE. SO, WITH ALL OF THAT SAID, BACK TO THE REDLINE, THAT IS OUR PROPERTY AS PART OF THE CONDITION, WE WOULD LIKE TO PROFFER. WE WOULD LIKE TO -- ANTHONY HAD SOME LANGUAGE THERE. I'M GOING TO TAKE A SHOT AT IT. THERE ARE THREE POINTS TO IT AND THEN WE CAN SPELL IT OUT A LITTLE BIT MORE DETAILED THROUGH DISCUSSION WITH THE COMMISSION. TOLL BROTHERS HAS AGREED UPON WRITTEN REQUEST FROM THE CITY TO DEDICATE OR CONVEY IT A 15 FOOT LAKE MAINTENANCE EASEMENT PORTION OF THAT RED LINE THAT YOU SEE. TO BE CITY OR AYE FOR AS NEEDED OR AS APPROPRIATE.
THERE IS A LOT MORE HOMEWORK THAT NEEDS TO HAPPEN TO FIGURE
[01:25:02]
ALL OF THIS OUT. THE SECOND PIECE OF THAT WOULD BE THE BALANCE OF THE REDLINE THAT YOU SEE. THAT IS THE OPEN SPACE. A PORTION OF THE OPEN SPACE TO DUE NORTH OF THE BUFFER THAT I SHOWED YOU EARLIER. I CAN CERTAINLY GO BACK TO THE SITE PLAN IF YOU WOULD LIKE TO SEE YOU LATER. BUT, THERE IS OPEN SPACE IN THAT AREA THAT IS PART OF OUR PROJECT. IT IS NOT REQUIRED OPEN SPACE BUT ALMOST AN ACRE MORE THAN WHAT WE NEED.SO, THAT AREA IS AVAILABLE, IF NECESSARY, TO WORK WITH THE CITY. THE CITY COMES AND SAYS HEY, WE ARE WORKING ON A DESIGN YOU NEED ANOTHER FIVE FEET, 10 FEET. YOU WANT TO HANDLE IT LIKE THIS. SO, PART OF THE CONDITION THAT TOLL BROTHERS IS HERE AND CONTINUE TO PLAY BALL AND COOPERATE. IF THE CITY NEEDS SOME MORE AREA, THAT IS ABOUT THE EXTENT OF WHAT WE CAN OFFER WITHOUT THE SITE PLAN THAT IS BEFORE YOU THIS EVENING. THE LAST COMPONENT OF THAT, AGAIN, BECAUSE OF THE UNKNOWNS ASSOCIATED WITH THIS, THE BRIDGE, THE FUTURE COMMERCIAL COMPONENT, TOLL BROTHERS IS OFFERING TO PUT $100,000 INTO ESCROW , TO BE PLACED IN ESCROW WITHIN 10 DAYS OF OUR CLOSING. I WILL BE SOMETIME NEXT SPRING, THAT WILL BE MADE AVAILABLE TO THE CITY, AS THE CITY CONTINUES TO WORK THROUGH THE DESIGN AND PERMITTING AND CONSTRUCTION PROCESS. WHETHER THAT IS THE CITY OR THE COMMERCIAL DEVELOPER, WE ARE NOT REALLY SURE. BUT LIKE I SAID, THERE THAN A LOT OF PEOPLE THAT HAVE BEEN COOPERATING HERE. NSAID, THE COUNTY, THE CITY. TOLL BROTHERS WANTS TO PLAY ITS PART. OBVIOUSLY THERE IS AN UNKNOWN FUTURE COMMERCIAL DEVELOPMENT THAT MAY PLAY A ROLE IN ALL OF THIS, AS WELL.
WE WILL END WITH IDEA THAT IS THE CONDITION WE WOULD LIKE TO PUT OUT THERE AND I THINK ANTHONY CAN PROBABLY SUMMARIZE
IT MORE IN DETAIL. THANK YOU. >> GREAT. I JUST WANT TO SAY THANK YOU FOR WORKING WITH STAFF, PLANNING AND ZONING.
THIS IS A VERY GOOD-LOOKING PROJECT AND I APPRECIATE YOU WORKING WITH THE VARIANCES AND BRINGING MORE HOMES INTO COMPLIANCE. YOU KNOW? LISTENING TO STAFF. TOLL BROTHERS HAS SHOWN, ONCE AGAIN, THAT THEY ARE A GOOD PARTNER FOR THE CITY. SO WE CERTAINLY DO APPRECIATE THAT. IF WE HAVE QUESTIONS, WE CAN ASK QUESTIONS AND HAVE SOME DISCUSSION. IT WOULD PROBABLY BE EASIER TO GET ITEM B AND TALK ABOUT ITEM B AND ASK SOME QUESTIONS AND GET SOME ANSWERS TO SOME YOUR
QUESTIONS NOW. OTHERWISE, -- >> I WOULD MOTION TO APPROVE
ITEM B. >> WE HAVE A MOTION TO APPROVE
ITEM B. I HAVE A SECOND? >> THE REZONING.
>> YEAH, SECOND. >> ANYONE FROM THE PUBLIC WHICH YOU SPEAK ON THIS AGENDA ITEM?
>> BEEN SITTING THERE FOR A WHILE.
>> THE KID AND I WERE JOKING ABOUT GETTING A LITTLE BIT OLDER HERE. ANYWAY, MARK'S LAW, DO YOU NEED MY ADDRESS?
>> 12557 NORTHWEST 60TH STREET NORTHWEST FLORIDA, HERON BAY. I WILL MAKE THIS SHORT BECAUSE THEY MAY HAVE QUESTIONS ON OTHER PARTS HERE. ADAM CAME OUT AND HIS TEAM WE WENT THROUGH ALL OF THIS. ADDING A SINGLE STORY IS GREAT. THE ONE QUESTION I SAW ON THIS AND I MAY BE A LITTLE BIT CONFUSED ABOUT SETBACK. MY DEFINITION OF A SETBACK IS FROM THE PROPERTY LINE. WHEN I SAW THE PLANNING AND ZONING PRESENTATION, IT LOOKED LIKE THEY MADE ONE OF THE PROPERTY LINES A0 PROPERTY LINE. SO I AM ASSUMING WITH THE 10 FOOT SETBACK THAT THEY ARE GOING TO HAVE 20 FEET BETWEEN THEM. AM I CORRECT? IF YOU LOOK AT THE PLANNING AND ZONING, IT LOOKED LIKE MY NEIGHBORHOOD, THEN YOU HAVE ALL OF THE SPACE.
>> YOU ARE CORRECT. >> OTHER THAN THAT, WE HAD A MEETING WITH THE HOMEOWNERS. THE ONLY NEGATIVE HOMEOWNER RESPONSE WE GOT WAS I WILL MISS THE GOLF COURSE. THAT IS BASICALLY IT. SO, WE ARE ON BOARD HERE. THE ONE THING THAT I DON'T KNOW I SHOULD MENTION NOW OR LATER. IN THE CANAL, WE HAVE TALKED. THE CANAL IS VERY, VERY IMPORTANT TO HERON BAY. WE CAN ARGUE ABOUT HILLSBORO AND HOW WE NEVER AGREE. BUT WE CAN MAKE THIS CANAL WORK, I THINK IT IS GREAT. I THINK TOLL BROTHERS IS BENDING OVER BACKWARDS HERE AND OFFERING TO KICK IN SOME MONEY. TONY OF A LOW, PRINT 24. HE HAS HELPED.
WE CAN MAKE THIS WORK. >> WITH THE BRIDGE AND THE TRAFFIC CIRCLE. SO, I HOPE WE CAN MAKE THAT WORK. THE ONLY HANG-UP WE HAVE THAT RIGHT NOW. ADAM AND I HAVE BEEN WORKING ON
[01:30:02]
THIS. IT INVOLVES LAWYERS, OF COURSE.>> THAT IS YOUR FIRST PROBLEM.
>> OF COURSE. >> WE DON'T HAVE THE COST SHARING AGREEMENT. SO, WE GOT THE COST SHARING AGREEMENT PROBABLY FIRST RUN, A MONTH AGO, MAYBE. AND OUR MAP WENT THROUGH IT. HE WROTE THE ROAD -- WHOLE THING. DRAFT PRESS WAS REALLY FAR-OFF. IT WAS A STRANGE ARRANGEMENT WHERE THE HOMEOWNERS DID NOT PAY AN ASSESSMENT, THE AGENT
>> HOWEVER THAT WORKS WITH YOU GUYS, IF WE DO APPROVE IT, WE
CAN ALWAYS APPROVE IT. >> I JUST WANTED TO MAKE SURE THAT AS WE GO FORWARD HERE AND YOU GUYS PROVE STUFF THAT YOU KEEP -- WE WILL PUSH BOTH GUYS TO BE, AND 30 DAYS .
>> IF WE DO APPROVE IT , WE WILL APPROVE IT WITH THE
>> IF IT TAKES 30 DAYS, NORTHWE 79TH -- THE ONLY OTHER QUESTION IS ON THE DIAGRAM THAT YOU ARE SHOWING. YOU ARE SHOWING IT TO CONTINUOUSLY CONNECT ON THE LEFT SIDE BUT YOU SHOWED IT STOPPING AT THE LAMP. IT IS THE INTENT TO ALL THE WAY ACROSS AND CONNECT BOTH CANALS. RIGHT? OKAY. YOU MIGHT WANT TO CLEAN UP YOUR DIAGRAM. THAT'S ABOUT IT.
>> ANYBODY ELSE? >> ONE LAST COMMENT ABOUT THE CANAL. WE ARE LOOKING AT A 50 FOOT WIDTH. THE OTHERS ARE 100.
I'M OKAY. BECAUSE AT THE END THERE, IF YOU LOOK AT IT, AND THIS IS A CONTENTION. IT'S ONE OF THOSE RESERVE AREAS. IT'S FULL OF WEEDS AND CATTAILS. THIS CANAL COULD BE 20 FEET WIDE, FULL OF WEEDS AND CATTAILS, AND THAT WOULD SERVE
A SECURITY PURPOSE . >> THANK YOU FOR YOUR COMMENTS.
SOMEBODY ELSE? YES. NAME AND ADDRESS FOR THE RECORD.
>> -- 11730 -- IN BAY COVE. WHEN TOLL BROTHERS FIRST MADE THE PROPOSAL THEY SHOWED ALL TWO-STORY HOMES. AND HERON BAY SAID , HOW ABOUT SOMEONE STORIES? DO THEY CAME UP WITH ONE MODEL, 600 FEET SMALLER THAN THE TWO-STORY. NOW THERE ARE 18 HOMES IN BAY COVE ON THE GOLF COURSE HE HAS 24 HOMES BEING AFFECTED IN OLD BROOKE. OF THOSE 42 HOMES 11 ARE TWO-STORY. WE HAVE NO GUARANTEE THAT THIS ISN'T GOING TO BE A 52 HOME, TWO-STORY COMPLEX. WHICH IS GOING TO CREATE A 35 FOOT TALL WALL OF HOMES SURROUNDING THE WHOLE DEVELOPMENT. I KNOW THAT YOU CAN PUT A REQUIREMENT OR ANYTHING LIKE THAT THAT THEY NEED A PERCENTAGE OF ONE-STORY HOMES ON THE SITE OR NOT. THE OTHER QUESTION IS, WITH THE VARIANCES AND EVERYTHING ELSE, THAT WHEN YOU ALL SET THE STANDARD OR IT WAS DECIDED THERE WOULD BE 52 HOMES, I DON'T KNOW IF IT WAS JUST AN ARBITRARY NUMBER THAT YOU ALL PICKED OUT OF THE AIR FOR THAT MEETING OR WHAT. IF IT HAD BEEN 50 HOMES, NO VARIANCES. THEY PICKED UP TO FIVE FEET FOR EVERY LOT THERE THAT THEY NEEDED. SO BASICALLY, I'M NOT LOOKING FORWARD TO SEEING A 35 FOOT WALL OF TWO-STORY HOMES.
