[1. Call to Order]
[00:00:10]
>>> GOOD EVENING, EVERYONE. I WOULD LIKE TO CALL THIS REGULAR CITY COMMISSION FOR THE CITY OF PARKLAND, PLEASE RISE FOR THE PLEDGE.
[4. Approval of Minutes]
>> MOTION AND SECOND. ALL IN FAVOR.
[5. Comments from the Public on Non-Agenda Items]
>> AYE. >> PASSES UNANIMOUSLY.
COMMENTS FROM THE PUBLIC ON NONAGENDA ITEMS. ANYONE HERE FROM THE PUBLIC? OKAY. SEEING AS WE DON'T, I'LL MOVE TO THE COMMISSION AND WE WILL START WITH COMMISSIONER
FIRST I WOULD LIKE TO ONCE AGAIN SHARE MY CONDOLENCES WITH THE BRAYER FAMILY FOR THE LOSS OF CHARLIE PRYER.
I WILL TELL YOU THAT FROM THE EULOGIES THAT THIS IS A FAMILY THAT LOVES A LOT AND THAT CHARLIE WAS WELL LIVED AND A WELL LOVED MAN AND I AM VERY SORRY FOR HIS LOSS.
THE FISHING DERBY WAS A BIG SUCCESS.
THE NEXT ONE IS AUGUST 12TH. I WOULD STRONGLY SUGGEST THAT IF YOU'RE BRINGING THE KIDS OUT AGAIN FOR THE FISHING DERBY THAT YOU MAKE SURE THAT THEY HAVE WATER AND HATS BECAUSE IT WAS VERY HOT OUT THERE BUT WE CAUGHT SOME GREAT FISH AND WE HOPE TO DO IT AGAIN. I HAD THE OPPORTUNITY THE OTHER DAY TO HAVE COFFEE WITH BSO OVER AT THE WAWA WHICH WAS A GREAT EVENT. VERY WELL AT THE ENDED BY BOTH BSO AND BY THE PUBLIC COMING IN. MANY OF WHOM WERE SHOCKED TO SEE SUCH A SHOW OF FORCE THERE. I THINK SOME OF THEM WERE EVEN SCARED. WHICH IS A GOOD THING.
I WANTED TO BRIEFLY MENTION THAT THIS MORNING I ATTENDED A HEARING BROUGHT BY SOME OF THE FAMILIES IN THE CIVIL ACTION OF DEALING WITH THE MSD TRAGEDY. ONE OF THE ATTORNEYS FOR THE PLAINTIFFS HAS FILED A MOTION FOR REENACTMENT AT THE SCHOOL ITSELF. I KNOW IT'S ALREADY OUT IN THE PAPER. THE SUN SENTINEL PUT AN ARTICLE OUT AND I SAW ON SOME OF THE MEDIA NEWS SITES THAT THAT IS OUT THERE AS WELL SO I WANTED TO MAKE SURE THAT WE BROUGHT THAT YOU ON THE DAIS TO LET THE PUBLIC KNOW WE ARE DEFINITELY MINDFUL OF THAT GOING ON AND PAYING VERY CLOSE TO TAXI TO WHAT IS -- ATTENTION TO WHAT IS HAPPENING IN ADDITION TO MYSELF AND THE CITY ATTORNEY BEING PRESENT WE MADE SURE THAT THE COURT WAS AWARE OF THE FACT THAT THERE ARE MEMBERS OF OUR COMMUNITY WHO WERE TRAUMATIZED NOT JUST THE VICTIM'S FAMILIES THEMSELVES BUT ALSO PEOPLE IN THE COMMUNITY AND STUFF.
SO WE'RE -- THE COURT HAS INDICATED THAT IT'S GOING TO ALLOW THIS TO HAPPEN. IT IS NOT IN OUR HANDS TO CONTROL THAT. THAT'S UP TO THE JUDICIARY AND THIS PARTICULAR JUDGE'S RULE. THE JUDGE IS GOING TO ALLOW IT TO HAPPEN. WE ARE IN THE PROCESS OF FINDING OUT WHAT EXACTLY THAT WILL MEAN BUT THE COURT AND THE ATTORNEYS FOR BOTH OF THE PARTIES HAVE INDICATED THAT THEY'RE EXTREMELY MINDFUL OF ITS IMPACTS TO THE COMMUNITY AND SO THEY WILL BE LETTING US KNOW EXACTLY WHEN THIS IS GOING TO HAPPEN.
IT WILL BE HAPPENING BEFORE SCHOOL STARTS.
AND THEY WILL BE LETTING US KNOW SO THAT WE CAN GET INFORMTION OUT AND SHARE THAT WITH THE COMMUNITY SO THAT THEY CAN MAKE WHATEVER ARRANGEMENTS THEY NEED TO MAKE TO GET THIS DONE.
THERE IS A HEARING SCHEDULED NEXT WEEK ON THURSDAY TO UPDATE THE COURT ON THE STATUS OF EVERYTHING AND WE HAVE ALREADY RECEIVED A PROPOSED ORDER FROM THE PLAINTIFF'S ATTORNEY TO HAVE THE COURT EXECUTE THAT ORDER BASED ON WHAT SHE SAID AND THAT'S GOING AROUND THE CITY ATTORNEY IS NOW IN POSSESSION OF THAT AND WILL BE REVIEWING IT. THOSE ARE MY COMMENTS.
>> THANK YOU. COMMISSIONER CUTLER.
>> COMMISSIONER MAYERSON. >> THANK YOU.
[00:05:03]
AGAIN, I TOO AS COMMISSIONER CUTLER SAID WANT TO PASS ON MY CONDOLENCES TO YOU AND YOUR FAMILY.I KNOW THAT YOUR FATHER MEANT A LOT TO YOU AS WELL AS THE OTHER MEMBERS OF YOUR FAMILY. AGAIN, BEING AT THAT SERVICE DEFINITELY LEARNED A LOT ABOUT YOUR FATHER.
HOW HE INTERACTED AND CONSTANTLY CALLED HIS BROTHER EVERY DAY AND OTHER STORIES WE WON'T GO INTO BUT I DO WANT TO PASS ON THOSE COND CONDOLENCES.
TY KNOW THAT YOU APPRECIATE IT. AGAIN, SAY THING.
COFFEE WITH A COP. THE WAWA WAS PACKED.
A LOT OF PEOPLE DECIDED NOT TO GO GET GAS THAT DAY, THAT MORNING. BUT AGAIN IT WAS A GREAT TURNOUT. THERE IS LOTS OF ACTIVITY AS I NOTICED GOING ON AT THE PARK FOR THOSE OF YOU WHO DON'T FREQUET AS MUCH AS I DO. OBVIOUSLY FENCES, DUGOUTS, OTHER THINGS GOING ON SO THINGS LOOK LIKE THEY'RE ON TRACK SO NANCY THANK YOU FOR THAT. STAFF AS WELL.
TY KNOW THAT THIS IS PARK AND REC MONTH SOCY SEE A LOT OF THE PARK AND REC PEOPLE HERE READY TO CELEBRATE.
AND THAT KIND OF BRINGS ME OVER TO OUR EATS AND BEATS CONCERT.
I THINK THAT WE HAVE ONE OF THE BEST CONCERT SCHEDULES IN THE COUNTY IF NOT IN THE STATE. GREAT MUSIC THAT GOES ON.
FOOD TRUCKS. SO, AGAIN, I WANT TO THANK STAFF FOR THE GREAT WORK. I SPECIFICALLY WANT TO GIVE A SHOUTOUT TO FELICIA BECAUSE HER KARAOKE DEBUT WAS PHENOMENAL.
I HEARD SHE'LL BE AT THE NEXT ONE ON AUGUST 5TH, BE PREPARED.
[LAUGHTER]. >> I WANT TO THANK ANTHONY AS WELL AS PROBABLY MORE IMPORTANTLY ALLISON AS WELL AS THIS COMMISSION FOR MOVING FORWARD IMPLEMENTING OUR PUBLIC NOTICES ON COUNTY WEBSITES. I BELIEVE WE ARE THE FIRST CITY TO DO THIS IN BROWARD COUNTY. THIS WAS PART OF HB 7049.
IT WAS ENACTED BY THE STATE. I GUESS THERE ARE STILL SOME TWEAKS TO GO THROUGH THERE BUT WE'VE PUBLISHED OR FIRST NOTICE THE OTHER DAY. IT IS ON WHAT, WHAT IS THE NOTICE ON? CAN'T DISCUSS IT, THE BID, BUT NOT ONLY IS THIS A COST SAVING MEASURE FOR THE CITY BUT IT ALSO GIVES THE RESIDENTS MORE ACCESS AND IT'S A LOT MORE EFFICIENT SO WHEN RESIDENTS AND THERE ARE SOME THAT DON'T EVEN SUBSCRIBE TO THE NEWSPAPER CAN GET WHAT'S GOING ON SO WHEN WE TALK ABOUT SENDING OUT A NOTICE THAT A LOT OF TIMES WE HEAR DID EVERYBODY IN THE AREA GET NOTICE AND WHATEVER ELSE IS GOING ON, WE CAN DO THAT THROUGH A WEBSITE LINK AS INCLUDING WHETHER IT'S IN OUR EMAIL BLAST OR WHATEVER MAY BE.
THAT MAY BE SOMETHING WE MIGHT WANT TO LOOK TO DO.
THIS PAST SATURDAY I DID NOT AT THE END THE FISHING DERBY.
BUT I DID AT THE END CHRISTMAS IN JULY AT THE FLA LIVE ARENA.
THIS IS GOING ON FOR 22 YEARS. IT'S A COLLABORATION BETWEEN THE KIWANIS CLUBS OF BROWARD COUNTY ALONG WITH THE COUNTY COMMISSIONER AND SCHOOL BOARD. WHAT THEY DO IS THEY HELP SERVE THE COUNTY'S HOMELESS CHILDREN. THEY PROVIDE THEM WITH NEW CLOTHING, SCHOOL SUPPLIES, TOILETRIES, SHOES, SNEAKERS, AND OTHER SUPPLIES. THIS THERE ARE OVER 300 VOLUNTEERS THERE OVER THE LAST 22 YEARS.
I THINK THEY'VE SERVICED 53,000 HOMELESS CHILDREN AND THAT DOESN'T INCLUDE THE FIVE AND UNDER BECAUSE THEY DON'T COUNT
IN THAT MIX. >> ONE THING THAT I WOULD ENCOURAGE IS THAT IF DO YOU HAVE HARDSHIPS, REACH OUT BECAUSE WE HAVE A LOT OF RESOURCES WHETHER IT'S IN OUR COMMUNITY OR IN THE COUNTY TO BE ABLE TO UTILIZE. JULY IS IRRIGATION MONTH.
I KNOW THAT FOR THE EAST SIDE OF PARKLAND WE DO HAVE I GUESS
[00:10:06]
SOMEWHAT OF AN ADVANTAGE MAYBE TO UTILIZE THE EPA THERE'S WATER SENSE LABEL DEVICES WHERE THERE'S POTENTIAL TO GET REBATES DEPENDING UPON WHAT'S THERE. INTERESTING ENOUGH I HAD THIS CALL FOR JURY DUTY THIS WEEK ALTHOUGH I WAS NOT SELECTED.BUT I DO WANT TO SAY THAT IT'S IMPORTANT WHEN A LOT OF PEOPLE GET -- WE ALL GET IT IN THE MAIL.
>> VERY SORRY FOR YOUR LOSS. I ENJOYED LEARNING MORE ABOUT CHARLIE. FIRST TIME I GOT TO MEET HIM WAS DURING EARLY VOTING WHEN I THINK HE DID MORE OF HOSTING ALL OF US AS CANDIDATES THAN HE WAS THERE TO SUPPORT YOU AND I QUICKLY LEARNED WHERE YOU GET YOUR SENSE OF HUMOR FROM.
HE WAS A REALLY FUNNY GUY AND A GOOD HEART AND THE STORY I THINK THAT WAS MOST TOUCHING TO ME IS HOW YOU GUYS AS A FAMILY BROUGHT YOU ALL TO PARKLAND TO START ANEW AND TO SEE HOW THAT FAMILY HAS GROWN AND BLOSSOMED IN THE CITY AND THE FACT THAT HE WAS ABLE TO SEE YOU BECOME NOT ONLY COMMISSIONER BUT VICE MAYOR OF THE CITY WHICH HE CALLED HOME I THINK WAS VERY SPECIAL.
I KNOW HE WAS PROUD OF YOU. JUST WE'RE ALL HERE FOR YOU.
>>> ON TOP OF THAT, I ALSO WENT TO COFFEE WITH A COP.
PEOPLE WERE PULLING THEY QUICKLY REALIZED IT WAS COFFEE AND COPS MEETING DONUTS. IT WAS NOT LOST ON ME THAT THEY WERE USUALLY I AM VERY CLOSE WITH THE -- SO I LOOK FORWARD TO RENEWING THAT NEXT GO AROUND.
AND LAST I JUST WANT TO TOUCH ON I GUESS THE COURT DECISION THAT COMMISSIONER CUTLER BROUGHT UP BECAUSE PUTTING ASIDE THE LEGALITIES OF IT, I THINK IT IS A VERY DIFFICULT WHILE I UNDERSTAND KIND OF THE BASIS FOR IT, I THINK IT'S A VERY DIFFICULT THING TO KIND OF SEE HAPPEN AND UNDERSTAND THAT IT'S GOING TO HAPPEN. AND SO WHAT I WOULD ASK IS MAYBE NOW IF YOU COULD TIME IT AND START REPUBLISHING OR CIRCULATING INFORMATION ABOUT EAGLES HAVEN BECAUSE I THINK THIS IS WHERE THEY SHINE ESPECIALLY.
AND OTHER THAN THAT, AT LAST ALL I GOT.
-- THAT'S ALL I GOT. >> THANK YOU.
>> I'LL BE BRIEF. I'M A LITTLE UNDER THE WEATHER.
FIRST OF ALL, I CAN'T THANK YOU ON BEHALF OF MYSELF AND MY FAMILY ALL ENOUGH. CITY STAFF.
FOR REACHING OUT TO MY FAMILY AND SHOWING US LOVE.
MUCH APPRECIATED. MY DAD MOVED THE FAMILY HERE 40 YEARS AGO LIKE THE MAYOR RAISED FIVE KIDS HERE.
AND LOVED PARKLAND BEYOND WORDS. AND SO HE GAVE PART OF THAT TO US. IT IS LARGELY BECAUSE OF MY DAD THAT I HAVE CHOSEN TO SERVE ON THIS DAIS SO I AM HONORED TO DO THAT WITH YOU ALL. I THANK YOU.
IT IS AMAZING TO ME -- LET ME SAY THIS IT THIS WAY.
IT NEVER CEASES TO AMAZE ME HOW MUCH OF A COMMUNITY WE ARE.
THERE'S A DIFFERENCE BETWEEN A PLACE TO LIVE AND BEFORE THIS WE HAD THE WORKSHOP ABOUT PEOPLE LOVE PARKLAND AS A PLACE TO LIVE.
WE'RE LIFTING UP THOSE WHO ARE IN NEED.
IT IS AMAZING TO ME TO SEE ALL THE LOVE AND SUPPORT THAT WE HAVE FOR ONE ANOTHER AND THAT WE'RE TRULY BLESSED IN THAT REGARD. I KNOW I MISSED A LOT OF EVENTS SO I'LL CATCH YOU BUT THANK YOU ALL ON BEHALF OF MY ENTIRE
[00:15:01]
FAMILY. THANK YOU ALL.>> THANK YOU VICE MAYOR. I TOO WANT TO EXTEND MY CONDOLENCES. MUCH LIKE GEORGE.
YOU KNOW, SPENDING TIME WITH CHARLIE ON IF CAMPAIGN TRAIL WAS A LOT OF FUN. I THINK FOR ALL OF US THE CAMPAIGN TRAIL, YOU KNOW, IT WAS INTERESTING.
IT WAS FUN. IT WAS INTERESTING.
WE REALLY GOT TO MEET THE COMMUNITY.
IT WAS A BLESSING. THAT'S ONE OF THOSE THINGS YOU TALK ABOUT. THE COMMUNITY.
BUT YOU HAVE AN AMAZING FAMILY. HEARING ALL THE BROTHERS SPEAK AND YOUR MOTHER AND FRIENDS, IT WAS -- YOU REALLY HAVE A TIGHT KNIT WONDERFUL TO SEE.
HAPPY BIRTH DAY TO PARKLAND. I KNOW WE HAD PARKLAND DAY.
PEOPLE ARE LIKE DID I MISS A PARTY.
WHAT WAS GOING ON THERE? WE HAD THE PARTY BEFORE.
WHAT WAS IT, TUESDAY WAS THE ACTUAL BIRTHDAY.
