[6. Presentations]
UNANIMOUSLY. BEFORE WE DO THE PROCLAMATIONS AND RECOGNITIONS, WE'RE GOING TO START WITH A PRESENTATION BY BROWARD COUNTYVICE MAYOR MICHAEL UDINE. >> IT'S GREAT TO BE BACK IN THE CITY OF PARKLAND. THE VIEW'S DIFFERENT FROM THIS SIDE BUT I'M HAPPY TO BE HERE IN MY FAVORITE CITY IN BROWARD COUNTY AND I COULD SAY THAT BECAUSE IT'S TRUE. AND I HAVE A BUNCH OF CITIES THAT I REPRESENT, BUT PARKLAND ALWAYS HAVE A SPECIAL PLACE DUE TO THE LEADERSHIP OF COMMISSIONS AND THE MAYOR, AND KEEPING PARKLAND A GREAT PLACE IT IS TO LIVE. THEY ASKED ME, CITY MANAGER AND TOD ASKED ME FOR A QUICK 5 MINUTE UPDATE. SO I'M PACKING EVERYTHING WE'RE DOING IN THE COUNTY INTO FIVE MINUTES FOR YOU. THE FIRST IS PARKLAND IS A RECIPIENT OF PLENTY OF PROJECTS THROUGH OUR BROWARD MPO PENNY TAX.
RESIDENTS CAN FIND THE LIST ON THE BROWARD.ORG WEBSITE THERE'S A DASHBOARD WHICH WILL SHOW THE PROJECTS FUNDED BY BROWARD COUNTY AND THE PENNY TAX IN THE CITY OF PARKLAND. THE LIST IS LONG AND COMPREHENSIVE AND THESE ARE THINGS WE'VE WORKEDON TOGETHER THAT YOU'VE INDICATED WAS A PRIORITY THAT YOUR TREMENDOUS STAFF WORKING WITH THE STAFF IN BROWARD COUNTY BECAUSE EVERY TIME WE SEE THESE THINGS, MY MARCHING ORDERS TO THE PEOPLE ON MY SIDE ARE, LET'S GET THINGS DONE AND LET'S GET SOME WINS. EVEN IF THEY'RE SMALLER PROJUECTS GET THEM IN TE BOOKS AND THE WINS, SO THE RESIDENTS CAN SEE WHERE THEIR DOLLARS ARE GOING IN THE CITY OF PARKLAND. ONE OF THE THINGS WE'RE WORKING WITH WITH BROWARD IS AFTER THE PANDEMIC IS BRINGING HIGH PAYING JOBS INTO BROWARD COUNTY. SO BROWARD COUNTY PARTERED WITH THE NOVA SOUTH EASTERN UNIVERSITY. AND WE'RE BUILDING AN ACADEMY AT THE NOVA LIBRARY. DOWN IN THE CENTER PART OF THE COUNTY, WHEN IT'S EVENTUALLY DONE, THEY WILL PROBABLY WORK WITH SOME OF THE COUNTY LIBRARIES, TO HAVE A HUB.
I ENCOURAGE ANYBODY FROM THE CITY COMMISSION OR ANYBODY FROM THE PUBLIC THAT WANTS TO CHECK IT OUT. IT'S THE FOURTH FLOOR IT'S GOING TO BE A HUGE BUSINESS INCUBATOR, THEY'VE HIRED A STAFF AND IT'S A MULTI-MILLION DOLLAR PROJECT TO START AND INCUBATE BUSINESSES WITHIN BROWARD COUNTY. THEY'RE DOING IT AT FAU, AND THERE'S BEEN UNICORNS THAT CAME OUT OF THAT AND FROM THAT MODERN MEDICINE IT'S NOW A BILLION DOLLARS COMPANY. WE'RE DOING THAT IN BROWARD AND WE'RE BRINGING THOSE COMPANIES HERE AND ONE OF THE LOGICAL THINGS WE NEEDED TO DO IS HAVE THAT ECOSYSTEM STARTING POINT. AND THESE STUDENTS THAT WE SEE AND I SEE WE HAVE GREAT ONES HERE THAT YOU WILL HONOR LATER. THESE STUDENTS ARE ALREADY STARTING TO DEVELOP THINGS THAT NEED TO SCALE UP THROUGH BUSINESS INCUBATORS, AND THIS IS GOING TO BE THE PLACE DO IT. IT'S BEEN A HUGE SUCCESS, IT'S BEEN WRITTEN UP NATIONWIDE, IT'S GOVERNMENT AND PRIVATE SECTOR TOGETHER, SO THAT MEANS IT'S FAST. MUCH FASTER THAN GOVERNMENT ALONE, NO DISRESPECT TO ANY OF US GOVERNMENT PEOPLE SO WE'RE EXCITED ABOUT THAT. I ALSO JUST WENT TO JUNIOR ACHIEVEMENT BECAUSE ONE OF THE THINGS WE'RE SEEING IS THIS IS STARTING EARLIER AND EARLIER. I KNOW MISS RUNS A PROGRAM AND BY THE WAY SHE GETS THESE KIDS THEY'RE ALREADY STARTING TO LEARN ABOUT
[00:05:04]
APPS AND FINANCE. JUNIOR ACHIEVEMENT IS TRYING TO DO MORE IN ADDITION TO THEIR FINANCE ACADEMY AND EVERYTHING THEY DO THERE, THAT JA WORLD THEY WANT TO DO MORE WITH RESPECT TO APPRENTICESHIPS FOR THE TRADES. NOT EVERYBDY THROUGHOUT THE COUNTY IS GOING TO GO TO COLLEGE AND GO TO PROFESSIONAL SCHOOL.THE TRADES THAT WE HAVE AIR CONDITIONING MECHANIC, THE PLUMBING TRADES, THESE ARE HIGH IT PAYING JOBS. AND WHILE THEY MAY NOT BE SEXY ON INSTAGRAM TO THEIR FRIENDS RIGHT NOW, THOSE PEOPLE ARE MAKING GOOD DOLLARS DOING THAT AND IT'S SOMETHING WE'RE TRYING TO ENCOURAGE IN BROWARD COUNTY. WE'RE TALKING ABOUT A FILM COMMISSION TO BRING MORE FILM PROJECTS TO THE COUNTY. THEY'RE ALREADY DOING A LOT, BUT WE FIND WE'RE NOT GETTING THE RECOGNITION OR THE DOLLARS THAT FLOW FROM IT AND WE'RE WORKING WITH A FILM COMMISSION TO BRING MORE FILM PROJECTS IN BROWARD COUNTY. WE OBVIOUSLY HURRICANE SEASON'S COMING UP, THE COUNTY'S PREPARED, THE RADIO SYSTEM, THE P 25 RADIO SYSTEM WAS ONE OF MY BIG PROJECTS AFTER WHAT HAPPENED AT STONEMAN DOUGLAS, THE NORTH PART OF THE COUNTY IS DONE, HOLLYWOOD CAME ON A LITTLE LATE, BUT THEY'RE NOW COMING ON TO THE SYSTEM. SO, THE P25 RADIO SYSTEM WITH BROWARD COUNTY LATEST AND GREATEST IS UP AND RUNNING. IF YOU PLUG IT IN, IF IT'S HARDWARE IT'S THE COUNTY'S RESPONSIBILITY IF IT'S HUMOR PEOPLE IT'S THE SHERIFF'S RESPONSIBILITY. UP HERE YOU GET OUR DISPATCH THROUGH CORAL SPRINGS. WE'VE INSTITUTED TEXT TO 911 THAT CAME OUT A FEW YEARS AGO WHICH IS BIG. AND BREAKING NEWS, WE'RE GOING TO HAVE SOON IS VIDEO TO 911. SO, MOST OF THE CALLS COMING IN ON 911 ARE CELL TONE PHONE CALLS THERE'S TECHNOLOGY OUT THERE NOW THAT'S NOT CRAZY EXPENSIVE THAT THEY'RE WORKING ON INCORPORATE INTO THE 911 WHEN THE CELLPHONE KICKS IN, YOU GET AN OPERATOR, WHEN YOU PUSH THE IT BUTTON ON YOUR PHONE, YOUR CELLPHONE IS A VIDEO CAMERA ON THE SCENE. THINK ABOUT THE TECHNOLOGY USE FOR CPR, IT'S OPT IN, SO IF YOU HAVE PRIVACY ISSUES DON'T ACCEPT THE LINK. IN REALTIME, YOU'LL HAVE REALTIME VIDEOS. THEY'RE WORKING ON THAT NOW.
>>> COVID, WE'VE TALK ABOUT THIS, EVERYONE'S TALKED ABOUT IT, AND THEY KEEP TALKING ABOUT IT. OBVIOUSLY THINGS ARE BEING RELAXED, WE'RE DOING VACCINATIONS. WE SEEM TO BE PLATEAUING AT THE LEVEL OF PEOPLE BEING VACCINATED. IT'S NOT REALLY A BIG ISSUE IN PARKLAND, PARKLAND'S UP OVER 70 SOMETHING PERCENT WHEN YOU COUNT PEOPLE THAT HAVE ALREADY HAD COVID, PARKLAND'S GOT TO BE CLOSE IN THE PARKLAND AREA TO HERD IMMUNITY. I KNOW THEY SAY IF YOU'VE HAD IT, YOU SHOULD STILL GET VACCINATED I'LL LEAVE THAT TO THE DOCTORS. BUT OTHER PARTS OF THE COUNTY ARE NOT SEEING THE SAME TYPE OF NUMBERS AS FAR AS PERCENTAGES. WE'RE WORKING ON IT AND THE COUNTY IS FUNDING SOME OF THAT WITH THE LOCAL HOSPITAL, THE I DID IT CAMPAIGN TO REALLY SHOW PEOPLE TO GET THE VACCINE. IT'S INTERESTING BECAUSE I WAS AT A LUNCH TODAY WITH THE PRESIDENT OF BAPTIST, AND HE WAS TALKING ABOUT IT. AND THEY'RE SEEING, TOO, THE SAME TYPE OF THINGS WITH PLATEAUING WITH VACCINATIONS AND THEY'RE HOPING THAT THE F.D.A. FINALLY GIVES IT REGULAR AUTHORITY. NOW THEY'RE DOING IT UNDER EMERGENCY USE SO THERE ARE PEOPLE STILL NERVOUS PWITH THAT, BUT HOPEFULLY WHEN THEY GAVE FULL BLOWN AUTHORITY TO DO IT THAT WILL CONVINCE PEOPLE TO GET VACCINATED. THAT'S A BIG ISSUE WITH THE COUNTY. FINALLY, OUR GARBAGE. GARBAGE IS NOT A CRAZY THING THAT EVERYONE LIKES TO TALK ABOUT BUT IT'S A HUGE ISSUE WITH BROWARD COUNTY, WE'RE DRIVING BY GARBAGE FACILITY GETTING BIGGER AND BIGGER AMOUNTS OF TRASH. I KNOW VICE MAYOR MAYERSOHN WORKS AS THE CITY'S LIAISON TO THE WORKING GROUP. BECAUSE THE COUNTY'S WORKING WITH ALL THE CITIES TO COME UP WITH PLANS FOR THE FUTURE. GARBAGE IS A VERY EXPENSIVE PROPOSITION, RIGHT NOW WE SEND GARBAGE OUT OF THE AREA, THERE'S BEEN MAJOR PROBLEMS WITH
[00:10:03]
THE RECYCLING NUMBERS DUE TO THE ISSUES IN THE FAR EAST. I CAN TELL YOU THAT THE WORKING GROUP IS MAKING A LOT OF PROGRESS, THEY'RE ROOKING AT AN INTERLOCAL AGREEMENT WITH THE COUNTY SO THAT ALL THE CITIES AND THE COUNTY WOULD SIGN ON OR A DEPENDENT DISTRICT. I KNOW WE TALKED ABOUT THE INDEPENDENT DISTRICT, I THINK THAT'S OFF THE TABLE AND THE WORKING GROUP RAS REVERSED THEIR POSITION ON THAT, THEY'RE NOT GOING TO GIVE BROWARD COUNTY'S GARBAGE TO TALLAHASSEE. WE'RE WORKING TOGETHER ON COMMISSIONER MAYERSOHN AS I MENTIONED IS OUR.IN THE FUTURE, MT. TRASHMORE CAN STOP GROWING AS BIG AS IT IS, WE CAN GET BACK TO RECYCLING AND PROTECT OUR RESOURCES. THE SEAL WE HAVE IN PARKLAND, ENVIRONMENTALLY PROUD. OUR BROWARD ENVIRONMENTAL DEPARTMENT IS LUCKY, WE HAVE ONE OF THE MOST PROMINENT EXPERTS IN ENVIRONMENTAL IN DR. JENNIFER.
WE HAVE DASHBOARDS OF THE DIFFERENT RESILIENCY PROJECTS THAT WE'RE DOING IN BROWARD COUNTY. I KNOW WE WORK WITH THE CITY AND WITH YOUR ENGINEERING AND YOUR BUILDING TEAM FOR SUSTAINABLE BUILDING FOR DIFFERENT THINGS. I CAN TELL YOU, I REMEMBER WHEN I WAS MAYOR, 10 YEARS AGO AND WE USED TO HAVE THE FARMER'S MARKET, AND IT WOULD POUR ON MONDAY, TUESDAY, WEDNESDAY, THURSDAY, WE COULD STILL HAVE THE FARMER'S MARKET. BUT AS MORE AND MORE STUFF IS BUILT, THERE NEEDS TO BE MORE WATER RETENTION TYPE OF AREAS AND DIFFERENT THINGS FOR RESILIENCY THAT WE'RE LOOKING AT. THESE THINGS ARE BECOMING INSURANCE ISSUES AND FINANCIAL ISSUES, THE BETTER WE DO AS A COUNTY AND A CITY, THE CHEAPER IT WILL BE FOR OUR RESIDENTS BECAUSE OUR INSURANCE RATES WILL GO DOWN AND IT WILL BE EASIER TO GET REFINANCING MORTGAGES AND THAT KIND OF THING. THAT'S REALLY THE QUICK, FIVE MINUTE, WHICH TURNED INTO LIKE 10 MINUTES, BUT WHAT ARE YOU GOING TO DO, I'M THE FORMER MAYOR, SHE'S GOT TO LET ME GO A LITTLE LONGER. I'M HAPPY TO ANSWER QUESTIONS. THE RESIDENTS OF PARKLAND ARE LUCKY TO HAVE A HARD WORKING. I SEE THESE GUYS EVERY WHERE. WE SPEND A LOT OF TIME TALKING ABOUT ROAD ISSUES AND I SPEAK TO EVERYONE ON THIS COMMISSION USUALLY ON A WEEKLY OR BIWEEKLY BASIS. YOU HAVE AN AMAZING STAFF. PARKLAND'S LIKE THE LITTLE CITY THAT COULD, WE DON'T HAVE A LOT OF PEOPLE IN STAFF BUT THESE GUYS REALLY PULL THEIR WEIGHT AND GET THINGS DONE. IT'S SUCH A GREAT PLACE AND I THANK YOU AS A RESIDENT FOR EVERYTHING YOU DO.
>> OBVIOUSLY WE'RE SO FORTUNATE HAVE YOU AT THE COUNTY LEVEL WORKING FOR US, WHICH HELPS US DO OUR JOB, WHICH HELPS THE RESIDENTS ON THE COUNTY LEVEL. SO WE ABSOLUTELY APPRECIATE IT AND THE UPDATE WAS FANTASTIC, I'M GLAD THERE WERE SO MANY PEOPLE HERE TO LISTEN TO THAT UPDATE. DOES ANYBODY HAVE ANY
QUESTIONS FOR VICE MAYOR? >> HAVE A GREAT NIGHT EVERYONE.
[7. Comments from the Public on Non-Agenda Items (Part 1 of 2)]
>> I'M GOING TO SKIP ONE MORE PERSON, BECAUSE SCHOOL BOARD MEMBER DEBBIE HICKSON IS HERE AND SHE WANTED TO -- I'M GOING TO LET HER USE HER PUBLIC COMMENT OR WHATEVER YOU WANT TO CALL IT TO INTRODUCE HERSELF AND THIS IS A GREAT OPPORTUNITY BECAUSE WE HAVEN'T HAD THIS MANY PEOPLE IN OUR CHAMBERS IN QUITE SOME TIME, IT'S AN HONOR TO HAVE YOU HERE. AND I JUST DON'T KNOW IF YOU HAVE ANY QUESTIONS IF YOU WANT ME TO JUST GIVE A QUICK UPDATE. WE ARE OFFERING SUMMER SCHOOL, SO I'LL TELL YOU
[00:15:02]
A LITTLE BIT ABOUT THAT. IT IS FOR EVERYONE, NOT JUST FOR PEOPLE NOT MEETING THE ACADEMIC PROGRESS. IT WILL BE SIX WEEKS AND IT'S FOUR HOURS AND THEN WE'LL BE OFFERING OTHER PROGRAMS AFTERWARDS SO I'M GOING TO GUESS PARKLAND HAS PROBABLY PARTNERED WITH US TO DO SOME OF THAT. WE ARE IN THE MIDST OF TESTING RIGHT NOW SO THAT IS A BIG UNDERTAKING, BUT ODDLY ENOUGH, AS MUCH AS IT DOESN'T COUNT THIS YEAR, WE'RE SEEING LARGE NUMBERS OF STUDENTS COMING TO TAKE THE TEST. SO THAT IS A GOOD THING BECAUSE WE'RE ABLE TO THEN, USE IT AS A TOOL. WE'RE HAVING IN-PERSON GRADUATIONS. I JUST CAME FROM THE SENIOR AWARDS NIGHT SO THIS WAS PERFECT TIMING. AND THAT'S I GUESS, A QUICK OVERVIEW, BUT REALLY I JUST WANTED TO SAY HELLO ANDTHANK YOU FOR THE SUPPORT. >> WE ABSOLUTELY APPRECIATE YOU STOPPING IN, DOES ANYBODY HAVE ANY QUESTIONS.