NOW I KNOW THAT'S WHAT THE NEW DEVELOPMENT IS . BUT HERON BAY HAS BEEN THERE FOR 22 YEARS. I KNOW THE ARCHITECT HAS CHANGED, LANDSCAPING HAS CHANGED, REVEALS. BUT IT IS DISTINCTIVE FROM CASADA. ANYTHING NORTH OF HILLSBORO. SO I WOULD LIKE EVERYONE TO TAKE THAT INTO ACCOUNT OF THE SURROUNDING AREA AND ALL OF THAT, AND THE EFFECT OF LOOKING AT A 35 FOOT TALL HOME. I HAVE BEEN IN OTHER AREAS OVER THERE. IT'S NOT AN ATTRACTIVE SITE. I'M SURE THAT THE HOMES WILL BE BEAUTIFUL.
IT'S GOING TO BE DIFFERENT THAN WHAT IS IN HERON BAY BECAUSE THERE IS A MODERN FLOOR PLAN AND EVERYTHING LIKE THAT.
THAT'S BASICALLY IT I THINK. THINGS VERY MUCH.
>> YOU CAN CONFIRM. >> WE HAVE INTRODUCED A
[01:35:03]
ONE-STORY MODEL. THAT WAS OBVIOUSLY A REACTION TO COMMENTS THAT CAME UP EARLIER IN THE PROCESS THAT AT ONE POINT THERE WERE NONE. AGAIN, IT IS MARKET DEMAND. WE HAVE HAD CONVERSATIONS , ULTIMATELY WHAT THE MARKET DICTATES WE WILL SELL THE ONE-STORY MODEL. AND IF CUSTOMERS COME IN AND WANT TO PURCHASE 10 ONE-STORY MODELS WITHIN THE COMMUNITY THAT'S WHAT HAPPENS. IT'S REALLY ULTIMATELY UP TOONE-STORY DEMAND. >> THANK YOU. ANYONE ELSE? I'M SEEING THAT THERE IS NONE. WE HAVE A MOTION TO APPROVE BY VICE MAYOR. THIS IS FOR AGENDA ITEM B.
>> ARE WE GOING TO TALK THROUGH ALL OF THEM? THEY ARE INTERRELATED. DO YOU WANT TO TALK THROUGH THE REZONING
FIRST? >> I FIGURE WE GET THROUGH THIS WHEN I'M ASSUMING RELATIVELY EASY.
>> THAT'S FINE. THAT'S FINE. YEP.
>> SO WE HAVE A MOTION BY THE VICE MAYOR AND SECOND BY COMMISSIONER MAYERSON. ROLL CALL.
>> UNANIMOUSLY. NOW WE WILL DO ITEM C.
>> MOTION TO APPROVE. >> SECOND.
>> ANYONE FROM THE PUBLIC? YOU ARE ALLOWED TO SPEAK AGAIN BUT YOU DON'T HAVE TO. I'M JUST SAYING YOU CAN. --
>> THAT WOULD GO ON D. >> 10 D, THE SITE PLAN. THAT'S
NEXT. >> AFTER THIS ONE. BECAUSE WE'VE GOT TO PUT IT ON A REGULAR AGENDA ITEM.
>> THE ONLY OTHER COMMENT I HAVE YEAR, WE WENT IN A DISCUSSION ON THE ONE STORIES TOO. AND ITS MARKET CONDITIONS.
WE FEEL THERE IS GOING TO BE A DEMAND FOR ONE STORIES.
>> I WILL RAISE THAT. >> YOU MIGHT WANT TO PUT SOME KIND OF MINIMUM , YOU KNOW. 10, 15 ONE STORIES OR SOMETHING OUT
OF THIS. >> IT'S A LITTLE HARD TO DICTATE THE MARKET. IF PEOPLE DON'T WANT TO BUY THEM YOU
MIGHT NOT -- >> BUT YOU ARE PLANNING LOTS
AND -- >> WE WILL TALK ABOUT THAT WHEN
WE GET THERE. >> THAT'S MY ONLY POINT.
>> ITEM C. CAN WE SPEAK AN ITEM C? WE HAVE A MOTION. I'M SORRY.
>> PLEASE SHOW THAT PASSES UNANIMOUSLY. SO ITEM D. HOLD
ON. >> BEFORE WE HAVE A DISCUSSION, KATELYN, DO WE HAVE AN IMAGE OF WHAT WAS PROJECTED FOR THE VILLAGE ? WHAT THEY DREW UP AS THEIR ROUGH IMAGE . I'M TRYING TO UNDERSTAND WHERE THE INTERSECTION IS. THE LAST IMAGE THAT GOT PUT UP WHERE THE ROADWAY IMAGE GOES ON TO THE PROPERTY. YEAH, THAT ONE. SO THE DESIGN FOR THE VILLAGE AND WHERE THAT ROADWAY MEETS INTO IT FOR PURPOSES OF ACCESS, I KIND OF WANTED TO SEE THAT IN THIS PARTICULAR SLIDE .
>> IF WE WANT TO TALK ABOUT THE CANAL NOW SINCE COMMISSIONER CUTLER IS BRINGING IT UP WE COULD DISCUSS THAT NOW BECAUSE THERE'S NOT REALLY NECESSARILY AN ITEM TO PUT THAT.
>> I DON'T KNOW HOW LONG IT WILL TAKE HER TO FIND THAT. WE COULD SEE THAT AS WE TALK ABOUT IT.
>> MY CONCERN , FYI, I'M ALL FOR THE CANAL. UNTIL WE REALLY KNOW WHAT'S GOING TO HAPPEN WITH THE COMMERCIAL I THINK WE'VE GOT TO WAIT UNTIL WE GET THERE , UNTIL THE DEVELOPER COMES IN AND SAYS THIS IS DEFTLY WHERE IT'S GOING TO GO.
THEN WE CAN BRING BACK THE POT CONVERSATION ABOUT WHERE IT'S GOING TO GO, WHAT IT WILL BE. I THINK WE ARE PREMATURE. TO MARK'S POINT, HE DOESN'T NEED 50. I'M SAYING, IF SHE CAN GET
US. >> YEAH, I THINK SEEING IT IS HELPFUL. IF I CAN ALSO INTERJECT. FIRST, I WANT TO THANK NANCY , JACKIE, ANTHONY, TOLL BROTHERS, THE HLA -- A .
[01:40:06]
ORIGINALLY, THE CANAL WAS SOMETHING RESIDENTS HAD ASKED FOR FOR NOT ONLY SECURITY AESTHETICS AND A COMMERCIAL PROJECT, ORIGINALLY, THE ANSWER WAS IT CAN'T BE DONE WITH THE HELP OF THE CITY ATTORNEY AND WE HAVE GOTTEN TO THE GAME PLAN FOR HOW IT CAN BE DONE AND WHAT WAS NEEDED. YOU NEED AT LEAST A 15 FOOT EASEMENT ON THE NORTH END AND THE SOUTH END FOR MAINTENANCE AND ACCESS. TO THE MAYOR'S POINT, THE WIDTH OF THE THE CANAL MAY VARY. THE SMALLER OR BIGGER, IF YOU REMEMBER THE CONCEPTUAL PLAN THAT WE WERE USING FOR THE VILLAGE CONCEPT, THEY INCREASE WATER AS YOU GOING TO THE VILLAGE FOR AESTHETICS PURPOSES TOO. AND MAKE IT A NICERPROJECT. >> THAT'S WHY I WANTED TO SEE
THE IMAGE. >> WHAT WE WERE TRYING TO AVOID, AND WHAT HELPS WITH THIS EASEMENT, AS WE WERE TRYING TO AVOID THE ENTIRETY OF THE CANAL BUTTING INTO WHAT MAY ULTIMATELY BE THE ENTRANCE TO THE COMMERCIAL PROJECT. AND WHAT TOLL IS DOING IS GIVING US, AS I UNDERSTAND, CORRECT ME IF I'M WRONG, IT'S NOT ONLY THE 15 FOOT EASEMENT. BUT IF WE NEED AN EASEMENT OR WHATEVER THE TERMINOLOGY IS FOR THE ENTIRETY OF THE AREA AND READ FOR PURPOSE OF YOU THERE BUT THE MAINTENANCE AREA OR THE BODY OF WATER.
>> THE POINT IS, WE JUST CAN'T.
>> WE ARE PLANNING OUT THE CANAL TONIGHT.
>> THIS IS WHAT IT'S GOING TO LOOK LIKE AND THIS IS WHERE IT'S GOING TO GO. UNTIL WE GET TO THE NEXT PHASE. FOR SECURITY PURPOSES, LET'S REMEMBER, THERE IS NO ACCESS FOR ANYBODY TO GET THERE. RIGHT? THERE IS NO BRIDGE TO GET OVER. RIGHT NOW, ONCE THE WALL GETS PUT UP, IT'S NOT LIKE THERE'S ANY TRAFFIC THERE. RIGHT NOW THE CANAL IS NOT NEEDED. BUT OBVIOUSLY ONCE THE BRIDGE COMES AND THE COMMERCIAL WE'VE GOT TO LOOK AT THAT. BUT UNTIL WE GET TO THAT POINT I THINK WE
KIND OF JUST SAY -- >> THIS IS PAVING THE WAY FOR IT. THIS IS GIVING US , AND SCOTT CAN CORRECT ME IF I'M WRONG, IT'S GIVING US THE ABILITY TO USE THE AREA AND READ FOR PURPOSES OF THE CANAL OR MAINTENANCE AREA FOR THE NORTH END OF THE CANAL. WHATEVER IT IS. WHATEVER IT IS.
RIGHT? >> I WANT TO CLARIFY. YOU ARE ABSOLUTELY RIGHT. BUT I WANT TO BE CLEAR FROM WHAT I SAID EARLIER. THIS IS DESIGNED BY OUR CIVIL ENGINEER TO FIND OUT THE 15 FEET WAS SOMETHING THE CITY NEEDED . IT'S DESIGNED THIS WAY. IT MAY OR MAY NOT BE. OUR CIVIL ENGINEER IS WORKING FOR THE CITY. HE DID AN EXERCISE FOR TOLL BROTHERS GIVEN THE CONVERSATIONS WE WERE HAVING WITH YOUR STAFF. AND IF IT WAS DESIGNED THIS WAY WE CAN POTENTIALLY ACCOMMODATE AN ADDITIONAL AREA WITHIN OUR PROPERTY. IT WAS MORE OF A STUDY TO SEE HOW MUCH OF THE DEVELOPMENT SITE COULD BE IMPACTED WITHOUT ACTUALLY IMPACTING OUR LOTS, OUR OPEN SPACE, OUR ROADWAY NETWORK. SO YOU ARE CORRECT. I JUST WANT YOU TO UNDERSTAND WHAT THIS EXHIBIT WAS REALLY FOR.