HAPPY BIRTH DAY PARKLAND. AND TO TOUCH BASE I'LL RAMBLE A LITTLE BIT MORE THAN I TYPICALLY DO BECAUSE I WAS GOING TO SAVE SOME MORE LATER BUT I'LL DO IT LATER AND REPEAT MYSELF AGAIN LATER. BUT TO GO WITH THE DISTRICT COURT HEARING THANK YOU COMMISSIONER CUTLER FOR AT THE ENDING THAT AND -- ATTENDING THAT AND SPEAKING ON BEHALF OF THE RESIDENTS, TO COMMISSIONER ISRAEL'S POINT, IT WILL STIR UP ADDITIONAL EMOTION INNS IT'S UNDERSTANDABLE WHAT THE FAMILIES FEEL THEY NEED TO DO AND WE MUST ACCEPT THAT.
BUT WE NEED TO JUST UNDERSTAND THAT'S WHAT'S GOING TO HAPPEN.
>> ONE THING I WANTED TO TALK ABOUT BECAUSE YOU STARTED TO TALK ABOUT IT A LITTLE BIT ABOUT THE COMMUNITY AND WHAT OUR COMMISSION DOES AND HOW WE DO. WE SAW TODAY TONIGHT WE'RE GOING TO VOTE TO PASS HOPEFULLY THE SALE OF 21 ACRES.
WE BOUGHT 69 ACRES OF LAND. PAID $29 MILLION FOR THOSE ACRES. TONIGHT, WE HAVE ON THE AGENDA TO VOTE ON SELLING 21 OF THOSE ACRES FOR $19.5 MILLION.
THAT'S SOMETHING THAT'S SIGNIFICANT.
IT'S SIGNIFICANT AS A COMMISSION.
IT'S SIGNIFICANT AS A CITY. ONE OF THESE THINGS THAT OUR COMMISSION HAS DONE AND WE WILL CONTINUE TO DO IS MEET CHALLENGES HEAD ON. PINE TREE ROAD WAS SOMETHING WE TALKED ABOUT EARLY ON. WE MET THAT HEAD ON.
OBVIOUSLY WE STILL NEED TO GO THROUGH WITH THE ACTUAL FIXING OF THE ROADS BUT WE MET THAT CHALLENGE, THAT WAS GOING ON FOR MANY, MANY YEARS. LOX ROAD WAS IN DEPUTY OF BEING PUT ON HOLD, TABLED, OR CANCELED.
WE STUCK WITH IT AND KEPT GOING WITH HELP OBVIOUSLY AT THE TIME BROWARD COUNTY MAYOR. WE WERE ABLE TO KEEP THAT PROJECT ON TRACK AND THAT SHOULD BE STARTING SOON AND THAT'S A PROJECT THAT WE'VE BEEN TALKING ABOUT FOR MANY, MANY YEARS AND IT WAS THIS CLOSE FROM NOT HAPPENING.
WE TALK ABOUT OUR RESIDENTS. OUR RESIDENTS TALK ABOUT HOW MSD WAS OVERCROWDED AND HOW IT'S A SAFETY ISSUE.
ALL THESE DIFFERENT CONCERNS. WE MET THAT CHALLENGE HEAD ON.
WE STAYED AS A COMMUNITY, AS A COMMISSION.
WE STAYED POSITIVE. WE DIDN'T GET INTO THE NEGATIVITY THAT SOME FELT WAS NEEDED.
WE STAYED POSITIVE. AND WE CAME OUT SUCCESSFUL FOR THE RESIDENTS. THE REASON WE'RE HAVING THIS VOTE TONIGHT IS OUR COMMUNITY WAS CONCERNED.
WHAT WAS GOING TO HAPPEN WITH OUR FUTURE.
WHO IS GOING TO BE CHARGE OF OUR FUTURE.
WE DECIDED AS A COMMISSION THAT WE HAD TO BE THE ONES TO BE IN
[00:20:03]
CHARGE OF OUR FUTURE. WE STEPPED IN TO NSID.WE TOOK CONTROL OF THIS PROCESS. AND HERE WE ARE.
WE HAVE A LOT OF WORK TO DO BUT WE HAVE TAKEN OR WE WILL TONIGHT TAKE A HUGE STEP, ANYONE WHO HAD ANY DOUBTS THAT THIS PROJECT WAS GOING TO BE SUCCESSFUL WE WERE GOING TO SPEND RESIDENT MONEY, THAT GOES AWAY TONIGHT. ABSOLUTELY POSITIVELY GOES AWAY TONIGHT. WHAT WE'RE DOING FOR THE CITY THIS COMMISSION IS INCREDIBLE AND I CANNOT BE MORE PROUD TO SERVE WITH ALL OF YOU AND I KNOW SOMETIMES I BUST YOUR CHOPS, COMMISSIONER MAYERSON AND YOU KNOW YOU'VE -- YOU KNOW, IT WAS A SUPER MAJORITY VOTE BUT YOU KNOW WHAT, SOMETIMES YOU NEED SOMEBODY TO KEEP YOU IN CHECK. TO PLAY DEVIL'S ADVOCATE.
TELL YOU ARE YOU SURE. THANK YOU REALLY THINK HARD AND THINK ABOUT IT. SO I ALWAYS APPRECIATE THAT.
I DON'T WANT -- WELL, I I DO NOT WAY I DON'T WANT TO COME UP HERE AND SAY THIS IS WHAT I WANT TO DO, EVERYBODY JUST SAY YES.
TRUTHFULLY THAT WOULD BE AWESOME.
BUT ALL KIDDING ASIDE, IT IS NICE TO HAVE -- YOU KNOW SOME OF THAT. SO JUST MAKE SURE YOU EVALUATE ALL THOSE THINGS BEFORE MOVING FORWARD.
SO EVERYBODY HAS PLAYED A PART IN WHAT WE'RE ABOUT TO DO.
THERE'S STILL A LOT MORE WORK TO DO.
BUT IT'S GOING TO BE AWESOME BECAUSE WE HAVE SET THE TONE.
WE CONTINUE TO ACT PROFESSIONALLY REGARDLESS OF WHERE WE ARE ON ANY PARTICULAR ISSUE.
AND I THINK THAT'S IMPORTANT. AND IT'S GENUINE.
WE TALK ABOUT HOW WE'RE SUPPORTING VICE MAYOR BRYER IN THIS SITUATION. IT'S BECAUSE WE WANT TO.
WE'RE NOT OBLIGATED TO. WE VERY THAT RELATIONSHIP AND APPRECIATE IT. APPRECIATE YOU.
YOU APPRECIATE US. IT'S GENUINE AND THAT'S DIFFERENT BECAUSE NOT EVERY COMMISSION -- WE WERE TALKING EARLIER ABOUT DIFFERENT COMMISSIONS.
NOT EVERY COMMISSION HAS WHAT WE HAVE.
WE CAN DISAGREE AND THAT'S OKAY. BUT WE DISAGREE PROFESSIONALLY.
WE'RE GENUINE AND THAT TO ME IS IMPORTANT.
AND AGAIN JUST TO TOUCH ONE MORE TIME ON HERON BAY.
IT WAS NOT DONE BY JUST US. RESIDENTS OF HERON BAY STEPPED UPCOMING TO MEETINGS TALKING ABOUT THINGS THEY WOULD LIKE TO SEE AND NOT JUST HERON BAY. SOME SAID THE WHOLE PROPERTY IS ONLY WORTH 13 MILLION. WE KNOW THAT'S NOT THE CASE.
BUT THAT'S NEITHER HERE NOR THERE.
SOME RESIDENTS SAY IT'S NOT THE CITY'S RESPONSIBILITY -- YOU KNOW, YOU SHOULD NOT BE IN DEVELOPMENT.
WE'RE NOT. WE'RE NOW HANDING OVER THIS PORTION TO A DEVELOPER WHO IS GOING TO BUILD BEAUTIFUL HOMES THAT RESIDENTS ARE GOING TO WANT TO BUY.
THE DEVELOPER WE CHOSE HAS BEEN INSTRUMENTAL IN HELPING US GET THERE. EVERY ISSUE OR CONCERN WE'VE HAD HAS BEEN ANSWERED. TY CANNOT BE MORE COMFORTEDABLE WITH THE DEVELOPER WE'RE CHOOSING SO I'M THANKFUL TO LINDSEY AND TOLL BROTHERS FOR LISTENING TO US AND MOVING FORWARD. THE HOA HAS BEEN FANTASTIC THROUGHOUT THIS PROCESS AT THIS TIME LOOK FORWARD TO THE HOS STEPPING UP AND ALLOWING THIS COMMUNITY TO JOIN IT, JOIN HERON BAY AS WE TALKED ABOUT. HAVING ACCESS TO -- WITHIN HERON BAY. I KNOW THE BOARD IS EAGER TO DO THAT SO I'M HOPING THAT WILL HAPPEN SOONER THAN LATER.
AND THEN OBVIOUSLY TRENTS. WE ALWAYS APPRECIATE THE TRENTS OF WHAT THEY HAVE TO SAY, GOOD OR BAD, IT'S IMPORTANT FOR US TO HEAR IT. AND THE SURVEY TODAY AGAIN KIND OF PROVED WE'RE ON THE RIGHT TRACK.
IT'S NEVER GOING TO BE 100% BUT WE'RE ON THE RIGHT TRACK.
TWO MORE PEOPLE I WANT TO THANK. I'LL START WITH NSID.
I KNOW ROD GETS A LOT OF CRAP AS HE SHOULD.
I DON'T KNOW IF HE SHOULD BUT WHATEVER.
HE HAD AN ULTIMATE VISION. THERE'S GOING TO BE 168 ACRES OF NATURAL PRESERVE AND HE DID THAT BECAUSE HE WAS TRYING TO DO SOMETHING OR IS TRYING TO DO SOMETHING THAT WILL BENEFIT OUR COMMUNITIES GREATLY. WE COULD BE LOOKING AT 1,500, 1,000, 2,000 RESIDENTIAL UNITS. THAT'S NOT A SCARE TACTIC.
THAT THE IS FACT. WHAT NSID DID FOR OUR COMMUNITY CANNOT BE UNDERSTATED. AND I APPRECIATE ROD GIVING US
[00:25:03]
THE CITY THE OPPORTUNITY TO DO WHAT WE'RE GOING TO DO AND TODAY IS THE FIRST STEP. AND LASTLY, NANCY.WE TALKED ABOUT IT A LITTLE BIT EARLIER TODAY.
YOU CAN HAVE THE BEST IDEAS IN THE WORLD.
YOU CAN HAVE THE BEST VISION. BUT IF YOU'RE NOT ABLE TO EXECUTE IT DOESN'T MATTER. AN IDEA IS NOTHING WITHOUT EXECUTION. AND NANCY THIS CAN NEVER BE UNDERSTATED. BECAUSE WE DON'T KNOW, WE KNOW WHAT DIRECTION -- WELL, WE DON'T KNOW EXACTLY WHAT DIRECTION WE'RE GOING TO TAKE WITH THIS COMMUNITY -- WITH THIS DEVELOPMENT. BUT IT'S GOING TO BE IN OUR VISION. # HUNDRED PERCENT IN OUR VISION AND I DON'T MEAN HOURS AS THIS COMMISSION.
I MEAN OURS AS A COMMUNITY. WE WOULD NOT HAVE HAD THAT OPPORTUNITY IF NANCY HAS NOT BEEN SO STEADFAST AND SO DILIGENT AND SO PROFESSIONAL IN HER JOB FROM DAY ONE.
NOT MANY CITIES CAN SIT BACK AND SAY CERTAINLY OF OUR SIZE WELL I'M JUST GOING TO CUT A CHECK FOR $25 MILLION TO BUY THIS LAND SO THAT WE CAN CONTROL IT. I'M HARD PRESSED TO KNOW IF ANY CITY CAN DO IT. THAT CAN NEVER BE UNDERSTATED.
EVER. NO MATTER WHAT HAPPENS, WHOEVER GETS THE CREDIT OR WHOEVER GETS THE BLAME OR WHATEVER, I'M HAPPY TO TAKE ALL THE BLAME BUT YOU GET ALL THE CREDIT.
BECAUSE AGAIN IDEAS ARE ONLY AS GOOD AS WHAT YOU HAVE TO BE ABLE TO EXECUTE. SO FROM THE BOTTOM OF MY HEART I APPRECIATE IT BECAUSE I CANNOT BE MORE EXCITED FOR THE CITY OF PARKLAND TO SEE WHAT WE ULTIMATELY END UP DOING BECAUSE WE RIGHT NOW HAVE IF NOT THE BEST DAIS IN BROWARD COUNTY, CERTAINLY ONE OF. AND I'M VERY EAGER TO GET STARTED TO PHASE TWO. SOCY JUST I CAN'T THANK YOU ENOUGH. [APPLAUSE] NOW THAT I RAMBLED ANTICIPATE WILL REPEAT MYSELF PROBABLY LATER BECAUSE I WANT TO REITERATE SOME OF THAT STUFF WHEN IT COMES UP ON THE AGENDA BECAUSE I THINKS IT'S IMPORTANT.
IT'S VERY IMPORTANT. BECAUSE IT CANNOT BE UNDERSATED WHAT WE'RE DOING AS A COMMISSION, WHAT WE'RE DOING AS STAFF. WHAT WE'RE DOING AS RESIDENTS.
WHAT WE'RE DOING AS A CITY. IT'S INCREDIBLE.
IT REALLY IS. NIGHTS LIKE TONIGHT, I AM THROUGH THE ROOF WITH EXCITEMENT.
AND HONOR AND ALL THAT OTHER GOOD STUFF.
WHICH MAKES ME RAMBLE. OKAY. SO WE HAVE PROCLAMATIONS
[6. Proclamations and Recognitions]
AND RECOGNITIONS. WE'LL GO DOWN TO THE WELL.>> IT'S ACTUALLY FOR APPROXIMATE PUBLIC OUT THERE.
YOU GUYS CAN HEAR ME JUST FINE.
PARKS AND REC. [APPLAUSE] NOW I SEEM TO BE BEING NICE AND SPEAKING HIGHLY OF EVERYONE SO I'M GOING TO GO RAMBLE A LITTLE BIT ABOUT CHRISTINE.
ONE THING THAT MAKES PARKLAND SO INCREDIBLE IS BELIEVE IT OR NOT OUR PARKS. BUT BEFORE CHRISTINE TOOK THE REIGNS AS PARKS AND REC DIRECTOR, THERE WERE SOME SHORT FALLS IN WHAT WE WERE DOING AS FAR AS MAINTENANCE AND HOW WE WERE BUILDING STUFF. THE PROGRAMMING.
THINGS LIKE THAT. YU'VE STEPPED IN.
I MEAN IT'S BEEN MANY YEARS NOW SO IT'S NOT THAT YOU'RE NEW BUT EVERY YEAR YOU GET SOME ACCOLADES AND TONIGHT IS THAT NIGHT. BUT YOU'RE MAIZING.
THE EVENTS THAT YOU PUT ON, THE WAY YOU HANDLE -- YOU WORK WITH YOUR STAFF AND PARKLAND DAY I MEAN IT'S AMAZING.
AND I KNOW YOU DON'T DOIT ON YOUR OWN AND YOU DON'T WANT ALL THE CREDIT. I KNOW THAT AND I GET THAT AND THAT'S ONE OF THE THINGS THAT'S SPECIAL.
NOT JUST ABOUT YOU BUT ABOUT NANCY.
ABOUT ALL OF US HERE. NOBODY HERE IS LOOKING TO BE THE HERO. WE JUST WANT TO DO WHAT WE CAN DO FOR OUR COMMUNITY. AND THAT'S WHAT MAKES PARKLAND SPECIAL. WE TALK ABOUT THAT ALL THE TIME.
SO WITH THAT SAID, PARKS AND RO INTEGRAL PART OF COMMUNITIES ALL
[00:30:04]
OVER THE COUNTRY INCLUDING THE CITY OF PARK LORAND.PARKS AND REC DEPARTMENTS ARE IMPORTANT TO MAINTAINING A HIGH QUALITY OF LIFE IN A COMMUNITY BY IMPROVING THE HEALTH OF CITIZENS, CONTRIBUTING TO THE ECONOMIC AND ENVIRONMENTAL WELL BENG OF PARKLAND. PARKS AND REC PROGRAMS AND FACILITIES BUILD HEALTHY ACTIVE COMMUNITIES THAT AID IN THE PREVENTION OF CHRONIC DISEASE, PROVIDE THERAPEUTIC RECREATION SERVICES FOR THOSE MENTALLY OR PHYSICALLY DISABLED AND IMPROVE THE MENTAL AND EMOTIONAL HEALTH OF ALL CITIZENS.