>> I KNOW, BUT JUST FOR THOSE WHO DON'T, YOUR BACKGROUND YOUR EDUCATIONAL BACKGROUND AND EXPERIENCE SO PEOPLE GET TO KNOW
YOU. >> I AM DEBBIE HICKSON I'M A 32 YEAR VETERAN TEACHER IN THE BROWARD COUNTY SCHOOL SYSTEM AND I WENT THROUGH THE BROWARD COUNTY SCHOOL SYSTEM AS A STUDENT. I STARTED MY CAREER AS A SCIENCE TEACHER, I TRANSFERRED TO SOUTH BROWARD HIGH SCHOOL 27 YEARS AGO AND THAT'S WHERE I REMAINED UNTIL I WAS ELECTED SCHOOL BOARD MEMBER AND THEN I HAD TO TAKE A LEAVE OF ABSENCE. I DECIDED TO BE ON THE BOARD AND I WAS DECIDED TO HAVE AN OPPORTUNITY TO BE PART OF THE DECISION MAKING THAT HAPPENS IN OUR SCHOOLS. I LOVE BROWARD COUNTY AND I LOVE BROWARD COUNTY'S SCHOOL SYSTEM AND I'VE DEDICATED MY ENTIRE LIFE TO IT AND REALLY HAPPY NOW TO BE IN A POSITION TO MAKE POSITIVE CHANGES.
>> AND WE ABSOLUTELY APPRECIATE THAT AND YOUR EXPERIENCE AND YOUR DEDICATION TO THE BROWARD COUNTY SCHOOL SYSTEM IS GOOD FOR US. SO, WE APPRECIATE EVERYTHING YOU DO.
>> THANK YOU. DID YOU HAVE A QUESTION?
>> NO. >> AGAIN, FEEL FREE TO REACH OUT, HAPPY TO HELP WHERE I CAN, AND SO HAPPY THAT WE'RE GOING TO BE DOING IN-PERSON GRADUATIONS, I KNOW STUDENT ARE AS WELL.

EVERYONE. SO NOW WE'RE BACK ON SCHEDULE. SO, NOW WE'RE GOING[7. Comments from the Public on Non-Agenda Items (Part 2 of 2)]
TO GO WITH COMMENTS WERE THE PUBLIC. SO ALYSON DO WE HAVE A LIST OF PEOPLE SIGNED UP TO SPEAK, WELL, FIRST YOU HAVE ANE-MAIL CANS RIGHT? >> OKAY. PERFECT. I GOT AN
E-MAIL AND THEN TWO PEOPLE. >> THIS IS FROM JASON COFENDER.

AGENDA ITEM. SO SHOULD I WAIT? >> YES.
>> FIRST WE HAVE JEFF SCHWARTZ. >> JEFF, THANK YOU.
>> NAME AND ADDRESS FOR THE RECORD, PLEASE.
>> HI, JEFF SCHWARTZ PRESIDENT OF THE HISTORICAL SOCIETY, 8255 CHARTER'S LANE, PARKLAND FLORIDA. I DON'T KNOW HOW MANY PEOPLE IN THE ROOM KNOW IT BUT PARKLAND HAS BEEN LUCKY ENOUGH TO HAVE A HISTORICAL SOCIETY THAT HAS MOVED FORWARD WITH A LOT OF EVENTS AND A LOT OF THINGS FOR THE CITY, ONE OF THE MOST IMPORTANT THINGS WE'VE DONE FOR THE CITY IS PLAN WHAT WE CALL THE PORTALS OF PARKLAND'S PAST. THE PORTALS OF PARKLAND'S PAST ARE HISTORICAL MARKERS AROUND TOWN. NOW, WE COULDN'T HAVE DONE IT WITHOUT THE SUPPORT OF THE CITY AND WE APPRECIATE YOUR SUPPORT AND EVERYTHING YOU'VE DONE FOR US TO HELP US MOVE FORWARD WITH THIS PROGRAM AND CONTINUE TO MOVE FORWARD. I WANT TO THANK YOU GUYS EVERY ONE OF YOU FOR SHOWING UP LAST WEEK AT VAST SATURDAY WHEN WE PLANTED OUR 13TH HISTORICAL MARKER IN THE CITY OF PARKLAND. THAT'S A PRETTY IMPRESSIVE NUMBER FOR A SMALL TOWN. THE ARTICLE ON THIS PARTICULAR PORTAL WAS WRITTEN BY OUR COMMISSION CUTLER AND WAS ON WHAT HOPEFULLY EVERYBODY IN TOWN KNOWS IS A VERY, VERY, IMPORTANT IN INDIAN BURIAL SITE. I WANT TO THANK YOU FOR BEING THERE AND THANK BILL'S TEAM FOR DIGGING A HOLE. BILL'S TEAM JUST REPLACED TWO OF OUR PORTALS ONE AT BRIDGE PARK AND ONE AT CAMP BELOSIA.
I'M TERRIBLY SORRY ABOUT THAT. BUT THANK YOU VERY MUCH FOR YOUR SUPPORT, AND WE LOOK FORWARD TO MORE OF IT IN THE FUTURE AND PUTTING MORE OF THESE HISTORICAL MARKERS AROUND TOWN AND
PRESERVING OUR HISTORY. >> THANK YOU VERY MUCH WE
APPRECIATE EVERYTHING YOU DO. >> MIKE SCOLACHI.
>> GOOD EVENING, >> MIKE SCOLACHI 7250 SOUTHWEST. I WOULD LIKE TO INVOKE THE ROBERT'S RULE OF ORDER TONIGHT SO IF YOU WOULDN'T MIND STOPPING THE CLOCK FOR ME.
>> OKAY. HOW LONG DO YOU ANTICIPATE?
>> WELL, I'M GOING TO TRY AND GO AS QUICK AS I CAN, BUT I HAVE SEVERAL ISSUES TO DEAL WITH HERE TONIGHT. THEY'RE NOT GOING TO
BE AS JOYOUS AS YOU JUST HAD. >> THAT'S OKAY, OBVIOUSLY I DON'T WANT TO STOP YOU FROM SPEAKING.
>> MY POINT BEING, YOU ARE MORE THAN WELCOMED TO SPEAK AND I WANT TO LISTEN, BUT WE CAN ALSO DO SOME OF THIS PRIVATELY SO WE
COULD TRY AND GET. >> MAYOR, I PLAN ON THAT, BUT I
HAVE TO ADDRESS THIS PUBLICLY. >> I JUST WANT TO MAKE SURE IT'S CLEAR THAT YOUR TIME HERE IS NOT ALL THAT YOU'LL GET.
YOU'LL GET YOUR DUE TIME. THANK YOU. YOU'LL GET YOUR DUE TIME
WITH ME AS SOON AS YOU LIKE. >> THANK YOU, SIR.
>> THANK YOU, MIKE. >> OKAY. I WANTED TO OPEN UP WITH A LITTLE BIBLE VERSE AND IT'S VERY CLEAR IT SAYS DO NOT HARM YOUR NEIGHBORS WHO LIVE PIECEFULLY BESIDE YOU, IF YOU DO, GOD'S VERY SPECIFIC HE SAYS YOU WILL FALL INTO THE TRAP.
NOW, I COME BEFORE YOU TONIGHT WITH MULTIPLE NEIGHBOR ISSUES AND I WOULD LIKE TO START WITH YOU DON'T KNOW WHAT'S COMING DOWN THE PIKE, MARK PIKE. GUY COMES INTO OUR CITY, FOUR TIME SUPER BOWL GUY, CALLS ME FRANTIC THAT THE CITY JUST IMPROSED $15,000 FINES ON THE GUY'S PROPERTY, I ATTENDED THE MAGISTRATE MEETINGS, AND I WAS DISGUSTED BY IT. HERE WE TAKE
[00:40:04]
OUR HEROS AND MAKE THEM ZEROS, I BET YOU THEY USED THAT WHEN THEY WENT TO THOSE SUPER BOWLS, AND HE GOES YES, THEY DID. WE HAD SIX KIDS GROWING UP AND MY PARENTS TAUGHT US WHEN THE NEIGHBOR CAME TO THE NEIGHBORHOOD YOU BROUGHT THEM A PIE, COOKIES, SOMETHING TO EAT, YOU WELCOME THEM. YOU DIDN'T COME IN AND FINE THEM AND GET HIM ALMOST OUT OF TOWN, HE ALMOST HAD TO LEAVE. THE GUY FOLLOWED THE RULES, AND SAID I'M A LANDSCAPE DESIGNER, I'M A 5 STAR COMPANY, YOU DON'T HAVE A 5 STAR COMPANY IN THIS TOWN. NONE OF THESE TREES WOULD BE HERE IF IT WASN'T FOR MY COMPANY, THEN THE CITY DIDN'T EVEN WANT TO PAY ME WHEN I WAS DONE, BUT THAT'S FOR OTHER ISSUES. OKAY. WE HAVE A GROWING TOWN HERE I'VE BEEN IN THE RANCHERS FOR A LONG TIME. AND SOME OF THE THINGS I'M DEALING WITH ARE SOME OF THE OLDER RANCHERS HERE. I THINK THE WAY WE HANDLE THE PEOPLE HERE AND INVITE THEM AND NOT COME IN AND ROUGH THEM UP. I THINK IT'S REALLY RUDE. HOPEFULLY WE CAN COME TOGETHER, I'M HERE FOR PEACE, NOT WAR. OKAY. WE'RE GOING TO START WITH JIM WILL LARD WHO IS MY 87-YEAR-OLD NEIGHBOR WHO LIVERS ACROSS THE STREET FROM ME. I USED TO RUN WITH WITH PAT DONELY, THE WATER. PAT AND I MADE SURE THE WATER LEVELS WERE ALWAYS PERFECT. WE DIDN'T NEED THE CITY TO DO IT. WE ALL WORKED TOGETHER OVER THERE, OKAY. BUT, YOU KNOW, PEOPLE MOVED OUT, AND YOU KNOW, YOU GUYS DECIDED YOU WANTED TO RUN THE WATER AND NOT ME, AND I SAID, GO AHEAD, BUT JIM WILLARD HAS TWO CALLS, THE ONLY CALLS IN THE CITY. THE GUY IS 87 YEARS-OLD. HE CALLED ME FRANTIC, HE WOULDN'T COME IN HERE BECAUSE HE'S OLD, HE'S PROBABLY IN BED, OKAY. HIS COWS DON'T HAVE WATER, I RUN OVER THERE WITH MY BACK HOE AND DO THE CITY'S JOB AND LOSE A $14,000 BRACELET AND DIGGING UP TO GET THE COWS SO THEY DON'T DIE AND I GOT PICTURES OF THE COWS, IT'S DISGUSTING, I'VE BEEN HERE AGAIN AND AGAIN AND ASKED PLEASE MAINTAIN THE CANALS AND YOU DON'T. THEY'RE ACTUALLY CALLED WATER. I'M NOT TRYING TO START PROBLEMS BUT I HAD TO GO TO WAR WITH YOU GUYS, THE OLD FATHERS BECAUSE THEY WERE TRYING RUN US GUYS OUT. UNFORTUNATELY I WON, UNFORTUNATELY AGAIN AND AGAIN I HAVE TO COME AGAINST YOU GUYS WITH LAWSUITS AND UNFORTUNATELY THE TAXPAYERS HAVE TO PAY FOR IT. IT COST THE CITY 3 QUARTERS OF A MILLION DOLLAR TO KEEP UP A WAR THEY KEPT LOSING. I SAY THIS HUMBLY, WE HAVE FARMER'S RIGHTS. AND THAT'S WHEN I WENT TO THE COURT UP IN WEST PALM BEACH AND WE WON 8-0 FRIDAY AFTERNOON, A JURY AWARDED $268,000. NO, I DON'T WANT TO HAVE TO COME BACK HERE TO THIS PODIUM. I THOUGHT I WAS RETIRED. I THOUGHT WE COULD LIVE IN PEACE, BUT WHEN YOU ATTACK MY NEIGHBORS, YOU ATTACK ME. AND A LOT OF PEOPLE DON'T FEEL COMFORTABLE UP HERE BECAUSE IT'S AN UNCOMFORTABLE PLACE TO BE. AND NOT EVERYONE WANTS TO GET UP AND TALK. BUT ALL MY SUPPORTERS ARE ALL RIGHT THERE, OKAY. SO, WE'RE GOING TO START WITH JEFF SWE PAID FOR EVERYTHING, NOBODY CHIPPED IN, AND I BURIED THAT THING WITH THE SAME MONTHS THAT I STOOD THESE TREES UP. OKAY. I HELPED STO STONEMAN DOUGLAS, THE CITY MANAGERS WANTED TO STEAL IT. I WENT TO DEPOSITIONS AND HE TESTIFIED IN HIS OWN HAND WRITING AND THEY WOULDN'T PAY ME BECAUSE I WON'T DO DIRT FOR THE CITY, THEY WANTED ME TO SCAM THE SCHOOL FOR $250,000. IF YOU GUY THE CARE FOR THE SCHOOL, IT'S TIME TO PAY THEM BACK. I DON'T WANT TO BE A COMMITTEE GUY, I DON'T WANT BE UP ON ANY PODIUMS, I FOUND A DONATION TO BRING THE TREES IN HERE WITH THE POLICE DEPARTMENT, THE FIRE DEPARTMENT, THE SCHOOL, I STOOD WITH THOSE[00:45:01]
GUYS AND PLANTED THOSE TREES AND THE CITY DIDN'T SHOW UP BECAUSE I WON'T SCAM THE SCHOOL FOR $250,000. MY NEIGHBOR MARLIN AND ERICA, ZACH AND THE KIDS ARE SOME OF THE SWEETEST KIDS IN THE NEIGHBORHOOD, I WAS THERE BEFORE THEY CAME. ZACH WORKED FOR ME AND HIS SISTER, MARLO WORKS AT PUBLIX, OKAY. AND ZACH, NOW IS AWAY AT COLLEGE, WENT TO THE GROCERY STORE TO PICK UP HIS SISTER AND SAID REPUBLIC, BELIEVE IT OR NOT IN A GREEN UNIFORM, ZACH GETS ROUGHED UP. HE NEEDS AN APOLOGY FOR THAT.SHELL ACCEPT APOLOGIES TONIGHT AND SHE WANTS A PUBLIC APOLOGY.
SHE DOESN'T WANT A PRIVATE APOLOGY. I HAD TO COME INTO THIS PULPIT AND BASICALLY THREATEN OCONNELL BECAUSE HE ROUGHED UP MY BLACK GUY. I BROUGHT ANOTHER BLACK GUY THAT HE COULDN'T ROUGH UP. HOLD ON, THIS ONE RIGHT HERE DESERVES AN APOLOGY, SHE CAME IN WITH HER SON'S STUFF ON. THAT'S THE RUDEST THING, YOU KNOW WHAT, GUYS, YOU HAVE TO UNDERSTAND, LET ME TALK, MAYOR, PAUL OCONNELL TOOK MY BLACK GUY AND PUT HIM IN THE DIRT. I HAD TO WIN LAWSUITS AGAIN AND AGAIN, HUNDREDS OF THOUSANDS I HAD TO TAKE FROM THE GUY. I DON'T WANT TO DO THAT. SO, PLEASE, NOW WE HAVE DEMANDS OF THE RANCHES.
OKAY. YOU COME INTO THE RANCHES, YOU GLEAN THE GOODNESS, YOU BRING THE DOGGY PARTS, THE FARMER'S MARKET, ALL THE EVENTS, WE LOVE IT, IT TAKES US AN HOUR TO GET BACK AND FORTH ON THOSE DAYS, WE DON'T COMPLAIN. OUR ROADS ARE TRASHED. I GO DOWN THE STREET IN MY $84,000 TRUCK, AND I FEEL LIKE I'M IN AN OLD PICKUP TRUCK. YOU BRING ALL THESE PEOPLE IN OUR NEIGHBORHOOD AND THERE'S NO GIVING BACK AND YOU FINE MY NEIGHBORS WHO ARE AGRICULTURAL, THEY DON'T HAVE TO DO NOTHING. WE HAVE FARMER'S RIGHTS. 764 BY 51, THAT'S TERRE BULLETS SIZE. THE FARMER'S RIGHT IS VERY STRONG, WE WON IN FEDERAL COURT WE WANT YOU TO PULL BSO OFF OF THE RANCHES, STARTING TODAY, PLEASE DO NOT HARASS US ANYMORE, YOU DON'T WANT ME TO FILL THESE CHAMBERS.
>> I APPRECIATE YOU COMING HERE TONIGHT AND APPRECIATE YOU
BRINGING UP ALL THESE ISSUES. >> THEY'RE NOT DONE, MAYOR,
POINT OF ORDER. >> THIS IS SOMETHING I THINK WOULD BE BETTER WHERE WE COULD HAVE DIALOG BACK AND FORTH.
>> I'M WILLING TO DO THAT WHEN ARE YOU GUYS READY TO MEET.
>> IF YOU COULD GIVE HIM MY PHONE NUMBER MY E-MAIL.
>> MRS. PERKINS DOESN'T WANT A PRIVATE APOLOGY. PUBLICLY, WITH ALL DUE RESPECT MAYOR, HE WAS DOWN AT PUBLIX TRYING TO PICK UP HIS SISTER, THE KID DIDN'T WANT TO GO DOWN THERE ANY MORE. MY GOD SON WHOSE BLACK DIDN'T LIKE HIM IN THE NEIGHBORHOOD I HAD TO DEFEND AGAINST THE PREJUDICE IN THE NEIGHBORHOOD. I'M FROM MINNESOTA, WE DIDN'T HAVE SEPARATE WATER FALLS OR RAILROAD TRACKS THAT THEY HAD TO GO ON THE OTHER SIDE OF THE RAILROAD TRACKS. WE DIDN'T KNOW THAT STUFF, SO WHEN I CAME DOWN HERE, I DIDN'T THINK THAT I WOULD HAVE THE CHIEF OF POLICE PUT MY BLACK GUY IN THE GROUND SWEATING OUT IN THE 95 DEGREE SUN AND WHEN I COME BY, THEY'RE LAUGHING, CHIEF OCONNELL. PUT PAUL OCONNELL ON THE PHONE, HE SAID, WHERE'S. I WATCHED THE POLICE DEPARTMENT COME AGAINST ME, MAYOR, YOU WEREN'T HERE. BUT ALL THESE GUYS, THEY'RE ALL BEHIND ME NOW. IT WAS JUST ME AND I WAS A YOUNG MAN WHEN I CAME AGAINST YOU AND NOW I'M OLDER AND WISER, THERE ARE POLITICAL ASPIRATIONS, I WOULD LIKE TO TALK A FEW MORE THINGS, MAYOR, BECAUSE THESE PEOPLE CAME FOR ME TO ADDRESS
IT. >> AND I APPRECIATE EVERYONE BEING HERE. I HAVE OFFERED. I'LL MEET YOU TOMORROW.