>> UNDERSTOOD. UNDERSTOOD. >> I WANT TO THANK THE H AWAY, OUR STAFF , FOR FACILITATING A PATH WHERE IT'S POSSIBLE.
>> IT'S JUST NOT THERE YET. >> IT MAY BE BIGGER, IT MAY BE SMALLER, BUT IT'S SOMEWHERE SEPARATING THE TWO PARCELS.
>> WE CAN HAVE THAT CONVERSATION AT A LATER DATE.
WE HAVE BETTER INFORMATION. WITH THAT, DO WE WANT TO TALK
ABOUT -- >> I WANT TO RAISE A COUPLE OF OTHER ISSUES. I APPRECIATE THAT TOLL BROTHERS HAS GONE BACK AND REDUCED THE NUMBER OF LOTS THAT ARE SUBJECT TO THE VARIANCES. I THINK IN THE END IT WILL BE A PRETTIER, NICER COMMUNITY AS A RESULT. I AM CONCERNED TO THE RESIDENCE POINT , I AM CONCERNED THAT I DON'T WANT THIS TO BE THE ONLY DEVELOPMENT IN HERON BAY THAT IS SOLELY TWO-STORY HOMES. I KNOW THAT WAS BROUGHT UP BY THE COMMUNITY APPEARANCE BOARD AND THE RESIDENCE. I WOULD LIKE TO HAVE SOME COMMITMENT TO TOLL BROTHERS THAT THERE WOULD BE ONE STORY HOMES. HOWEVER, WE CAN TALK ABOUT WHAT THAT IS. BUT SOME COMMITMENT THAT THIS IS NOT GOING TO BE THE ONLY OUTLIER IN HERON BAY WITH NO ONE-STORY MODEL IN IT. I KNOW THEY ARE OFFERING ONE STORY. I KNOW THAT IS PART OF THE PACKAGE. AND I APPRECIATE THAT.
BUT I HAVE TALKED TO SCOTT AND TOLL BROTHERS ABOUT THIS. I DO THINK GETTING SOME SORT OF GUARANTEED NUMBER , AT LEAST AS A MINIMUM, AND OBVIOUSLY THE MARKET WILL DICTATE THE REST, WILL ALLEVIATE THE CONCERN THAT THIS IS NOT THE ONLY TWO-STORY EXCLUSIVE DEVELOPMENT IN HERON BAY.
[01:45:01]
>> TOLD WOULD HAVE TO SPEAK ON THAT. I HAVE A HARD TIME
DICTATING. >> I WILL ADDRESS IT. MAYOR, TO BE DIRECT, I AGREE. AND SO DO SOUL BROTHERS. THE MARKET DICTATES. AND WE WOULD LIKE TO LEAVE IT AT THAT. WE COULD AGREE TO SAY THAT WE WILL GUARANTEE THAT WE WILL SELL TWO OF THESE LOTS FOR A SINGLE-FAMILY HOME. AND THEN THE MARKET DICTATES. IT'S A REALLY DIFFICULT THING TO DO TO A HOMEBUILDER. OUR PREFERENCE WOULD BE NOT. BUT WE CAN SAY
THAT. >> I'M NOT LOOKING TO HEM YOU IN. AND I APPRECIATE THE TWO. BECAUSE TO ME, THAT ALLEVIATES THE CONCERN THAT THIS WILL BE ALL TWO-STORY HOMES. SO NOT LOOKING TO AFFECT THE MARKET DRIVEN PREDICTIONS. BUT AT LEAST -- TWO-STORY ON WHAT LAW IS SELECTED AS BEING
ACCOMMODATING THAT CONCERN. >> THINK YOU WILL SELL TWO
SINGLE STORY HOMES? >> I GUESS THIS ONE IS TO ANTHONY OR TO CAITLIN. WITHIN OUR ANTI-MONOTONY REGULATIONS CAN WE INCORPORATE SOMETHING REGARDING TWO-STOY VERSUS ONE STORY HOMES? OR THAT IS NOT SOMETHING WE CAN MELD INTO THAT
REQUIREMENT? >> YOU CAN CERTAINLY BRING THAT FORWARD AT A LATER DATE AS PART OF A TEXT AMENDMENT. CURRENTLY, THE EXISTING LANGUAGE IN THE ANTI-MONOTONY CODE WOULD NOT REQUIRE SOME SORT OF NUMBER OF LOTS THAT ARE'S -- ARE
TWO-STORY VERSUS ONE STORY. >> IT WOULD AFFECT FUTURE
PROPERTIES BUT NOT THIS ONE. >> THAT WOULD BE CORRECT.
>> YOU DON'T KNOW THE LOT THAT THEY WOULD IT. I CAN APPRECIATE YOUR CONCERNS , HAVING SEEN THE , MAYBE FIVE ONE-STORY GETS SOLD ON THE OTHER SIDE. SO HE STILL HAS THE SAME ISSUE. BUT THE ONE STORIES ARE ON THE OTHER SIDE. I WOULD HATE TO
HANDCUFF A DEVELOPER . >> AND I'M NOT LOOKING TO HANDCUFF THEM. BUT I DO APPRECIATE . SCOTT AND I, AND THE TOLL BROTHERS TALKED ABOUT THIS THE OTHER DAY, I DO APPRECIATE THE COMMITMENT. IF THE NUMBER IS TWO THAT SATISFIES MY CONCERN THAT WE WILL HAVE NOT ONLY ONE SUBDIVISION IN ALL OF HERON BAY. GRANTED, THERE COULD BE 10, THERE COULD BE THREE. I DON'T KNOW. THAT WILL DEPEND ON THE MARKET. AND TO YOUR POINT, WHERE THEY GO MAY NOT ALLEVIATE ALL OF THE CONCERNS OF THE RESIDENCE. THAT THERE MAY BE AT LEAST TWO ONE-STORY HOMES IN THE DEVELOPMENT.
>> MY CONCERN IS WE ARE MAKING AN ARBITRARY RESTRICTION. THE WHOLE POINT OF DOING SOMETHING IS TO ADDRESS THE ISSUE. BUT IF WHAT WE ARE DOING HAS THE POSSIBILITY OF ADDRESSING IT WITHOUT A GUARANTEE THEN WE JUST IMPOSE SOMETHING THAT ULTIMATELY IS ONLY TO THE DETRIMENT OF THE DEVELOPER.
OBVIOUSLY, THEY PARTNERED WITH US TO TAKE US DOWN THIS ROAD AND I THINK WE HAVE SEEN IT HERE OVER THE LAST HOWEVER MANY MONTHS. THEY WERE THE RIGHT CHOICE IN TERMS OF PARTNER. WE CAN ALL BE COMFORTABLE WITH THAT. STILL, THEY ARE STILL A BUSINESS AND THEY ARE THE ONES WERE BUYING THE PROPERTY. I OBVIOUSLY WANT TO DO RIGHT BY OUR RESIDENTS. BUT IN DOING THAT I THINK WHATEVER SOLUTION WE FASHION HAS TO BE SOMETHING THAT IS DIRECTLY TIED TO THE PROBLEM AS OPPOSED TO SOMETHING THAT MAY OR MAY NOT, TO THE EXTENT IT DOESN'T, THEN IT'S JUST A LIMITATION WITHOUT A RESULT.
>> THE PROBLEM WAS, THIS WAS INITIALLY PROPOSED AS BEING THE ONLY SUBDIVISION WITH IN HERON BAY, SINGLE-FAMILY SUBDIVISION WITHIN HERON BAY WITHOUT ANY ONE-STORY HOMES. WE ONLY SOLVED THAT PROBLEM BY GUARANTEEING THAT THERE IS A NUMBER, WHATEVER THE NUMBER IS, WHETHER IT'S TWO OR MORE, I'M SATISFIED THAT TWO GETS US THERE BECAUSE YOU'VE GOT A 1 TO 26 RATIO IT WORSE. BUT IT MAY BE FAR WORSE BASED ON DEMAND. AND IF TOLL BROTHERS IS CONFIDENT AND COMFORTABLE WITH THAT GUARANTEE THEN I DON'T THINK THERE IS AN ISSUE HERE.
BUT GOING FORWARD WITHOUT ANY REQUIREMENTS THAT THERE'S GOING TO BE AT LEAST SOMEONE STORIES IN THIS DEVELOPMENT
WOULD MAKE IT THE OUTLIER. >> BUT I ALSO THINK THEY DIDN'T INITIALLY OFFER THE ONE STORY. THEY ONLY OFFERED TWO-STORY. SO THEY DID MODIFY THEIR PLANS TO ADD HAT MODEL OF ONE STORY. SO THEY ARE DOING THEIR PART. AT THIS POINT IT'S UP TO THE MARKET. I KNOW A LOT OF PEOPLE WHO DON'T LIKE GOING UPSTAIRS. I HAVE A TWO-STORY AND I NEVER GO UPSTAIRS. IT'S TOO HARD FOR ME. I LIKE HAVING A TWO-STORY . YOU KNOW? AT
[01:50:03]
LEAST THEY PUT THE OFFER OUT THERE. IT'S TOUGH.>> WE ARE JUST DOING IT TO DO IT.
>> I DISAGREE. WE ARE DOING IT TO GUARANTEE THAT THERE WILL BE ONE-STORY HOMES IN THIS DEVELOPMENT.
>> THE POINT IS, THE GENTLEMAN IS SAYING THESE ARE DIRECTLY ACROSS FROM MY HOUSE. SO WE WE WILL MAKE THAT A CONDITION AT LEAST SAY IT HAS TO BE ON THE VIEW . RIGHT, THAT'S MY POINT.
IT'S A SLIPPERY SLOPE. >> I DON'T WANT TO MAKE IT TOO ONEROUS. AND I APPRECIATE THE CONCERN OF THE RESIDENT. THE SOLE CONCERN IS THAT WE DON'T WANT TO MAKE THIS A DEVELOPMENT THAT DOESN'T MIRROR OR MATCH WITH THE REMAINDER OF WHATEVER IT IS. 50 OTHER SUBDIVISIONS WITHIN HERON BAY. AND THAT WAS MY CONCERN. THAT WAS THE GENESIS OF PNC'S CONCERN ABOUT NOT OFFERING ONE-STORY MODELS. THAT'S NOT WHAT HERON BAY IS.
SO THAT WAS PART OF THE GENESIS.
>> SCOTT AND LINDSAY, I ASSUME YOU WORKED WITH HERON BAY TO MATCH COLORS, STYLE. SO HERON BAY , AS A COMMUNITY, HAS ALREADY APPROVED ELEVATIONS AND COLORS.
>> I'M NOT GOING TO GO THAT FAR. WE PRESENTED THE BUILDING DESIGN DURING A COUPLE OF MEETINGS. THE SMALLER GROUP MEETING. THE PACKAGES THAT I SHARED WITH YOU, IF YOU REMEMBER ON THE SCREEN, THERE WERE ABOUT 16 DIFFERENT PACKAGES. THOSE ARE ALL HERON BAY APPROVED COLOR PACKAGES,
SCHEMES, ROOFS. ALL OF THAT. >> I GET WHAT YOU ARE SAYING AS FAR AS TWO-STORY. BUT AS LONG AS THEY ARE MATCHING COLORS, SCHEMES AND ALL THAT STUFF, THAT'S REALLY THE ONLY THING THAT I THINK IS FOR US TO MAKE SURE HAPPEN.