PARKS AND REC AREAS ARE FUNDAMENTAL TO THE ENVIROMENTAL WELL BEING OF THE COMMUNITY. THE CITY OF PARKLAND'S PARKS AND RECREATION AREAS ENSURE THE EASTBOUNDING LOGICAL BEAUTY OF THE PARKLAND COMMUNITY. THE PARKS AND RECREATION DEPARTMENT IS COMMITTED TO PROVIDING SAFE, FUN, AND ACCESSIBLE PARKS, TRAILS, FACILITIES AND LEE SURE OPPORTUNITIES FOR ALL PARKLAND RESIDENTS.
BE IT RESOLVED THAT I RICH WALKER AND THE CITY OF PARKLAND AND THE COMMISSION HEREBY PROCLAIM THE MONTH OF JULY AS PARKS AND RECREATION MONTH. [APPLAUSE]
[8. Approval of the Agenda]
>>> APPROVAL OF THE AGENDA. MOTION TO APPROVE.
>> SECOND. >> MOTION TO APPROVE VICE MAYOR AND SECOND BY COMMISSIONER MAYERSON.
>> PASSES UNANIMOUSLY. >>> CONSENT AGENDA.
[7. Presentations]
>> MOTION TO APPROVE. >> SECOND.
LUCDWIN LUCK. WE'RE GLAD TO HAVE YOU PRESENTING. WE'VE GOT TO MEET EACH OTHER SO IT'S GREAT. GLAD TO HAVE YOU HERE DOING YOUR
PRESENTATION. >> THANK YOU, MAYOR.
COMMISSIONERS OF THE CITY OF PARKLAND.
I'M LUCDWIN LUCK AND I REPRESENT THE CHIEF FINANCIAL OFFICER OF THE STATE. MANY PEOPLE MAY NOT BE FAMILIAR WITH HIM BUT DEPARTMENT THE DEPARTMENT OF FINANCIAL SERVICES REGULATES THE INSURANCE INDUSTRY.
AS YOU CAN IMAGINE I GO OUT TO THE COMMUNITY AND WHEN I MENTION ABOUT INSURANCE INCLUDING PROPERTY INSURANCE JUST KNOW THAT I'M JUST A MESSENGER SO PLEASE DON'T BEAT ME OVER THE HEAD. THERE ARE A LOT OF ISSUES REGARDING INSURANCE. I'LL GO BACK TO PROPERTY BUT WHEN IT COMES TO INSURANCE THE DEPARTMENT OF FINANCIAL SERVICES REGULATES ALL LINES OF INSURANCE WHETHER AUTO, LIFE, YOU NAME IT.
WITH THE EXCEPTION OF FLOOD INSURANCE WHICH IS REGULATED BY FEMA. BUT GOING BACK TO PROPERTY INSURANCE BECAUSE I WANT TO FOCUS PARTICULARLY ON OUR -- IT'S A NEW GRANT CALLED MY SAFE FLORIDA HOME PROGRAM AND THAT'S BASICALLY A WAY TO KIND OF HELP THE COMMUNITY OR HOMEOWNERS LOWER THEIR RATES WITH SOME OF THE IMPROVEMENTS THAT CAN BE ADDED TO THE HOMES WHETHER IT'S THE WINDOWS, DOORS, GARAGE DOORS OR THE ROOF. BUT BEFORE I GO INTO THAT
[00:35:01]
BECAUSE I WANT TO KIND OF BE A CONTINUING RELATIONSHIP BECAUSE WHAT I DO IS TYPICALLY TO GO THROUGH THE CITY AND TO DIFFERENT COUNTIES. I COVER -- AS YOU CAN IMAGINE I DO QUITE A BIT OF TRAVEL BUT NEVERTHELESS, FOR THOSE WHO MAY NOT KNOW WHO OUR CHIEF FINANCIAL OFFICER OF THE STATE IS, HE SITS ON CABINET WITH THE GOVERNOR ATTORNEY GENERAL AND THE COMMISSIONER OF AGRICULTURE AND THE CFO IS HERE RIGHT THERE SO THIS WILL GIVE YOU AN IDEA WHO HE IS.HE DOES ALSO WEAR SEVERAL HATS. STATE WILL DO IS THEY HAVE A POT OF FUNDS FOR THE HOME IMPROVEMENT SO THE HOMEOWNER REGARDLESS OF IF IT'S A TOWNHOUSE, APARTMENT, SINGLE HOME, YOU NAME IT, THE HOMEOWNER WILL BE ABLE TO APPLY FOR THIS FOR HOME VALUES OR PROPERTY VALUE THAT IS $700 OR $700,000 OR LESS. I KNOW TYPICALLY IN THE COMMUNITY PROPERTY ARE PROBABLY A LITTLE OVER $700,000 BUT NEVERTHELESS THERE IS OTHER ASPECTS OF THE GRANT THAT CAN BE APPLICABLE. SO I'LL MENTION THAT WHEN IT COMES TO PURCHASING THE WINDOWS OR IMPACT WINDOWS, DOORS, GARAGE DOORS, WITH THE EXCEPTION OF THE ROOF THERE IS NO STATE SALES TAX SO WHEN YOU GET THESE RETAIL ITEMS KNOW THAT THERE IS NO STATE SALES TAX ON THESE ITEMS. NOW REFERRING BACK TO THE GRANT FOR THOSE WHO ARE ELIGIBLE IF HOMEOWNER WILL BUT UP 5,000 AND THE STATE MATCHES IT TO 5,000 SO BASICALLY, AGAIN, I KNOW IT'S MAYBE A SMALL BIT BUT IT'S SOMETHING THAT WE NEVER REALLY HAD IN THE PAST BUT THAT'S SOMETHING THAT HOPEFULLY WILL GROW IN THE FUTURE BUT IT'S A STEP IN THE RIGHT DIRECTION.
WHEN IT GOES TO PROPERTY INSURANCE THERE'S A LOT OF THINGS THAT WERE DONE PREVIOUSLY OR DURING THE SPECIAL SESSION THAT HAPPENED IN SEPTEMBER. BUT, AGAIN, A LOT OF THIS INFORMATION CAN BE FOUND ON MY FLORIDA CFO.COM.
I DO APOLOGIZE FOR THE LINK NOT WORKING.
>> THANK YOU VERY MUCH. SINCE YOU'RE THE MESSENGER AND I WAS RAMBLING BEFORE, I MIGHT AS WELL DO IT NOW.
TY KNOW OUR STATE REPRESENTATIVE HAS WORKED HARD TO MAKE CHANGE IN HOMEOWNERS INSURANCE. HOMEOWNERS INSURANCE I DON'T UNDERSTAND HOW WE'RE NOT REALLY ATTACKING THAT.
BECAUSE THAT'S BECOMING A BIG, BIG ISSUE.
NOT BECOMING. IT'S ALREADY AN ISSUE.
IN FACT TODAY FARMERS INSURANCE JUST DROPPED 100,000 FLORIDA RESIDENTS BECAUSE THEY'RE PULLING OUT OF THE STATE OF FLORIDA. STATE FARM IS NO LONGER ACCEPTING HOMEOWNERS IN BROWARD COUNTY.
I JUST GOT DROPPED FROM MINE FOR THE SECOND TIME IN TWO YEARS.
[9. Consent Agenda]
[10. Regular Agenda]
[00:41:33]
>> ITEM 10 A. RESOLUTION 2023-039.
THIRDSING THE PURCHASING DIRECTOR TO NEGOTIATE CONSTRUCTION MANAGER SERVICES AGREEMENT.
A RESOLUTION ON THE CITY COMMISSION AND CITY OF PARKLAND FLORIDA APPROVING THE EVALUATION COMMITTEE'S RANKING.
AND AUTHORIZING THE PURCHASING DIRECTOR TO NEGOTIATE A CONSTRUCTION MANAGER SERVICES AGREEMENT FOR PRECONSTRUCTION SERVICES AND TO PROVIDE A GUARANTEED MAXIMUM PRICE AND COMPLETION DATE VIA THE CONSTRUCTION MANAGER AT RISK DELIVERY METHOD PROVIDING FOR CONFLICTS AND AN EFFECTIVE DATE.
>> GOOD EVENING, EVERYONE. PUBLIC WORKS DIRECTOR FOR THE RECORD. SO WHAT WE'RE PRESENTING TO YOU TODAY IS THE RECOMMENDATIONS OF RANKING FOR THE CMR RISK.
BEFORE I WENT OVER WHAT THE CMR MEANS, IT'S CONSTRUCTION MANAGER AT RISK. IT'S A TYPE OF CONTRACT THAT WE REQUESTED WHEN WE CAME IN WITH A DESIGN.
IT'S A SYSTEM THAT WORKS VERY WELL WITH THE CONTRACT.
WE'RE WORKING VERY CLOSE WITH THE DESIGNER THROUGH THE ENTIRE PHASE. 30, 60, 90%.
WE'LL WORK ON CONSTRUCTBILITY. PRESENTING.
TELLING US WHAT WE CAN DO. AND THAT WAY WE KNOW WE GET THE BEST PRODUCT ON THE DESIGN OF THE CONSTRUCTION.
SO THE CMR IS ALL ABOUT WORKING TOGETHER IN COLLABORATION BETWEEN THE DESIGN AND THE FIRM. THE ADVANTAGE LIKE I SAID IS IMPROVE CONSTRUCTBILITY OF DESIGNS, GREAT OPPORTUNITY FOR ENGINEERING, INCREASED QUALITY CHECKS AND DESIGNS AND BASICALLY MOST IMPORTANT IS SHARED COST SAVINGS IF THE CONTRACT COMES IN LESS THAN THE MAXIMUM GUARANTEED PRICE.
SO IN FRONT OF YOU WE'RE GOING TO BE PRESENTING THIS THREE TIMES. SO THE PROCESS WILL BE AT THIS TIME WE'RE ASKING YOU TO APPROVE THE RANKING FOR THE TOP RANKED FIRM AND ALSO ALLOW THE PURCHASING DIRECTOR TO NEGOTIATE PRECONSTRUCTION SERVICES AND ALSO TERMS AND CONDITIONS OF THE CONTRACT. FOR THE MAXIMUM GUARANTEED PRICE. ONCE THE NEGOTIATION IS OVER WE'RE GOING TO COME BACK AGAIN HERE TO PRESENT TO THE COMMISSION WHAT THE PRECONSTRUCTION PRICE IS AND ALSO THE TERMS AND CONDITIONS. YOU'LL APPROVE THAT.
ONCE WE CONTINUE WITH THE DESIGN AND WE PRESENT AND GO OVER THE 30, 60, 90% WHEN WE REACH ABOUT 09% OF DESIGN THE CONSTRUCTION MANAGER RISK WILL GO OUT FOR BID AND THEY WILL GET THEIR OWN PRICES AND WE'LL GET A REAL MAXIMUM PRICE.
THEN WHEN WE HAVE NEGOTIATED THAT PRICE WE'LL BRING IT BACK TO YOU GUYS ON RESOLUTION 3 TO GET THE FINAL APPROVAL AND WE'LL BE THIS IS A LITTLE BIT OF HISTORY OF HOW WE WENT.
[00:45:02]
AN RFQ WAS ISSUED JOB JUNE 1ST. WE GOT THE PROPOSALS OPENING ON THE 22ND. WE RECEIVED THE THREE PROPOSAL SUMMATION, CONSTRUCTION. AND SHIFT CONSTRUCTION.THE EVALUATION COMMITTEE WAS HELD ON THE 27TH.
AND THEN THE MEMBERS WERE MYSELF AND OTHERS.
THE RANKING ENDED UP HAVING -- YOU HAVE IN FRONT OF YOU WAS KAUFFMAN WHICH WAS RANKED NUMBER ONE.
>> GREAT. SO I'M A BIG FAN OF THIS PROCESS. BECAUSE I THINK IT GIVES THE CITY THE GREATEST OPPORTUNITY TO VALUE ENGINEER THE PROJECT.
ESPECIALLY WITH THE RISING COST OF SUPPLIES, MATERIALS, LABOR, ALL THOSE DIFFERENT ISSUES. AND IT ALLOWS ANOTHER ENTITY TO WORK WITH THE DESIGNER AND THE CONSULTANT, SOMEONE WHO'S EXPERIENCED IN BUILDING PARKS. RIGHT.
SO YOU BRING IN SOMEBODY WHO UNDERSTANDS HOW TO BUILD PARKS.
HOW THINGS COST. YOU COMBINE THAT WITH THE DESIGNER AND YOU SHOULD COME UP WITH THE ULTIMATE OUTCOME.
AND THEN TONIGHT WE'RE JUST GETTING THIS PERSON ON BOARD TO HELP FACILITATE US TO THE NEXT STEP AND THEN WHAT WILL HAPPEN IS WE GET TO COME BACK AND RE-EVALUATE THE LATEST SITE PLAN THAT WE SAW AND WE'LL GET TO SEE REAL COST.
SO WE WILL SAY OKAY MAYBE WE NEED TO CHANGE THIS.
MAYBE WE CAN ADD THAT. WHATEVER IT ULTIMATELY ENDS UP BEING IS WE GET ANOTHER BITE AT THE APPLE AS FAR AS WHAT THE PARK WILL LOOK LIKE ULTIMATELY BUT IN REAL NUMBERS AND REAL TERMS AND REAL WHY THE LAKE IS THIS BIG.
WHY THIS IS HERE. WHY THIS COSTS THAT MUCH.
WE'LL HAVE MORE EDUCATION AS TO WHY THE DESIGNER ULTIMATELY DID WHAT THEY DID. SO FOR ME I DON'T KNOW IF ANYONE HAS QUESTIONS BUT THIS IS I DON'T KNOW IF THIS IS THE FIRST TIME WE DID IT THIS WAY OR WHATEVER BUT THIS IS REALLY A MUCH IN MY OPINION. BECAUSE ONE THING WE TALK ABOUT WHY I FIRST RAN FOR COMMISSION WAS AND CHRISTINE COMING ON BOARD AS PARKS AND REC DIRECTOR IS WHY ARE WE BUILDING WHAT WE'RE BUILDING AND ARE WE BUILDING THEM THE WAY PEOPLE WILL USE THEM? ALL THOSE DIFFERENT THINGS, THE DESIGNER KNOWS A LOT BUT THEN A CONSTRUCTION MANAGER KNOWS EVEN MORE. SO THEN HAVE YOU TWO EDUCATED PEOPLE TALKING ABOUT A PROJECT THAT'S TELLING US THIS IS WHAT'S BEST. RIGHT.
THAT'S -- AND THAT'S WHAT WE NEED.
I'M NOT A PARK EXPERT. I GO TO THEM A LOT.
MY KIDS PLAY ON THEM ALL THE TIME.
BUT I'M NOT A PARKS EXPERT. I DON'T KNOW IF THE FIELD SHOULD BE THIS BIG OR IF IT SHOULD N THIS CONFIGURATION.
I DON'T KNOW. I OBVIOUSLY HAVE IDEAS BUT I DON'T KNOW. I WANT PROFESSIONALS TO TELL ME THIS IS THE BEST WAY TO DO IT. AND WHEN YOU PUT TWO QUALIFIED PROFESSIONALS TOGETHER, I CAN FEEL MANUFACTURE COMFORTABLE THAT -- MORE COMFORTABLE THAT I'M BEING PRESENTED WITH THE RIGHT COST OR WHATEVER AND I CAN SIT BACK AS I SHOULD AS AN EXECUTIVE TO KIND OF SAY I HAVE FAITH IN WHAT YOU'RE DOING.
THAT'LLS WHAT I LOVE ABOUT THIS PROCESS.
I'M REALLY EXCITED TO SEE I'M READ I DID TO GET TO THE NEXT STEPS SO WE CAN SEE WHAT IT'S -- WHAT MORE IT'S GOING TO LOOK LIKE AND BE ABLE TO EVALUATE THAT.
SO THANK YOU VERY MUCH FOR CHOOSING THIS PROCESS.
COMMISSIONER. >> I HAVE -- I MEAN, I AGREE WITH YOU. THE AT RISK DEPENDING UPON THE SITUATION HAS A LOT OF FLEXIBILITY.
I MEAN, OBVIOUSLY WHEN YOU HAVE YOUR ARCHITECT AND YOUR CONSTRUCTION MANAGEMENT TALKING TOGETHER CLEARLY I MEAN DOING SOME RESEARCH FROM THE STANDPOINT ARCHITECTS WILL TELL YOU FORM FOLLOWS FUNCTION. SOL YOU CAN CREATE THE GREATEST THING BUT IF YOU CAN'T ACTUALLY UTILIZE IT, IT'S REALLY IRRELEVANT. BUT THE PART THAT I WANTED TO BRING UP HERE BECAUSE TODAY WE'RE APPROVING THE RANKINGS.