>> GREAT. >> HOW ABOUT AFTER WORK BECAUSE I WORK 12 HOURS A DAY AND I'M UP AT 5:30.
[00:50:04]
>> I WANT TO TRY AND STAY ON TOPIC, LET ME KNOW YOUR ISSUES, BUT AGAIN, THIS IS NOT UNFORTUNATELY, THIS IS NOT A PLACE WHERE WE COULD HAVE DIALOG. THIS WILL GIVE US NO
OPPORTUNITY. >> I UNDERSTAND THAT MAYOR.
>> I UNDERSTAND THAT, MAYOR AND I APPRECIATE THAT.
>> I HEAR WHAT YOU'RE SAYING AND I APOLOGIZE FOR WHAT HAS HAPPENED. BUT WITHOUT US SITTING DOWN AND HAVING DIALOG, IT'S HARD TO HAVE HAD THAT IN THIS HERE.
>> WE ALL HAVE JOBS AND WE HAVE TO WORK REALLY HARD TO PAY THE
TAXES OVER THERE. >> I HAVE A JOB, I GET ALL OF THAT, AND I CAN APPRECIATE EVERYTHING YOU'RE DOING I JUST WANT TO OFFER WHAT I JUST OFFERED.
>> I ACCEPT YOUR OFFER. >> AND WE DO HAVE TO TRY AND
MOVE ON IT. >> MAYOR, BECAUSE I CAN EXPLAIN SOME OF THE THINGS WE TALKED ABOUT ROADS, WE JUST HAD STRATEGY PLANNING, WE CAN HAVE A DIALOG, THIS IS NOT THE PLACE
>> WE ALL HEAR WHAT YOU'VE SAID.
>> UNFORTUNATELY YOU COULD MEET WITH ME.
>> THERE'S NO SUNSHINE LAW IF YOU GUYS WITH WITH US TOGETHER.
>> IF WE'RE ALL IN ONE ROOM TOGETHER, WE CAN'T MEET?
>> NO. YOU'LL HAVE TO MEET WITH US INDIVIDUALLY. I KNOW ALL MY FELL COMMISSIONERS WILL DO EXACTLY THE SAME AS I'LL DO.
LET'S HAVE DIALOG AND WE CAN ADDRESS EACH ONE OF YOUR ITEMS ONE BY ONE, AFTER OUR DIALOG, YOU'RE MORE THAN WELCOMED TO COME BACK IF YOU'RE NOT SATISFIED. IF YOU WANT TO READDRESS OUR CONVERSATION IN PUBLIC, I WILL GIVE YOU WILL FURTHER OPPORTUNITY TO HAVE THAT CONVERSATION.
>> HOPEFULLY WE DON'T HAVE TO. >> I DON'T THINK WE'LL HAVE TO BUT I WANT TO OFFER THAT NOW, BECAUSE LIKE I SAID, I DON'T WANT TO STOP YOU FROM TALKING BUT WE DO HAVE TO TRY AND MOVE ON THE MEETING AND THEN AFTER OUR DIALOG.
>> I WILL GET TOGETHER WITH YOU FOR SURE TOMORROW.
>> AND I BELIEVE NANCY GAVE YOU MY INFORMATION.
>> I'LL MAKE MYSELF AVAILABLE FOR YOU ACCEPT FOR TOMORROW MORNING AT 8:45. OTHER THAN THAT YOU GOT ME.
>> THANK YOU, MIKE. AND I LOOK FORWARD TO TALKING WITH YOU.
>> THANK YOU, COMMISSIONS AND GUYS FOR LISTENING, KEN, THANK
YOU. >> AND THANK YOU ALL FOR COMING. AND REST ASSURED BACK TO YOU, HOW THAT CONVERSATION.
WE'RE ALL HERE WANTING TO SERVE YOU SO, WE'RE MORE THAN HAPPY TO HAVE CONVERSATIONS WITH YOU, IT'S JUST THIS SITUATION IS DIFFICULT BECAUSE THIS IS NOT REALLY AN OPPORTUNITY FOR BACK AND FORTH DIALOG. SO, DO WE HAVE ANY OTHER COMMENTS FROM THE PUBLIC ON NON-AGENDA ITEMS? MARIE?
>> A NAME AND ADDRESS FOR THE RECORD, PLEASE.
>> WELL, I'M GLAD TO INTRODUCE MYSELF, I'M MARIE I'M FROM I LIVE IN PARKLAND ABOUT 25 YEARS. AND TWO THINGS VERY BOTHER ME.
ONE IS THE ROADS THEY'RE GETTING WORSE AND IN 25 YEARS THEY HAVEN'T DONE NOTHING EXCEPT TAKEN OUR MONEY AND USES THAT FOR WHAT? THIS IS ONE. THE OTHER THINGS I WOULD LIKE TO NOTE OR DO, I WOULD LIKE YOU TO KNOW WE HAVE NO PROTECTION, POLICE PROTECTION IN OUR NEIGHBORHOOD. IT SHOULD NEVER, NEVER, HAPPEN TO ANYBODY IN PARKLAND. PERIOD. POLICE HAVE TO PATROL OUR NEIGHBORHOOD JUST LIKE ANY OTHER NEIGHBORHOOD.
THANK YOU, FOR HAVE AING ME. >> THANK YOU VERY MUCH, MARIE,
IT WAS GREAT TO SEE YOU. >> I HAVE THREE MINUTES.
>> YOU HAVE MORE? >> I WOULD LIKE TO SAY ONE
THING. >> I WOULD LIKE ALL OF YOU TO
PRAY FOR ISRAEL, THANK YOU. >> THANK YOU.
>> ANYONE ELSE? >> COMMENTS FROM THE PUBLIC ON NONAGENDA ITEMS, SEEING NO ONE ELSE, WE'RE GOING TO MOVE TO THE COMMISSION. START WITH COMMISSIONER BRIER.
[00:55:02]
>> THANK YOU, MAYOR, I'LL BE BRIEF, I JUST WANT TO FIRST THANK THE MEMBERS OF OUR COMMUNITY ADVISORY BOARD, DENISE AND DR. ROD FOR ALL THEIR WORK AND ALL THE OTHER MEMBERS OF THE CAB ON THE SCHOLARSHIPS. I THANK YOU GUYS FOR ALL YOUR WORK AND ALL THE WORK THAT THE CAB IS DOING AND ALL OF OUR ADVISORY BOARDS. I WANT TO REMIND EVERYONE THAT WE HAVE OUR MEMORIAL DAY CELEBRATION COMING UP HONORING OUR SOLDIERS AND VETERANS, WE'RE FORTUNATE THIS YEAR THAT WE'RE GOING TO HAVE THE 13TH ARMY BAND PERFORMING AND THAT'S LED BY THE MUSIC DIRECTOR AT MARJORIE STONEMAN DOUGLAS. I WANT TO CONGRATULATE ALL OF OUR SENIORS ON THEIR GRADUATION, THIS HAS BEEN THE MOST CHALLENGING FOR THE KIDS THEY HAVE EVER IMAGINED, THEY HAVE GONE THROUGH THE SHOOTING, THE AFTER MATHS OF THAT AND NOW THE PANDEMIC. MY HOPE IS THAT THESE YOUNG PEOPLE WILL BE ABLE TO ENJOY, THEY WILL BE ABLE TO ENJOY GRADUATION AND HOPEFULLY GO ONTO GREAT THINGS IN COLLEGE AND ELSEWHERE, AND WITH THAT,
I'LL KEEP IT BRIEF. >> THANK YOU, COMMISSIONER
BRIER. COMMISSIONER ISROW. >> I ECHO COMMISSION BRIER'S SENTIMENTS. WE'RE FORTUNATE TO BE ABLE TO DO IT LIVE IN-PERSON, AND I THINK EVEN TONIGHT, SEEING MORE PEOPLE HERE IN THE CHAMBER IS JUST AGAIN A REMINDER OF THE PROGRESS WE'RE MAKING AND IT'S ALL THANKS TO A LOT OF EVERYONE'S CONTRIBUTED EFFORT.
THIS IS NOT SOMETHING THAT PEOPLE DID ALONE, IT REQUIRED KIND OF A QUOTE, TAKES A VILLAGE. SO THANK YOU EVERYONE FOR CONTINUING TO FOLLOW THE GUIDELINES AND MAKING SURE WE'RE DOING EVERYTHING TO KEEP EVERYONE SAFE AND HEALTHY.
COMING ALONG THE END OF THE SCHOOL YEAR, EVERYONE'S AWARE OF THE DIFFERENT OPPORTUNITIES AN PROGRAMS THAT THE CITY HAS FOR THE SUMMER FOR THE KIDS, THERE ARE A LOT OF GREAT OPPORTUNITIES, PROGRAMS, CAMPS, I JUST WANT TO MAKE SURE THAT PEOPLE ARE AWARE OF THIS BECAUSE THIS IS ONE OF THE GREAT THINGS THAT'S AN ATTRIBUTE TO OUR CITY. I WANT TO TALK ABOUT THE SCHOLARSHIPS THAT WE AWARDED TONIGHT, TO HEAR THE KIDS AND ASPIRATIONS AND ACCOLADES, IT'S IMPRESSIVE. DESPITE THE FACT THAT WE'RE DEALING WITH A PANDEMIC, LIFE STILL GOES ON AND A LOT OF THESE KIDS ARE PUSHING FORWARD WITH STUDIES AND EXTRACURRICULARS AND IT'S EXTREMELY IMPRESSIVE AND THEY ALL DESERVE THE REWARD AND RECOGNITION THEY GOT. AND FINALLY, I WANT TO TALK ABOUT GUN VIOLENCE AWARENESS. I THINK IF MY CITY CAN BE A PROPONENT FOR THIS IT'S PARKLAND. THIS IS ONE OF THE ISSUES THAT WILL NOT BE INVOLVED OVERNIGHT OR IN A YEAR, IT'S GOING TO BE AN ONGOING WORK IN PROGRESS AND I APPRECIATE EVERYONE THAT'S COMMITTED TO THAT AND MAKING SURE THIS ISN'T ABOUT TAKING PEOPLE'S GUNS AWAY OR A SECOND AMENDMENT ISSUE. IT'S ABOUT MAKING SURE THAT THE PEOPLE WHO CHOOSE TO EXERCISE THEIR EXACT AMENDMENT RIGHT DO SO IN A SAFE FASHION AND WE PUT CONTROLS IN PLACE TO ENSURE THAT THINGS THAT HAPPEN HERE IN PARKLAND AND AROUND THE WORLD, DON'T HAPPEN AGAIN. FOR THAT, AGAIN, I ECHO, MEMORIAL DAY WEEKEND COMING UP, MAKE SURE WE GIVE THE DUE RECOGNITION FOR THOSE WHO SERVE AND PAID THE ULTIMATE SACRIFICE FOR US TO BE HERE. SAY THE PLEDGE ABOUT FREEDOM AND LIBERTY, IT DOESN'T COME EASILY, I WOULD LIKE TO THANK EVERYONE FOR THAT.
>> THANK YOU VERY MUCH, COMMISSIONER ISROW.
>> COMMISSIONER CUTLER. >> THANK YOU MAYOR, I ALSO WOULD LIKE TO CONGRATULATE THE GRAD GRADUATES AND COULD NOT SAY THE CONGRATULATIONS THAN THE TWO PREVIOUS COMMISSIONERS. I WENT TO AN INCREDIBLE TOUR AT THE CRAIG AND BAR BRA WEANER HOLOCAUST REFLECTION EXHIBIT.
IT WAS AN INCREDIBLE TOUR, THE HIGHLIGHT WAS A VIRTUAL ABILITY THROUGH ARTIFICIAL INTELLIGENCE TO ACTUALLY SPEAK TO A SURVIVOR OF THE HOLOCAUST AND ASK ANY QUESTION. IT'S REALLY INCREDIBLE. I WANT TO THANK MAYOR WALKER WHO GAVE A GREAT
[01:00:02]
STATE OF THE CITY TO THE PARKLAND CHAMBER AND FORMER MA MA MAYOR MICHAEL UDINE FOR TALKING TO US ABOUT WHAT'S GOING ON IN THE COUNTY. LASTLY, I WANT TO LET THE COMMISSION KNOW ON MAY THE 10TH I WAS INVITED TO ADDRESS THE LAUDERDALE LAKE COMMISSION IN REGARDS TO THE LEADERSHIP OF THE RUBIN STAYSSY, A GRIEVANCE INJUSTICE. I TOLD THIS COMMISSION BEFORE COMMISSIONERS BRIER AND ISROW TOOK OFFICE ABOUT THIS PROJECT.SO THAT YOU GUYS ARE UP TO SPEED, AN JULY 19TH, 1935, RUBIN STAYSSY WAS ACCUSED BY A WHITE WOMAN OF ASSAULT HE WAS ARRESTED. MR. STACY DENIED THE ALLEGATIONS OF HAVING ATTACKED ANYONE BUT WAS CONSIDERED GUILTY BECAUSE HE RAN. RATHER THAN USING A POLICE LINEUP, MR. STACY WAS TAKEN TO THE HOME OF THE SNATCHED BY A MOB OF WHITE PEOPLE WHILE IN THE CARE AND CUSTODY OF THE SHERIFF'S AND DEPUTIES, DRAGGED FROM THE POLICE CAR AND LINCHED AND SHOT 13 TIMES. NO WITH STANDING THE FACT THERE WERE CLAIMS OF 100 MASKED MEN INVOLVED IN THE LYNCHING IN WHAT WAS THEN A COMMUNITY OF 9,000 PEOPLE. NOT A SINGLE ONE OF THE PERPETRATORS WAS EVER IDENTIFIED. MR. STACY WAS DENIED A FAIR TRIAL, DENIED ADEQUATE PROTECTION AND DENIED JUSTICE IN OUR COUNTY. IT WAS A COMPLETE SHOCK TO ME AS A HISTORIAN THAT I FOUND OUT ABOUT THAT INFORMATION WHILE DOING RESEARCH FOR PARKLAND'S HISTORY, BECAUSE EVEN THOUGH I WAS BORN AND RAISED IN THIS COUNTY, IT WAS NEVER TAUGHT IN ANY OF THE SCHOOLS THAT I WENT TO, AND SO, I WAS NOT PROVIDED THAT HISTORY GROWING UP. ON MONDAY MARCH 4TH, 2019, WE KICKED OFF A COMMUNITY REMEMBRANCE OUR INTENT WAS TO INITIATE A PARTERSHIP WITH THE EQUAL JUSTICE INITIATIVE IN A CAMPAIGN TO RECOGNIZE THE VICTIMS OF LYNCHING BY COLLECTING SOIL FROM LYNCHING SITE AND ERECTING MEMORIAL MARKERS. SEVERAL OF PARKLAND'S RESIDENTS ARE ON OUR COMMISSION INCLUDING JEFF SCHWARTZ WHO WAS JUST HERE AND ON JULY 19TH OF 2020 BROWARD COUNTY PRESENTED A PROCLAMATION THAT DAY AS RUBIN'S DAY OF REMEMBRANCE DAY. CHANGING THE NAME OF MEMORIAL BOULEVARD TO CONTINUE OUR EFFORTS TO MEMORIALIZED INJUSTICE THAT HAPPENED TO MR. STACY AND BRING AN AWARENESS TO THE SYSTEMIC RACISM IN OUR COUNTRY. THE COMMENTS TONIGHT CERTAINLY BROUGHT ABOUT THOUGHTS IN MY MIND THAT WE NEED TO CONTINUE IN THAT PROCESS OF MAKING SURE THAT THIS KIND OF STUFF DOESN'T HAPPEN. THE HONOR ROADWAY NAME CHANGE AND THROUGH THE EFFORTS OF SWORNSON AND MCKENZIE. THEY EXPECT TO CHANGE THAT ROAD NAME.
I WILL BE REQUESTING THAT THIS COMMISSION AT OUR NEXT MEETING TOGETHER WITH THE COMMISSIONS OF ALL THE MUNICIPALITIES IN THE COUNTY ADD THE LEAGUE OF CITIES WHO HAS ALREADY EXPRESSED THEIR DESIRE TO BE ON BOARD AND ANY OTHER MEMBERS OF OUR COMMUNITY OF GOOD CONSCIENCE TO SHOW THEIR SUPPORT FOR THIS AND THE REMEMBRANCE PROJECT BY POCK PROCLAMATION OR OTHERWISE.
LET'S BRING ON RACIAL JUSTICE AND EQUALITY IN OUR COMMUNITY,
NOW IS THE TIME TO DO THAT. >> THANK YOU, VERY MUCH,
COMMISSIONER CUTLER. >> VICE MAYOR MAYERSOHN?