>> AND SUBCOMMUNITIES SHOULD HAVE SOME DISTINCT ELEMENT TO IT AS LONG AS IT HAS A CONFORMITY.
>> OF COURSE, OF COURSE. WHAT I'M SAYING, VISUALLY, AS LONG AS THE AESTHETICS ARE THE SAME. WHETHER IT'S TWO-STORY OR ONE-STORY. I DON'T KNOW IF PEOPLE WOULD GO TO A SUB DEVELOPMENT OF A LARGER DEVELOPMENT AND SAY, WELL THIS IS COMPLETELY UNLIKE ANYTHING AROUND HERE JUST BECAUSE THERE'S TWO-STORY HOMES. MAYBE THAT'S ME PERSONALLY.
>> IF I COULD JUST ADD. THE WHOLE CONCEPT OF ADDING THE SINGLE-STORY PLAN CAME OUT OF THE PLANNING ZONING MEETINGS FOR THE ANTI-MONOTONY TO BREAK UP THE LINES. BUT JUST HAVING IT AVAILABLE DOESN'T GUARANTEE THERE WILL BE ANY OF THEM MADE OR BUILT. THEY DID SHOW ON THEIR SCHEDULE THAT THEY WOULD BE BUILDING A NUMBER OF HOMES. THE TOLL BROTHERS COULD COMMIT TO BUILDING SOME SINGLE-STORY HOMES AS PART OF THEIR SPEC HOMES. THAT WOULD AT LEAST GUARANTEE THAT SOME OF THE HOMES WOULD BE SINGLE-STORY SO THAT YOU CAN GET THAT ANTI-MONOTONY AND BREAK UP THAT SITE LINE.
>> I LIKE THAT IDEA ONLY BECAUSE PEOPLE ARE MORE
INCLINED . >> WHAT I'M SAYING IS I DON'T
KNOW IF THEY BUILD ONE OF EACH. >> OKAY.
>> -- LIVED IN HERON BAY SINCE 1997. THIS DISCUSSION KIND OF AMAZES ME BECAUSE I WAS THERE THE WHOLE TIME WCI, CORE RIDGE PROPERTY, THEY ARE ALL BUILDING. AND EVERY NEIGHBORHOOD HAS TWO-STORY HOMES, ONE-STORY HOMES . YOU COULD GO TO THE SALES OFFICE AND THEY WOULD SAY, THIS PROPERTY WAS DESIGNATED FOR TWO-STORY. THIS PROPERTY WAS DESIGNATED FOR ONE STORY. I DON'T KNOW IF THEY CAME FROM WCI . I DON'T KNOW IF THEY CAME FROM CORAL SPRINGS AND PARKLAND. THAT'S THE WAY IT WAS BUILT. I WILL TELL YOU, OLDER FOLKS LIKE KEN AND I , AND IF THERE ARE SOME OLDER FOLKS THEY WILL PROBABLY BUY IN THIS NEIGHBORHOOD. A LOT OF THOSE FOLKS LIKE ONE-STORY HOMES. THIS TURNS OUT TO BE ALL TWO-STORY HOMES , I TELL YOU, IT'S NOT GOING TO LOOK GOOD.
IT IS A MONOTONY . AND SIMEON LIVES THERE. HE KNOWS. IT'S A
NICE, BEAUTIFUL MIX . >> THEY ARE ALL DIFFERENT
COLORS. >> THEY'RE ALL DIFFERENT COLORS
, ONE-STORY, TWO-STORY. >> HAVE TWO OF THE SAME MODELS AND COLORS NEXT TO EACH OTHER. RIGHT? IF YOU DON'T HAVE THE SAME MODEL, THE SAME COLOR NEXT TO ONE ANOTHER YOU ARE NOT GOING TO HAVE MONOTONY. IT'S GOING TO BE BROKEN UP. I GET WHAT YOU'RE SAYING WITH THE ONE-STORY AND TWO-STORY.
>> YOU ARE SAYING THAT HAVING ALL TO STORIES IS A MONOTONY.
>> IF IT WAS ALL ONE-STORY HE WOULD FEEL IT'S A MONOTONY.
BUT THEY ARE GIVEN THE OPTION FOR ONE AND BOTH. YOU ARE THE ONE SAYING THE MARKET WILL DRIVE PEOPLE TO WANT TO BUY A
SINGLE STORY HOME. >> YOU ALSO HAVE THEM SAYING THAT THEY ARE WILLING TO COMMIT TO TWO AS A MINIMUM. AS I
[01:55:06]
UNDERSTOOD SCOTT, AND HE CAN CLARIFY ME, THAT IF WE NEED THIS REQUIREMENT THEY WILL COMMIT TO TWO AT A MINIMUM.THAT , TO ME, ALLEVIATES THE CONCERNS THAT MARK AND THE RESIDENTS HAVE SHARED. WHICH IS THAT THERE IS NOT GOING TO BE ONE DEVELOPMENT IN HERON BAY THAT ONLY HAS TWO-STORY HOMES.
>> FINE. >> I HAVE A PROBLEM WITH IT.
>> I JUST HAVEN'T HEARD HIM COMMIT TO IT.
>> COMMISSIONER BRIER IS CORRECT. WE WILL ALLOW THE MARKET TO DICTATE. BUT IF THAT IS THE WILL OF THE MAJORITY OF THIS COMMISSION THAT WE WOULD AGREE . YES.
>> SCOTT ? SCOTT? SCOTT? >> GO AHEAD. SORRY.
>> IN YOUR COMMITMENT YOU ARE NOT COMMITTING WHERE IT GOES.
YOU ARE JUST COMMITTING TWO-STORY HOMES. SO ON A SINGLE-STORY COME YOU CAN PUT THEM ON THE BOTTOM OR THE SIDE.
>> AND IT'S STILL GOING TO FEEL MONOTONOUS FOR THE FIRST RECORDERS OF THE NEIGHBORHOOD.
>> LET ME CLARIFY, IT'S NOT OUR INTENTION , FROM WHAT I'M BEING TOLD, IT'S NOT OUR INTENTION TO BUILD SPEC HOMES.
IT'S 52 OHMS. THIS IS NOT A VERY LARGE COMMUNITY WHERE DEVELOPERS WOULD BUILD A SPEC HOME. THAT'S NOT OUR INTENTION.
THERE MAY OR MAY NOT BE A MODEL. WE MAY STAGE OUR DESIGN CENTER OUT OF SOMEWHERE. WE ARE GOING TO SELL, AGAIN, ASSUMING THAT'S THE AGREEMENT AND THE MARKET DOESN'T DICTATE OTHERWISE AND SOMEONE WANTS TO BUY ONE-STORY HOMES ALL OVER THE PLACE, WE ARE NOT GOING TO NECESSARILY DICTATE WHERE THE ONE-STORY HOME GOES EITHER. THE INTENTION WOULD BE THE TWO LOTS THAT YOU SEE ALL THE WAY DOWN --
>> SO MANY CAN SAY, I WANT TO BUY THAT AND PUT IT HERE.
>> ABSOLUTELY. >> IT DOESN'T SOLVE THE PROBLEM OF THE HOMEOWNER THAT CAME AND SAID, I'M GOING TO LOOK AT A TWO-STORY HOME IN MY BACKYARD. I'M GOING TO SAY, BACKYARD.
>> IT DOESN'T SOLVE THAT. WE HAVE A ONE-STORY MODEL. WE ARE GOING TO MARKET IT AND SELL IT. IF THE MARKET DICTATES THAT WE SELL MORE THAN TWO THEN WE SELL MORE THAN TWO. THE COMMUNITY HAS A MIX , WHICH IS PART OF THE DISCUSSION WE ARE HAVING
HERE NOW. >> I WILL JUST SAY IT. I GUESS WE ARE ADDRESSING VARIANCES. OBVIOUSLY , 12 1/2 FEET AS OPPOSED TO A 12 FOOT SIDE SETBACK , OPENS UP LITTLE MORE SPACE. SO EVEN IF YOU WERE TO PUT 52 HOMES ON ALL TO STORIES, A LITTLE WIDER SET BACK GIVES MORE SPACE IN BETWEEN. SO THOSE HOMEOWNERS THAT ARE LOOKING ACROSS THE CANAL SEE A LITTLE BIT MORE SPACE THAN NECESSARILY STUFF THAT'S CONGESTED.
>> YES. >> I'M TRYING TO SIT HERE AND SOLVE A PROBLEM. THAT'S THE ONLY WAY, I CAN SEE AT THIS POINT, TO DENY THAT ASPECT OF THE VARIANCE. THEY WANT A 10 FOOT SIDE . THE CODE SAYS 12 1/2. SEE HAVE 25 FEET AS OPPOSED TO 20 FEET IN BETWEEN THOSE HOMES. WHICH OPENS UP THE HOMES FOR HOMEOWNERS TO LOOK AND THEY ARE NOT LOOKING AT HOWEVER MANY HOMES ARE ON THE NORTH PART , 30 HOMES OR WHATEVER IT MAY BE, THERE'S LITTLE BIT MORE SPACE IN
BETWEEN. >> THEN YOU ARE GOING TO BE ASKING THEM TO TAKE HOMESITES AWAY.
>> THEY ARE ASKING TO PUT ALL OF THE HOMESITES IN THERE. MIND YOU, YOU GUYS DID A GREAT JOB. I CERTAINLY APPRECIATE THE DILIGENCE, THE TIME THAT YOU SPEND. AGAIN, HOMEOWNERS ARE
COMING HERE . >> ONE HOMEOWNER.
>> NOTHINGS BEEN BUILT. NOBODY SAYS ANYTHING UNTIL ALL THE SUDDEN IT GOES UP. NEVER SAID ANYTHING UNTIL A STORAGE
FACILITY WENT UP. >> AND IT WASN'T JUST ONE HOMEOWNER. PNC RAISE THE ISSUE THAT WE NEEDED ONE STORIES IN THIS DEVELOPMENT. THE HLA HAS RAISED THAT ISSUE. MULTIPLE RESIDENTS HAVE RAISED THAT ISSUE. IT WAS AN ISSUE DISCUSSED IN THE COMMUNITY APPEARANCE BOARD. MY ONLY REQUEST WAS NOT TO REINVENT THE WHEEL. MY ONLY REQUEST WAS TO ASK OF TOLL SO THAT THEY ALLEVIATED ALL OF THOSE CONCERNS TO ENSURE THAT THERE WERE AT LEAST SOME ONE-STORY MODELS. SCOTT HAS TOLD US , I WILL AGREE TO TWO. I'M NOT
[02:00:01]
UNREASONABLE SAYING IT NEEDS TO BE 10.>> IF WE CAN GET PAST THIS AND GET BY THIS WITH TWO AND YOU AGREE TO TWO I'M FINE WITH TWO.
>> THAT WOULD BE GREAT. >> WE HAVE ANY OTHER QUESTIONS, CONCERNS ? DO WE HAVE A MOTION?