AND I ASKED JEFF FOR INFORMATION REGARDING HOW WE RANK AND WHO DID WHAT AND I THINK COMMISSIONER ISRAEL BROUGHT UP ON ONE OF THE RANKINGS A COUPLE OF MONTHS AGO WAS WE HAD PEOPLE FROM OTHER CITIES THAT WERE COMING INTO PLAY.
ILL JUST GIVES ME A LITTLE BIT OF A REASON TO PAUSE.
NOT THAT I DISAGREE WITH THE RANKINGS THEMSELVES BUT THE
[00:50:01]
OUTSIDE PERSON. THERE WERE A LOT OF DISPARITIES BETWEEN WHAT SABRINA YOU HAD AS FAR AS RANKING THE BIDDERS.AND I JUST HAD THIS CONCERN. THIS MAY BE A PROCUREMENT TYPE OF SITUATION WHERE IF WE'RE GOING TO GO OUTSIDE MAYBE INSTEAD OF JUST HAVING ONE PERSON WE HAVE THREE OR FOUR TO GIVE THAT VARIETY BECAUSE YOU DON'T WANT IT TO BE WHERE AGAIN SOMEBODY COULD BE USING IT FROM A DIFFERENT CITY AND SAYING I HAD A BAD EXPERIENCE WITH COMPANY X, Y, Z.
SO THEREFORE I'M GOING RANK THEM ON A LOWER LEVEL.
AND HERE IN PARKLAND WE'VE HAD A GREAT EXPERIENCE.
SO IT KIND OF -- THAT CHECKS AND BALANCES DEPENDING UPON HOW MUCH CHECK YOU HAVE AND HOW MUCH BALANCES COULD TIP THE SCALES IN A WAY THAT MAY NOT BE BENEFICIAL PTO US.
S I JUST BRING THAT UP. OTHERWISE, I MEAN, MY COMMENT
WOULD BE MOTION TO APPROVE. >> DURING THE --
>> DO WE HAVE A SECOND? >> SECOND.
>> THANK YOU >> SO WE HAVE A -- ANYONE FROM THE UBLIC WISH TO SPOKE ON THIS ITEM? SEEING THAT THERE'S NONE WE HAVE A MOTION TO APPROVE BY COMMISSIONER MAYERSON AND SECOND BY COMMISSIONER ISRAEL.
>> COMMISSIONER MAYERSON. >> YES.
>> COMMISSIONER ISRAEL. >> COMMISSIONER CUTLER.
>> PLEASE SHOW PASSES UNANIMOUSLY.
THANK YOU VERY MUCH. >>> ITEM 10 B.
RESOLUTION 2023-045, PROPOSED MILLAGE RATE.

AND FINALLY ITEM 10 E, FY 2024 INITIAL STORM WATER MANAGEMENT ASSESSMENT.

DIRECTING THE PRAZENICAS OF NOTICE.
PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE.
WE'LL NEED SEPARATE VOTES ON EACH ITEM.
>> CHRIS JOHNSON. WELCOME TO THE 2024 FIRST BUDGET MEETING. THIS IS THE FIRST STEP IN A MONTH'S LONG PROCESS. HERE'S THE CALENDAR FOR THE NEXT FIVE MEETINGS. TONIGHT WE'RE HERE TO VOTE ON A MAXIMUM MILLAGE RATE SENT TO THE BROWARD COUNTY PROPERTY APPRAISER. ALSO THE FIRE ASSESSMENT RATE, SOLID WASTE RATE, AND THEN THE STORM WATER ASSESSMENT RATES AS WELL. AFTER THIS WE WILL HAVE A RESIDENT WORKSHOP ON AUGUST 9TH. WE WILL FOLLOW THAT UP A WEEK LATER WITH A WORKSHOP WHERE YOU ALL WILL HAVE YOUR FEEDBACK.
YOU WERE GIVEN YOUR BUDGET BOOKS FOR TONIGHT.
[00:55:01]
TAKE -- SUMMER BREAK. AND ON AUGUST 16TH IT WILL BE YOUR TURN TO ANY QUESTIONS YOU ALL MAY HAVE TO SEND THEM OUR WAY. THEN ON SEPTEMBER 13TH AT 7:00 P.M. THAT WILL BE THE SECOND READING OF THE FIRE SOLID WASTE AND STORM WATER ASSESSMENTS AND THAT WILL BE THE ORDINANCE TO ADOPT THE BUDGET AND MILLAGE RATE AND THEN ON SEPTEMBER 20TH THAT MEETING IS A LITTLE BIT DIFFERENT STARTING AT 6:00 O'CLOCK. THAT WILL BE THE FINAL ORDINANCE TO ADOPT THE 2024 BUDGET AND MILLAGE RATE.SO WITH THAT BEING SAID, FOR THE CURRENT YEAR WE RECEIVED OVER 14% INCREASE IN OUR PROPERTY VALUE.
WHAT DOES THAT MEAN FOR US? WE'RE GOING TO GET AN ADDITIONAL ALMOST 3.7, $3.8 MILLION IN REVENUE.
BASED ON A PROPERTY VALUE OF ABOUT 7.5, $7.6 BILLION.
SO JUST FROM LAST YEAR TO THIS YEAR OUR PROPERTY VALUES INCREASED ALMOST A BILLION DOLLARS.
AND OF THAT ABOUT $600 MILLION WAS FROM EXISTING VALUES AND LITTLE OVER $300 MILLION CAME FROM NEW CONSTRUCTION.
SO THAT KIND OF WORKS OUT TO 80% OF OUR HOMES HAVING HOMESTEAD EXEMPTION. WE HAVE ONE OF THE LOWER EXISTING INCREASES IN THE COUNTY.
THAT'S BASICALLY ALL THE RESALES THAT WENT ON THROUGHOUT THE YEAR. I WANT TO POINT THIS OUT THAT ONCE WE GET THE BUILD OUT HERE THAT 3% CAP IS PROBABLY ABOUT WHAT OUR ADD VERY ALREADY RUM INCREASE WILL BE.
I ALWAYS WANT TO REITERATE THAT FOR YOU AND MEMBERS OF THE PUBLIC LISTENING AT HOME. SO IN THIS BUDGET WE'RE PROPOSING THE SAME MILLAGE RATE AS 4.2979 BASED ON THAT $7.5 BILLION BASE. AND AS OF RIGHT NOW THE APPROXIMATE ROLE IS ABOUT 4.135 MILS.
SO THE NEXT PART OF THE PROCESS IS THE FIRE ASSESSMENT.
BASED ON THE PREVIOUS DISCUSSIONS OF PREVIOUS PLANNING SESSIONS, YOU ALL GAVE US GUIDANCE TO INCREASE THAT FEE BY OUR FIRE CONTRACT. THAT CORRESPONDS TO ABOUTAL DOLLAR $417 TO $431.64.
AND THEN THIS YEAR FOR THE FIRST TIME THIS IS KIND OF THE CULMINATION OF THE STORM WATER PROCESS.
THIS IS THE FIRST HEARING FOR THE ACTUAL RATES ORDINANCES WERE PASSED IN MAY AND JUNE AND WE'RE GOING TO COLLECT ABOUT $500,000 IN REVENUE DIRECTLY RELATED TO STORM WATER SERVICES.
SO BRINGING THIS UP MENTIONING THE PAST STRATEGIC PLANNING SESSIONS AND ALSO PAST BUDGET PRESENTATIONS IS THAT AT SOME POINT IN TIME DOWN THE ROAD ONCE WE GET TO BUILD OUT THAT 3% CAP OF OUR REVENUE KICKS IN AT SOME POINT IN TIME, CONTRACTUAL INCREASES FOR FIRE AND POLICE WILL OUTWEIGH THE REVENUE WE GET FROM ADD VEALORUM GROWTH. POSSIBLY 2026 WHEN THAT COULD
[01:00:02]
KICK IN POSSIBLY. RIGHT NOW, VELORUM -- IT WOULD BE JUST OVER $700,000 AND AS MENTIONED IN THE PAST ANY OF THOSE FUTURE DECISIONS WILL BE DISCUSSED AT FUTURE PERHAPS PLANNINGS SESSIONS. WITH THAT I WILL TAKE ANY QUESTIONS Y'ALL MAY HAVE BUT FIRST I WANT TO GIVE A SPECIAL SHOUTOUT TO -- [APPLAUSE] SHE WAS INSTRUMENTAL IN PUTTING THIS ALL TOGETHER.SHE ALWAYS DOES A PHENOMENAL JOB ON THE BUDGET AND GRANT SIDE AND SHE'S A VERY VALUABLE ASSET TO THE CITY.
I WANT TO MAKE SURE SHE GETS THE RECOGNITION SHE SO DESERVES.
>> THANK YOU VERY MUCH, CHRIS. I WANT TO JUST HIGHLIGHT A COUPLE OF THINGS THAT YOU BROUGHT UP JUST SO IT'S ON THE RECORD FROM US AS WELL. 83% OF PARKLAND RESIDENTS ARE HOMESTEADED. AND A LOT OF PEOPLE SAY WELL THE HOME VALUES ARE GOING SO HIGH AND PARKLAND IS GOING CRAZY.
WHY WOULD WE EVER NEED TO RAISE TAXES.
8 #% OF OUR HOMES ARE HOMESTEADED MOONING THE 3% CAP ON PROPERTY TAXES. THAT AFFECTSES CITIES.
YOU DON'T HAVE TO PAY ADDITIONAL TAXES.
AS A CITY IT'S A BIT MORE DIFFICULT BECAUSE YOU DON'T COLLECT AS MUCH MONEY. SO CHRIS POINTED OUT WHICH IS IMPORTANT FOR RESIDENTS TO UNDERSTAND, AS MUCH AS HOME VALUES HAVE GONE UP IN PARKLAND WHICH IS EXTRAORDINARY WHICH IS GREAT FOR ALL OF US, WE WERE ONE OF THE LOWEST -- WE HAD ONE OF TO LOWEST PERCENTAGE INCREASES IN ALL OF BROWARD COUNTY AS FAR AS PROPERTY TAXES. CHRIS ALSO POINTED OUT THAT OUR FIRE AND POLICE SERVICES, THOSE INCREASES WILL OUTPACE OUR AD VELORUM INCREASE. WE'VE ALL ACKNOWLEDGED AND ARE DOING WHAT WE CAN AND THIS PROJECT IS ONE OF THE THINGS THAT WE'RE LOOKING TO DO TO DIVERSIFY SOME OF OUR REVENUE.
SO WE'RE WORKING ON THAT. THERE'S A STORAGE FACILITY THAT WE'RE CONSIDERING. WE ARE LOOKING FOR ALTERNATE MEANS OF REVENUE. BUT IT IS SOMETHING WE NEED TO BE CONSCIOUS OF AND WE NEED TO MAKE SURE RESIDENTS KNOW WE UNDERSTAND WE'RE MAKING SOME ADJUSTMENTS AS BEST WE CAN.
BUT AT SOME POINT WE MAY BE IN A POSITION WHERE WE CAN'T DO THAT.
SO SOMETIMES WHEN WE THINK OUTSIDE THE BOX, WE'RE DOING THAT BECAUSE I FOR ONE AND I'M SURE THE REST OF YOU AGREE WE DON'T WANT TO BE THE ONES WHO HAVE TO RAISE OUR MILLAGE RATE IF WE CAN AVOID IT. SO THAT'S ONE OF THE THINGS WE'RE TRYING TO DO. DOES ANYBODY HAVE ANY QUESTIONS?
>> I DON'T HAVE A QUESTION. I JUST HAVE COMMENTS.
I GIVE YOU GUYS SO MUCH CREDIT BECAUSE ONE OF THE HARDEST THINGS I THINK FOR ANY ORGANIZATION IS MANAGING YOUR FINANCES. DOESN'T MATTER WHAT IT IS.
WHAT KIND OF BUSINESS OPERATION. AND AS A RESIDENT, I CAN'T TELL YOU HOW PLEASED I AM TO COME INTO A BRIEFING MEETING AND HAVE OUR CITY MANAGER TELL ME THAT SHE RECOMMENDS -- IT JUST MAKES THEIR LIFE EASIER BALANCING A BUDGET.
AND MORE IMPORTANTLY IS IF YOU LOOK AT ALL THE THINGS THAT WERE DONE OVER THE COURSE OF THIS BUNTS YEAR WHETHER IT'S PINE TRAILS, LIBERTY PARK IS STARTING.
SO MANY BIG PROJECTS AND TASKS TAKEN ON AND YET WE'RE STILL IN A POSITION TO BE ABLE TO TELL RESIDENTS OF THE CITY THAT WE'RE NOT GOING TO ACTUALLY RAISE YOUR TAXES.
DESPITE THE OTHER BIG PROJECTS SO I WANT TO MAKE SURE GOING BACK TO WHAT THE MAYOR SAID EARLY ON THAT CREDIT IS GIVEN WHERE CREDIT IS D DUE BECAUSE CITY STAFF IS ALL INVOLVED IN MAKING SURE THEIR BUDGET IS CONTROLLED.
OBVIOUSLY THE FINANCE DEPARTMENT KND OF QUARTER BACKS IT.
I'M NOT JUST AT A COMMISSIONER. AISLE A RESIDENT WHO ALSO DOESN'T LIKE TAXES RAISED. SO THANK YOU ALL.
I HOPE THAT WE CAN CONTINUE ON THIS PATH.
I RECOGNIZE IT'S NOT ALWAYS GOING TO BE THIS EASY BASE ON THE WAY THINGS ARE JUST BY VIRTUE OF OUR CITY BEING A BEDROOM CITY BUT FOR NOW, IT NEEDS TO BE STATED THAT YOU GUYS ARE SOME OF THE BEST I THINK IN THE COUNTY IF NOT THE STATE.
[01:05:02]
VICE MAYOR. >> I WANT TO ECHO THOSE COMMENTS. I DON'T WANT TO STEP ON OUR HISTORIAN'S THUNDER HERE BUT I'LL CHANNEL MY INNER CUTLER.
WHEN WE STARTED AS A CITY IN PARKLAND IT WAS MINIMAL SERVICES AND WE HAVE GROWN AS A CITY AND AS A RESULT DEMANDS HAVE GROWN.
MY FAMILY FIRST CAME HERE THERE WERE NO PARKS AND NOW WE'RE TALKING ABOUT A NEW ONE. TO DO THAT AND I LOVE THE SLIDE YOU NORMALLY HAVE CHRIS AND I KNOW YOU'LL HAVE IT WHERE YOU SHOW THE MILLAGE RATES OF OTHER CITIES IN THE NEIGHBORING COMMUNITIES TO DO THAT AND KEEP OUR MILLAGE RATE HERE BECAUSE WE AS A COMMISSION HAVE DEMANDED A LOT OF OUR STAFF IN THE LAST FEW YEARS IN TERMS OF IMPROVING OUR PARKS AND FIXING OUR ROADS AND TACKLING AS THE MAYOR SAID EARLIER TOUGH ISSUES WHICH OFTEN REQUIRES MONEY AND TO DO THAT AND KEEP OUR MILLAGE RATE WHEN IF OUR RESIDENTS BENEFITTED BY NOT ONLY A LOW MILLAGE RATE BUT A HIGHER PROPERTY VALUE PICKED UP THEIR HOUSE AND MOVED IT INTO ANOTHER CITY NEARBY OR MANY OTHER CITIES NEARBY THEY WOULD BE PAYING MORE IN TAXES. SO TO DO THAT AND KUDOS TO ALL OF OUR CITY STAFF FOR ACCOMPLISHING THAT BECAUSE TO DO THAT ALONG WITH WHAT WE'VE ASKED OUR CITY STAFF TO DO IN TERMS OF PROVIDING MORE SERVICES, IMPROVING OUR PREACHINGS AND INFRASTRUCTURE FOR OUR RESIDENTS IS AN ACCOMPLISHMENT.
>> SO I AGREE. IT'S NO EASY TASK TO HAVE A BALANCED BUDGET. IT'S NOT LIKE A BUSINESS WHERE YOU GOT MORE REVENUE HERE OR WHATEVER IT IS.
THIS COMES A BALANCE BUDGET SO EVERY PIECE OF THE PIE THAT WE DECIDE TO MOVE CREATES ANOTHER THING.
IN FACT, INTERESTING ENOUGH I WAS IN LIGHT HOUSE POINT AS I SAID LAST NIGHT AND IT CAME TO I THINK FIRE ASSESSMENT FEE.
SO THEY WERE AT $272.13, SOMETHING LIKE THAT.
DON'T QUOTE ME. AND ONE COMMISSIONER SAID CAN'T WE MAKE IT 275 OR 270 AND THE CFO SAID WE COULD BUT YOU GOT A BALANCED BUDGET SO EVERY LITTLE THING TWEAKED INTO SOMETHING ELSE AND THE MATRIX IS BECAUSE THEY ASSIGN ITEMS WHERE X AMOUNT OF DOLLARS FOR CAPITAL AND IT BECOMES A DIFFICULT THING.