>> THANK YOU, MAYOR. JUST TO ECHO, KIND OF THE SAME SENTIMENTS AS EVERYBODY ELSE HAS, OBVIOUSLY, CONGRATULATIONS TO OUR SCHOLARSHIP WINNERS, THEY'RE OUTSTANDING YOUNG PEOPLE AND FROM WHAT WE'VE READ AND SEEN THEY'VE GOT A TREMENDOUS CAREER AHEAD OF THEM AND I ALSO WANT TO THANK OR CAB MEMBERS I KNOW IT'S NEVER EASY PICKING OUT WINNERS AND LOSERS,
[01:05:01]
UNFORTUNATELY, I THINK THEY'RE ALL WINNERS, I KNOW YOU GUYS HAVE SPOKEN ABOUT REFORMULATING HOW TO JUDGE NEXT YEAR, THANK YOU YOU GUYS FOR YOUR SERVICE. AGAIN, ECHOING THE SAME SENTIMENTS FOR GRADUATION. CONGRATULATIONS FOR ALL THOSE GRADUATING AND MOVING UP WHETHER IT BE KINDERGARTEN, MIDDLE SCHOOL, HIGH SCHOOL, WHERE EVER IT MAY BE. MAYOR, YOU DID A GREAT JOB AT THE STATE OF CITY. I WANT TO THANK VICE MAYOR FOR BEING HERE AS WELL AS DEBBIE HICKSON. CHALLENGER BASEBALL ENDED THEIR SEASON, THEY HAD A GEAT SEASON, AND REALLY, THEY DID A TREMENDOUS JOB AND THERE WERE SOME OTHER COACHES IN THERE SO CONGRATULATIONS TO ALL OF THEM. AND I DON'T HAVE ALL THE SPECIFIC CHAMPIONS, BUT I THINK LITTLE LEAGUE IS WINDING DOWN SO CONGRATULATIONS TO ALL THOSE THAT HAVE RECEIVED TITLES AND I THINK THEY MOVE ONTO ANOTHER ROUND, SO, GOOD LUCK TO THEM AS THEY MOVE FORWARD. AGAIN, COMMISSIONER BROUGHT UP THE SOLID WASTE WORK GROUP, THE WORK GROUP HAD A DIFFERENT FLAVOR OF GOING BACK TO WHAT WE HAD OF INDEPENDENCE FROM AN INDEPENDENT DISTRICT THAT WAS BEING THE VOICE OF THE STATE BEING THAT YOU HAD TO HAVE A PROCLAMATION OR A BILL GOING TO THE STATE.THERE WERE CONCERNS THAT THE FLAVOR OF THE STATE LEGISLATURE MAY NOT BE TOO FRIENDLY TO BROWARD COUNTY AND IT KIND OF SHIFTED OVER TO SOMETHING MORE LOCAL BUT WE'RE STILL WORKING THROUGH A LOT OF DECISION MAKING PROCESS. SO EVEN THOUGH WE'RE STILL SUPPORTING AN INDEPENDENT DISTRICT. I BELIEVE AS DO OTHERS THAT IT'S A VIABLE COMMODITY. ONE OF THE THINGS WE WILL BE BRINGING BACK IS THERE'LL BE A REQUEST TO DO A SOLID WASTE STUDY. THE COUNTY IS SUPPOSED TO BE FUNDING 50% OF THAT AND THE CITIES ARE FIGURING OUT I GUESS BY POPULATION WHAT THAT COST WILL BE BRINGING THAT BACK ONCE WE GET A SCOPE AND WHATEVER ELSE IT MIGHT BE, THEN I WILL BRING THAT BACK AND IT WILL BE A PART OF THAT INITIAL MEMORANDA OF THE STUFF WE HAVE AND WHEN WE GET THAT WE COULD FURTHER DISCUSS THAT. AND THOSE
ARE MY COMMENTS. >> THANK YOU VERY MUCH, VICE
MAYOR. >> SO, OBVIOUSLY I'M GOING TO ECHO MOST OF THE STUFF MY COMMISSIONERS SAID UP HERE. I'M LOOKING FORWARD TO THE MEMORIAL DAY EVENT TO HONOR THOSE WHO HAVE GIVEN UP THEIR LIVES AND FAMILIES AND WHAT HAVE YOU.
OBVIOUSLY, GRADUATION, I'M EXCITED FOR THE CHILDREN TO BE ABLE TO HAVE THE OPPORTUNITY TO HAVE A LIVE GRADUATION. THAT'S GREAT. OBVIOUSLY, I WANT TO THANK THE VICE MAYOR UDINE. A PARKLAND RESIDENT, SO PARKLAND IS WELL REPRESENTED. I LOVE THAT YOU GUYS CAME, RUPERT TO SAY THE SCHOLARSHIP WINNERS RECEIVE THE CHECK THAT SHOWS DEDICATION, I APPRECIATE YOU GUYS BEING HERE TONIGHT. OBVIOUSLY, CHALLENGER BASEBALL, PARKLAND LITTLE LEAGUE, THEY HAD A SUCCESSFUL SEASON, THEY ARE ALL-STARS START IN A COUPLE OF WEEKS AND I KNOW WE'RE HOSTING TOM OF THE TOURNAMENTS WHICH IS A HUGE EXCITEMENT THERE. I WANT TO SAY THANK YOU TO DEBBIE HICKSON AND THE HISTORICAL SOCIETY, YOU DO AMAZING STUFF, I WANT TO THANK JEFF AND HIS TEAM FOR PUTTING UP THE PORTAL AND KEEPING UP WITH THE PORTALS, EVERYTHING YOU DO WITH THE HISTORICAL SOCIETY WHAT YOU'RE DOING WITH RUBIN STACY, IT'S INSPIRING TO SEE SOME OF THE THINGS YOU DO AND HOW MUCH PASSION YOU HAVE FOR THAT. I THINK HISTORY IS SO IMPORTANT. NOT JUST PARKLAND'S HISTORY BUT HISTORY IN GENERAL. SO WITH WHAT I SAW ON SATURDAY WITH DOING THAT PORTAL, YOU KNOW WITH THE BLUNT SITE, I THINK IT'S IMPORTANT TO TRY AND MAKE MORE EFFORTS TO TRY AND FIND PEOPLE TO TAKE THE BATON AND CONTINUE WITH THE HISTORICAL SOCIETY.
SO, I DON'T KNOW, MAYBE WE CAN REACH OUT TO MSD, MAYBE THEY HAVE A HISTORICAL CLUB THAT WE COULD TRY AND GARNER INTEREST
[01:10:01]
FROM SOME OF THE KIDS TO GET THEM TO BE INTERESTED IN THE PARKLAND. I WAS JUST THINKING ABOUT THAT THIS WEEKEND, AND YOU KNOW, THERE'S KIDS INTERESTED IN EVERYTHING. AND I THINK YOU KNOW THAT MIGHT BE AN OPPORTUNITY TO FIND FRESH BLOOD TO MAKE SURE WE'RE CARRYING ON THE HISTORICAL SOCIETY. OH, MY LAST THING IS TO FDOT, I APPRECIATE THEM DOING THAT PRESENTATION. I KNOW IT GAVE A LOT OF RESIDENTS AN OPPORTUNITY TO SPEAK. SO, I THINK THAT WAS GREAT WE HEARD WHAT THEY SAID, WE WERE ABLE TO HAVE SOME CONVERSATION WITH THEM AT OUR PREVIOUS MEETING. SO THAT WAS GOOD, SO WE'RE CONTINUING OUR DIALOG BUT THE PROJECT IS MOVING FORWARD WHICH IS A GREAT THING.IT'S GOING TO BE A BIG BENEFIT SOT CITY OF PARKLAND. AND THAT'S ALL I HAVE FOR MY COMMENTS. SO, NOW WE'LL GO TO
[8. Approval of the Agenda]
APPROVAL OF THE AGENDA. >> MOTION TO APPROVE?
>> SECOND. >> SO WE HAVE A MOTION TO
APPROVE. ALL IN FAVOR? >> AYE.
[9. Consent Agenda ]
>> PLEASE SHOW IT PASSES UNANIMOUSLY.
>> CONSENT AGENDA? >> MOTION TO APPROVE CONSENT
>> ANYONE FROM THE PUBLIC COMMENT ON THE CONSENT AGENDA?
>> SO WE HAVE A MOTION BY VICE MAYOR MAYERSOHN AND A SECOND BY
COMMISSIONER BRIER. ROLL CALL? >> .
[10. Regular Agenda]
(ROLL CALL) >> PLEASE SHOW IT PASSES
UNANIMOUSLY. >> ITEM 10 A. A RESOLUTION THE CITY COMMISSION OF THE CITY OF PARKLAND FLORIDA TO AWARD THE LOWEST RESPONSIBLE AND BIDDER FOR COVERED BRIDGE PARK ITB 2021 -- 07 IN THE AMOUNT OF 828 THOUTD.
>> I THINK YOU GUYS ARE FAMILIAR WITH IT'S A PIECE OF LAND ON HOMBURG ROAD JUST WEST OF STATE ROAD 7. THE IMPROVEMENTS INCLUDE MULTIPLE NATURE TRAILS, NATURE PLAY AREA FOR CHILDREN, A MEDITATION GARDEN WITH A SMALL GATED PARKING LOT, ALL THAT'S PROPOSED. STAFF'S RECOMMENDING TO AWARD TO THE LOWEST RESPONSE BIDDER. AND I SAY LOWEST BIDDER BECAUSE THE FIRST LOWEST BIDDER THE NUMBER ONE LOWEST WAS DEEMED UNRESPONSIVE. SO WE'RE RECOMMENDING TO AWARD TO M & J IN THE AMOUNT OF $873,000. REALIZING IT IS OVER WHAT THE ORIGINAL DIGITI WAS FOR THIS, BUT I THINK YOU HAVE SOME INFORMATION IN YOUR PACT EXPLAINING THAT THE COST OF MATERIALS HAS GONE UP ET CETERA AND SO FORTH. WE DO HAVE SOME GOOD NEWS AND I WOULD LIKE SHERRY TO COME UP AND SPEAK TO THAT. I THINK YOU'LL FIND THAT INTERESTING AND LIGHT.
>> THANK YOU, MAYOR, VICE MAYOR COMMISSIONERS. I'M THE BUDGET MANAGER IN THE FINANCES DIVISION. GOOD NEWS? YES. WE DO HAVE A GRANT FROM THE FLORIDA DEPARTMENT OF AGRICULTURE AND CONSUMER SERVICES FOR $17,000 AND WE'RE REQUIRED TO MATCH $17,000 TO PLANT TREES. WHICH WE HAD PLANNED TOP PLANT VERY MANY TREES, SHRUBS AND OTHER VEGETATION. AND THAT IS AN AGREEMENT THAT WE'VE ALREADY HAD SIGNED AND IS READY TO GO. THE OTHER PIECE OF GOOD NEWS IS THAT WE WERE LISTED NUMBER SIX OUT OF 43 FOR THE GRANT OUT OF THE DEPARTMENT OF ENVIRONMENTAL PROTECTION AT THE STATE LEVEL, THAT'S PRETTY GOOD THERE'S $8 MILLION REQUESTED, THE STATE HAS NOT FUNDED THIS PROGRAM YET AT LEAST FOR THOSE LARGE PROJECTS. WE'RE HOPING THAT SOME OF THE LOBBIEST WORK UP THERE AND SOME OF THE PARKS AND REC LOBBYING WILL GET THAT FUNDED BECAUSE THERE'S ADDITIONAL FUNDS COMING INTO THE STATE. WE HAVEN'T HEARD YET BUT BEING NUMBER SIX ON THE LIST OUT OF 43 AND THAT WOULD BE A $200 GRANT WITH A $200,000 MATCH BUT THAT'S A WAIT AND SEE BUT WE'RE
SITTING IN A GOOD POSITION. >> THANK YOU VERY MUCH FOR THAT, THAT IS GREAT NEWS AND THANK YOU FOR FINDING THE
>> I KNOW, ABSOLUTELY, I KNOW DURING STRATEGIC PLANNING WE
[01:15:01]
SAID, MAYBE YOU COULD FIND A GRANT AND YOU DID, YOU FOUND TWOSO THANK YOU. >> OBVIOUSLY, WE'RE ALL DISAPPOINTED, IT'S A LITTLE BIT OVER BUDGET, BUT CONSIDERING WHAT'S GOING ON RIGHT NOW, ALL MATERIAL COST LABOR COSTS ARE GOING UP EVERY WHERE, IT'S NOT JUST HERE SO IT'S NOT A REFLECTION ON OUR STAFF WHEN YOU DO THE ESTIMATING IT'S DONE MONTHS AND MONTHS, THIS WAS PROBABLY DONE YEARS AGO. WELL, AT LEAST A YEAR OR A YEAR AND-A-HALF. SO, OBVIOUSLY IT'S DIFFICULT TO PLAN FOR WHAT WE'RE SEEING WITH COST MATERIALS AND LABOR COST AND STUFF LIKE THAT. I WANTED TO MAKE SURE I SAID THOSE POINTS. DOES ANYBODY ELSE HAVE? VICE MAYOR?
>> SHERRY, I HAVE A QUESTION, ON THE FERDAP GRANT, CAN THAT BE USED FOR ANY PROJECT OR IT HAS TO BE USED FOR THIS ONE?
>> THIS HAS TO BE USED FOR THIS ONE IT'S VERY SPECIFIC, HE LISTED EACH ELEMENT, AND WE PRESENTED SITE PLANS FOR ALL OF
THAT. >> THIS PARTICULAR PROJECT IS
THE ONE THAT'S RANKED 6TH? >> RIGHT.
>> WHICH IS GREAT, OBVIOUSLY, YOU KNOW BEING SIX OUT OF 43 PUTS YOU IN A GOOD SEAT TO GET SOMETHING SO THAT'S GOOD NEWS.
>> MY CONCERN ABOUT THIS WAS THAT THIS WAS A PROJECT THAT INITIALLY STARTED AS AN INVASIVE CLEARING AND WE CLEARED OUT THE AREA AND THEN IT KIND OF MORPHED INTO MAYBE WE SHOULD MAKE IT IT INTO A PASSIVE TYPE OF PARK AND ADDED DIFFERENT ELEMENTS AND DIDN'T EXPECT IT TO EXCEED THE BUDGET THAT IT HAS. THERE WERE SOME ISSUES WITH IT REGARDING THE PARKING LOT AND THE TRAFFIC AND JUST TO GET COMMISSIONER ISROW AND BRIER UP TO SPEED IS THAT IF YOU'RE GOING WEST DOWN HOMBURG ROAD, IN ORDER TO GET INTO THE PARKING AREA, YOU HAVE SABLE PASS, AND THEN YOU HAVE TO MAKE A U-TURN. THERE WERE CONCERNS FROM RESIDENTS AND OTHER CONCERNS FROM COUNTRY POINT ABOUT PRIVACY ISSUES AND THINGS LIKE THAT. I KNOW AT THE TIME IT WAS LISTED AS A PRIORITY IN OUR STRATEGIC PLANNING, THE FACT THAT THIS HAS BEEN TWO YEARS IN THE MAKING, I'M NOT SURE HOW THAT PRIORITY LEVEL IS AT THIS POINT AND I'M WONDERING WETHER OR NOT FUNDING FOR THIS MAY BE USED IN OTHER AREAS THAT SEEM AT LEAST A HIGHER PRIORITY.
SO, I JUST PASS IT OUT TO THE COMMISSION TO SEE IF THAT'S SOMETHING MAYBE TO HAVE FURTHER DISCUSSION. I DON'T KNOW FROM A STAND POINT OF THE INVITATION TO BID, HOW THOSE PRICES WILL HOLD UP, WETHER OR NOT WE HAVE TO GIVE THEM A RESPONSE WITHIN 30 DAYS, 15 DAYS, SO, I JUST DON'T KNOW THAT.
>> I THINK THE FACT THAT WE PREVIOUS COMMISSION APPROVED IT, IT WAS IN THE BUDGET, YOU KNOW, I'M NOT SURE THAT I WOULD NECESSARILY WANT TO GO BACK ON WHAT THE PREVIOUS COMMISSION HAD APPROVED AND CONSIDERING ITS WITHIN OUR BUDGET, YOU KNOW...
>> IT'S ABOVE OUR BUDGET. >> WELL, IT'S ABOVE OUR BUDGET, CORRECT, BUT THE PROJECT WAS DEEMED.
>> I MEAN I WAS ON THE COMMISSION AT THE TIME, I THINK KEN AND MYSELF AND YOU WERE ON THERE, MAYOR, I JUST BRING IT UP, I VOTED NO, I CAN'T COME BACK AND ASK TO RECONSIDER IT, IT'S JUST I'M NOT COMFORTABLE WITH SPENDING THOSE DOLLARS ON SOMETHING AT THIS POINT IN TIME THAT I DON'T SEE NECESSARILY AS A PRIORITY ISSUE IN THAT AREA WHICH AGAIN IS MY DISTRICT AND I WALK BY THAT PATH ALL THE TIME. THERE'S NOT A LOT OF TRAFFIC, THERE'S NOT, I MEAN PEOPLE EVEN SITTING BY THE COVERED BRIDGE PARK, IT'S JUST SOMETHING THAT I'M NOT SURE WHETHER THE ESCALATING DOLLARS SHOULDN'T BE OR MIGHT BE SPENT IN OTHER
AREAS, THAT'S ALL. >> OKAY. SO, I JUST WANT TO CONTINUE TO INFORM COMMISSIONER BRIER AND COMMISSIONER ISROW BECAUSE THE INVASIVES WERE REMOVED, IT BECAME AN OPEN SPACE, THERE'S LESS PRIVACY NOW BECAUSE OF ALL THE INVASIVE WE TOOK. SO, ASSUMING WE DO THE PARK AND ADD THE LANDSCAPING, THAT WILL GET THEIR PRIVACY BACK WHICH IS SOMETHING THAT THEY WOULD BE MISSING IF WE DON'T GO FORWARD WITH THIS PROJECT. IT'S
[01:20:05]
A PASSIVE PARK WHICH MEANS IT'S DUSK TO DAWN AT THE MOST, THERE'S NO BATHROOMS OR LIGHTS, THE PLAYGROUND PER SE IS NATURAL IT'S GOT ROCKS, IT'S NOT LIKE SWINGS OR ANYTHING LIKE THAT.IT'S A TRULY PASSIVE PARK AND AGAIN IT'S DUSK TO DAWN. THERE WERE, TO VICE MAYOR'S POINT, THERE WERE ISSUES WITH THE PARK, ORIGINALLY I THINK IT WAS 20 SPOTS IS WHAT WE ORIGINALLY SAID 25 OR SOMETHING LIKE THAT, WE WENT DOWN TO 8, I THINK IF I'M NOT MISTAKEN. AND THE PARKING SPOTS, OBVIOUSLY WERE AN ISSUE, BUT TO HAVE A PASSIVE PARK WHICH WE HAVE NOW ESSENTIALLY WITH COVERED BRIDGE. RIGHT NOW IF PEOPLE WANT TO PARK THERE THEY GOT TO PARK ON THE SIDE OF THE ROAD WHICH IS DANGEROUS AND IT DOESN'T GIVE ACCESS TO HANDICAP. SO PART OF THE REASON WE WANTED TO DO THE PARKING LOT WAS BECAUSE IT WOULD OFFER ACCESS TO EVERYONE. IT WOULD BE SAFER BECAUSE THERE WOULD BE SOME PARKING WHICH WE DID YOU KNOW, SHRINK DOWN DRAMATICALLY, AND BEING A PASSIVE PARK, THERE'S NOT GOING TO BE PEOPLE PARKED THERE AT NIGHT, THERE'LL BE A GATE, NO OVERNIGHT PARKING.