>> I THINK THE OTHER CONCERN WAS , WHERE ARE WE AT WITH THE HLA AGREEMENT? I KNOW WE TALKED ABOUT THAT. MARK SHARED HIS CONCERNS ABOUT IT. I THOUGHT, LAST MONTH, WE HAD A MONTH TO GET THIS DONE AND IT WOULD BE BANGED OUT BY TONIGHT.
>> I DID MEAN TO TOUCH ON THAT MY PRESENTATION SO I APOLOGIZE.
WHAT MARK SHARED IS ACCURATE. THEY GOT OUR DOCUMENTS SHORTLY BEFORE WE WERE IN FRONT OF YOU. I THINK AT THE BEGINNING OF JULY WE RECEIVED COMMENTS BACK. I DO WANT TO SAY THERE WAS A DISAGREEMENT. THERE WERE TWO LAWYERS SAYING THE SAME THING.
SAYING IT SOMEWHAT DIFFERENTLY. WE GOT CORRESPONDENCE BACK FROM THE HLA LAWYER AGAIN. THIS IS ALL COMING THIRDHAND. I HAD THE CONVERSATIONS. OUR ASSOCIATION LAWYER LOOKED EVERYTHING WE GOT BACK FROM THE ASSOCIATION. WE DON'T HAVE ANY SIGNIFICANT ISSUE OR CONCERN. IT'S NOW A MATTER OF THE LAWYERS WORKING TOGETHER TO SOLVE AND FIND THE RIGHT LANE WHICH THAT WORKS.
BUT THE INFORMATION THAT CAME BACK FROM THE HERON BAY ASSOCIATION ATTORNEY, WE UNDERSTAND. WE UNDERSTAND THE CONTEXT, THE ISSUES. SO NOW IT'S A MATTER OF WORKING TO THE DOCUMENTS . ADAM AND MARK SPOKE EARLIER TODAY. WE ALL TRIED TO COMMIT TO PUSH THE LAWYERS TO WITHIN THE NEXT 30 DAYS TO REALLY MAKE SOME REAL PROGRESS ON THIS. PART OF THE ISSUE WAS, THE DAY AFTER WE DID GET THOSE REDLINE COMMENTS WE HAD A VERY SMALL OPPORTUNITY TO LOOK AT OUR ATTORNEY WHO WENT ON VACATION AND SUMMERTIME. HE GOT BACK ON SUNDAY. IT'S WEDNESDAY. WE'VE DONE AS MUCH AS WE CAN. SO JUST SHARING THE UPDATE. BUT WE AGREE WITH WHAT MARK SHARED.
>> YEAH. I WANTED TO ASK ANTHONY. ANTHONY, PUTTING ASIDE ALL THE OTHER ISSUES THAT WE'VE BEEN TALKING ABOUT , AND OBVIOUSLY WE WILL WORK THOSE IN, ARE WE ABLE TO APPROVE THE SITE PLAN AND VARIANCES SUBJECT TO THE CONDITION THAT THEY REACH A MUTUALLY AMICABLE AGREEMENT WITH THE HLA? OR DO WE NEED TO TABLE THIS UNTIL IT'S DONE?
>> I BELIEVE YOU CAN. THERE SITE PLAN IS CONTEMPLATING THEY WILL GET ACCESS THROUGH HERON BAY. SO THEY NEED TO GET THIS AGREEMENT IN PLACE IN ORDER TO HAVE THAT ACCESS INTO THE ENTRYWAY. SO I BELIEVE YOU CAN.
>> WE ARE IN FULL AGREEMENT WITH THAT. YES.
>> THOSE WERE MY ISSUES. IT IMPROVES THE STORM WATER RETENTION, IMPROVES FLOW. THERE'S OTHER BENEFITS TO THE SECURITY AND AESTHETICS. THE ISSUE REGARDING ALL OF THE EASEMENTS AND THE DOLLARS PUT IN FOR THAT CONSTRUCTION, THE TWO MINIMUM CONTENTION ON THE ONE-STORY .
>> IS THAT A MOTION YOU'RE MAKING?
>> I'M HAPPY TO CONTINUE THE DISCUSSION BUT HAPPY TO MAKE THAT MOTION SUBJECT TO THESE CONDITIONS.
>> ANYMORE CONDITIONS? > AS I UNDERSTAND IT, THE VARIANCES ARE ONLY FOR THE SPECIFIC LOTS. THEY ARE ONLY
FOR THE SPECIFIC LOTS, KATELYN. >> MAY I, COMMISSIONER AND MAYOR? MAY I? THERE ARE A NUMBER OF EXISTING CONDITIONS ARTIE BUILT INTO THE RESOLUTION AS IS. INCLUDING, THE CONDITION ABOUT LIMITATIONS ON THE LOTS THAT ARE ABLE TO OBTAIN THESE VARIANCES. BUT THE NEWER CONDITIONS THAT WE DISCUSSED TODAY, IF YOU ARE MINIMAL TO THEM, THOSE ARE THE ONES THAT I THINK NEED TO BE ADDED . I DO HAVE SOMETHING WHICH THAT I HAVE WORKED ON . IF YOU'RE INTERESTED, I CAN PROPOSE THOSE. AS I UNDERSTAND IT, ASIDE FROM THE VARIANCES BEING APPLICABLE TO SPECIFIC LOTS WE DISCUSSED , IT WOULD BE THE FOLLOWING CONDITIONS. CORRECT ME IF I'M WRONG, ONE IS THAT THE TOLL BROTHERS WOULD PROVIDE A MINIMUM OF A 15 FOOT MAINTENANCE EASEMENT ON THE SOUTH SIDE OF THEIR PARCEL FOR THE POTENTIAL CONSTRUCTION OF THE FUTURE CANAL . TWO IS THAT THEY WOULD PROVIDE US WITH, I DON'T KNOW IF IT IS AN EASEMENT, SCOTT, WHATEVER IT IS. ACCESS TO, RIGHTS TO, EASEMENT TO THE REMAINING OPEN SPACE THAT IS WITHIN THAT RED AREA FOR THE PURPOSE OF MAINTENANCE IN THE CANAL. THREE WOULD BE $100,000 IN ESCROW FOR THE CONSTRUCTION AND RELATED COSTS ASSOCIATED TO THAT. I THINK FOUR OH WE TALKED ABOUT, IF NEED BE, MAINTENANCE CAN BE ACCESSED THROUGH WHATEVER WALL
[02:05:02]
YOU ARE PUTTING UP. I DON'T KNOW IF THAT WAS BROACHED. AND SID WOULD NEED TO GET INTO THE MAINTENANCE AREA TO GET TO THECANAL . >> THAT WOULD BE COVERED.
>> YOU HAVE TO JUMP OVER THE WALL TO GET IN TO MAINTAIN THE
CANAL. >> WE WOULD PROVIDE, I DON'T
KNOW. >> THE ONLY ADJUSTMENTS, IF YOU DON'T MIND , WE SHOULD STIPULATE . THE $100,000 SHOULD BE WHATEVER WE WANT TO USE IT .
>> AS LONG AS THE CANAL GETS BUILT ONE WAY OR ANOTHER
AGREED. >> $100,000, WE USE IT FOR WHATEVER IT'S USED FOR. AND THEN WHATEVER EASEMENT WE NEED FOR WHATEVER WE DO. I JUST DON'T WANT TO TIE IT ANYTHING SPECIFIC. YOU KNOW WHAT I'M SAYING?
>> AS LONG AS A BODY OF WATER SEPARATES THIS PARCEL I THINK MARK AND THE HLA WILL BE SATISFIED THAT WE HAVE REMEDIED
TO THAT ISSUE. >> BUT AGAIN, WE ARE JUST BEING SPECIFIC TO THESE VARIANCES. SO THEY WILL GIVE US $100,000 FOR OUR USE AND THEY WILL GIVE US AN EASEMENT FOR OUR USE.
WHATEVER IT ENDS UP BEING . JUST KEEP IT OPEN-ENDED.
THAT'S ALL I'M SAYING. >> I AGREE.
>> I WANT A BODY OF WATER THERE.
>> BUT THERE'S NO GUARANTEE THAT WILL BE ABLE TO ACCOMPLISH IT. IT'S MOVING IN THE RIGHT DIRECTION.
>> JUST DON'T TIE YOURSELVES DOWN. THAT'S ALL. I'M NOT SAYING WE ARE NOT GOING TO DO ANYTHING. I'M JUST SAYING,
DON'T TIE YOURSELF DOWN. >> I DON'T THINK $100,000 TIES
US DOWN AT ALL. >> YOU ARE LIMITING THE USE OF
THE $100,000 TO THE CANAL. >> IF THE COMMERCIAL DEVELOPERS COMES IN AND SAYS WE ARE BUILDING A BODY OF WATER THERE.
I AM FINE . AS LONG AS THE BODY OF WATER GETS BUILT. IF SOMEONE ELSE PAYS FOR AND 100,000 GOES TO SOMETHING ELSE THAT'S FINE.
>> RIGHT. THE $100,000 IS ESCROW DEVELOPING.
>> I BELIEVE THAT'S WHAT TOLL OFFERED.
>> ALL OF THIS ORIGINATED WITH THE DISCUSSION OVER THE CANAL , WHAT CAN TOLL DO TO HELP CONTRIBUTE TOWARD THE CANAL? ANTHONY AND I WORKED UP SOMETHING WHICH EARLIER TODAY.
I THINK SIMEON WAS TALKING EARLIER ABOUT WHAT WE ARE GOING TO DO IN REGARD TO THE ADDITIONAL EASEMENT FOR EXAMPLE. ALSO, WITH REGARD TO THE DOLLARS, FROM TOLLS PERSPECTIVE, WE WANT TO SEE A BODY OF WATER THERE. THEY WANT TO SEE A BODY OF WATER THERE. WE WANT THOSE DOLLARS. YOU HAVE TO SPECIFY HOW THEY ARE USED BY THE CITY FOR WHAT DESIGN FEES, WETLAND MITIGATION CREDITS, DIGGING THE CANAL. I UNDERSTAND THAT AS WELL. FOR TOLL BROTHERS, IT NEEDS TO GO TOWARDS SOME DOLLARS ASSOCIATED WITH EXPLORING OR CONSTRUCTING
THE CANAL. >> YOU ARE COMMITTING TO 21 --
20 ONE-STORY HOMES. >> I HAVE A LIST HERE IF YOU
WOULD LIKE ME TO READ IT OUT. >> PROBABLY BETTER THAN MINE.
>> ON THE VARIANCES, THEY ARE ON THE LOT THEMSELVES ? OR THEY
ARE WITH TOLL BROTHERS? >> THE LOT.
>> SO IF A HOMEOWNER, LET'S SEE& ON THE HOME. YOU BUILD WHATEVER IT IS. FIVE YEARS LATER I DECIDE I WANT TO BUILD SOMETHING ELSE THAT WOULD, IF IT WENT AWAY, I WOULD HAVE TO REQUEST A VARIANCE. IT STILL REMAINS WITH THE LOT.
>> IF I CAN ADDRESS THAT FIRST, IF YOU WANT TO BUILD INTO THE SETBACK YOU WOULD HAVE A PROBLEM. PART OF THE REASON WE ASKED THE LOT COVERAGE VARIANCES TO ALLOW FUTURE HOMEOWNERS TO EXPAND. WHETHER IT IS AN ADDITION OR IN MOST CASES IT IS EXPANDING THE SIZE OF THE CANOPY , CABANA, BACKYARD AREA. THAT WOULD BE ALLOWABLE WITH VARIANCES.