WE LOOK AT THESE BUDGET BOOKS AND SIT THERE JUST BE MINDFUL THAT EVERY LITTLE BECAUSE NANCY AND I HAVE HAD THIS DISCUSSION FOR NUMEROUS YEARS. EVERY TWEAK YOU WANT TO MAKE CREATES AND SNOW BALLS INTO ANOTHER.
KUDOS TO YOU HER BARRIE. I KNOW YOU'RE ALWAYS LOOKING FOR MONEY SO THANK YOU. APPRECIATE THAT.
>> IS THERE A GRANT FOR THAT ARE?
>> JUST A COUPLE OF THINGS THAT I JUST WANTED TO POINT OUT.
SO, AGAIN, SOLID WASTE ASSESSMENT FEE.
I KNOW THAT WE'RE GOING TO PROBABLY BE LOOKING AT IN ANOTHER YEAR RENEGOTIATING WITH WASTE MANAGEMENT.
JUST LOOKING AT THIS WHEN YOU'RE AT $91.33 FOR DISPOSAL FEE, HOPEFULLY IF THIS AUTHORITY MOVES FORWARD IN TAKING PLACE HOW IT WORKS OUR DISPOSAL FEE WILL COME DRAMATICALLY DOWN.
NOW I CAN'T PROMISE THE HOLDING FEE WILL NOT GO UP BUT THE DISPOSAL FEE WILL GO DOWN AND HOPEFULLY THERE'S THE BALANCE TOO MAKE THAT HAPPEN. TAT'S NUMBER ONE.
THE STORM WATER MANAGEMENT FEE, I KNOW THERE IS SOME CONCERN FROM RESIDENTS OF WHAT IT'S BEING USED FOR OR WHATEVER.
BUT, AGAIN, WE SPENT A LOT OF TIME STAFF SPENDS A LOT OF TIME MAINTAINING OUR CANALS AND INFRASTRUCTURE.
AND THIS IS SOMETHING THAT I DEFINITELY THINK AND AGAIN THE WAY WEATHER IS GOING RAIN DOESN'T SEEM LIKE IT'S SUBSIDING OR THE AMOUNT OF RAIN WE HAD AND GETTING BACK TO TINS THING IT'S GOING IN A DIRECTION WHERE THE HUNDRED YEAR STORMS ARE BECOMING NORMAL AND NOT NECESSARILY THAT AN EVENT THAT HAPPENS EVERY HUNDRED YEARS. AND THEN FINALLY WE'LL GO TO THE FIRE ASSESSMENT FEE. I JUST WANT TO BE CLEAR THAT I'M NOT OPPOSED TO A FIRE ASSESSMENT FEE BUT I CAN'T SUPPORT THE METHODOLOGY THAT WE'RE CURRENTLY USING.
>> WHERE DID THAT COME FROM? >> IT'S NEW TO ME.
IT'S NEW INFORMATION. >> BUT THE OTHER THING THAT I WANT TO POINT OUT AND I KNOW THAT THERE IS SOME CONVERSATION WHICH I THINK AGAIN WILL BENEFIT US AS A CITY AS WELL AS THE RESIDENTS IN THE GEOGRAPHICAL AREA OF CORAL SPRINGS PARKLAND, COCONUT CREEK IS POSSIBLY LOOKING AT A FIRE DISTRICT WHICH NOT ONLY COVERS FIRE ASSESSMENT BUT COVERS EMS WHICH THIS FIRE FEE DOES NOT. SO I KNOW THERE'S CONVERSATIONS AND DIFFERENT PHILOSOPHIES, ANGST WITH IT BUT I THINK IF
[01:10:03]
THAT IS SOMETHING THAT CAN COME TO FRUITION I THINK IT WILL BENEFIT ALL COMMUNITIES. SO I HOPE THAT COMES TO FRUITIONAND THOSE ARE MY COMMENTS. >> OKAY. THANK YOU.
>> COMMISSIONER CUTLER. >> THANK YOU, MAYOR.
SO I'M GOING TO SAY TO EVERYBODY THE SAME THING WITHOUT SAYING IT. GREAT JOB.
OKAY. WHAT I WANT TO SAY THOUGH TO THE PUBLIC IS THAT THE COMMISSION HERE HAS SAID A LOT OF GREAT THINGS ABOUT WHAT YOU GUYS HAVE DONE BUT THE PROOF IS IN THE PUDDING.
SO ALL THE MATERIALS, BUDGET BOOKS, AND ALL THE BACK UP INFORMATION AND THE DATA THAT HAS BEEN ACCUMULATED AND ASSESSED AND PUT TOGETHER IS ALL AVAILABLE FOR THE PUBLIC TO VIEW. IT'S ON THE WEBSITE.
>> THIS WILL BE ON THE WEBSITE TOMORROW MORNING.
>> IT'S ON THE WEBSITE. YOU'LL HAVE AN OPPORTUNITY TO LOGE AT ALL THE MATERIALS -- LOOK AT ALL THE MATERIALS AND BACK UP INFORMATION AND NOT JUST TAKE OUR WORD FOR IT.
WE'RE NOT UP HERE BLOWING OUR OWN HORNS HERE.
THIS STUFF IS REAL AND WE'VE DONE REALLY GAD JOB WITH IT AND -- GOOD JOB WIT SO I'M PROUD OF YOU GUYS FOR DOING THAT AND I WANT THE PUBLIC TO BE AWARE OF THE FACT THAT THEY HAVE ACCESS TO THIS. WE AS ALWAYS WOULD LIKE ANY COMMENTS THAT THEY HAVE SO THAT WE CAN GO AHEAD AND MOVE FORWARD COLLECTIVELY AS A CITY NOT JUST AS A COMMISSION BUT AS A CITY IN DOING WHAT WE NEED TO DO FROM A BUDGETARY STANDPOINT.
GREAT JOB, GUYS. >> ALL RIGHT.
THANK YOU. >>> SO DOES ANYBODY -- WE'LL START WITH ITEM B, ANYBODY WANT A MOTION?
>> MOTION TO APPROVE 10 B. >> WHAT ARE WE APPROVING IT AT?
>> MAXIMUM MILLAGE RATE. >> 4.2979.
WHICH IS WHAT IT IS CURTLY. ANYONE FROM THE PUBLIC WISHING TO SPEAK ON REGULAR AGENDA ITEM B? SEEING THAT THERE'S NONE WE HAVE AN APPROVAL BY ITEM B.
>> JUST THE ONE. >> SO WE HAVE A MOTION TO APPROVE ITEM B. AND A SECOND.
ROLL CALL. >> COMMISSIONER ISRAEL.
>> YES. >> COMMISSIONER CUTLER.
>> YES. >> COMMISSIONER MAYERSON.
>> YES. PLEASE SHOW PASSES UNANIMOUSLY.
>> MOTION TO APPROVE. >> SECOND.
>> ANYONE FROM THE PUBLIC? ITEM C.
SEEING THERE'S NONE MOTION TO APPROVE BY COMMISSIONER CUTLER AND SECOND BY COMMISSIONER ISRAEL.
>> I WONDER HOW THIS WILL GO. >> COMMISSIONER CUTLER.
>> YES. >> COMMISSIONER MAYERSON.
>> NO. >> COMMISSIONER ISRAEL.
>> BE CLEAR, YES. >> VICE MAYOR.
>> YES. >> PLEASE SHOW PASSING 4-1.
>> ANYONE FROM THE PUBLIC? ITEM D.
SOLID WASTE. MOTION TO APPROVE BY COMMISSIONER MAYERSON AND SECOND BY THE VICE MAYOR.
>> ROLL CALL. >> COMMISSIONER MAYERSON.
>> YES. >> COMMISSIONER ISRAEL.
>> YES. >> COMMISSIONER CUTLER.
>> YES. PLEASE SHOW PASSING UNANIMOUSLY.
>>> ITEM E. ANYONE FROM THE PUBLIC WHO WOULD LIKE TO COME SPEAK? COME ON.
>> I ACTUALLY HESITATE TO COME UP HERE BECAUSE YOU'RE ALWAYS SO POSITIVE ABOUT EVERYTHING AND I'M GOING TO THROW THIS NEGATIVE VIBRATION IN HERE. I DON'T REALLY -- I DON'T MIND THE FEE. I BELIEVE I SHOULD PAY FOR WHAT I GET. BUT WHAT I DON'T LIKE IS PAYING FOR WHAT SOMEBODY ELSE IS GETTING.
THE ASSESSMENT AS FAR AS I CAN TELL I AGREE WITH THE PROGRAM MANAGEMENT REGULATORY COMPLIANCE AND THE OPERATION AND MAINTENANCE WHICH COMES TO 3754. I BELIEVE I SHOULD PAY FOR IT AND EVERYBODY ELSE SHOULD BUT IT'S THE OTHER STUFF I DON'T AGREE TO. WHERE YOU CAME UP WITH THIS $500,000. I MEAN, YOUR OWN STAFF SAYS BASED ON REVIEW OF DISCUSSIONS WITH STAFF THE CITY SPENDS APPROXIMATELY $100,000 PER YEAR TO ADDRESS STORM WATER RELATED FUNDING PROJECT AS AND REPAIR WORK.
THESE PROJECTS INCLUDE TURN BRIDGE, COUNTRY ACRES, PARKWOOD,
[01:15:05]
RANCHES. TRIMMING.IT WERE RARE MEASURES TO MITIGATE FLOODING.
AND I ALSO HAVE TO MENTION THERE WAS NOT ANY MENTION IN THERE ABOUT PINE TREE ESTATES SO THEY SEEM TO BE OKAY. THE REASON I DON'T LIKE THIS IS BECAUSE YOU'RE SPENDING THE MONEY -- YOU HAVEN'T SPENT THE MONEY. YOU SAY IT'S $100,000 SO THE OTHER QUOTE IS BASED ON THE RATE STRUCTURE PROVIDED YOU SHOULD BE CHARGED 225 PER MONTH FOR EVERY RESIDENT NOT THIS 80 WHATEVER IT IS, 87 FOR PINE TREE I THINK. YOU HAVEN'T REALLY SPENT THAT MONEY. I'VE LOOKED AT YOUR BUDGET.
THERE'S A BUDGET MANUAL THAT TALKS ABOUT CODES.
AND THERE'S A STORM WATER AND FLOOD MANAGEMENT CODE IN THERE AND THERE'S NOT ONE ENTRY IN ANY BUDGET I'VE SEEN OR ANY OF THE EXPENSE REPORTS I'VE SEEN AND I'VE SEEN QUITE A FEW BUDGET EXPENSE REPORTS. YOU CAN ASK CHRIS BECAUSE HE GIVES THEM TO ME. THERE'S NOT ONE CODE IN THERE FOR STORM WATER MANAGEMENT. SO I DON'T SEE HOW YOU'RE GOING TO JUSTIFY CHARGING US FOR SOMETHING YOU'VE NEVER SPENT MONEY ON. I CAN'T AGREE WITH IT.
I WAS SURPRISED BOB DIDN'T SAY ANYTHING BECAUSE PINE TREE AND I THINK IT'S PARKWAY NINE WE'RE GOING TO BE PUT TOGETHER IN THE SAME GROUP AND PARKWAY NINE I THINK MENTIONED THEY GET SOME KIND OF VACUUM SERVICE FOR THEIR STORM DRAINS OR SOMETHING LIKE THAT. IF I WAS THEM I WOULD NOT WANT TO BE PUT IN THE PINE TREE GROUP BECAUSE THEY'RE GOING TO BE ASSESSED FOR OUR SWELLS AND ALL THIS OTHER MAINTENANCE STUFF THAT YOU GUYS ARE TALKING ABOUT. AND I THINK YOU'RE TALKING ABOUT REDOING THE SWELLS. CLEANING THEM UP AND THAT'S AN EXPENSE. I IMAGINE THESE PARKWAY NINE PEOPLE DON'T WANT TO PAY FOR THIS.
SO NSID HAS ANYWHERE FROM 15 TO 20 DIFFERENT GROUPS THAT THEY ASSESS DIFFERENTLY THROUGHOUT THEIR NSID AREA OUT IN THE WEDGE AND EVERYTHING. I THINK EACH COMMUNITY HAS THEIR OWN LITTLE ASSESSMENT. YOU GUYS NEED TO LOOK INTO SOMETHING LIKE THAT SO YOU SPLIT EVERYBODY UP SO THEY ONLY PAY FOR WHAT THEY GET BECAUSE THIS APPEARS TO ME THAT'S NOT GOING TO HAPPEN. PEOPLE ARE GOING TO PAY FOR
SOMETHING THEY'RE NOT GETTING. >> I'M ONLY GOING TO SAY THIS ON THIS PARTICULAR TOPIC BUT I WANT TO SAY PUBLICLY SO IT'S OUT THERE. WHAT WE'RE DOING IS A BETTER JOB MAINTAINING THE STORM WATER THROUGHOUT THE CITY.
THAT YOU NOW HAVE AN ABILITY TO HOLD US ACCOUNTABLE FOR THAT BECAUSE YOU'RE PAYING FOR THAT FEE.
WE ALSO TAKE SOME OF THOSE FUNDS THAT WE COLLECT AND USE THOSE FOR FUTURE CAPITAL PROJECTS. THE FIRST CAPITAL PROJECT THAT WE HAVE PLANNED ONCE THOSE FUNDS BECOME AVAILABLE FROM THIS ASSESSMENT IS IN PINE TREE. SO YOU WILL BE DIRECTLY IMPACTED POSITIVELY BY THIS PARTICULAR FEE.
SO IT WILL NOT BE IMMEDIATE AND ALSO KEEP IN MIND LIKE EVERY OTHER RATE AND FEE EVERY YEAR WE CAN REASSESS THAT.
SO THIS ASSESSMENT, THIS STUDY THAT WAS DONE THAT CAME UP WITH THIS ASSESSMENT IF WE GO TWO YEARS FROM NOW AND WE'RE FINDING OUT THAT THERE IS AN OVERAGE, WE CAN LOWER THE FEE AND CANCEL THE FEE AND DO THOSE THINGS. THERE ARE OPPORTUNITIES THIS WILL COME BACK YEAR AFTER YEAR. THIS IS SOMETHING THAT WE'RE GOING TO TRY. WE BELIEVE IT'S REQUIRED FOR THE ENTIRE CITY. AND THAT'S WHY WE'RE IMPLEMENTING IT. IT WAS RECOMMENDED BY OUR CONSULTANTS. THIS IS SOMETHING WE'VE BEEN WORKING ON FOR SEVERAL YEARS. THANK YOU VERY MUCH FOR YOUR
>> ANY OTHER COMMENTS FROM THE PUBLIC?
>> MOTION TO APPROVE. >> SECOND.
>> NOBODY WANTED TO LEAN TO THE MICROPHONE.
SO WE IS -- WE HAVE A MOTION AND SECOND.
>> COMMISSIONER ISRAEL >> YES.
>> COMMISSIONER CUTLER. >> YES.
>> COMMISSIONER MAYERSON. >> YES.
PLEASE SHOW PASSING UNANIMOUSLY. >>> ITEM 10 F.
ORDINANCE 2023-010 APPROVING PURCHASE AND SALE AGREEMENT WITH POLL BROTHERS INC. -- TOLL BROS INC. FOR 21 ACRES
[01:20:01]
OF LAND LOCATED ON THE HERON BAY GOLF COURSE SITE FURTHER DESCRIBED IN EXHIBIT 1 AUTHORIZING EXECUTION OF PURCHASE AND SALE AGREEMENT FOR THE SALE IN THE AMOUNT OF $375,000 PEREZ DID HE RECALL UNIT APPROVED -- RESIDENTIAL UNIT APPROVED ON THE PROPERTY. PROVIDING IMPLEMENTATION, CONFLICTS, AND EFFECTIVE DATE. THIS IS FIRST READING.I DID DO SOME DETAILED KEY BUSINESS TERMS IN THE BACK UP BUT IF YOU WOULD LIKE I'M HAPPY TO GIVE YOU AN OVERVIEW.
>> TOLL WILL DEPOSIT A QUARTER MILLION DOLLARS INTO ESCROW AND THE DUE DILIGENCE PERIOD WILL BEGIN THE 75 DAY DUE DILIGENCE PERIOD WILL BEGIN IF AND WHEN THIS AGREEMENT IS APPROVED BY THE COMMISSION ON SECOND READING.
DURING THE DUE DILIGENCE PERIOD TOLL WILL HAVE 75 DAYS TO CONDUCT INSPECTIONS AND INVESTIGATIONS DEEMED NECESSARY ON THE PROPERTY MAKE A DETERMINATION ON WHETHER THEY WANT TO PROCEED WITH THE SALE. THEY CAN TERMINATE THE AGREEMENT AND RECEIVE THEIR QUARTER MILLION DOLLARS BACK.