POPLE FROM COUNTRY POINT OR SABLE PASS COME AND SPEAK, AND I UNDERSTOOD THEIR COMPLAINTS, MY CONCERN IS IF WE LEAVE IT LIKE IT IS, TO ME, IT NEEDS TO BE DONE ONLY TO GET THAT AREA BACK TO LOOKING NICE. YOU KNOW, RIGHT NOW IT'S VERY DISSHELVLED WITH THE TREES. THAT'S MY THOUGHT ON IT. COMMISSIONER
CUTLER? >> THANK YOU, MAYOR. SO, AS YOU GUYS PROBABLY KNOW I DID VOTE FOR THIS AND I CONTINUE TO DESIRE TO HAVE THIS DONE FOR A NUMBER OF REASONS, MANY OF WHICH WERE POINTED OUT BY THE MAYOR BUT IN ADDITION TO THAT, AS YOU COME INTO OUR CITY, HOMBURG ROAD IS OUR MAIN ROAD AND THAT'S ONE OF THE FIRST THING THAT YOU SEE. AS I SEE IT EVERYDAY COMING DOWN THE ROAD T IT LOOKS LIKE A TRAIN WRECK. AND I THINK THAT IN ORDER FOR US TO CONTINUE TO UPHOLD THE KIND OF QUALITY CITY THAT WE HAVE WE REALLY SHOULD INVEST IN MAKING THAT A FEATURE OF THE CITY BECAUSE THAT'S AN ENTRYWAY INTO THIS AREA. I THINK THAT MAKING IT A PASSIVE PARK AND WHAT THE DESIGN HAS ENCAPSULATED RELATIVE TOLL THAT WILL ONLY ENHANCE THAT AS YOU COME DOWN THE ROAD. I RECOGNIZE THERE ARE DIFFICULTIES BECAUSE WE DID GO WAY OVER BUDGET RELATIVE TO WHAT WE THOUGHT WE WOULD HAVE OUT THERE. ON THE MATCHING GRANT DOLLARS, THAT WE WOULD BENEFIT FROM, WE HAVE TO MATCH THAT BUT WE COULD MATCH THAT OUT OF THE MONEYS THAT WE WOULD BE SPENDING ANYHOW.
>> THAT'S CORRECT. >> AT LEAST WE'RE GETTING DOLLARS TO HELP MAKE UP FOR THE FACT THAT WE'RE GOING TO BE IN A SITUATION BECAUSE OF COVID AND THE ECONOMY AND ALL THE OTHER STUFF THAT WE'RE DEALING WITH, THROUGH THE GOOD SERVICES OF WHAT SHHERY'S BEEN ABLE TO ACCOMPLISH HERE. I STILL FAVOR THE IDEA OF US MOVING FORWARD WITH THIS, I THINK THAT THE PEOPLE THAT ARE IN THAT DISTRICT THAT USED TO BE MINE THAT'S NOW YOUR'S DID COME BEFORE US AND THEY DID COMPLAIN A LOT ABOUT THE IDEA OF PRIVACY, BUT THE DESIGN THAT THEY'VE PUT FORWARD AND THE WAY THAT THEY'RE GOING TO LANDSCAPING IT, I THINK AT THE END OF THE DAY THEY'RE GOING TO BE VERY HAPPY WITH IT. AND THEY'RE GOING TO GROW TO LOVE IT AND THEY WILL HAVE IMMEDIATE ACCESS TO IT. SO, THAT'S MY THOUGHTS ON IT.
>> COMMISSIONER ISROW. >> THANK YOU, MAYOR. I'M ACTUALLY A LITTLE TORN HERE BECAUSE I AGREE WITH BOTH THE SENTIMENTS OF VICE MAYOR MAYERSOHN, AND COMMISSIONER CUTLER, I THINK FOR ME IT'S THE PROBLEM OF TIMES, I WOULD LIKE TO MOVE FORWARD BUT THE QUESTION IS ARE THESE GRANTS TIME BOUND MEANING THEY HAVE TO BE EXPENDED IN A CERTAIN TIME PERIOD?
>> YES, THE TREE GRANT IS DUE BY NEXT FEBRUARY, WE HAVE TO GET THOSE TREES PLANTED. THE FERDAP GRANT IF FUNDED WE HAVE MULTIPLE
YEARS TO GET THAT DONE. >> IN TERMS OF PRIORITIZATION,
[01:25:03]
I AGREE, THIS MIGHT NOT BE A HIGH PRIORITY ITEM. IF THERE'S A POSSIBILITY OF RECOGNIZING THAT WE COULD PUSH THIS THING OUT AND EVERYONE HOPES THAT AT SOME POINT THE INFLATION THAT WE'RE SEEING IN TERMS OF COST MATERIALS AND SERVICES, WILL HOPEFULLY SELF REGULATE. BUT THE QUESTION FOR ALL OF US TO ASK OURSELVES IS WHETHER THIS IS A PRIORITY THAT IS HIGHER THAN OTHER ITEMS ON THE STRATEGIC PLANNING LIST ESPECIALLY SOME THAT WE MAY HAVE PUSHED OUT TO FURTHER DATES. THIS IS NOT NECESSARILY TO SAY NO TO THE PROJECT, BUT MAYBE NOT NOW BUT>> OBVIOUSLY I HAVE CONCERNS OF BEING OVERBUDGET, IT'S GO TO HEAR WE HAVE AN OPPORTUNITY TO CAPTURE $17,000. DO WE HAVE ANY IDEA WHEN THE GRANT WILL BE ANNOUNCED OR SITED?
>> IT'S NOT IN THE BUDGET RIGHT NOW, SO WE'RE WAITING TO SEE IF THE BUDGET FOR THE STATE CHANGES IN ANY WAY WITH THE NEW RELIEF
PACKAGES COMING THROUGH. >> I DO AGREE THAT THIS IS A PRIORITY FOR THE CITY. I'VE SEEN THAT BRIDGE FOR A LONG, LONG TIME BEEN THERE FOR FAMILY PHOTOS. WE'VE BEEN THERE FOR DAY AT THE PARK WHEN THE KIDS WERE LITTLE. AND I AGREE WITH COMMISSIONER CUTLER THAT IT IS ONE OF THE FIRST THINGS THAT PEOPLE COMING INTO THE CITY OF PARKLAND SEE AND RIGHT NOW IT'S NOT THE MOST BEAUTIFUL OF SPOTS. I HAVE MY OWN CONCERNS ABOUT THE OVERBUDGET BUT MY CONCERN IS IF WE GO ON FURTHER AND KICK THIS CAN DOWN THE ROAD, ARE WE GOING TO BE FURTHER OVER BUDGET BECAUSE I DON'T SEE COSTS ADJUSTING ANYTIME IN THE IMMEDIATE FUTURE AND I KNOW THE CITY'S DONE A GOOD JOB OF TRYING TO GET BIDDERS IN. SO MY HOPE IS THAT WITH THE BUDGET OVERAGE THAT WE'RE AT, MUCH OF THAT, ALMOST ALL OF IT WILL BE ABSORBED BY THE GRANT FUNDING THAT WE'RE HOPEFULLY ABLE TO ACCOMPLISH. WITH THAT, LET'S SEE WHERE IT GOES.
>> AS FAR AS WAITING, THE COSTS WILL NOT COME DOWN. AND THIS PROJECT IS READY. LIKE WE'RE DESIGNED, LIKE WE'RE READY.
>> SO, THIS IS A PROJECT FIRST THING YOU SEE WHEN YOU DRIVE DOWN HOMBURG IS THIS AREA, THIS PROJECT IS READY SO IT'S WE'RE OVER BUDGET, WHAT, 200 AND SOME ODD THOUSAND?
>> $274,000. WHICH WE COULD POTENTIALLY GET BACK. KNOWING WE'RE RANKED 6 OUT OF 43 AND IT'S $8 MILLION. YOU KNOW, YOU WOULD LIKE TO THINK THAT ONCE IT GETS FUNDED WE'LL GET THAT. AND WHETHER WE PAY FOR THE PARK IN FULL, THAT GRANT IS STILL SOMETHING WE COULD USE TO OFFSET THE COST OF MONEYS SPENT,
CORRECT? >> YES. THE FERDAP GRANT, WAS
THAT FUNDED LAST YEAR? >> YES AND WE GOT IT LAST YEAR.
>> SO, DO YOU HAVE A SENSE OF TIME FRAME OF?
>> WELL, JULY 1ST IS THE BUDGET FOR THE STATE, SO HOPEFULLY
WE'LL HEAR BEFORE JUNE 30TH. >> AND I GUESS FROM A PROCUREMENT STAND POINT, DO WE HAVE TIME TO LET'S SAY, AND I JUST THROW THIS OUT THERE, TABLE IT UNTIL JUNE'S MEETING AND THEY'RE STILL HOLDING A PRICE OR DO THEY TURN AROUND AND
GO NO, THEY'RE NOT INTERESTED. >> A BID VALIDITY IS TYPICALLY 90 DAYS. WE CAN ALWAYS ASK FOR AN EXTENSION.
>> 90 DAYS FROM THE DAY OF OPENING, SO THAT WAS ABOUT A MONTH AGO, TO WE WOULD HAVE 2 MONTH LEFT.
>> SO IF WE TABLE THIS TO OUR JUNE MEETING THAT WOULD STILL GIVE US AT LEAST SOME FLAVOR OF WHERE WE MIGHT BE BETTER?
>> THEN, YOU WOULD KNOW IF WE HAVE THE $200,000.
>> SO, FOR ME, OBVIOUSLY, GETTING THE GRANT IS BETTER, BUT I WOULD LIKE TO MOVE FORWARD WITH THE PROJECT WHETHER WE GET THE GRANT OR NOT. KNOWING WE'RE 6 OUT OF 43 GIVES ME CONFIDENCE THAT WE WILL MORE THAN LIKELY GET THE GRANT. WE'VE GOTTEN THE GRANTS BEFORE. I WOULD STILL WANT TO MOVE WITH THE PARK
REGARDLESS. >> RIGHT NOW IT'S NOT IN THE STATE BUDGET. IT'S AN $8 MILLION ASK FOR THOSE 43
PROJECTS AND IT'S NOT BUDGETED. >> SO, COMMISSIONER CUTLER?
>> JUST A QUICK QUESTION, EVEN IF IT DOESN'T GET FUNDED THIS YEAR, IT CAN BE FUNDED NEXT YEAR? NO?
[01:30:07]
>> NO, IT'S ANTNNUAL. >> THE BID OPENING WAS MARCH 23RD, SO 90 DAYS FROM THAT DATE WILL BE THE MAXIMUM.
>> WE'RE NOT GOING TO KNOW BY OUR NEXT MEETING. SO HAVING THIS WAIT, TO ME, WE EITHER APPROVE IT NOW OR SCRAP THE PROJECT ALL TOGETHER. WHICH I'M CERTAINLY NOT IN FAVOR OF. THIS IS A PROJECT, AGAIN, COMMISSIONER CUTLER SAID, THIS IS RIGHT ON THE FRONT OF HOMBURG, THIS IS A LARGE FACE TO OUR CITY WHILE I'M DISAPPOINTED WE'RE OVER BUDGET, WE'RE GOING TO SEE THAT HAPPENING FOR THE NEXT YEAR OR TWO AND IT'S UNFORTUNATE BUT IT'S GOING TO HAPPEN. THIS WILL NOT BE THE LAST PROJECT OVER BUDGET AND IF WE WAIT, THINGS WILL GET MORE EXPENSIVE AND IT WILL PUT US MORE OVER BUDGET AND TO ME AS FAR AS PRIORITIES CONCERNED WITH OUR LATEST STRATEGIC PLANNING I WOULD HAVE PUT THERE WAY UP THERE BECAUSE IT'S AT THE FOOT OF HOMBURG. I BELIEVE THE RESIDENTS WHO ARE DISAPPOINTED ABOUT THEIR VISIBILITY, ONCE THIS PARK IS DONE AND THE TREES ARE UP, THEY'RE GOING TO GET THAT BACK. THEY'RE GOING TO HAVE THEIR PRIVACY BACK AND WE DID, YOU KNOW, SHRINK OUR PARKING TO MAKE IT SAFER. WE DIDN'T PUT PARKING SO PEOPLE COME THERE, WE PUT PARKING THERE SO IT'S SAFER FOR OTHERS AND IT BEING A PASSIVE PARK FROM DUSK TO DAWN TELLS ME, LET'S ME HONEST, HOW MANY PEOPLE GO TO THE PARKS.ORG THE EVENING.
>> I HAVE A QUESTION FOR ANTHONY, YOU SAID THAT THERE'S 90 DAY BUT THEN THERE'S THE OPPORTUNITY FOR THE BIDDER TO
VOLUNTARILY EXTEND. >> YOU COULD REACH OUT AND ASK IF THEY WOULD ACCEPT AN EXTENSION TO THE 90 DAYS.
>> GIVEN THAT WE'RE NOT GOING TO HEAR BACK ON THE GRANT WITHIN TIME OF THE NEXT MEETING TO AT LEAST TABLE IT UNTIL THE NEXT MEETING, GIVE ANTHONY THE OPPORTUNITY TO GO AND SEE IF THIS BIDDER IS WILLING TO EXTEND EVEN TO A MONTH. BECAUSE THERE'S NO NEGATIVE INFLUENCE, IT'S EITHER WE GET TO THE NEXT MEETING AND THEY'RE NOT WILLING TO.
>> SO, WE HAVE TO ASK OURSELVES DO WE WANT TO DO THIS PROJECT ONLY IF WE GET THE GRANT. SO IS THIS A PROJECT YOU WANT TO DO
ONLY IF WE GET THE GRANT? >> I THINK IT'S MORE OF AN INFORMED DECISION OF WHETHER TO DO THE PROJECT RIGHT NOW BASED ON THE GRANT OR NOT. THAT'S MY POSITION ON IT. MEANING THERE'S NO DETRIMENT IN WAITING FOR THE BIDDER THE OPPORTUNITY TO
EXTEND. WE DON'T LOSE ANYTHING. >> I KNOW WE DON'T LOSE ANYTHING, BUT AGAIN, MY QUESTION IS IF WE DON'T GET THE GRANT DO
WE NOT WANT TO DO THE PROCESS. >> I THINK IT CHANGES THE DYNAMIC OF THE DECISION PROCESS, YES. IF WE WANT TO MAKE AN INFORMED DECISION TO HAVE AS MUCH AS INFORMATION AS POSSIBLE.
>> VICE MAYOR? >> MAYOR, I UNDERSTAND WHERE YOU'RE GOING IS THAT OBVIOUSLY, YOUR COMMITMENT TO DO THIS PROJECT I THINK IS A VERY VALID CONCERN. I WOULD OFFER AND SAY THAT MAYBE, AGAIN, DEPENDING UPON THE GRANT BECAUSE THAT'S REALLY WHERE IT ESCALATES ABOVE THE BUDGET. I MEAN IF WE'RE TALKING ABOUT $35,000, THAT'S NOT A HUGE JUMP ESPECIALLY WITH THE WAY PRICES ARE GOING. THERE'S ALWAYS THE OPPORTUNITY TO CHANGE THE SCOPE OF THE PROJECT AS YOU SAID, A LOT OF THE COVER WITH THE TREES AND EVERYTHING ELSE CAN BE INCORPORATED WHEN YOU TAKE A LOOK AT THE 6-ACRE PARK, IT'S STILL A PARK AND HAS COVERAGE AND HAS TREES BUT IT'S NOT AS EXTENSIVE WITH THE SCOPE OF WORK OF THIS PARK WITH THE ELEMENTS IN THERE. THAT MAY BE SOMETHING TO WORK WITHIN THE BUDGETARY
DOLLARS. >> BUT THEN WE'RE TALKING ABOUT
A REDESIGN. >> IT'S GOING TO COST US $119,000 FOR A DESIGN AND YOU'RE TALKING ABOUT ANOTHER $100,000.
YOU MAY BE BACK TO THE $800,000. BILL, YOU WANTED TO SAY
SOMETHING IN IS >> I THINK ONE OF THE EVERYBODY
[01:35:05]
TALKED ABOUT REMOVING THE INVASIVE. AND WE HAVE ESCALATING COSTS FOR DIFFERENT REASONS THE ECONOMY ET CETERA.BUT WE HEARD THE RESIDENTS AND WE PROGRAMMED IN MUCH MORE MATURE LANDSCAPING, BIGGER TREES AND THOSE KINDS OF THINGS. I WOULD JUST CAUTION YOU IF WE GO TO SCALPING OUT THINGS THAT MAY COMPROMISE THAT. BECAUSE IF THE WISH OF THE COMMISSION IS TO PUT IT BACK IN THERE AND PROVIDE VIE PRIVACY. I WOULD MAKE A MOTION THAT WE APPROVE THE RESOLUTION 10-A AND MOVE FORWARD WITH THE
PROJECT. >> ANYBODY HAVE A SECOND?