>> RIGHT. BUT INSTEAD OF CONTRACTING OUT WITH TOLL BROTHERS TO BUILD IT , I WANT TO BUILD A FIVE YEARS LATER FOR WHATEVER REASON. I CAN STILL DO THAT.
>> FOR LOT COVERAGE. >> I CAN REDUCE OR INCREASE.
>> THAT'S EXACTLY RIGHT. YEAH.
>> AND IT'S ONLY 16 LOTS THAT ARE THE LOT COVERAGE.
>> YEAH. JUST A COMMENT ON THE VARIANCES. I WANT TO BE UPFRONT AND FORTHRIGHT . WE HONESTLY HAD A MEETING IN MAY , A SPECIAL MEETING TO LOOK AT ALL OF THE DEVELOPERS. SCOTT, YOU WERE HERE. I KNOW LINDSAY WAS. I KNOW I WAS. I THINK THE MAYOR WAS VERY CLEAR THAT WE DIDN'T WANT VARIANCES AT THAT TIME. WE SAID, LOOK, HERE'S THE CODE TO FIGURE OUT WHAT YOU ARE GOING TO DO WITHIN THE CODE. YOU SAID 52 IS THE MAXIMUM AMOUNT OF HOMES. I'M FINE WITH IT. SO THAT'S WHAT WE WANTED. I DO WANT TO COMMEND YOU GUYS. AND I DO WANT TO SAY IT PUBLICLY THAT YOU WORKED HARD TO GET TO WHERE IT IS, TO WHERE I'M COMFORTABLE BASED UPON OUR CODE, BASED UPON WHAT YOU'VE DONE TO APPROVE THE VARIANCES TONIGHT . BECAUSE I THINK THAT YOU WORKED HARD
[02:10:04]
AND IDENTIFIED WHAT NEEDS TO BE DONE IN A TRUE PARTNERSHIP WITH THE DEVELOPER. SOMETIMES DEVELOPERS COME IN AND PROMISE YOU THE WORLD. THREE MONTHS LATER THEY ASK FOR ANOTHER THING. BUT YOU GUYS MIGHT DOWN THE ROAD. AT THIS POINT, I'M SUPPORTING THE VARIANCES BECAUSE I THINK YOU GUYS WORKED HARD TO GET THERE. YOU ADDRESSED A LOT OF THE ISSUES.UNFORTUNATELY, CAN'T APPROVE THE 21 SINGLE-STORY HOMES BECAUSE IT'S NOT IN HERE. AS I SAID TO YOU, SCOTT , IF WE COULD HAVE TURNED THE CLOCK BACK AND DEVELOPED 3.1 IT WOULD HAVE WORKED OUT WITHOUT ANY PROBLEMS.
>> I AGREE WITH COMMISSIONER . >> IT GIVES MORE FLEXIBILITY IN TERMS OF THE CANAL , FOR EXAMPLE, DEPENDING ON WHAT THE ULTIMATE DESIGN IS. THE FIRST ONE I HAVE IS WITHIN 10 BUSINESS DAYS OF RECEIVING A WRITTEN REQUEST FOR THE CITY THE APPLICANT SHALL CONVEY A 15 FOOT WIDE EASEMENT TO THE CITY OR AN SID -- OF THE TOLL DEVELOPMENT PARCEL TO ACCOMMODATE A PROPOSED CANAL SECTION ENACTING THE CURRENT NSID TO THE DRAINAGE CANAL THAT RUNS SOUTH ALONG HILL ROAD.
THAT'S THE FIRST ONE. I WORKED WITH MR. BACHMAN BACK AND FORTH. IT WAS TODAY. THE SECOND ONE, IF NECESSARY TO ACCOMMODATE THE PROPOSED CANAL THE APPLICANT AGREES TO WORK WITH THE CITY IN AN EFFORT TO -- ADDITIONAL PROPERTY WITHIN THE DEVELOPMENT PARCEL , PROVIDED SUCH DEDICATED CHIN OR CONVEYANCE DOES NOT -- APPROVED LOTS, STREET SYSTEM AND INFRASTRUCTURE NETWORK SHOWING THE APPROVED SITE PLAN.
>> CAN I PAUSE YOU? >> I JUST WANTED SOME CLARIFICATION ON WHAT SCOTT SAID EARLIER . ON THE SOUTH END THEY INDICATED THERE WAS ABOUT AN ANCHOR -- ACRE WORTH OF LAND WITH FLEXIBILITY ON THE SOUTH END.
>> LET ME SHOW A SITE PLAN. THERE IS AN ACRE OF EXCESS OPEN SPACE WITHIN THE COMMUNITY ITSELF . I CAN SHOW YOU THE SITE PLAN HERE. WE ARE TALKING ABOUT THE AREA ON THE BOTTOM WHERE IT SAYS, EIGHT FOOT WALL. YOU CAN KIND OF SEE THE HOME IS ON AN ANGLE AND THERE ARE A BUNCH OF TREES TO THE SOUTH OF THAT. THAT IS WHAT THE TRAPEZOIDAL AREA IS. IT'S
ABOUT 5400 SQUARE FEET TOTAL. >> SO YOU ARE STILL PUTTING THE
WALLOP? >> YES. THE WALLS GOING UP REGARDLESS. I CAN GO BACK TO IT IF YOU WOULD LIKE ME TO. IT WOULD BE EVERYTHING THAT SOUTH OF THAT. IT IS OPEN SPACE. AS PART OF OUR PROJECT. BUT IF THE CITY SOMEHOW NEEDS IT AS PART OF THE DESIGN IT'S AVAILABLE FOR US TO TALK TO YOU ABOUT AND GIVE UP SOME OF IT IF NECESSARY.
>> ASIDE FROM THE 15 FEET, ANTHONY, THE ONLY THING THAT CONFUSED ME WITH WHAT YOU SAID IS IT DIDN'T SOUND LIKE WE WERE GETTING AN EASEMENT NOW ON THE REMAINDER OF THE RED
TRIANGLE. >> I THOUGHT IT'S TWO SEPARATE THINGS. IF WE NEED LAND FOR THE CANAL YOU ACTUALLY DEEDING THAT
LAND TO US. >> WE ARE CONVEYING 50 FEET TO YOU NO MATTER WHAT FOR A MAINTENANCE EASEMENT. NO MATTER WHAT. WE ARE GIVING IT TO THE CITY OR NSID. AS YOU WORK WITH YOUR DESIGN CONSULTANT IF YOU SAY WE NEED MORE AND YOU HAVE ABOUT 5400 SQUARE FEET OF AREA DEPENDING ON WHAT THE DESIGN LOOKS LIKE AND YOU NEED AN EXTRA 2500 SQUARE FEET , WE WOULD CONVEY OR GIVE AN EASEMENT FOR THAT AS WELL.
>> MOTION? >> HANG ON. THERE'S A FEW MORE. THAT WAS CONDITION NUMBER TWO. ADDITIONAL CONDITION NUMBER THREE WOULD THE WITHIN FIVE BUSINESS DAYS OF THE CLOSING ON THE PROPERTY . SIDE NOTE, WOULD BE AFTER THEY RECEIVED OTHER APPROVALS INCLUDING THE APPROVAL FROM THE COUNTY. THE APPLICAN WILL DEPOSIT $100,000 IN ESCROW THAT WILL BE AVAILABLE TO COVER EXPENSES ASSOCIATED WITH THE POTENTIAL CANAL AT THE SOUTH END OF THE PROPERTY. ADDITIONAL CONDITION NUMBER FOUR WOULD BE THE APPLICANT SHALL DEVELOP A MINIMUM OF TWO OF THE 52 HOMES AS ONE-STORY HOMES . ADDITIONAL CONDITION NUMBER FIVE, I NEED A LITTLE ASSISTANCE. THIS IS THE ONE THAT REQUIRES THE APPLICANT TO WORK WITH THE HERON BAY ASSOCIATION TO FINALIZE THE AGREEMENT. I DIDN'T GET THE TIMEFRAME ON THAT. SO YOU MAY NEED TO HELP ME ON THAT.
>> THEY CAN'T DO ANY WORK UNTIL THAT IS SETTLED .
>> WE CAN CLOSE. >> WE HAVE HAD CONVERSATIONS SAYING THAT WE ARE GOING TO TRY REALLY HARD OVER THE NEXT 30 DAYS. WE WILL TRY REALLY HARD OVER THE NEXT WEEK TO GET OUR
[02:15:04]
LAWYER TO BRING DOCUMENTS BACK TO THEIRS. THEN WE WILL PUSH THEIRS. SO WE SAID 30 DAYS. BUT AGREEING TO A 30 DAY TIMEFRAMEWITH THE WAY LAWYERS ARE . >> UNDERSTANDABLE.
>> CORRECT. >> IT WAS MY INTENT . AND OBVIOUSLY, THE SOONER THE BETTER. THAT WAS MY INTENT THAT BEFORE ANYTHING ELSE CAN MOVE FORWARD THAT IT IS DONE.
>> WE ARE IN AGREEMENT WITH THAT.
>> IS THAT FAIR ENOUGH, MARK? DOES THAT ADDRESS YOUR CONCERN?
>> I HOPE SO. >> THE SITE PLAN APPROVAL WOULD BE CONDITIONAL UPON THE APPLICANT EXECUTING AN AGREEMENT WITH THE HERON BAY MASTER ASSOCIATION TO PROVIDE FOR AXIS INTO THE COMMUNITY AND COST SHARING.
>> MICROPHONE. >> SO THOSE WERE THE FIVE
ADDITIONAL CONDITIONS. >> I THINK ADAM WAS TRYING TO TELL ME THAT I DIDN'T UNDERSTAND. AS FOR DOCUMENTS HERE. THERE IS AN INCORPORATION DOCUMENT , THE BYLAWS . HERON BAY, WE DON'T CARE WHAT'S IN THERE . WHAT WE HAVE BEEN WORKING ON , AND WE SENT BACK TO THE ATTORNEY, WAS THIS COST SHARING AGREEMENT WHICH TALKS ABOUT MONEY AND ALL THAT.
>> THEY CAN'T MOVE FORWARD UNTIL THAT GETS WORKED OUT.
>> I THINK ADAM REALIZED THAT AND HE HAS PUSHED THE ATTORNEY TO SAY YOU HAVE TO DO THE COST SHARING.
>> THIS APPROVAL, MARK, THIS APPROVAL TONIGHT AS I UNDERSTAND IT, AND ANTHONY CAN CORRECT ME IF I'M WRONG, IS CONTINGENT UPON THAT GETTING DONE. SO THAT DOESN'T GET DONE THE SITE PLAN AND THE VARIANCES ARE IMPROVED . CORRECT,
ANTHONY? >> THAT'S CORRECT. IT'S A CONDITION OF APPROVAL. THEY NEED TO SATISFY IT BEFORE THEY
CAN PULL A BUILDING PERMIT. >> THAT IS MY MOTION.
>> TO HAVE A SECOND? >> SECOND.
>> ANYONE FROM THE PUBLIC? DIDN'T WANT TO PUSH YOU TO THE SIDE. I GAVE MARK A LITTLE LEEWAY SINCE HE'S THE PRESIDENT OF THE H AWAY. -- HOA.