PRESUMING THEY DO NOT TERMINATE DURING THE DUE DILIGENCE PERIOD WITHIN THREE DAYS TO THE END OF THE PERIOD TOLL WILL MAKE THE NEXT THREE BUSINESS DAYS ANOTHER THREE QUARTERS OF A MILLION DOLLARS DEPOSIT SO THE CITY WILL HOLD $1 MILLION WITHIN THREE BUSINESS DAYS OF EXITING THE DUE DILIGENCE PERIOD.
AFTER THAT WE ENTER THE ENTITLEMENT PERIOD WHERE TOLL WILL HAVE 12 MONTHS TO OBTAIN THOSE FINAL DEVELOPMENT APPROVALS I SPOKE OF BEFORE. THERE IS AN ADDITIONAL AUTOMATIC THREE MONTH EXTENSION AFTER THAT 12 MONTHS IF TOLL DOCUMENTS TO THE CITY MANAGER THAT THEY ARE DILIGENTLY PURSUING THOSE ENTITLEMENTS TO FRUITION. SO FOR A TOTAL OF 15 MONTHS AFTER THE DUE DILIGENCE PERIOD. IN ADDITION TO THE MILLION DOLLARS DEPOSIT MENTIONED BEFORE, TOLL WILL ALSO BE GIVING $10,000 IN MONTHLY DEPOSITS DURING THE DUE DILIGENCE -- EXCUSE ME, DURING THE INVESTIGATION AND ENTITLEMENT.
THE $10,000 A MONTH IS NOT REFUNDABLE AND IS PAID DIRECTLY TO THE CITY NOT IN ESCROW. THE INTENTION IS PROBABLY FOR MAINTENANCE. THE AGREEMENT DOES PROVIDE FOR COOPERATION AMONG THE PARTIES GIVEN THAT THE CITY IS THE OWNER FE THE PROPERTY AND TOLL WILL BE SUBMITTING IF YOU APPROVE THIS THE DEVELOPMENT APPLICATIONS FOR THE CITY TO SIGN THOSE APPLICATIONS SINCE WE HAVE A TIMELINE HERE FOR THE CITY TO DILIGENTLY PROCESS THEIR APPLICATION AND FOR TOLL TO DILIGENTLY RESPOND TO REVIEW COMMENTS THE CITY PUTS OUT.
I SPOKE OF THE BUYER'S RIGHT TO TERMINATE AS TO DENIAL OF FINAL DEVELOPMENT APPROVES TO MAKE IT CLEAR AND YOU'VE PROBABLY HEARD ME STATE THIS BUT IF YOU SHOULD APPROVE THIS AGREEMENT YOU ARE NOT APPROVING THE UNDERLYING DEVELOPMENT OF THAT PROPERTY.
ALL OF THE DEVELOPMENT APPLICATIONS WILL -- ARE SUBJECT TO REVIEW BY THE DEVELOPMENT REVIEW COMMITTEE AND PLANNING AND ZONING DEPARTMENT. IT COMES TO YOU FOR REVIEW WITH PUBLIC HEARINGS, ET CETERA, DURING THE NORMAL MONTHS AND THE AGREEMENT EXPLICITLY STATES THAT THE APPROVAL OF ANY DEVELOPMENT AGREEMENTS IS NOT MANDATED BY THE AGREEMENT NOR IS ANY OTHER APPROVAL AND THAT SUCH APPROVALS ARE SUBJECT TO THE PROCESS UNDER FLORIDA LAW. ANTHONY, WHEN WE CLOSE GET THE MONEY THE CLOSING IS TO OCCUR WITHIN 30 DAYS FOLLOWING TOLL RECEIVING THOSE FINAL DEVELOPMENT APPROVALS THAT I
SPOKE OF BEFORE. >> SO I WANT TO MAKE SURE I
[01:25:52]
REPEAT WHAT I SAID ABOUT MARK BECAUSE HE'S HERE NOW.THIS IS THE FIRST STEP IN FINALIZING THIS CONTRACT SO TONIGHT AS ANTHONY SAID EARLIER, WE'RE MERELY APPROVING THE SALE OF THE PROPERTY. THIS FINAL SITE PLAN, HOW MANY HOMES, ALL THE COLORS, ALL THAT STUFF WILL ULTIMATELY GO THROUGH THE REGULAR PROCESS THAT ANY CONSTRUCTION WILL HAVE.
SO THAT IS GOING TO HAVE ITS OWN PROCESS.
TONIGHT, AGAIN, IT'S A HUGE STEP.
WE PAID $29 MILLION FOR 69 ANGERS AND WE'RE GETTING 19.5 FOR 21 ACRES. KUDOS TO US TO REALIZING AND UNDERSTANDING AND LISTENING TO WHAT THE RESIDENTS OF NOT JUST HERON BAY BUT THE CITY OF PARKLAND WAS ASKING FOR.
I SAID EARLIER, MARK, I APPRECIATE ALL THE HARD WORK THAT YOU AND YOUR BOARD HAS DONE TO PUT US IN THIS POSITION.
SO I WANT TO PUBLICLY THANK YOU NOW THAT YOU'RE HERE.
I LOOK FORWARD TO YOU WORKING WITH TOLL BROTHERS AND GETTING THAT WHOLE PROCESS STARTED TO WHERE THEY CAN BECOME PART OF THE COMMUNITY. THEY CAN HAVE ACCESS.
ALL THOSE THINGS THAT WE TALKED ABOUT EARLIER, WE'RE REALLY LOOKING FORWARD TO WORKING TOGETHER.
SO IT'S GOING TO BE GREAT. AND THEN WE HAVE THE CONSULTANT COMING FOR THE NEXT PHASE AND WE'LL BE DOING MUCH MORE WORKING TOGETHER. SO I'M LOOKING FORWARD TO IT.
THIS IS, AGAIN, THE FIRST STEP. TONIGHT REALLY WE SAID IT EARLIER. WE SHOULD BE VERY PROUD OF WHAT WE HAVE ACCOMPLISHED ALREADY IN THIS PROJECT.
AND WE HAVE A LOT MORE TO GO. A LOT MORE HE HAVE I HAVE LIFTING. -- HEAVY LIFTING.
BUT WE ARE POSITIVELY HEADED IN THE RIGHT DIRECTION.
AND WE HAVE POSITIVELY MADE THE RIGHT DECISION.
SO I'M LOOKING FORWARD TO WORKING WITH YOU GUYS TO GET US THROUGH THE FINAL PHASE OF NOT JUST THIS PORTION BUT THE TOWN CENTER PORTION BECAUSE I THINK IT'S GOING TO BE SOMETHING WE'RE GOING TO LOOK BACK TEN, 15, 20, 30 YEARS FROM NOW AND WE'LL BE ABLE TO SAY THAT WE WERE PART OF MAKING HISTORY.
>> I HAVE A QUESTION AND THEN COMMENTS.
ANTHONY, ONE OF OUR CONCERNS AS WE SHARED AT PRIOR MEETINGS IS AND THIS HAS NOTHING TO DO WITH TOLL BROTHERS BUT AS WE'VE TALKED ABOUT, HERON BAY STILL HAS COMMUNITIES WITHIN IT STILL NOT COMPLETED 20 PLUS YEARS LATER SO WE WANTED TO TALK ABOUT INCENTIVES OR DISINCENTIVES OR WHATEVER IF LANGUAGE IS WITHIN THIS CONTRACT TO ENSURE THAT TOLL BROTHERS IS DILIGENT AT COMPLETING THE PROJECTS BUILDING OUT THE PROJECT SO THE RESIDENTS DON'T FACE THOSE CIRCUMSTANCES IN THIS APPROXIMATE ESSENTIAL SUBDIVISION WE FACED IN OTHERS WITHIN HERON BAY.
>> I'M SURE LINDSEY HAS HER OWN THOUGHTS AND TOLL DOES TOO ABOUT HOW QUICKLY THEY WANT TO DEVELOP IT AND GET THIS SOLD BUT KEEP IN MIND A COUPLE OF THINGS. THE EASEMENT THAT WE'RE GRANTING THEM AT SEVEN AND A HALF YEARS FROM LAST MONTH IS ONLY A CERTAIN WINDOW FOR CONSTRUCTION BUT TO YOUR POINT, VICE MAYOR, WE DID HAVE THOSE DISCUSSIONS WITH TOLL AND WE WERE ABLE TO WORK OUT AN ADDITIONAL INCENTIVE OR DETERRENT AS YOU MAY LOOK AT IT WITH THEIR ATTORNEY. IT WILL BE COMING TO YOU FOR A SECOND READING BUT ESSENTIALLY RATHER THAN JUST LIKE A STRAIGHT PENALTY BECAUSE AS TOLL WILL TELL YOU IF THEY'RE IN A SPOT WHERE THEY HAVEN'T BUILT FIVE YEARS FROM NOW A CERTAIN AMOUNT OF HOMES, IT'S PROBABLY ECONOMY OR SOME OTHER REASON.
THAT'S THEIR POSITION. BUT WE WERE ABLE TO WORK OUT THAT FIVE YEARS FROM CLOSE FIELD GOAL THEY HAVEN'T PULLED AT LEAST 30 BUILDING PERMITS AT THAT POINT THEN ALL OF THE IMPACT FEES WOULD BE DUE ON ALL OF THE AMOUNT OF HOMES THAT
[01:30:01]
WOULD BE APPROVED. SO NORMALLY YOU PAY IMPACT FEES AS YOU PULL THERMIT. ALL RIGHT.AND THOSE IMPACT FEES ARE USED SO THAT THE CITY CAN PREPARE FOR THAT FORTH COMING DEVELOPMENT FRAY STRUCTURE AND OTHERWISE.
THAT NUMBER CAN BE QUITE SIGNIFICANT SO THAT ALL OF THAT WOULD BE DUE UP FRONT AS AN ADDITIONAL INCENTIVE TO KEEP IT
MOVE. >> AND SO WHILE IT'S NOT GUARANTEED THAT WE'RE GOING TO BUILD UP TO OR IT'S A MAXIMUM OF 52 HOMES IT'S ONLY USED FOR RESIDENTIAL PURPOSES.
THAT'S PART OF THE CONTRACT. >> CORRECT.
UNDER THE CONTRACT TOLL HAS TO SUBMIT DEVELOPMENT APPLICATIONS
OF NO MORE THAN 52 UNITS. >> I WANT TO ECHO THE MAYOR'S COMMENTS. THIS HAS BEEN A COMMUNITY EFFORT. I KNOW MARK AND THE ENTIRE BOARD OF HERON BAY BOTH PRIOR AND CURRENT MEMBERS HAVE LOST A WILL THE OF SLEEPLESS NIGHTS AND HAVE WORKED HARD, PROBABLY HARDER THAN THEY THOUGHT THEY'D WORK IN VOLUNTEER POSITIONS ON THIS PROCESS. WE'VE STILL GOT A LONG WAY TO GO BUT WE'RE ON THE RIGHT TRACK AND ARE WORKING TOGETHER AND COLLABORATIVELY SO HOPEFULLY THOSE WILL BE WELL AT THE ENDED TO. SO WITH THAT, MAYOR, THERE'S OTHER COMMENTS I'M READY TO MAKE A MOTION.
>> I'LL MAKE A MOTION TO APPROVE ITEM 10 F.
>> I JUST HAVE A COUPLE OF COMMENTS.
YOU CAN HAVE A SECOND. >> MAKE COMMENTS.
>> OBVIOUSLY AS WE ALL KNOW I WAS THE NO VOTE ON THIS AS WELL AS SOME OTHER NO VOTES. BUT I DO WANT TO TAKE A MOMENT TO THANK ALL OF YOU, ANTHONY, NANCY, STAFF, LINDSEY, MARK FOR THE WORK THAT YOU DID TO MAKE THIS HAPPEN.
IT IS DEFINITELY A TESTAMENT TO TRY TO PUT ALL THESE THINGS TOGETHER EVEN WITH NSID AND EVERYBODY ELSE.
SO KUDOS TO YOU ALL. ONE THING AS WE LOOKED AT THIS IS THAT AND AGAIN I UNDERSTAND YOU CAN'T HAVE COMPLETE CONTROL OVER EVERY ASPECT OF IT. BUT ONE THING THAT WAS PART OF MOVING FORWARD WITH THIS WAS WE WANTED TO CONTROL WHAT'S THERE.
SO THE FIRST COMMENT THAT I GUESS I HAVE AND I DON'T SEE IT BEING A PROBLEM BUT I ASK ANTHONY AND LINDSEY WHETHER OR NOT BECAUSE I DIDN'T SEE IT IN THE AGREEMENT BUT MY CONCERN IS, AGAIN, WE WANT TOLL BROTHERS TO BUILD HOMES.
WE WANT THEM TO BUILD THEM. WE DON'T WANT THEM FOR SOME ECONOMIC REASON TAKING THAT LAND AND SELLING IT TO SOMEBODY ELSE.
SO WHETHER OR NOT WE CAN MAKE SOME SORT OF RESTRICTED COVENANT FOR A PERIOD OF TIME I DON'T KNOW.
BUT I ASK YOU TO THINK ABOUT THAT AS WE IN THE SECOND READING IF THAT'S SOMETHING THAT THE COMMISSION WOULD DESIRE TO HAVE OR TOLL BROTHERS WOULD BE WILLING TO ACCEPT.
>> IT WAS ANY UNDERSTANDING THAT WAS PART OF THIS.
BECAUSE WE RAISED THAT AT A PRIOR MEETING THAT UNLIKE OTHER DEVELOPMENTS IN HERON BAY WHERE THEY SOLD IT OFF TO OTHER DEVELOPMENTS THAT TOLL BROTHERS WOULD PURCHASE, SUBMIT, AND
BUILD HOMES. >> IF IT'S -- IS IT IN THERE?
>> THERE IS NO RESTRICTIVE COVENANT ONCE YOU CLOSE.
SO AFTER THEY GET ALL THOSE DEVELOPMENT APPROVALS.
>> THEY CAN TURN AROUND AND SELL I IF THEY WANTED TO.
>> THEORETICALLY THEY COULD SELL IT THEREAFTER.
YOU CAN SPEAK TO TOLL AND SPEAK TO THEIR INTENT.
NOW IN TERMS OF SIGNING THE AGREEMENT DURING THOSE PERIODS THAT WE SPOKE OF WHICH WERE PROBABLY NOT CLOSING FOR ABOUT A YEAR AND A HALF THEY CAN ONLY SIGN IT TO AN AFFILIATE OF TOLL.
>> CERTAINLY THAT'S NOT OUR INTENT TO SELL ANY OF THE LAND.
SO YOU MEAN ULTIMATELY YOU HAVE CONTROL THROUGH THE ARCHITECTURAL PROCESS AND WE HAVE A MEETING WITH MARK AND ALL OF OUR ATTORNEYS TO TALK ABOUT HOW WE'LL BE JOINING THE COMMUNITY OF HOA SO THERE'S GOING TO BE ARCHITECTURAL CONTROLS THERE AS WELL. SO OUTSIDE OF THAT HAVE I DON'T KNOW THAT WE CAN DO ANYTHING CONTRACTUALLY TO GUARANTEE WE WON'T SELL THOSE LOTS DOWN THE ROAD.
[01:35:05]
BUT YOU STILL MAINTAIN CONTROL.LOT SIZE AND THAT'S ALL APPROVED.
I JUST DON'T SEE ANY MECHANISM TO GUARANTEE THAT IT WON'T BE
SOLD. >> I THINK IT'S A GOOD POINT, BOB, AND IF THERE'S NO OBJECTION FROM TOLL THEN I DON'T SEE WHY THERE SHOULD NOT BE A RESTRICTED COVENANT ON THE PROPERTY NOT ONLY JUST FOR THAT TOLL TO ULTIMATELY BE THE DEVELOPER BUT ALSO THAT THE LAND ONLY BE USED FOR RESIDENTIAL PURPOSES WHICH I
>> BUT I THINK BOTH OF THOSE IF WE'RE ALL ON THE SAME PAGE IT SHOULD NOT MATTER. I THINK IT'S JUST A BELT AND SUSPENDERS BECAUSE A LOT OF THOSE THINGS CAN CHANGE.
>> BUT A LOT OF THINGS COULD CHANGE.
WHAT IF SOMEBODY BUYS TOLL BROTHERS.
>> THEN THEY WOULD JUST STAND IN THEIR SHOES.