>> I WOULD, I ECHO THE SENTIMENTS OF COMMISSION ISROW AND MAYERSOHN THAT I'M ALL FOR THE PROJECT AND I WANT IT TO OCCUR IF THERE'S NO PREJUDICE FOR US BEING IN A POSITION TO KNOW MORE ABOUT THE FUNDING PROCESS IN THE NEXT 30 DAYS, THEN, I DON'T SEE THE DOWN SIDE OF APPROVING IT AT THAT TIME.
I'M ALL FOR THE PROJECT, I'M TRYING TO BE THE EQUALIZER TO WHAT I SEE AS TWO DIFFERENT SIDES TO IT. BUT WITH THE GREAT WORK OF OUR TEAM, AND WE GET THE FUNDING, WE'RE AT LEAST IN A BETTER POSITION TO KNOW THAT WE'RE GOING TO MOVE FORWARD. I AGREE THAT MODIFYING THE PROJECT TO SCALE IT DOWN WILL NOT SERVE THE INTEREST OF THE RESIDENTS, I ADEGREE THAT THE COSTS ARE WHAT THEY ARE, AND WE'RE A LITTLE TAKEN ABACK BY THE ESCALATION AND THE COST ASSOCIATED WITH THE PROJECT. BUT I ALSO AGREE THAT THIS IS PART OF THE CHARM AND CHARACTER AT THE HEART OF PARKLAND, AND PUTTING THE FUNDS INTO THIS COVERED BRIDGE IS PART OF PRESERVING THAT HISTORY AND CHARM. SO, I WANT TO BE MINDFUL OF THAT. NOW, WETHER OR NOT WE GET VOTED ON OR WHETHER THIS GETS VOTED ON AND APPROVED TWO WEEKS FROM NOW OR A MONTH FROM NOW, I DON'T SEE THAT AS BEING A CONSEQUENTIAL DELAY.
>> THE ONLY ISSUE WE HAVE IS THE BIDDER IS IN THE SAME BOAT WE ARE. HE'S GOING TO HAVE TO REACH OUT TO HIS SUPPLIERS TO SEE IF THEY WILL HOLD THEIR PRICING OVER THE 90 DAYS.
THEY'RE IN THE EXACT SAME BOAT. >> WHICH THEY COULD NOT. WHICH
MEANS, WE COULD BE. >> YOU'RE BASING OUR DECISION ON HIM SAYING I'LL GIVE YOU MORE TIME TO MAKE SURE DECISION, I DON'T KNOW IF, ANTHONY WILL HAVE THAT CONVERSATION, I DON'T KNOW IF HE'S GOING TO SAY YES, I'LL HOLD THE PRICE FOR ONE HON AND TEN DAYS. IT COMES DOWN TO WHAT THE MAYOR SAID BEFORE, AND THAT IS IS THIS A DECISION DEPENDENT ON GETTING THIS FUNDING OR NOT.
ONE WAY OR THE OTHER, IF THERE'S NO FUNDING, ARE YOU GOING TO SAY NO? I MEAN, THAT'S WHAT IT COMES DOWN TO.
>> I MEAN, TO ME THAT'S EXACTLY THE POINT. IF WE DON'T GET THE FUNDING WE DON'T WANT THE PROJECT. IF WE DIDN'T KNOW ABOUT THE FUNDING TODAY WE WOULD HAVE HAD TO MAKE A DECISION ONE WAY OR THE OTHER WHETHER WE WANT TO GO FORWARD WITH THE PROJECT.
FOR ME, AGAIN, THIS IS RIGHT ON THE FRONT OF HOMEBURG. EVERYONE WHO DRIVES DOWN HOMEBURG SEES THIS. IS THERE ANYONE HERE FROM THE PUBLIC WHO WOULD LIKE TO SPEAK ON THIS AGENDA ITEM?
>> SEEING THAT THERE'S NO ONE FROM THE PUBLIC WANTS TO SPEAK ON THE AGENDA ITEM TELLS ME THE RESIDENTS VOICED THEIR CONCERNS, ONE WAS THE PARKING, WE CUT THE PARKING FROM 20 TO EIGHT, AND THE SECRETARY WAS HOW MUCH PRIVACY THEY WERE GOING TO BE GIVEN, AS BILL STATED WE BEEFED THAT UP. SO, WE HEARD THEIR CONCERNS AND WE ADDRESSED THEIR CONCERNS TO THE BEST OF OUR ABILITIES BY ADDING ADDITIONAL LANDSCAPING AND REDUCING THE AMOUNT OF PARKING. SO, FOR ME, IT'S I WOULD APPROVE THIS NOW.
YES, I'M DISAPPOINTED IT'S OVER BUDGET, I UNDERSTAND THE TIMES WE'RE IN, WE'RE GOING TO SEE THIS MORE AND MORE OFTEN, I SEE THIS EVERY SINGLE DAY IN MY BUSINESS. EVERYDAY, THIS ISN'T
[01:40:03]
GOING TO CHANGE ANYTIME SOON, I WISH IT WOULD BUT IT'S NOT GOING TO. SO WE JUST NEED TO DECIDE WETHER OR NOT WE WANT TO DO IT.I'M NOT A FAN OF WAITING. SO IF YOU DON'T, I GUESS KEN'S MOTION, I'LL PASS THE GAVEL AND I'M GOING TO SECOND THAT MOTION BECAUSE I SEE IF WE DON'T DO IT I WANT TO DO THIS PARK WHETHER WE GET THE MONEY OR NOT. IF WE GET THE GRANTS WHICH I FEEL CONFIDENT WE HAVE AN OPPORTUNITY TO GET IT ALTHOUGH IT'S NOT IN THE BUDGET, I SEE THAT AS A BONUS BECAUSE I THINK THIS PROJECT NEEDS TO HAPPEN. SO, YOU ARE IN CHARGE.
>> IS THERE ANY FURTHER DISCUSSION?
>> OKAY. ROLL CALL. >> COMMISSIONER CUTLER?
>> YES. >> COMMISSIONER ISROW?
>> NO. ON THE BASIS THAT I STILL THINK WE SHOULD WAIT AND SEE GIVE IT TIME TO FIND OUT IF WE GET THE FUNDING, I'M NOT SAYING NOT TO DO THE PROJECT I DON'T THINK IT'S AN IMMEDIATE
PRIORITY. >> COMMISSIONER BRIER?
>> YES. >> VICE MAYOR MAYERSOHN?
PASSES 3 TO TWO. >> CONSIDERATION OF AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PARKLAND RIGHTS OF WAY OF THE CITY OF LAND DEVELOPMENT CODE TO CONFORM TO STATE LAW AND PROVIDE OBJECTIVE DESIGN STANDARDS PROVIDING FOR CONFLICT, SEVERABILITY AND AN EFFECTIVE DATE, AND IF I MAY SPEAK ON THIS SINCE FIRST READING I HAVE BEEN CONTACTED BY A NUMBER OF INDIVIDUALS AND THEIR ATTORNEYS, WHICH IS TYPICAL WHEN YOU DO TELECOMMUNICATIONS ORDINANCES THESE DAYS, THEY HAVE DIFFERENCES OF AGREEMENT. I THINK I'VE WORKED THROUGH A LOT OF THOSE ISSUES, AND I JUST WANTED TO POINT OUT BECAUSE I KNOW WE DID RECEIVE A COUPLE OF COMMENTS FROM THE INDUSTRY THAT THE FIRST, LET ME AGAIN REMIND YOU WE'RE TALKING ABOUT TELECOMMUNICATIONS FACILITIES IN THE RIGHT'S OF WAY NOT ON PRIVATE PROPERTY OR OTHER CITY PROPERTY NOT IN THE RIGHT'S OF WAY. AND THE GOAL OF PREPARING THIS ORDINANCE WAS JUST TO DEAL WITH THE LIMITED ISSUES OF THE REGISTRATION PROCESS WHICH IS THE FIRST THINK THAT THE TELECOMMUNICATIONS COMPANIES THEY NEED TO DO BEFORE INSTALLING AND THEN SMALL WIRELESS FACILITIES BECAUSE THOSE ARE THE APPLICATIONS THAT YOU'RE SEEING MODERN DAY TODAY.
I DON'T THINK WE'VE GOTTEN ANOTHER APPLICATION IN THE RIGHT-OF-WAY FOR YEARS THAT WASN'T A SMALL WIRELESS FACILITY. SO MANY OF THE COMMENTS WE RECEIVED WERE OUTSIDE OF THE SCOPE OF THAT AND WERE ABOUT EXISTING PROVISIONS MANY OF WHICH WERE RAISED A FEW YEARS AGO. I FEEL CONFIDENT THAT WHAT WE HAVE BEFORE YOU COMPLIES WITH STATE LAW AND THERE WAS AN ADDITIONAL COMMENT WE RECEIVED BEFORE THE MEETING, I'M NOT SURE WHY THAT INDIVIDUAL DID NOT SHARE KNOWS COMMENTS WITH ME EARLIER. THE ONLY ONE CHANGE I WOULD REQUEST, VERY MINOR, THERE WAS A COUPLE OF REFERENCES THAT WE ADDED TO THE NEW FDOT UTILITY MAN NEWLY. WE ADDED THAT 2017 REFERENCE BUT THERE WAS ONE ADDITIONAL PROVISION THAT STILL REEMBODYED 2010. SO IF YOU DESIRE TO APPROVE THIS I WOULD RECOMMEND AN AMENDMENT OF SECTION 105120 F 4 TO REFLECT THE 2017 AND THE

SMALL WIRELESS FACILITIES SHOULD BE DELETED. ANY REQUIREMENT THAT WILL EXISTING UTILITY POLES COMPLY WITH DESIGN STANDARDS

PROPOSED ORDINANCE, THIS PROVISION SHOULD BE REVICED TO REFERENCE THE 2017 ADDITION OF THE FLORIDA DEPARTMENT OF TRANSPORTATION UTILITY ACCOMMODATION MANUAL. 337.4017 D 11. THIRD SENTENCE CURRENTLY READS, THE GROUND MOUNTED EQUIPMENT COMPONENTS OF THE SMALL WIRELESS FACILITY SHOULD BE PAINTED HUNTER GREEN.FLORID STATUTE SECTION 337.4017 R STATED THAT WHATEVER COLOR BE REASONABLE. IN ADDITION, THERE SHOULD BE MORE FLEX ABILITY ON THE METHOD OF COLORATION BEYOND PAINT BECAUSE PAINTING MAY NOT BE THE OPTIMAL METHOD OF COLORATION FOR TECHNICAL REASONS, THEREFORE A REQUIREMENT IS NOT PRACTICAL AND IS UNREASONABLE. WE REQUEST THE CITY MODIFY THE LANGUAGE TO STATE THAT THE GROUND MOUNTED EQUIPMENT COMPONENTS OF THE WIRELESS FACILITY SHALL BE GREEN. FLEX ABILITY NECESSARY WITH RESPECT TO THE COLOR REQUIREMENT AND THE METHOD OF COLORATION. IN ADDITION, THE PROPOSED ORDINANCE ONLY ADDRESSES CERTAINLY PROVISIONS OF ARTICLE 105 OF THE CITY'S LAND CODE. DO NOT COMPLY WITH FLORIDA STATUE SECTION 337.401 INCLUDING 2019 AMENDMENTS TO THE STATUE. WE REQUEST THAT THE CITY POSTPONE THE ADOPTION OF THIS ORDINANCE.
>> THIS IS FROM DEBORAH MARTEGUE.
>> ON BEHALF OF MY CLIENT T MOBILE SOUTH LLC, WE HAVE APPRECIATED WORKING WITH YOUR CITY ATTORNEY GENERAL ANTHONY SOROKA. GOVERNORED BY ARTICLE 105. WHILE WE UNDERSTAND AND APPRECIATE THAT THE GOAL OF THIS PROPOSED AMENDMENT IS AN UPDATE IN RESPONSE TO SB 1,000 EFFECTIVE JULY 1ST, 2019.
CONTAINED IN ARTICLE 105. T MOBILE IS CONCERNED THAT ISSUES IDENTIFIED IN 2017-2018 REMAIN VAGUE OR OBJECTIONABLE. BUT WITH RESERVATIONS AS DESCRIBED BELOW. WE STRONGLY ENCOURAGE THE CITY TO AMENDMENT THE ORDINANCE DEFER BRIEFLY TO RESOLVE OR CONTINUE THE DIALOG WITH THE INDUSTRY IN THE NEAR FUTURE TO FIND A MUTUALLY AGREEMENT. ON BEHALF OF T-MOBILE THE FOLLOWING ARE CONTINUING OBJECTIONS FOR THE RECORD. ONE, WE HAVE EXPRESSED CONCERNS WITH THE DIMENSIONAL LIMITATIONS IN B 1 IN 2017-18. T-MOBILE BELIEVES SUCH LIMITATIONS ARE IN CONFLICT WITH THE FLORIDA STATUTES.
RESPECTFULLY, WE REQUEST THAT ANY AND ALL PHYSICAL LIMITATIONS BE DE-LEED TO AVOID CONFLICTLE VOLLEYBALL METRIC ENVELOPE IN LIEU OF PHYSICAL DIMENSIONS. IN THE EVENT THESE DIMENSIONAL LIMITATIONS ARE RETAINED THIS WOULD INADVERTENTLY UNLAWFUL BARRIER TO ENTRY. BASED UPON OUR MOST RECENT DISCUSSIONS WITH ATTORNEY ANTHONY SOROKA WE UNDERSTAND 105 IS INTENDED TO 105-40B. AND THE EXCEPTION ONLY FOR SHROUDED TOP, MOUNTED SMALL WIRELESS FACILITY ANTENNAS IN 105. DIALOG WITH THE CITY STAFF TO IMPLEMENT THE ORDINANCE IN AN EFFORT TO DETERMINE WETHER OR NOT ANY LANGUAGE GIVES RISE TO ANY REAL WORLD IMPLEMENTATION ISSUES. IN THE EVENT THAT OCCURS WE AGREE TO NOTIFY STAFF AND DETERMINE THEN IF A LEGISLATIVE AMENDMENT IT APPROPRIATE. THANK YOU FOR YOUR TIME AND CONSIDERATION, IT'S IMPORTANT FOR T-MOBILE TO WORK WITH THE CITY OF PARKLAND IN A POSE AND CONSTRUCTIVE MANNER TO BRING UPGRADED WIRELESS SERVICE BEST REGARDS.
>> DID YOU GET ALL THAT ANTHONY SOROKA?
>> I GOT EVERY WORD. >> SO, WHERE WERE WE.
COMMISSIONER CUTLER? >> I JUST WANT TO CLARIFY, BASED ON YOUR ANALYSIS OF WHAT THESE TWO COMMENTS HAVE SAID RELATIVE TO THOSE PROVISIONS, YOU'RE CONFIDENT WITH HOW WE
HAVE THIS STRUCTURE? >> I JUST WANT TO POINT OUT A COUPLE OF THINGS, MOST OF THE COMMENTS WERE REGARDING EXISTING LANGUAGE THAT'S NOT BEING PROPOSED TO CHANGE TONIGHT AND THE REALITY IS IN THIS AREA OF THE LAW THERE'S PRETTY MUCH A STATE LAW ALMOST EVERY YEAR, SOMETIMES THERE'S TWO EACH YEAR THAT AMEND THE RELEVANT STATUTE AND IT'S ALWAYS TO FURTHER RESTRICT YOUR ABILITY TO REGULATE. SO, I COULD BRING AN ORDINANCE TO YOU THEORETICALLY EVERY YEAR TO DO THAT, BUT WHAT WE CHOSE TO DO IN THIS INSTANCE IS FOCUS ON THE APPLICATIONS WE DO GET WHICH ARE THESE SMALL WIRELESS APPLICATIONS. TO THE BEST OF MY KNOWLEDGE WE'VE NEVER HAD AN ISSUE WITH THEM. SO, JUST WANTED TO POINT THAT OUT WITH THAT ONE AMENDMENT, IF AT SOME POINT IT MAKES SENSE TO DO WHOLE SALE REVISIONS TO THE REMINDER OF THE ORDINANCE, WE COULD LOOK AT THAT AGAIN AND MANY OF THESE THINGS HAVE BEEN BROUGHT UP BEFORE, BUT WITH RESPECT TO WHAT'S BEFORE YOU SUBJECT TO THAT MINOR 2010 TO 2017 REVISION, I'M CONFIDENT IT'S WITHIN THE LAW AND IT WILL BE IMPLEMENTED IN THE LAW. IT'S A STATETORY WAIVER THAT YOU'RE REQUIRED TO HAVE. AND IF THERE WAS A TIME THAT AN APPLICANT SUBMITTED AND THEY HAD A BASIS THAT SOME OF OUR PROVISIONS WEREN'T REASONABLE, WE HAVE A PROVISION FOR THEM TO COME IN
AND MAKE THOSE CLAIMS. >> ON THAT BASIS AND SUBJECT TO THE 2017 CHANGE, I'LL SECOND THE MOTION.