>> THAT WAS PROBABLY ME TAKING A SHOT . HOLBROOK IS OUR RS THREE. HOW ARE THEY ABLE TO PUT A SIX FOOT, FIVE BEDROOM, SIX BEDROOM, FIVE BATHHOUSE ON AN 11,000 SQUARE-FOOT LOT? MAYBE THE SETBACKS WERE DIFFERENT BACK THEN , THAT WAS 20 SOMETHING YEARS AGO. HERE AGAIN, I'LL SAY IT, IF IT WOULD HAVE BEEN 50 HOMES INSTEAD OF 52 IT WOULD PROBABLY ALLEVIATE AND TAKE AWAY ALL OF THE REQUIRED VARIANCES. BECAUSE YOU ARE GOING TO GAIN 10 FEET . TWO HOMES, 140 FEET, SEE YOU GAIN 10 FEET . OR YOU ONLY NEED FIVE FEET BECAUSE HE WENT FROM 12 1/2 TO 10. YOU HAVE TO GAIN FIVE FEET PER HOUSE. SO YOU PICK UP. NOW YOU ARE BACK TO YOUR 80 FOOT LINES AND I WOULD THINK , FROM A MARKETING STANDPOINT, I KNOW TOLL BROTHERS IS EITHER THE BIGGEST OR ONE OF THE BIGGEST RESIDENTIAL DEVELOPERS IN THE COUNTRY. AND I RESPECT ALL OF THAT. BUT YOU GAVE UP TO TWO LOTS. HE BUILT A ONE-STORY HOUSE. THIS 3000 SQUARE FEET SET OF 2600 SQUARE FEET. 200 FEET LESS THAN YOUR TWO-STORY HOUSE . AND YOU MAKE IT UP ON SQUARE FOOTAGE , OVER WHICH IS PROBABLY ABOUT 400 OR $500 PER FOOT . SO WHAT YOU ARE LOSING YOU PICK UP BY LOSING THE TWO
LOTS. >> THANK YOU. ANYONE ELSE? I'M SEEING THERE'S NONE. WE HAVE A MOTION BY COMMISSIONER BREYER
AND SECOND BY -- ROLL CALL. >>
>> PLEASE SHOW IT PASSES UNANIMOUSLY.
>> YOU ARE NOW ON 10 E, WHICH IS THE COMMUNITY APPEARANCE
>> SO MOVED. ANYONE WISH TO SPEAK ON THIS ONE? HAVE YOU ALL SPOKEN OUT? SO WE HAVE A MOTION TO APPROVE. ROLL CALL.
UNANIMOUSLY. >> WE ARE ON 10 F, ORDINANCE
[02:20:04]
2024 -009. AMENDING LANDSCAPING CODE. AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA, AMENDING THE CITY OF PARKLAN LAND DEVELOPING CODE, BY AMENDING ARTICLE 95 "LANDSCAPING AND VEGETATION" TO RESTRUCTURE THE ARTICLE, MODIFY EXISTING REGULATIONS, ADD NEW REGULATIONS, AND WREAK LOCATE EXISTING FENCE AND WALL STANDARDS TO LAND DEVELOPMENT CODE ARTICLE 15 "DETAILED USE REGULATIONS", DIVISION 60, "FENCES, WALL AND HEDGES", SECTION 15-6040 , "GENERALLY ", PROVIDING FOR IMPLEMENTATION, CONFLICTS, SEVERABILITY, CODIFICATION, AND AN EFFECTIVEDATE. -- >> I WANT TO MAKE SURE THAT'S ADDRESSED. I WOULD APPRECIATE ALLOWING THAT TO SPEAK FIRST.
>> ARE YOU ADDRESSING COMISSIONER CUTLER?
>> I CAN SPEAK TO ONE OF THEM. I SUSPECT PATTY IS PROBABLY MORE APPROPRIATE TO SPEAK TO FAMILY FRIENDLY LANDSCAPING.
BUT THE FIRST ONE THAT COMMISSIONER CUTLER RAISED, THERE SOME LANGUAGE IN THIS DRAFT. OR THE FIRST READING OF THIS ORDINANCE THAT DEALS WITH UNIFIED BURNS. HAD SOME LANGUAGE ABOUT REQUIRING A DEVELOPER TO GET AN EASEMENT FROM AN ADJACENT PROPERTY OWNER. I THINK COMMISSIONER CUTLER RIGHTLY POINTED OUT THAT COULD BE CREATING POTENTIAL FUTURE ISSUES IN THE FUTURE INCLUDING POTENTIAL -- I AGREE.
WE HAVE ARTIE SPOKE ABOUT THE ITEM. WE ARE WORKING ON LANGUAGE TO BRING BACK TO YOU TO ADDRESS THAT. FOR A SECOND
READING. >> ON THE SECOND ISSUE, I WAS JUST CONCERNED ABOUT THE LONGEVITY OF THAT PARTICULAR PROGRAM AND WHETHER OR NOT WE WANT TO TIE OURSELVES SPECIFICALLY TO THAT GUIDE OR HAVE LINKAGE IN THEIR ALLOW
SOME FLEXIBILITY. >> ANTHONY CAN TWEAK THE VERBIAGE IN IT. BUT THE BOOK THAT WE ARE ADOPTING, WE ADOPTED IT IN ANOTHER SECTION IN OUR ORDINANCE FOR OUR WATER USAGE. THIS IS ADOPTED BY THE STATE OF FLORIDA AND THE'S FLORIDA STATUTES ALREADY. SECTION 185 IN THE FLOOR THE STATUTES. SO WE CAN SAVE REFERENCE TO THE GUIDEBOOK
>> AS AMENDED FROM TIME TO TIME.
>> SO IF IT CHANGES. >> THAT'S ALL I NEED. THAT'S
>> WITH THOSE TWO -- >> COMMISSIONER CUTLER IS GOOD SO I'M GOOD. WE HAVE A MOTION BY COMMISSIONER MAYERSOHN AND
SECONDED BY ISROW. -- >> I SECOND WITH CUTLER
UNANIMOUSLY. >> THANK YOU. HAVE A GREAT
NIGHT. >> WE ARE NOW ON 10 G. SPEED DETECTION SYSTEMS FOR ENFORCEMENT SCHOOLS ON SPEED LIMITS. FIRST READING. AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA, AMENDING -- TO CREATE SECTION 20-8 SPEED DETECTION SYSTEMS FOR ENFORCEMENT OF SCHOOLS ON SPEED LIMITS TO AUTHORIZE THE PLACEMENT OF SPEED DETECTION SYSTEMS ON ROADWAYS IN SCHOOL ZONES PROVIDING FOR CODIFICATION AT AN EFFECTIVE
DATE. >> JUST FOR CLARITY , THIS IS AN ORDINANCE SO THAT IF WE DECIDE , IN THE FUTURE, TO IMPLEMENT THE SPEED RADARS WE WILL HAVE THE AS AN ORDINANCE.
SHOULD THIS PASS. SO WE ARE NOT IMPLEMENTING ANY SPEED DETECTION SYSTEMS. WE ARE JUST IMPLANTING AN ORDINANCE THAT WOULD ALLOW US TO DO THAT IN THE FUTURE.
>> MOTION TO APPROVE? >> SECOND.
>> PUBLIC? THANK YOU. SO APPROVED BY COMMISSIONER MAYERSOHN AND SECONDED BY ISROW. ROLL CALL.
>> UNANIMOUSLY. NOW WE GO BACK TO NINE HE, ON THE CONSENT AGENDA.
>> 90, RESOLUTION 2024-068 . FY 2025 FEE SCHEDULE. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA, TO AMEND THE IN MINISTRY AND USER FEE AND CHART SCHEDULES FOR SERVICES, ACTIVITIES, AND USE THE FACILITIES PROVIDED BY THE CITY OF PARKLAND IS PRESENTLY SET FORTH IN THE RESOLUTION
[02:25:02]
2023-053, PROVIDING ADDITIONAL BUILDING DEPARTMENT FEES, USER FEES AND CHARGES TO THE FEES AND CHARGES SCHEDULE PROVIDING FOR EXECUTION, PROVIDING FOR AN EFFECTIVE DATE.>> I'VE HAD DISCUSSIONS WITH NANCY FOR SEVERAL YEARS ABOUT ADDRESSING OR AT LEAST LOOKING INTO THE ISSUE WHEN SOMEBODY USES A CREDIT CARD TO PAY FOR SOMETHING THEY GET CHARGED A FEE , A PROCESSING FEE. SO AT THE TIME IT WAS VERY MINIMAL.
MOST RECENTLY , IN CONVERSATION , WE ARE ABSORBING ABOUT
>> TO ME, IT ACCURATELY REFLECTS ON THE TRUE COST THAT IT COSTS FOR SOMEBODY TO USE THE CARD. $100,000 COULD PROVIDE A POSITION , IT COULD PROVIDE FOR A LOT OF OTHER THINGS. SO I THINK IT'S SOMETHING THAT WE JUST NEED TO INSTITUTE IN OUR FEE SCHEDULE. AGAIN, WHETHER IT'S A FLAT 3%
. >> IN OUR ONE-ON-ONE WE DID DISCUSS THIS AND DID SOME EXTENSIVE RESEARCH ON WHAT OTHER MUNICIPALITIES DO. IT'S ABOUT A 50-50. WE DECIDED THAT IT WAS A BEST TO IMPLEMENT THIS FEE AT THIS TIME BECAUSE WE ARE SIGNIFICANTLY INCREASING THE BUILDING DEPARTMENT FEES PICK SO WE DIDN'T WANT TO DO A DOUBLE COMPOUND OF INCREASED FEES. NOT THAT WE WOULD LOOK AT IT IN THE FUTURE. BUT RIGHT NOW IS NOT THE CORRECT TIME TO DO IT.
>> THE ONLY REASON I MAY SAY I COULD DISAGREE ON THE IS BECAUSE ALL IT'S DOING IS INCREASING THE BURDEN OF THE
CREDIT CARD PROCESSING FEE. >> CORRECT.
>> SO I WOULD RATHER OFFSET IT. LOOK, PEOPLE HAVE TO PAY IT NO MATTER WHAT. IT'S THE SAME IN ALMOST ANY BUSINESS. THERE'S A BENEFIT TO PEOPLE USING CREDIT CARD. NUMBER ONE, IT MEANS THEY GET TO PAY IT OVER TIME. NUMBER TWO IS THEY GET POINTS OR WHATEVER IN EXCHANGE . WHATEVER THE CASE MAY BE, I JUST DON'T KNOW THAT . I ACTUALLY AGREE WITH YOU, BOB. I THINK THIS IS SOMETHING FOR THAT KIND OF DOLLARS ON AN ANNUAL BASIS.
PEOPLE CAN EITHER PAY A CHECK, WE CAN OFFER ACH OR WHATEVER THE OTHER OPPORTUNITY IS. BUT I AGREE. THAT IS A COST SAVINGS THAT PEOPLE ARE GOING TO FIND A WAY TO PAY IT ONE WAY OR ANOTHER. WE JUST DON'T NEED TO BEAR THE COST OF IT.
>> WHAT IS THE COST? 3%? 2%? >> 2.9.