>> WELL I MEAN PER CONTRACT I MEAN IF WE DESIGN IF WE APPROVED THE DESIGNS AND WE APPROVED THE QUANTITY AND THE SITE PLANS, IF TOLL BROTHERS HAS SOMEONE ELSE BUILD IT DOES THAT REALLY --
>> YEAH, IT DOES BECAUSE A LOT OF THIS IS BASED OFF THE RELATIONSHIP OF MAKING SURE THAT IT'S NOT JUST THAT THEY PLAN IT OUT. IT'S THAT IT'S DEVELOPED AND THERE'S SOMEONE ON THE BACK END IN TERMS OF WARRANTY AND TAKING CARE OF CONCERNS AND ADDRESSING IT AND THAT WAS A LOT OF THE VOTE OF CONFIDENCE IN TOLL REPRESENTING THAT TO THE
COMMISSION AND THE COMMUNITY. >> HE DID THIS AND TOLD ME THAT
[01:41:11]
IN THAT PROCESS IT TOOK ABOUT THREE MONTHS TO COME TO THIS AGREEMENT. AS YOU KNOW, YOU KNOW, BOB, YOU'RE SAYING THIS TOO, THERE'S A LOT OF OTHER -- THERE'S LITTLE DETAILED PIECES HERE AND NOW WE HAVE TO WORK OUT FOR EXAMPLE, TOLL BROTHERS IS GOING TO HAVE TO DO A SURVEY INCLUDING THE COMMON AREA. IT'S JUST NOT THE BOUNDARIES HERE. IT'S THE PROPERTY, THE COMMON AREA. THERE'S GOT TO BE AN AGREEMENT BETWEEN US AT WHAT LEVEL OF COMPLETION WHETHER IT'S 80, 90% THEY TURN IT OVER. WE NEED TO WORK OUT WITH HIM BEFORE TURNOVER THAT THEY'RE DOING ALL THE MAINTENANCE FOR THE PROPERTY. THE CONCERN IS I HOPE EVERYTHING GOES QUICK HERE WITH ANTHONY AND THEIR ATTORNEY WITH THREE ATTORNEYS AND THE HOA BUT IT HAS TO BE -->> WE CAN HAVE THE SECOND MEETING --
>> I WOULD HOPE WE WOULD NOT CLOSE UNTIL THAT PART IS DONE.
>> JUST TO BE CLEAR I DON'T THINK WE'RE CLOSING FOR A YEAR
AND A HALF. >> OKAY. SO THAT --
>> YEAH. >> SO WE SHOULD BE ABLE TO WORK
IT OUT BY THEN. >> AND PRESUMING THAT THE DEVELOPMENT APPROVALS ARE APPROVE.
>> I THINK THIS ENTIRE DAIS' POSITION AND YOURS AS WELL THAT THIS DEVELOPMENT BE PART OF HERON BAY, A SUBDIVISION WITHIN
HERON BAY. >> YOU LIVE THERE YOU'VE SEEN ISSUES WE HAVE WITH THE TURNOVER.
>> BUT IF IT TAKES YOU THREE MONTHS MAYBE A YEAR AND A HALF.
THERE'S TIME. DON'T TAKE A YEAR AND A HALF.
>> DON'T EVEN TAKE THREE MONTHS. >> THERE'S PLENTY OF TIME BUT --
>> WE'RE WORKING TOGETHER. HER ATTORNEYS WILL COME TO THE TABLE WITH SOME IDEAS AND WE GET THIS PIECE DONE.
>> IT'S HARD TO START THE CONVERSATION UNTIL WE AT LEAST HAVE THIS AT LEAST TONIGHT UNLESS SOMETHING DRASTICALLY
CHANGES -- >> IT WASN'T BROUGHT UP THE $500,000 EASEMENT PART. IS THAT PART OF THIS?
>> THAT'S NOT. >> IT'S SOMETHING ELSE.
>> OKAY. WELL, I WAS GOING TO BRING THAT UP.
>> I DON'T KNOW WHEN THAT IS. >> WELL, HERE'S MY PERSPECTIVE.
AND I UNDERSTAND LIKE I SAID WHATEVER THE REASONS MAY BE.
BUT WE TALKED ABOUT THIS AND THE MAYOR MENTIONED THIS.
THIS IS A COMMUNITY THAT ALL GOT BEHIND THIS.
THERE ARE OBVIOUSLY SOME COMMUNITIES THAT BENEFIT MORE THAN OTHERS. BUT I WOULD LIKE TO SEE THAT HALF A MILLION DOLLARS AND I GO TO YOU AND YOUR BOARD IS TO CONSIDER DONATING THAT MONEY TO THE MEMORIAL FUND OR WHATEVER IT IS THAT'S RIGHT IN BACK OF HERON BAY TO BUILD THERE.
THAT'S WHERE I WOULD LIKE TO SEE THIS GO.
NOW, WE DON'T HAVE ANY JURISDICTION OVER IT.
I'M ONLY ASKING YOU TO CONSIDER IT.
AND THAT'S WHY I WOULD HOPE THAT BETWEEN NOW AND THAT SECOND READING YOUR BOARD AND THE COMMUNITY WOULD MAKE THAT AFFIRMATIVE. AND THAT'S WHY TONIGHT I'M NOT GOING TO SUPPORT THIS ONLY BECAUSE OF THAT REASON.
SO I'M GIVING YOU TIME BETWEEN NOW LIKE I SAID I'M NOT ASKING
FOR -- >> BOB, I RESPECT YOU AND I KNOW THAT WAS YOUR REASON AT THE PRIOR READINGS TOO.
>> YOU DON'T HAVE TO GIVE ME AN ANSWER TONIGHT.
JUST BRING IT BACK TO YOUR BOARD.
HAVE A CONVERSATION. SEE WHERE THEIR THOUGHTS ARE AT.
>> I WILL DO THAT. I KIND OF KNOW WHERE THEIR
THOUGHTS ARE AT. >> AGAIN, YOU KNOW, THIS WAS A -- THE WHOLE THING THIS WAS A COMMUNITY ISSUE.
THERE ARE A LOT OF COMMUNITIES THAT VOICE DIFFERENT OPINIONS.
[01:45:04]
I MEAN, WE EVEN TALKED ABOUT THIS ON HOW TO KIND OF FRAME IT IN SOME ASPECT WHERE IT DIDN'T PUT THIS COMMISSION IN A PICKLE WHERE EVERY TIME SOMETHING HAPPENED ONE COMMUNITY WOULD WANT SOMETHING AND ANOTHER COMMUNITY WOULD WANT SOMETHING.WE WERE VERY CLEAR. AND I DO HAVE TO INTERRUPT YOU THERE. WE WERE VERY CLEAR THIS WAS NOT FOR HERON BAY. THIS WAS FOR THE COMMUNITY.
AND WHILE WE DID USE CITY FUNDS THE CITY WILL BE REIMBURSED AND THEN SOME. THE CITY WILL BE MAKING MONEY ON THIS DEAL AND WILL NOT BE UNDER WATER WHERE HERON BAY IS MAKING MONEY. THIS WAS NOT DONE FOR HERON BAY.
THIS WAS DONE FOR THE CITY OF PARKLAND.
AND THE CITY WILL BE FULLY PAID AND THEN SOME.
>> RIGHT. >> JUST TO BE CLEAR.
>> WELL, TO BE CLEAR, HERON BAY WILL BE RECEIVING THE FUNDS.
HERON BAY HAS A RIGHT TO USE THOSE FUNDS AS --
>> AND THEY'RE ALSO GIVING UP COVENANTS THEY DIDN'T HAVE TO GIVE UP AND OTHER THINGS LIKE THAT.
>> AGAIN, NOT GOING TO GET INTO THE DEBATE BUT IF THEY --
>> WE'VE ALREADY HAD THE DEBATE. YOU'VE BEEN CLEAR THAT YOU WOULD LIKE TO DO THAT TO THE MEMORIAL COMMITTEE.
MY PERSONAL OPINION I'M GOING TO LEAVE IT AT THAT.
SO WE'LL LEAVE IT AT THAT. YOU WEREN'T GOING TO VOTE FOR THIS ANYWAY. YOU HAVEN'T VOTED FOR A THING ON THIS ENTIRE PROCESS. AND HERE YOU ARE TELLING HIM I'M NOT GOING TO VOTE FOR IT BECAUSE I WANT YOU TO GIVE $500,000.
I WOULD VOTE FOR IT IF YOU GAVE THE $3,500,000 EVEN THOUGH I'VE VOTED NO FROM THE BEGINNING ON EVERYTHING.
>> BUT WE HAVEN'T EVEN VOTED ON A SECOND READING, RICH.
>> OKAY. SO I POINTED IT OUT. >> OKAY. IF SOMEBODY ELSE CAME ALONG AND SAID I AGREE WITH THAT, THEN WE'RE 3-2 VOTE.
>> OKAY. >> MARK WILL TAKE IT BACK TO HIS BOARD BUT I IMAGINE THERE ARE COSTS THAT THE HOA WILL HAVE TO
ABSORB. >> 300,000 IN THIS ALREADY.
>> THAT'S ALL. >> DO YOU HAVE ANYTHING ELSE?
>> I GOT SOME COMMENTS. >> GO AHEAD.
>> I'M GOING TO ECHO A LOT OF WHAT THE MAYOR SAID EARLIER ON IN IN MEETING WHICH IS PUT AGO SIDE FOR NOW JUST EVEN THIS PROJECT, THERE'S A LOT OF COMMISSIONERS COUNCIL MEMBERS, WHATEVER YOU WANT TO CALL IT, WHO FIND IT EASY TO NOT MAKE DECISIONS. THE HARD DECISIONS.
BECAUSE OF POLITICAL SAFETY. GIVES THEM THE ABILITY TO SAY THAT WASN'T MY FAULT. THAT WASN'T MY IDEA.
THAT WASN'T MY DECISION. WHAT I HAVE TO GIVE THIS COMMISSION A LOT OF CREDIT FOR IS FOR TAKING THOSE BOLD LEAPS TO TAKE DECISIONS THAT EITHER MAY NOT BE WELL FAVORED BY A CERTAIN NUMBER OF RESIDENTS BUT BECAUSE WE GENUINELY BELIEVE THAT IT'S IN THE BEST INTEREST OF THE COMMUNITY AT LARGE.
AND I THINK LOOKING AT PINE TREE WHICH NO PUN INTENDD HAS BEEN KICKED DOWN THE ROAD FOR WHO KNOWS HOW LONG AND YOU LOOK AT AN OPPORTUNITY THAT CAME UP HERE AND I -- WE NOT ONLY STUCK OUR NECKS OUT TO PROTECT OUR RESIDENTS AND OUR COMMUNITY BUT IT WAS A VOTE OF CONFIDENCE REALLY IN THE CITY OF PARKLAND. THERE WAS A LOT OF PEOPLE WHO THOUGHT MAYBE THIS LAND WOULDN'T BE WORTH WHAT WE WERE PAYING FOR IT. A LOT OF PEOPLE WHO THOUGHT THAT A CITY SHOULD NOT BE IN LAND SPECULATION.
I HEARD SOME RESIDENTS SAY THAT. AND THE REALITY IS THAT IN A GENERAL SENSE THEY'RE RIGHT. BUT WE SAW IT FOR WHAT IT WAS AND WE SAW IT BECAUSE THROUGH THE PRISM OF HOW WE FEEL ABOUT THIS COMMUNITY AND WHAT HAPPENED WE THINK ABOUT HOW WE VALUE THIS CITY. I THINKS IT'S IMPORTANT FOR EVERYONE TO UNDERSTAND THAT BECAUSE THIS PROCESS COULD HAVE GONE SO VERY DIFFERENTLY. SO VERY DIFFERENTLY.
WE'D BE HAVING VERY DIFFERENT CONVERSATIONS RIGHT NOW ABOUT HOW ARE WE GOING TO MANAGE THE INFRASTRUCTURE TO YOUR POINT.
WE'RE TALKING ABOUT CONCERNS ABOUT SCHOOL CAPACITY.
WE'RE TALKING ABOUT CONCERNS ABOUT TRAFFIC.
WE'RE TALKING ABOUT CONCERNS ABOUT INFRASTRUCTURE.
[01:50:02]
ALL OF THAT HAS BEEN GAITED BY THIS DECISION.AND SO I THINK IT'S VERY IMPORTANT TO HIGHLIGHT THAT BECAUSE WHILE AGAIN WE STILL HAVE A LONG WAY TO GO, I AGREE, THIS I THINK AFFIRMS THAT WHEN A COMMISSION IS HEADING IN THE RIGHT PLACE AND NOT MAKING POLITICALLY MOTIVATED DECISIONS THESE ARE THE RESULTS YOU CAN ACHIEVE.
I'M PROUD OF US AND OUR CITY AND OUR COMMUNITY FOR.COMING TOGETHER. PUTTING THEIR TAX DOLLARS, OUR TAX DOLLARS TOWARDS A PROJECT THAT DIDN'T HAVE A GUARANTEE OF SUCCESS. I THINK IT'S A VERY AMAZING ACCOMPLISHMENT JUST TO EVEN GET TO THIS POINT.
>> I JUST WANT TO SAY ONE THING BECAUSE I SAY HINDSIGHT IS ALWAYS 20/20. GOING THROUGH THIS PROCESS AND MARK KNOWS TO GET TO SOME OF BOB'S CONCERNS EARLY ON AND KEN'S CONCERNS EARLY ON, THERE WERE SOME DAYS WHERE I COULD HAVE VOTED TEN TIMES THAT DAY SO IT WAS A TOUGH CALL.
IT WAS A TOUGH CALL BECAUSE AS THE MAYOR POINTED OUT IT WAS NOT JUST ABOUT HERON BAY. IF IT WAS ABOUT HERON BAY MAYBE IT WOULD HAVE BEEN EASIER BUT IT WAS ABOUT THE WHOLE COMMUNITY OF PARKLAND. AFFECTING HOW IT IMPACTED TRAFFIC. PULLING FROM THE TRICOUNTY AREA.
IT WAS A TOUGH CALL AND AT THE TIME IT WAS A VERY POTENTIALLY RISKY CALL. WE'VE MADE A LOT OF HARD DECISIONS ON THIS DAIS AND WITH THAT EVERY POSITIVE AND NEGATIVE COMMENT HAS BEEN NEEDED. BECAUSE IF IT'S SUCH AN EASY DECISION WE DON'T NEED TO DEBATE IT BUT WE'VE MADE A LOT OF TOUGH DECISIONS AND WITH THAT YOU NEED EVERY YIN AND YANG IN THIS PROCESS. I'VE LOST A LOT OF SLEEPLESS NIGHTS IN THIS PROCESS AND I KNOW MANY OTHERS DID AS WELL.
SO LOOKING BACK AT IT THROUGH ROSE COLORED LENSES HERE AND WE HAVE A LONG WAY TO GO AND HAVE SOME ISSUES WE NEED TO WORK OUT AND I'M CONFIDENT WITH A COMMUNITY ORIENTED APPROACH AND PARTNERSHIP APPROACH WE WILL DO THAT.
I DO AGREE WITH COMMISSIONER MAYERSON AND CUTLER AND COMMISSIONER ISRAEL'S COMMENTS THAT WE AND THIS IS A TESTAMENT TO YOUR COMPANY THAT WE CHOSE A PARTNERSHIP AND CHOSE TO CONTROL THIS PROCESS BY ALIGNING OURSELF WITH A COMPANY AND IT WAS PART OF MY RANKINGS TOO, THAT WE WERE CHOOSING A BUSINESS PARTNER THAT %-P GOING TO PROVIDE A QUALITY PROJECT BUT ALSO BE A GOOD COMMUNITY PARTNER IN THE PROCESS BOTH BEFORE THEY BUILD THE PRODUCT AND AFTER THEY BUILD THE BRACT.
AND I HOPE THAT STILL CONTINUES TO BE TRUE.
I HOPE WE CAN WORK THROUGH SOME OF THESE OTHER ISSUES.
I DON'T KNOW THE LEGALITIES OF HOAS DONATING OR ANYTHING ELSE AND I KNOW THE HOA HAS ITS OWN PROCESS THEY HAVE TO GO THROUGH AND THAT THEY HAVE THEIR OWN EXPENSES AND EVERYTHING ELSE.
BUT I'LL PUT THAT ASIDE AND JUST SAY THAT I AM PROUD OF THIS COMMISSION. BOTH THE NOS AND THE YESES BECAUSE IT WAS NOT AN EASY DECISION.
I'M PROUD OF THIS COMMISSION MAKING TOUGH CALLS AN HOPEFULLY
GET SOME VICTORIES. >> COMMISSIONER CUTLER, DO YOU WANT TO SAY ANYTHING?
>> I'VE ALREADY SAID WHAT I NEED TO SAY.
THANK YOU VERY MUCH. >> OKAY. TO ME, I CAN APPRECIATE SOMEONE THINKING IT'S A TOUGH DECISION.
FOR ME THIS WAS A NO BRAINER FROM THE BEGINNING.