>> WHO MADE THE MOTION? >> I THOUGHT YOU MADE THE
>> THE QUESTION I HAD IS -- THE MOTION WAS BEFORE I HEARD THE COMMENT. THE POINT OF MY QUESTION IS, I DON'T WANT TO INVITE A LAWSUIT ESPECIALLY WITH T-MOBILE. WHEN WAS THE LAST TIME WE HAD A DIALOG WITH THEM AND IS THAT A CONTINUING DIALOG, WHEN THEY SPEAK ABOUT THIS, HOW IS IT LEFT OFF? MEANING DID THEY REQUEST SOMETHING AND WE SAID NO, OR IS IT LEFT
OPEN-ENDED? >> SO, PRETTY MUCH EVERY TIME WE PROPOSE A TELECOMMUNICATIONS ORDINANCE, GENERALLY THE INDUSTRY GETS INVOLVED. I'VE HAD GOOD COMMUNICATIONS WITH T-MOBILE. AGAIN WE'RE NOT REVISING THOSE OTHER PROVISIONS OF THE ORDINANCE AND WE HAVEN'T RECEIVED AN APPLICATION OUTSIDE OF THE SMALL WIRELESS CONTEXT IN YEARS, SO THERE HASN'T BEEN AN ISSUE. BUT DEBORAH IN THIS CASE KNOWS, SHE CALLS ME AND WE CONTINUE THE DIALOG. THERE WAS ONE ISSUE RAISED ABOUT SOMETHING
[01:55:03]
IN HERE AND ATTORNEYS AGREE TO DISAGREE. AT THIS POINT I'M NOT CONCERNED AND IF THERE WAS A VALID ISSUE WE WOULD LOOK AT IT AND WE WOULD ADDRESS IT IN ACCORDANCE WITH STATE LAW.>> AND THAT WAIVER INCLUDES ALL THE POTENTIAL MATTERS, MEANING
THE COLOR IT'S BROAD? >> IT'S A BROAD WAIVER AND I THINK ALL THE EXISTING FACILITIES DO HAVE THEIR MOUNTED EQUIPMENT PAINTED HUNTER GREEN. THE LITTLE AREA YOU COULD REGULATE THAT'S ONE OF THEM. I BELIEVE THEY'RE ALL PAINTED
HUNTER GREEN. >> THEY'RE HUNTER GREEN IN THE
CITY'S RIGHT-OF-WAY. >> WHEN I HEAR SOMEONE COMING FROM THE LAWYER OF A WIRELESS COMPANY IT'S NOT JUST A PUBLIC RESIDENT TO ME AS A LAWYER THAT MEANS SOMEONE IS POTENTIALLY GEARING UP FOR A FIGHT. I WANT TO UNDERSTAND THE CURRENT POSTURE OF IT AND IF THERE'S STILL ROOM TO GIVE WAIVERS.
>> IT DIDN'T LEAVE OFF HOSTILE AND I PROBABLY WORKED ON A NUMBER OF ORDINANCES IN A NUMBER OF CITIES IN MORE THAN A DECADE AND I CAN'T REMEMBER A TIME WHERE AT LEAST YOU DIDN'T GET SOME OF THOSE COMMENTS REGARDLESS OF WHAT YOU DO. BUT WE HAVE THAT DIALOG AND THEY KNOW WHERE TO FIND ME.
>> VICE MAYOR? >> ANTHONY, THEY'RE RECOMMENDING THAT WE TABLE THIS. RESPECTFULLY AS YOU SAID, LAWYERS AT THIS POINT AGREE TO DISAGREE.
>> AT LEAST IN THE SMALL WIRELESS FACILITY CONTEXT. IF YOU WANTED TO GIVE ME DIRECTION TO DO A WHOLE SALE REVISION ON THE REMAINDER OF THE ORDINANCE FOR THINGS THAT HAVEN'T COME IN, WE COULD LOOK AT THAT, I WAS FOCUSED ON UPDATING THE REGISTRATION AND UPDATING THE SMALL WIRELESS FACILITIES Z AND UNTIL THEY TRY TO OFFER AN APPLICATION FOR SOMETHING, IT'S
A NON-ISSUE, CORRECT? >> I MEAN, SOMEBODY CAN ALWAYS COMPLAIN ABOUT YOUR ORDINANCE, BUT WHAT IS THE HARM IF YOU HAVEN'T APPLIED AND GOT DENIED YET.
>> SOME OF THEIR COMPLAINTS WERE SECTIONS THAT WERE FULLY NOT AN ISSUE BEING REVISED TONIGHT? RIGHT.
>> RIGHT. AND THAT WAS THE POINT I WAS TRYING TO MAKE, WE'RE NOT AMENDING THE ENTIRETY OF THE ARTICLE. IT'S REALLY TO FOCUS ON THOSE ISSUES. IF YOU GUYS WOULD ROLL YOUR EYES AT ME EVERY TIME THE STATE MADE A NEW ORDINANCE EACH YEAR, WE CHOSE TO FOCUS ON THE RELEVANT APPLICATIONS. THESE DAYS WITH 5G YOU'RE GETTING THE SMALLER WIRELESS.
>> WITH THAT, I WILL RENEW MY MOTION TO APPROVE.
>> AS AMENDED? >> AS AMENDED WITH THE 2017
CHANGE. >> AND I WILL RENEW MY SECOND.
>> SO, WE HAVE A RENEWED MOEGS BY COMMISSION ISROW AND A SECOND
(ROLL CALL) >> PLEASE SHOW IS PASSES
UNANIMOUSLY. >> PROPOSED BREWPUB ORDINANCE.
>> I'M GOING TO RUN WITH THIS ONE SINCE I'M THE ONE WHO BROUGHT THIS UP, FIRST I WANT TO START OFF BY THANKING THE PLANNING AND ZONING BOARD, THEY HAD A LOT OF DISCUSSION ABOUT THIS PARTICULAR ITEM AND THIS IS BROUGHT UP SOME THINGS TO ME THAT I THINK NEEDS TO BE FURTHER ADDRESSED. ONE OF THOSE I FEEL LIKE WE NEED TO GO BACK, SEND THIS BACK TO STAFF, AND LET THEM REVIEW OUR CODE AS A WHOLE. IF YOU LOOK AT, I GUESS THE WAY THE PLANNING AND ZONING DIRECTOR PLAINED IT TO ME IS WE HAVE A LOT OF NO'S, OUR CITY AND CODE HAS A LOT OF NO'S, IF IT'S NOT EXPRESSLY PERMITTED IT'S PROHIBITED. I THINK WITH THE POTENTIAL COMMERCIAL NSID, AND WITH POTENTIAL COMMERCIAL WHERE EVER THAT WE HAVE EXISTING PROPERTIES NOW, WE NEED TO GO BACK AND LOOK AT WHAT WE'RE PROHIBITING AND MAYBE WE NEED TO ADD SOMETHING BECAUSE, WHAT PLANNING AND ZONING WAS DOING WAS ADDING A LOT OF CODES OR REGULATIONS ON SOMETHING WE
[02:00:06]
HAVEN'T SEEN AN APPLICATION ON. AND THAT APPLICATION HASN'T BEEN SUBMITTED BECAUSE IT'S NOT PERMITTED. SO WE SHOULD ALSO LOOK AT HAVING A VEHICLE THAT HAVING A BUSINESS THAT HAS AN IDEA, COME TO US SUBMIT AN APPLICATION, IDEA, BUSINESS PLAN WHATEVER, SO THAT WE COULD THEN GIVE GUIDANCE ON THAT PARTICULAR ITEM INSTEAD OF PUTTING CODES RESTRICTIONS ON SOMETHING WE'RE NOT EVEN SURE IF THAT'S WHAT IS EXACTLY PROPOSED. SO IN THIS INSTANCE, NOT KNOWING WHAT THE POTENTIAL APPLICANT WAS PLANNING TO DO, THE PLANNING AND ZONING BOARD AND THE STAFF MADE IT DIFFICULT FOR US TO ACTUALLY REVIEW. AND HAVING THINGS IN SPECIAL EXEMPTION GIVES AWES AN OPPORTUNITY AND LATITUDE, UNTIL WE SEE SOMETHING FROM AN APPLICANT, WE'RE SHOOTING IN THE DARK. MY PROPOSAL IS TO BRING THIS BACK TO STAFF, HAVE THEM REVIEW OUR PERMITTED USES AND LOOK FOR A POTENTIAL VEHICLE FOR AN APPLICANT TO COME TO US AND SAY HERE'S MY IDEA, HERE'S MY PLAN, THIS IS WHERE I WOULD LIKE TO SEE IT HAPPEN AND THEN IT GOES TO PLANNING AND ZONING OR IF GOES TO STAFF AND THREE LOOK AND EVALUATE IT AND THEN IT GOES TO PLANNING AND ZONING AND THEY CAN DISCUSS WHAT IS BEING PRESENTED IN FRONT OF THEM, RATHER THAN TRYING TO LOOK AT WHAT THEY THINK IT COULD BE.BECAUSE RIGHT NOW, I THINK, WITHOUT KNOWING IT'S TOUGH TO MAKE ANY CONCLUSIONS AS TO WHAT YOU SHOULD ALLOW OR NOT ALLOW.
>> COMMISSIONER ISROW? I TEND TO AGREE WITH YOU. INSTEAD OF TAKING A NEW SECTION OF THE CODE AND ADDING AN ALLOWANCE FOR SOMETHING THAT CONTEMPLATES FOR THINGS IN THE CODE AND FOCUS MORE ON THE RESTAURANT ON THE CODE AND BUILD OUT EXCEPTIONS OR
ADDITIONAL ALLOWANCES. >> I THINK WE JUST NEED TO BE MORE BROAD IN OUR THINKING INSTEAD OF TRYING TO PICK EVERY SINGLE THING THAT COULD BE A RESTAURANT OR BE THIS OR BE THAT, IF WE ALAW A VEHICLE FOR SOMEONE TO COME IN AND SAY LOOK I'M LOOKING TO DO A RESTAURANT, HERE'S MY TWIST, BUT HE HAS THE OPPORTUNITY TO GIVE THAT APPLICATION TO BE REVIEWED.
INSTEAD OF GOING THROUGH AND PICK EVERY SINGLE BUSINESS THAT COULD COME IN FRONT OF US, WE GOT TO LOOK AT THINGS A LITTLE MORE BROAD. THAT'S MY. COMMISSIONER CUTLER.
>> FOR GIVE ME MAYOR BECAUSE I'M CONFUSED, I THINK WHAT WE ALREADY HAVE BEFORE US, WHAT WE'VE DONE IN OUR CODE IS TO PUT OURSELVES AS A COMMISSION AS THE REPRESENTATIVES OF THE CITY IN THE POSTURE WHERE WE COULD PROTECT OUR COMMUNITY FROM BUSINESSES THAT COME IN UNDER VARIOUS CODES THAT MAYBE WE DON'T WANT TO HAVE COME INTO OUR COMMUNITY. WHAT YOU'RE PROPOSING IS THAT THEY GO AND TRY AND COME UP WITH SOME SORT OF BROAD-BRUSH THAT CONTEMPLATES INVITING MORE PROBLEMS THAN WHAT WE HAVE. I THINK WHAT OUR ATTORNEYS HAVE DONE AND THE PLANNING PEOPLE HAVE DONE AND STAFF HAVE DONE RELATIVE TO THE CODE NOW HAS PUT US IN A POSTURE WHERE AN APPLICANT LIKE THE BREWPUB WITH COME BEFORE US AND WE CAN MAKE DECISIONS AND DECIDE WHETHER WE WANT TO HAVE THAT KIND OF BUSINESS IN OUR COMMUNITY OR NOT. WHAT YOU'RE SUGGESTING IS, AND I CAN TELL YOU THAT I KNOW FROM EXPERIENCE THAT BY BROADENING THE SCOPE OF ALLOWING CERTAIN BUSINESSES TO COME IN HERE, YOU'RE GOING TO GET TAKEN ADVANTAGE OF BY THE COMMERCIAL INDUSTRY OUT THERE.
>> I'M NOT SAYING BROADEN THE SCOPE. RIGHT NOW THERE'S NO VEHICLE FOR RULE G TO COME TO PARKLAND AND TELL US WHAT HE IS PLANNING ON DOING. WE HAVE NO IDEA WHAT HIS BUSINESS PLAN IS WHAT HE IS THINKING OF DOING SO -- AM I CORRECT? AT THIS
[02:05:04]
JUNCTURE, THE WAY IT WAS EXPLAINED TO ME IS WE CAN NOT ACCEPT A APPLICANT BECAUSE THE TYPE OF BUSINESS ASSUMED AND THAT'S THE PART WE DON'T KNOW IS NOT PERMITTED. IT'S BECAUSE IT'S PROHIBITED WE CAN'T ACCEPT THE APPLICATION.>> SO, JUST TO CLARIFY THAT, SO, WE DO NOT PROCESS APPLICATIONS FOR USES THAT ARE NOT PERMITTED, RIGHT? THE SAME WAY IF SOMEBODY COSUBMITTED AN APPLICATION TO THE PLANNING DEPARTMENT FOR A COMMERCIAL USE IN A RESIDENT SHILEY NEIGHBORHOOD. THIS IS RESIDENTIAL NEIGHBORHOOD.
GENERALLY WE DON'T PROCESS APPLICATIONS FOR USES NOT PERMITTED IN THE CODE AND IT IS TRUE THAT OUR CODE DOES READ AS MANY LAND USE AND ZONING CODE THAT IF THAT'S NOT SPECIFICALLY
PERMITTED IT'S PROHIBITED. >> THERE ARE WAYS FOR SOMEBODY TO COME IN WITH A DESIRED PERSPECTIVE TO GET GUIDANCE FROM THE PLANNING AND ZONING BOARD BY WAY OF CHANGING THE CODE FOR EXAMPLE WHICH WAS THE DISCUSSION AT THEIR MEETING SO THAT WE AS A COMMISSION CAN MAKE DECISIONS ON WETHER OR NOT WE WANT TO ALLOW THAT BUSINESS TO COME INTO OUR COMMUNITY. WHAT THE MAYOR'S PROPOSING IS TO OPEN IT UP IN SOME FASHION TO MAKE IT BROADER AND ALLOW OTHER COMMERCIAL ASPECTS TO COME INTO OUR COMMUNITY, I DON'T KNOW IF THAT'S SOMETHING THAT WE WANT TO
DO. >> TO SAY I WANT TO MAKE IT BROADER, I'M SAYING WE HAVE TO LOOK AT IT IN A BROADER WAY.
BECAUSE WHAT PLANNING AND ZONES WAS DOING WAS ADDING CODES, ORDINANCES, AND RESTRICTIONS ON SOMETHING THEY A THEY DIDN'T KNOW WHAT WAS BEING PROPOSED BY THE APPLICANT. SO, WHAT I'M SAYING IS, AND THERE COULD BE WAYS, AND THIS THIS IS ONE OF THE OTHER REASONS I THINK HAVING AN IN-HOUSE PLANNER WILL HELP IN THE SITUATION, WE DIDN'T HAVE AN OPPORTUNITY TO SEE WHAT HE WAS PROPOSING. WE'RE SAYING WE WANT TO RESTRICT THIS OR DO THIS OR DO THAT, NOT KNOWING WHAT THE POTENTIAL APPLICANT IS, THEN THE APPLICANT COMES AND SUBMITS HIS APPLICATION AND THEN SAYS WELL, I WOULD LIKE TO CHANGE THIS, AND NOW PLANNING AND ZONING HAS TO GO BACK AND SAY, WE RESTRICTED THAT, ALL I'M REALLY PROPOSING IS SOME TYPE OF VEHICLE THAT AN APPLICANT CAN GET GUIDANCE FROM MICHELLE, NOT NECESSARILY, MAYBE IT'S THE PLANNING AND ZONING BOARD BUT FROM MICHELLE TO GIVE PLANNING AND ZONING GUIDANCE AS TO WHAT THEY'RE LOOKING AT. SO WHAT ARE YOU MAKING CODES ON? WHAT ARE THE RESTRICTIONS YOU ARE MAKING. AND WHEN I TALK ABOUT THE BUSINESSES THAT WE HAVE IN OUR CODE, I'M MERELY SAYING THOSE SHOULD BE RELOOKED AT ARE THEY MEETING TODAY'S TIMES, DO WE HAVE ENOUGH BUSINESSES, DO WE HAVE TOO MANY BUSINESSES, I'M NOT SUGGESTING. I'M ON THE SAME PAGE AS YOU WITH THAT, I JUST WANT TO MAKE SURE, ARE WE IN THE RIGHT PLACE TO PROTECT OURSELVES NOT TO LET MORE IN OR DIFFERENT THINGS IN BUT ARE WE PROTECTED NOW FOR WHAT WE HAVE? AND I THINK THIS POTENTIAL APPLICANT KIND OF, AT LEAST FOR ME, THAT'S WHY I WANTED TO HAVE THIS DISCUSSION BECAUSE MAYBE I'M WAY OFF BASE IN MY THOUGHT PROCESS. SO THAT'S, I THINK IF WE WENT BACK TO STAFF, HAD THEM RELOOK AT OUR EXISTING PERMITTED USES, AND POTENTIALLY SOMEHOW LOOK AT HOW WE COULD GIVE A POTENTIAL APPLICANT A VEHICLE TO SHOW US WHAT HE'S POTENTIALLY LOOKING TO DO SO THAT WE CAN THEN MAKE DECISIONS FROM A SPECIAL EXCEPTION BECAUSE THOSE GIVES US ALL THE RIGHTS WE WANT. WE COULD SAY NO WE WANT THIS OR DON'T WANT THAT. WHICH I'M TOTALLY FINE WITH DOING. I WANT TO BE SURE WE'RE PROTECTING
[02:10:01]
OURSELVES FOR WHEN THE POTENTIAL OF HERIN BAY COMES IN.>> THERE ARE A COUPLE OF THINGS, NUMBER ONE, FIRST OF ALL, I WANT TO THANK THE PLANNING AND ZONING BOARD FOR THE WORK THEY'VE DONE HAVING CONVERSATIONS BACK AND FORTH WHICH IS KIND OF OPENED UP MY EYES TO I'LL CALL THEM THE
UNINTENDED CONSEQUENCES. >> AND PART OF THOSE UNINTENDED CONSE CONSEQUENCES IS INITIALLY, I THINK WE'RE ALL SUPPORTIVE OF SMALL BUSINESSES TO BE ABLE TO GROW BUSINESSES IN THE COMMUNITY. SO, I THINK THAT CLEARLY HAS TO BE STATED. BUT, I THINK SOME OF THE THINGS IS THAT WHEN A POTENTIAL BUSINESS COMES IN EITHER A, AS THIS CONVERSATION WITH THE BREWPUB IS THAT IT IS A NOT-PERMITTED USE.