>> IT VARIES. THERE'S NOT AN EXACT AMOUNT. EACH CARD. VISA IS DIFFERENT THAN MASTERCARD. VARIOUS PROGRAMS ARE DIFFERENT.
>> THAT WE ONLY HAVE A SET PERCENTAGE BASED ON HOW WE
PROCESS IT? >> IT'S ALL VARIABLE DEPENDED ON THE CARD. CAPITAL ONE VENTURE WILL BE DIFFERENT THAN BANK OF AMERICA OR CASH REWARDS CARD. ON AVERAGE, IT'S PROBABLY SOMEWHERE BETWEEN 200 TO 400% AND MAYBE UP TO 3%.
>> SO WE INSTITUTED , BECAUSE IT DOESN'T OFFEND ME OF SOME HE WANTS TO USE A CREDIT CARD VERSUS ACH WHEN DROPPING OFF A CHECK. IT DOESN'T OFFEND ME IF WE ADDED A 3% CONVENIENCE FEE FOR CREDIT CARD PROCESSING. WITH THAT COVER THE COSTS BASED
>> IT ALSO APPLIES TO ALL OF YOUR CREDIT CARD. THAT WOULD BE YOUR SUMMER CAMPS AND ANYTIME USE A CREDIT CARD.
>> THAT'S JUST THE WAY OF THE WORLD NOW, UNFORTUNATELY.
>> IF YOU PAY YOUR PROPERTY TAX AND YOU WANT TO PAY WITH A CREDIT CARD THERE IS A COUNTY GEORGIA FEE. IF YOU WANT TO GET
YOUR LICENSE -- >> YOU ALREADY WON.
>> I WANT TO BASK IN THE GLORY.
>> HOW DOES THIS WORK? WHAT DO WE DO?
>> WE AMEND IT . >> YOU CAN MAKE A MOTION TO
APPROVE WITH AN AMENDMENT . >> 04, BOB.
>> 3% CONVENIENCE FEE FOR CREDIT CARD CHARGES.
>> I SECOND EIGHT. >> ANYONE FROM THE PUBLIC OBJECT TO THIS CONDITIONAL FEE? I'M SEEING THAT THERE'S NONE.
WE HAVE A MOTION BY COMMISSIONER MAYERSOHN AND
SECONDED BY ISROW. ROLL CALL. >>
>> PLEASE SHOW IT PASSES UNANIMOUSLY AND MAKE SURE WE MARK THIS DOWN IN THE HISTORY BOOKS. THIS MAKES UP FOR THE
FIRE. >> WE ARE DOING THE FIRE
ASSESSMENT FEE NEXT? NOT THAT N >> BEFORE WE START THIS, I JUST WANT TO SAY, THIS WAS A LONG NIGHT. BUT THIS IS VERY GOOD. I THINK WE HAD A LOT OF GREAT CONVERSATIONS. THE WORKSHOP WAS VERY GOOD. THIS MEETING WAS GOOD. I SAY IT ALL THE TIME. I
[02:30:01]
HAVE REALLY ENJOYED SERVING WITH YOU GUYS. OBVIOUSLY THE STAFF. EVEN THOUGH I'M EXHAUSTED .>> AND A BIG DEAL FOR THE RESIDENTS TOO. THIS HERON BAY PROJECT WAS SOMETHING WE WERE FACING DOWN THE BARREL OF SOME BAD OPTIONS. AND WITH LEADERSHIP FROM OUR MAYOR AND CITY STAFF, THIS COMMISSION, TOLD BEING A PARTNER, THE H AWAY, AND EVEN NSID, WE ARE GOING TO HAVE A MUCH BETTER COMMUNITY IN THERE THAN HUNDREDS OF HOMES , APARTMENTS
OR ANYTHING ELSE. >> AGREED. OKAY. CAPTAIN?
[11. Comments by the Broward Sheriff's Office]
>> GOOD EVENING MAYOR, VICE MAYOR, COMMISSIONER, CITY MANAGER. I WILL MAKE MY COMMENTS BRIEF. WE HAVE BEEN HERE FOR A LONG TIME. MOST OF YOU MENTIONED THE EVENT THAT WE HAD, IT WAS A GREAT EVENT. I WANT TO THANK ALL OF THE FEDERAL PARTNERS THEY CAME OUT AND SUPPORTED US. WHENEVER I CALL THEY ARE FIRST IN LINE TO SAY THEY WILL BE THERE. SO I REALLY APPRECIATE THEM. IT WAS A GREAT EVENT. AND EVERY YEAR I BELIEVE WE HAVE MORE AND MORE FOLKS ATTEND. I LOOK FORWARD TO HAVING IT NEXT YEAR AS WELL. WE HAVE OUR FIRST WEEK BACK AT SCHOOL SO WE HAVE AN OPERATIONAL PLAN. I TALKED ABOUT THIS A LITTLE BIT AT OUR MAYOR'S BACK-TO-SCHOOL BREAKFAST. SO FAR WE ARE DOING PRETTY GOOD . WE ARE PUTTING OUT A LOT OF REMINDERS ON SOCIAL MEDIA FOR FOLKS TO DRIVE SLOWLY, OBEY THE SPEED LIMITS. WE DID HAVE A THREAT LAST WEEK TO AN INDIVIDUAL AT PARK TRAILS ELEMENTARY. WE POSTED ABOUT THAT. THERE'S NO ACTIVE THREAT RIGHT NOW TO THE COMMUNITY AND WE HAVE IMPLEMENTED ADDITIONAL SAFETY MEASURES. BUT OUR THREAT MANAGEMENT UNIT IS INVESTIGATING AN ONGOING THREAT. SO IT'S A GOOD TIME TO REMIND OUR FAMILIES AND OUR COMMUNITY TO TALK TO YOUR KIDS ABOUT POSTING THINGS . IT'S NOT A PRANK . IT'S A CRIME. WE TAKE IT VERY SERIOUSLY. SO IT'S JUST A REMINDER TO TALK TO YOUR KIDS ABOUT THAT. WE HAVE GOTTEN SOME FEEDBACK REGARDING TRAFFIC IN THE AREA WHICH HAPPENS USUALLY WHEN WE GO BACK TO SCHOOL. EVERYBODY IS TRYING TO GET THEIR TIMING DOWN. JUST A REMINDER, FOR THOSE OF YOU DROPPING OFF CHILDREN AT MSD, PLEASE DON'T DOING THE ROADWAY. REMEMBER TO GO INTO THE CAR LINE AND DROP OFF THE KIDS. THEN WE ALSO HAVE SOME INFORMATION THAT VEHICLES WERE BLOCKING THE ROADWAY ON PARKSIDE DRIVE AND WE ARE WORKING ON THAT AS WELL. JUST EVERYBODY KIND OF WORKED TOGETHER AND HOPEFULLY BY THE END OF THE WEEK WILL BE SMOOTH SAILING WITH THAT. I ALSO WANTED TO TALK ABOUT YESTERDAY AFTERNOON. WE HAD A LOW-SPEED VEHICLE COLLIDED INTO THE BACK OF THE SCHOOL BUS. SO JUST A REMINDER FOR THOSE ON GOLF CARTS AND LOW-SPEED VEHICLES , MAKE SURE WE ARE ABIDING BY THE LAWS. THANKFULLY, THERE WERE NO INJURIES THAT. BUT NOW IS THE TIME WHERE WE START TO SEE THE LOW-SPEED VEHICLES COME OUT AND YOU'RE JUST NOT GOING TO WIN AGAINST A SCHOOL BUS. SO JUST BE CAREFUL. LASTLY, I WANT TO HIGHLIGHT THE EFFORTS OF OUR PARKLAND ROLL PATROL,AND OUR BURGLARY APPREHENSION TEAM.
ESSENTIALLY, TRY COUNTYWIDE AND REALLY ALL OVER FLORIDA, WE HAVE BEEN HAVING A RING OF PACKAGE THEFTS OCCURRING RELATED TO IPHONES. OUR ROW PATROL AND OFFICER SUCCESSFULLY IDENTIFIED A VEHICLE AND -- THAT WAS HERE IN PARKLAND. THEY WERE IN OUR REGIONAL BURGLARY APPREHENSION TEAM WHO DEVELOPED SOME INVESTIGATIVE LEADS OFF OF THAT. WE ARE ABLE TO IDENTIFY SOME SUBJECTS. AND WE ARRESTED THEM FOR COMMITTING THE SAME CRIME IN DEERFIELD AND WE WERE ACTUALLY ABLE TO CHARGE THEM FOR WHAT HAPPENED IN PARKLAND. SO IT WAS A GREAT OUTCOME WITH REGARDS TO WORKING TOGETHER AND REALLY GETTING ALL OF THAT INFORMATION AND THE PIECES OF THE PUZZLE TOGETHER.
>> THANKS. >> THANK YOU VERY MUCH.
>> DOES DSO HAVE A LEGISLATIVE DEPARTMENT? FOR FUTURE LEGISLATION TO PREVENT X, Y AND Z?
>> YES, WE DO. >> CAN YOU CONNECT ME WITH
>> THERE IS ONE ISSUE. PROBABLY WHETHER IT'S THROUGH -- STARTING AND WORKING WITH OUR LEGISLATORS. WHEN YOU SELL A SCHOOL BUS , IT'S YELLOW. WHEN YOU SELL IT AND YOU ARE NOT NECESSARILY USING AS A SCHOOL BUS YOU CAN CONTINUE TO KEEP IT YELLOW. SO BASICALLY YOU ARE IMPERSONATING A SCHOOL BUS. YOU COULD HAVE IT WHERE SO HE DRIVES AROUND AND SAYS, I'M THE DRIVER. I KNOW IT DOESN'T SAY BROWARD COUNTY SCHOOLS OR WHATEVER. YOU PICK UP KIDS AND ABDUCT THEM OR WHATEVER THAT MAY BE. THAT'S SOMETHING THAT I WOULD LIKE TO BE ABLE TO WORK WITH LAW ENFORCEMENT ON AND SEE WHAT WE CAN GET THROUGH OUR
[12. Comments by the Coral Springs-Parkland Fire Department]
[02:35:02]
>> I WILL GET YOU THAT INFORMATION.
>> LAST MONTH THERE WAS 140 FIRE AND EMS INCIDENTS. FOUR OF THOSE WERE FIRES. WE HAD A COUPLE OF EXTRA FIRE SINCE LAST MONTH. ONE OF THEM WE BELIEVE. AND A DISPOSING OF ITEMS OUT THE WINDOW DOESN'T ALWAYS HELP. AND THERE WAS A CAR FIRE IN THE CITY LAST MONTH AS WELL. THE ONLY OTHER THING THAT I HAVE THAT I WOULD LIKE TO ECHO ABOUT BLOCKING THE ROADWAYS, SHE WAS NICE ENOUGH TO LUPUS IN. ONE OF THE ROADS WERE ACCESS THAT WAS BLOCKED WAS THE FIRE STATION EXIT RIGHT HERE AT STATION 42. WE ARE ASKING THE RESIDENTS TO PLEASE DON'T BLOCK THAT ENTRANCE. WE WILL PUSH RIGHT THROUGH AND GET A TOW TRUCK. WE DO WANT TO HAVE ANY DELAYED RESPONSES. THAT'S ALL
I HAVE. THANK YOU. >> COMMENTS BY THE CITY