YOU SAID IT FROM DAY ONE. I SAID THERE IS NO WAY TO COMMISSIONER ISRAEL'S POINT. I HAVE SO MUCH FAITH IN THE CITY OF PARKLAND IT RESIDENTS, ITS STAFF AND US THERE'S NO WAY THIS WASN'T GOING TO BE SUCCESSFUL. ZERO.
THE SLEEP I LOST WAS TRYING TO CONVINCE EVERYBODY ELSE THAT THIS WAS SO MUCH THE RIGHT THING TO DO.
AND IT'S DISAPPOINTING THAT WE'RE STILL TRYING TO KNOCK IT DOWN. DISAPPOINTING.
ANYONE FROM THE PUBLIC WISH TO SPEAK ON THIS AGENDA ITEM? ANYONE TO MAKE A MOTION OR SHOULD I PASS THE GAVEL?
>> I MADE THE MOTION WITH THE CAVEATS THAT WE JUST TALKED ABOUT. I LOST MY TRAIN OF THOUGHT.
[01:55:01]
BUT IT WAS TO PRESERVE THE RELATIONSHIP WITH TOLL BROTHERS THAT TOLL BROTHERS WAS GOING TO BE OUR BUSINESS PARTNER THROUGH THIS FROM DINING TO COMPLETION. -- BEGINNING TO COMPLETION.>> THE IMPACT FEE PROVISION. >> RIGHT.
IF THEY DO NOT AGREE TO A RECOLLECTIVE COVENANT POST CLOSING I WANT TO GIVE FLEXIBILITY HERE FOR THAT POTENTIAL. UNLESS LINDSEY IS READY TO TELL ME RIGHT NOW YEAH WE'RE GOING TO AGREE WE'RE IN.
>> SHE SAID SHE CAN'T. >> LINDSEY IS THE LEGAL DECISION MAKER BUT I THINK THAT IT WAS ALWAYS MY UNDERSTANDING THAT WE WERE GOING TO BE PARTNERING EVER STEP OF THE WAY WITH TOLL BROTHERS AND WHETHER IT'S AN AFFILIATE, THAT TO ME IS BUSINESS BUT THEY WOULD STILL BE THE SAME ENTITY.
>> SO MAYBE YOU CAN HAVE SOME LANGUAGE.
WE STILL GOT TO VOTE A SECOND VOTE.
I JUST DIDN'T WANT IT TO MATE GAIT THE FIST VOTE AND HAVE TO
START OVER. >> I THINK THAT WE WERE TALKING ABOUT RESTRICTED COVENANT THAT'S ALREADY BEEN ADDRESSED FROM MID UNDERSTANDING IS THAT THE LAND WOULD BE COMMITTED TO RESIDENTIAL USE. THAT I THINK YOU SAID HAS ALREADY BEEN IN AGREEMENT CORRECT?
>> RIGHT. THEY HAVE TO SUBMIT DEVELOPMENT APPLICATIONS FOR SINGLE FAMILY RESIDENTIAL.
THAT'S APPROVED ON THE PROPERTY SHOULD THE COMMISSION SO APPROVE IT. THAT'S THE ONLY THING THAT CAN BE BUILT. ANOTHER WISE SOMEBODY WOULD HAVE
TO GO BACK. >> AND WHETHER IT'S ONE ENTITY THAT HOLDS THE LAND OR ANOTHER THAT DEVELOPS IT, AS LONG AS IT'S THE SAME ORGANIZATION I THINK THAT'S WHAT WE'RE ALL
TRYING TO ACCOMPLISH. >> OKAY. SOT THE KEY IS THE TOLL WROTES OR SOME AFFILIATED ENTITY IS THE ONE THAT BUILDS
>> OKAY. >> IS THAT ENOUGH DIRECTION?
>> RIGHT. BECAUSE DOESN'T THE ACTUAL --
>> YES. >> ASSIGNMENT RIGHT THAT MUST BE
SO THE ISSUE IS WHAT HAPPENS AFTER CLOSING AND THE CONTRACT
DOS AWAY. >> I THINK YOU JUST NEED ANOTHER PROVISION -- AS TO THE DEVELOPMENT RIGHTS OF -- ONCE YOU GET ENTITLEMENT THE ENTITLEMENT SHOULD BE INNURED TO
THE BENEFIT. >> I WILL DISCUSS THIS WITH THEIR TONE AND WE'LL WORK OUT A POTENTIAL MECHANISM FOR SECOND
READING FOR SECOND READING. >> I WILL SECOND THE VICE
MAYOR'S MOTION. >> WE HAVE A MOTION BY VICE MAYOR AND COMMISSIONER ISRAEL. ROLL CALL.
>> COMMISSIONER CUTLER. >> YES.
>> COMMISSIONER MAYERSON. >> NO.
>> COMMISSIONER ISRAEL. >> YES.
[11. Comments by the Broward Sheriff's Office]
>> OKAY. SO NOW WE HAVE COMMENTS BY THE BROWARD SHERIFF'S OFFICE.
>> GOOD EVENING. THANK YOU FOR MENTIONING COFFEE WITH A COP AND THOSE WHO AT THE ENDED.
IT WAS A GREAT EVENT. WE LOOK FORWARD TO THOSE AND THE DEPUTIES LOOK FORWARD TO THAT A LITTLE TWIST WAS THE VOUCHER FOR FREE DONUTS. THAT'S ALWAYS FUN.
I WANTED TO MENTION A COUPLE OF OTHER EVENTS THAT WE HAVE COMING UP. WE'VE PARTNERED WITH PARKS AND REC AND WE'RE DOING CONES WITH COPS AT THE SUMMER CAMPS.
SO WE'LL BE AT THE MIDDLE SCHOOL AND THE ELEMENTARY SCHOOL WHERE WE HAVE SUMMER CAMPS. WE'RE GOING TO DO THAT ON JULY 24TH AND 25TH SO THE DEPUTIES WILL BE PARTNERING WITH THE KIDS OUT THERE AND SCOOPING UP ICE CREAM AND PLAYING BASKETBALL JUST CONNECT, THE KIDS AND THE COMMUNITY OUT THERE. SO WE'RE LOOKING FORWARD TO THAT. AND ALSO ON JULY 31ST, WE HAVE OUR MEET YOUR SRO AT PARKLAND NIGHT OUT FROM 5:30 TO 7:30.
WE HOPE PEOPLE COME OUT FOR THAT YOUNG AND OLD.
WE HAVE A LOT OF ASSETS OUT THERE.
[02:00:02]
WE'RE PARTNERING WITH SOME FEDERAL AGENCIES AND WE'RE GOING TO HAVE THEM COME OUT AS WELL AND BRING THEIR TOYS AN EQUIPMENT. SO WE REALLY WANT TO GET A BIG GROUP OUT THERE. THE DEPUTIES ARE DOING A GREAT JOB BEING PROACTIVE, PATROLLING THE STREETS.AND JUST BEING REALLY VISIBL OUT THERE ANTICIPATE IT'S REALLY MAKING A DIFFERENCE AND I WANTED TO MENTION THAT.
LAST SUNDAY WE ACTUALLY HAD A CALL OF A CAR BREAK IN, IN PROGRESS AND OUR DEPUTIES WERE IN THE AREA RESPONDED TO THE SCENE AND ACTUALLY SAW THE VEHICLE FLEEING.
AND WE WERE ABLE TO FOLLOW THAT VEHICLE.
SET UP WITH OUR AVIATION AND K9 AND ONCE THEY WERE SOUTHBOUND ON THE TURNPIKE WE PULLED THEM OVER.
THEY ACTUALLY STOPPED FOR US. AND WE WERE ABLE TO MAKE AN ARREST ON THAT. AND CLOSE CASES IN TERMS OF THEM BREAKING INTO CARS. THAT WAS A GREAT JOB BY EVERYONE. JOINT EFFORT.
PRIOR TO THAT THEY WERE OUT THERE DOING HIGH VISIBILITY PATROL IN THE WEE HOURS, 3:00 IN THE MORNING.
THEY SAW A SUSPICIOUS VEHICLE OUTSIDE A GATED COMMUNITY AND ACTUALLY CAUGHT THEM BEFORE THEY COULD DO ANYTHING.
THERE WERE THREE INDIVIDUALS IN THE CAR, ADULTS, THEY DID NOT BELONG IN PARKLAND. THEY WERE NOT FROM PARKLAND.
THEY ALL GAVE DIFFERENT ACCOUNTS AS TO WHY THEY WERE IN PARKLAND BUT WE WERE ABLE TO DO SOME GOOD INFORMATION GATHERING.
IDENTIFIED THEM. AND PREVENTED LIKELY SOMETHING FROM HAPPENING WHETHER THEY WERE CASING THE COMMUNITY OR WHETHER THEY WERE THERE TO DO SOMETHING WE PREVENTED THAT.
GREAT WORK. AND THEN LASTLY I'LL MENTION RESIDENTIAL PARTICULAR BURGLARIES IN 2020.
IT WAS A CASE WHERE FOLKS CAME HOME AND THEY DISCOVERED THAT THEIR HOME WAS BROKEN INTO. THREE YEARS AGO.
THANKS TO THE DEPUTY'S PROCESSING OF THE SCENE HE NOTICED THERE WAS SOME BLOOD AT THE SCENE AND SWABBED IT AND ENTERED IT INTO OUR CODIS SYSTEM FOR DNA.
AND THANKFULLY ENOUGH, WE WERE ABLE TO GET A MATCH VERY RECENTLY AND IDENTIFIED A GENTLEMAN NAMED BRIAN LUNA.
HE'S SERVING TIME CURRENTLY FOR RESIDENTIAL BURGLARIES IN IN NEW YORK UNTIL 2026 SO WHEN HE GETS -- RATHER WHEN HE FINISHES THAT SENTENCE, HE'LL BE BROUGHT HERE TO BROWARD COUNTY TO ACCOUNT FOR HIS CRIMES HERE IN PARKLAND.
>> GREAT. ANYBODY HAVE ANYTHING?
>> YEAH. AMAZING WORK BY THE WAY.
THE WHOLE THING WITH WHAT WE WERE TALKING ABOUT EARLIER TONIGHT ABOUT THE COURT'S DECISION TO ALLOW THE REENACTMENT, WE REEK NUYS THIS WILL CREATE A LOT OF MEDIA ATTENTION AND I JUST WOULD ASK IF BSO CAN MAKE AN EFFORT TO BE IN THAT AREA AS MUCH AS POSSIBLE TO MAKE SURE THAT EVERYTHING IS UNDER CONTROL AND THAT THE MEDIA IS MAKING SURE THAT THEY'RE DOING AND NOT DOING WHAT THEY'RE SUPPOSED TO.
WE'VE BEEN WORKING TO FIGURE OUT WHAT THAT'S GOING TO LOOK LIKE AND WE'LL BE WORKING IN CONJUNCTION WITH THEM AND WE'LL ENSURE THAT THAT IS DONE WITH A MINIMAL IMPACT AS MUCH AS
POSSIBLE TO THE RESIDENTS. >> THANK YOU.
>>> ANYONE ELSE? THANK YOU VERY MUCH.
[12. Comments by the Coral Springs-Parkland Fire Department]
>> YOU'RE WELCOME. >> COMMENTS BY THE CORAL SPRINGS PARKLAND FIRE DEPARTMENT.
>> GOOD EVENING, EVERYONE. MIKE MOSER, DEPUTY CHIEF.
THIS MONTH WE HAD 145 EMS CALLS AND THREE FIRE INCIDENTS.
I WANT TO MENTION JUST A COUPLE QUICK THINGS.
WE'VE SEEN SOME FUNNY MEMES ON THE INTERNET ABOUT HOW HOT IT IS IN SOUTH FLORIDA BUT IT IS PRETTY SERIOUS.
WE'VE HAD AN INCREASE IN HEAT EMERGENCY CALLS THROUGHOUT THE
[02:05:03]
COMMUNITY AND WE JUST WANT PEOPLE TO BE AWARE OF THAT.IF YOU'RE SWEATING AND YOU'RE NOT FEELING GOOD THAT'S KIND OF OKAY. IT'S KIND OF TIME TO GET SOME DRAYS AND SHADE.
IF YOU ARE NO LONGER SWEATING AND YOU'RE HAVING SOME DIFFICULTY BREATHING OR ANY OTHER TYPE OF DISCOMFORT YOU'VE AS YOU ARE PATED THE HEAT EMERGENCY AND ARE NOW IN A HEAT STROKE SITUATION AND IT CAN BE FATAL.
SO PLEASE -- SO JUST BE CAREFUL OUT THERE.
ONE OTHER IMPORTANT THING, BROWARD COUNTY BOARD OF RULES AND APPEALS JUST ENACTED NEW LEGISLATION REQUIRING A NEW ACCESS SYSTEM FOR FIRST RESPONDERS.
SIMILAR TO THE BOXES IN THE COMMUNITIES NOW OR GATE REMOTE SYSTEM THAT YOUR RESIDENTS, GATED COMMUNITIES HAVE.
THE NEW LAW ALLOWS A SYSTEM FOR FIRST RESPONDERS TO APPROACH THE SCENE OF A GATED COMMUNITY AND WITH A CLICK OF THEIR RADIOS ON A SPECIFIC CHANNEL THAT'S SECURED OF COURSE THE GATE WILL
IMMEDIATELY OPEN FOR ACCESS. >> THERE WILL BE AN IMPACT TO COMMUNITIES WHO HAVE A GATE. THE COST IS NOT MUCH BASED ON SOME WORK THAT WE HAVE DONE SO WE'LL DEFINITELY BE WORKING WITH CITY STAFF TO MAKE SURE THAT GOES OFF WITHOUT A HITCH.
>> VERY GOOD. >> SO TO THAT POINT, NANCY, AND THIS MAY BE SOMETHING BECAUSE I KNOW INITIALLY WE HAD ACCESS WITH FIRE AS WELL AS POLICE. DOES BSO HAVE A SIMILAR I MEAN ALTHOUGH THEY'RE NOT REQUIRED SOMETHING SIMILAR SO THAT IF AN HOA WANTS TO DO IT IT'S KIND OF A, YOU TIME DEAL ONLY THAT BSO
CAN GET ACCESS TO THAT AS WELL. >> THAT'S A GOOD QUESTION.
THIS CAME THROUGH LEGISLATION OR RULES UPON RECOMMENDATIONS FROM THE FIRE CHIEF'S ASSOCIATION. HOWEVER, THIS IS NOT EXCLUSIVE TO FIRE AT ALL. ACTUALLY OUR ASSOCIATION WILL BE WORKING WITH THE LAW ENFORCEMENT COMMUNITY TO HAVE THE SAME CHANNEL IN THEIR RADIOS TO ALLOW THE SAME ACCESS.
>> THAT MAY BE SOMETHING WE SHOULD WORK ON SO THEY DO IT ONE TIME DEAL. THE OTHER QUESTION THAT I HAVE FOR YOU, DO YOU HAVE ANY UPDATES ON THE HUB?
>> I DO. ABOUT TWO MONTHS AGO MOVED TO THE NEXT VERSION OF THE CAD SOFTWARE ALLOWING THE OLDER VERSION TO BE USED FOR TESTING FOR THE HUB.
HOWEVER, IT'S NOT COMPLETELY SATISFIED WITH THE NEW VERSION THAT THEY'RE ON AND HAVE SOME BUGS AND SO IN ORDER TO ENSURE THAT THEY DON'T MAYBE HAVE TO FLEE BACK TO THE OLDER VERSION FOR LIVE CAD THERE'S NO FORWARD PROGRESS RIGHT NOW.
ONCE THEY GET CURRENT VERSION THAT THEY'RE ON THAT THEY'RE COMFORTABLE WITH THAT THEY'RE GOING TO SIGN OFF OF IT AND THEY CAN ABANDON THE OLD VERSION ALLOWING US TO TEST.
[13. Comments by the City Manager]
>> GREAT. >> COMMENTS BY THE CITY MANAGER.
>> I WOULD JUST LIKE TO THANK CHRIS AND HIS STAFF AND ALL OF MY DEPARTMENT HEADS FOR WORKING DILIGENTLY ON THE BUDGET AND PROUD THAT WE HAVE A BALANCED BUDGET AND GOOD WORK TO YOU ALL.
[APPLAUSE]. >> ABTHIS OF COURSE WE HAVE THE RESIDENT BUDGET WORK SHOP SCHEDULED AUGUST 9TH AT 6:00 O'CLOCK SO I WANT TO ENCOURAGE OUR RESIDENTS TO COME OUT AND ALSO WISHING YOU ALL A NICE LITTLE SUMMER BREAK AND I'LL SEE
COMMENTS BY THE CITY ATTORNEY. >> NO FURTHER COMMENTS TONIGHT, MAYOR. THANK YOU.
MOTION TO