THE QUESTION TURNS OUT INTO HOW DO WE HELP THAT BUSINESS THRIVE IN AN AREA OR AGAIN, MAYBE IT'S SOMETHING THAT THERE MAYBE ANOTHER AREA TO PUT IT IN BESIDE WHERE IT IS NOW THAT MIGHT BE PERMITTED THAT'S NOT CLOSE TO RESIDENTIAL HOUSING. BUT I THINK WHAT WE NEED TO DO IS PURPOSE THE BRAKES A LITTLE BIT, LOOK HAVING A MORE COMPREHENSIVE APPROACH OF WHAT BUSINESSES ARE ALLOWED. I LOOKED AT THE CODE TODAY, AS IT STANDS, IF I WANTED TO OPEN A BAKERY, IT'S NOT DEFINED IN OUR CODE. THE BAKERY, THERE'S NOTHING THAT EXISTS. SO, THINGS LIKE THAT, WE WOULD HAVE TO LOOK AT. AS I SAID PART OF THAT UNINTENDED CONSEQUENCE IF I WANTED TO OPEN UP A SIDEWALK CAFE OR OPEN UP ENTERTAINMENT, OTHER THINGS THAT ARE NOT IN THE MODEL OF THAT.
THIS PAUSE WOULD GIVE US THE ABILITY TO DO THAT. I'M SUPPORTIVE OF TAKING THE PAUSE AND HAVING STAFF TAKE A LOOK AT THE CODE AND SEE WHERE WE COULD MAYBE IMPROVE OR CHANGE DEFINITION, SOME OF THEM MAY BE ANTIQUATED.
>> POTENTIALLY WE MIGHT WANT TO HAVE A WORKSHOP TO DISCUSS OUR THOUGHTS FURTHER I WANT TO GIVE EVERYONE WHO WANTS TO OPEN A BUSINESS IN PARKLAND THE OPPORTUNITY. BUT THAT OPPORTUNITY HAS TO BE WITHIN THE PER PERIMETERS THAT WE SET. WHAT'S COMING IN, WE HAVE TO BE PREPARED. WE DON'T WANT TO HAVE TO GO THROUGH THIS FOR EVERY SINGLE PERSON. I DIDN'T NOTICE THE BAKERY BUT I LOOKED AT THE CODE TOO AND THERE'S A LOT OF BUSINESSES THAT TOTALLY MAKE SENSE. BECAUSE YOU CAN'T SUBMIT THE APPLICATION, IT DOESN'T GIVE US AN OPPORTUNITY TO SAY THIS IS A GREAT IDEA, COME ON IN. THIS IS A COMBRAET IDEA, BUT BECAUSE IT'S A SPECIAL EXCEPTION, BECAUSE WE'RE NOT GOING TO LIST EVERY SINGLE BUSINESS, THAT'S WHERE I'M MORE SAYING BROADLY, BUT WE KEEP IT AS A SPECIAL EXCEPTION, IT GIVES US THE TO SAY, OH, YOU WANT TO DO THIS, WELL THAT'S NOT FITTING WITH PARKLAND, I'M NOT SUGGESTING AT ALL WHEN I SAY BROADLY, I DON'T MEAN LET'S OPEN EVERYTHING UP TO BUSINESS. I'M JUST SAYING BROADLY, I LOVE THE SPECIAL EXCEPTION PORTION OF OUR CODE BECAUSE IT DOES GIVE US A LOT IT HAVE LATITUDE TO MAKE SURE WE'RE DOING WHAT WE THINK IS BEST FOR
BUSINESS. >> COMMISSIONER BRIER?
>> I THINK THERE ARE A LOT OF CHALLENGES HERE, ONE IS NOW UNDERSTANDING FROM ANTHONY, I KNOW NOW THAT THE CART WAS BEFORE THE HORSE BECAUSE WE DIDN'T HAVE A VEHICLE FOR THE APPLICATION PROCESS. I'M A HUGE PROPONENT ENCOURAGING SMALL BUSINESSES TO COME INTO PARKLAND AND SERVE OUR RESIDENTS AND SUCCEED. I'M ALSO A BIG FAN OF KEEPING RESTRICTIONS ON WHAT BUSINESSES COME OR DO NOT COME TO PARKLAND, BECAUSE I THINK OVER THE YEARS AND I'VE SEEN AND YOU HAVE ALL SEEN, THIS COMMISSION OR P & Z I LIKE THE IDEA OF THE SPECIAL EXCEPTION ABILITY I LIKE THE IDEA THAT WE'RE ABLE TO CURTAIL WHAT COMES IN ON A ONE BY ONE BASIS AND NOT OPEN THE FLOOD GATES TO A
[02:15:01]
GENERIC POOL OF BUSINESSES. I CAN'T STRESS THIS ENOUGH, IF YOU EVER WANT TO SEE ASIDE FROM OUR CITY STAFF IF YOU EVER WANT TO SEE RESIDENTS ENGAGED, DILIGENT, THOUGHTFUL AND CONSIDERATE OF WHAT'S GOING ON IN THE CITY, I ENCOURAGE OUR RESIDENTS TO WATCH THE LAST COUPLE OF P & Z MEETINGS, THE LAST WENT FOUR HOURS LONG. SAW THAT INVESTED INDIVIDUALS LAYING OUT THE CONCERNS AND THE IMPLICATIONS AND THE IMPACT THAT YOU COULD HAVE TO THE VICE MAYOR'S POINT OF UNINTENDED CONSEQUENCES ON THE CITY. THAT'S NOT TO SAY WE DO OR DON'T LIKE A PARTICULAR BUSINESS BUT HERE ARE THE THINGS WE SHOULD THINK OF. AND I THOUGHT IT WAS ONE OF THE MOST ROBUST DIALOGS OF PEOPLE THAT ARE MINDFUL OF OUR RESIDENTS AND THE CONCERN THAT THEY WOULD HAVE. IF THERE'S AN ABILITY TO HAVE AN OPPORTUNITY FOR A BUSINESS TO PRESENT AN APPLICATION THAT WOULD OTHERWISE BE PROHIBITED BUT THAT WE COULD AT LEAST TALK ABOUT STAFF TO ASSESS THE VIABILITY OF IT, THAT'S ONE THING. MY CONCERN IS THAT WE HAVE TWO THINGS, NUMBER ONE, I DON'T WANT ALL THE WORK FOR THE P & Z AND STAFF HAVE DONE TO DATE FOR NOT BECAUSE I THINK IT WAS A HELPFUL DIALOG ABOUT WHAT SHOULD AND SHOULDN'T BE IN PARKLAND. NUMBER TWO IS, I THINK THERE NEEDS TO BE MORE THAN A CONCEPT. IF SOMEBODY'S GOING TO COME INTO THE CITY WITH A BUSINESS PROPOSAL, AND I'M ALL FOR IT, WE'VE GOT TO GIVE ABILITY FOR THAT TO MATURE OUT AND DEVELOP OUT. WE'VE SEEN A LOT OF WORK AND HARD EFFORT BY CITY STAFF, ATTORNEY, MANAGER, ASSISTANT MANAGER, AND OUTSIDE PLANNING AND ZONING AND BUILDING FOLKS AND OUR P & Z BOARD PAY ATTENTION TO THIS ISSUE. WE NEED TO FIGURE OUT WHAT COMES FIRST.>> WELL, TO YOUR POINT, I THINK ALL THE WORK THAT PLANNING AND ZONING DID HAS GOTTEN US TO THIS POINT TO WHERE AT LEAST FOR ME, IT KIND OF WOKE ME UP TO SAY, LOOK, WE NEED TO DO YOU KNOW STAFF, WE NEED TO RELOOK AT OUR CODE. AGAIN, I DON'T WANT TO DRASTICALLY CHANGE ANYTHING, BUT WE JUST NEED TO CHANGE SOME THINGS AND MAKE SURE WE'RE PROTECTED AGAIN, WHEN HERRING BAY COMING IN AND MAKE SURE WE GIVE EVERY BUSINESS AN OPPORTUNITY TO COME TO PARKLAND. I THINK THE WORK THEY DID WAS FANTASTIC, THAT'S WHY I WANTED TO HAVE THIS DISCUSSION, I WANTED TO SEE WHAT -- THESE ARE MY IDEAS OF HOW I THOUGHT WE COULD TAKE IT TO THE NEXT STEP WHERE WE HAVE STAFF GO BACK AND RELOOK AT CODE AND ORDINANCES. GOES BACK TO P & Z, AND THEY CAN RELOOK AGAIN AND THEN IT COMES BACK TO US. AND IN THE MEANTIME, YOU KNOW, UNDERSTANDING THAT WE WOULD LIKE, WE KNOW THERE'S A BUSINESS POTENTIALLY THAT WANTS TO COME IN PARKLAND, BUT SOMEHOW GIVE HIM A VEHICLE TO SHOW US WHAT HE'S LOOKING TO DO SO THAT WE'RE ABLE TO BETTER ADDRESS WHAT CONCERNS COULD OR COULD NOT BE. AND WITHOUT SEEING THAT, IT'S HARD TO SAY YES OR NO. AND I DON'T WANT HIM TO HAVE TO COME -- I DON'T WANT THE PLANNING AND ZONING TO HAVE TO HAVE THREE MORE MEETINGS, BECAUSE WE DIDN'T GIVE HIM OPPORTUNITY TO COME IN AND SHOW US WHAT HE'S TRYING TO DO. SO, TO ME, IT SPEEDS UP THE PROCESS A LITTLE BIT, IT GIVES BETTER UNDERSTANDING TO STAFF, TO PLANNING AND ZONING CAN AND ULTIMATELY, US AND THE
APPLICANT. >> I APPRECIATE THAT IT'S A CHALLENGE WITHOUT AN APPLICATION, WITHOUT DEFINITIONS WITHOUT A SITE PLAN OR A PROPOSED BUSINESS PLAN WITHOUT ALL THOSE NUANCES THAT WOULD OTHERWISE BE THERE, HEARING FROM THE P & Z, HEARING FROM OUR STAFF AND OUTSIDE CONTRACTORS, IT'S A CHALLENGE TO CONTEMPLATE THE WHAT IF'S, I GET IT,
INCLUDING LOCATION. >> YEAH, SO, I MEAN, DIRECTION AT THIS POINT WOULD BE I DON'T KNOW IF I NEED TO MAKE A MOTION OR THIS IS JUST GUIDANCE WE'RE LOOKING TO GIVE? I'M GETTING -- DOZE EVERYONE SOUND LIKE THIS IS THE DIRECTION WHICH WOULD BE TO HAVE STAFF LOOK AT OUR ORDINANCE, GO THROUGH SOME OF THE BUSINESSES, AGAIN, NOT SAYING ADD EVERY SINGLE BUSINESS, THAT'S NOT AT ALL WHAT I'M SUGGESTING, BUT LOOK AT WHAT WE'RE HAVING MAKING SURE WE'RE PROTECTED FOR HERRING BAY, LOOK
[02:20:01]
AT SOME VEHICLE TO HAVE A POTENTIAL APPLICATION WHICH WE HAVE, AN OPPORTUNITY TO PRESENT SOMETHING TO US OR, YOU KNOW TO STAFF OR MICHELLE OR KAITLIN OR WHOEVER, TO GIVE THEN PLANNING AND ZONING THE OPPORTUNITY TO P PROPOSED AS OPPOSED TO TRYING TO DECIDE -- NOT KNOWING ANYTHING, YOU'RE MAKING CODES AND DECISIONS BASED ON WHAT YOU THINK HE'S GOING TO DO OR WHAT YOU THINK MIGHT COME, OR WHAT YOU THINK MIGHT BE THE DOWNFALL, FOR ME I WANT TO SEE, TO GEORGE'S POINT BEFORE WITH THE PARK. I WANT TO SEE MORE BEFORE I START TRYING TO MAKEDECISIONS. >> I AGREE WITH YOU, I JUST DON'T KNOW WHAT THAT WOULD LOOK LIKE. I GUESS MAYBE WE HAVE TO KIND OF DECIDE ARE WE TALKING ABOUT JUST THIS BREWPUB ISSUE OR IN GENERAL OUR CODE. I THOUGHT WE WERE TALKING ON A NARROW TOPIC BUT I THINK WE'RE EXPANDING IT.
>> I BELIEVE WE NEED TO LOOK AT THE CODE, IT DOESN'T MEAN WE HAVE TO CHANGE IT BUT LOOK AT IT BECAUSE OF WHAT'S COMING. TO BOB'S POINT, WE CAN'T PUT A BAKERY IN PARKLAND, THAT CLEARLY DOESN'T MAKE SENSE. I'M NOT SAYING I WANT TO ADD.
>> MR. MAYOR, I THINK I MIGHT BE ABLE TO HELP EXPLAIN THE CONCEPT THAT MICHELLE WAS ORIGINALLY PITCHING. IF IT'S NOT EXPRESSLY PERMITTED THEN THE USE IS PROHIBITED. THE ALTERNATIVE WAY THAT SOME OTHER MUNICIPALITYS STRUCTURE THEIR CODE IS USES THAT DEEM LIKE OR SIMILAR USES CAN BE BROUGHT FORTH TO THE PLANNING AND ZONING BOARD OR THE CITY COMMISSION UNDER THE SPECIAL APPLICATION SECTION. THAT ALLOWS YOU TO BRING FORWARD AN APPLICATION AS A SPECIAL EXCEPTION WITH ALL FIVE OR SIX CRITERIA ALONG WITH THE APPLICATION REQUIREMENTS OF THE SPECIAL EXCEPTION CRITERIA TO THE P & Z BOARD IF IT'S DEEMED SIMILAR OR LIKE EXPRESSLY PERMITTED USE IN THE TABLE. FOR EXAMPLE, A BAKERY IS PERMITTED BUT A PIZZA SHOP ISN'T. A PIZZA SHOP WOULD BE CONSIDERED LIKE OR SIMILAR USE TO A BAKERY AND THEY WOULD BE ABLE TO SUBMIT AN APPLICATION ALONG WITH THE SITE PLAN AND OTHER APPLICATION MATERIALS REQUIRED AND THEY WOULD PROCEED THROUGH THE NORMAL APPLICATION PROCESS THAT WOULD MITIGATE EVERY TIME US HAVING TO GO BACK THROUGH AND DO A VERY LENGTHY AND COSTLY TEXT AMENDMENT FOR EVERY USE THAT MAY NOT BE CONTEMPLATED. BECAUSE THERE'S NO WAY TO CONTEMPLATE EVERY PROPOSED POTENTIAL USE OF A CODE. IT'S USUALLY AN ADDITIONAL LINE ITEM ABOVE THE PERMITTED USE TABLE THAT SAYS LIKE OR SIMILAR USES NOT EXPRESSLY PERMITTED MAYBE CONSIDERED BY SPECIAL EXCEPTION VIA INITIAL APPROVAL BY THE PLANNING DIRECTOR AND BROUGHT THROUGH THE STAT PROCESS.
THAT'S WHAT THAT WOULD LOOK LIKE.
>> COMMISSIONER CUTLER? >> THAT'S THE KIND OF THING THAT I'M TALKING ABOUT. BECAUSE THEN THAT PUTS THE BURDEN ON THE APPLICANT TO COME FORWARD WITH SAYING THAT IT IS A LIKE-USE FOR WHAT YOU HAVE IN THE CITY AND IT THEN GIVES THAT TO COME UNDER THE SPECIAL EXCEPTION. TWEAKING TE CODE IN THAT REGARD IS FINE
BY ME. >> AND THAT'S WHAT I WAS
SUGGESTING. NOT A WHOLESALE. >> OTHERWISE WHAT YOU'RE GOING TO DO IS GET A FLOOD OF APPLICATIONS FOR ALL KINDS OF BUSINESSES AND THEN PUT THE BURDEN ON THE STAFF AND THE PLANNER TO FIGURE OUT WHETHER IT PIGEON HOLES INTO THIS.
>> TO MY POINT WHERE WE NEED TO LOOK INTO OUR CODES AND USES, BY ADDING THAT LINE, WE SHOULD BE SURE THAT WHAT'S LISTED IS WHAT WE WANT. BECAUSE NOW, BY ADDING THAT LINE, YOU DO OPEN IT UP. SO, AND THAT WAS MY POINT TO JUST BY LOOKING AT WHAT IS PERMITTED, BECAUSE YOU'RE ADDING THAT LINE, YOU'RE GIVING MORE, YOU KNOW, YOU'RE GIVING MORE AVAILABILITY TO COME INTO THAT PLACE. SO I'M MERELY SAYING LOOK AT THE CODE AND BE SURE THAT THAT'S SOMETHING STAFF CAN DO, P & Z CAN DO.
>> AND THEN COME BACK TO US AND LOOK AT IT AND APPROVE IT.
>> I GO BACK TO WHAT COMMISSIONER BRIER SAID I
[02:25:02]
APPLAUD PLANNING AND ZONING BECAUSE I THINK THIS IS A MORE EFFICIENT WAY OF DOING OUR APPLICATION PROCESS TO KUDOS TO THEM FOR BRING THIS TO OUR ATTENTION.>> THE NUMBER OF PERMITTED USES. FOR EXAMPLE WE DON'T HAVE ANYTHING WITH THE NUMBER OF RESTAURANTS THAT CAN BE IN A
>> SO, YOU COULD HAVE A SHOPPING PLAZA THAT HAS EVERY SPACE AS A RESTAURANT. SO IF SOMEBODY TURNS AROUND AND LIKE I SAID, WHETHER IT'S, YOU KNOW, DRY CLEANERS, WE'VE GOT 20 DRY CLEANERS, DO WE WANT A WHOLE SHOPPING PLAZA FILLED WITH DRY
CLEANERS. >> SO TO VICE MAYOR'S POINT, THAT'S WHERE I SAID MORE BROAD. I DON'T WANT TO GO TO GET SO FAR INTO. AND I'M NOT SAYING THAT'S NOT A BAD IDEA, MAYBE A SHOPPING PLAZA WITH JUST RESTAURANTS WOULD BE COOL. COMMISSIONER
ISROW? >> HEARING THIS, I THINK I AGREE WITH ADDING THIS LINE, THE "LIKE KIND". I THINK THIS MIGHTING WORTHY OF A WORKSHOP AND THAT WAY WE HAVE MORE OF A HOLE LIST TICK APPROACH BUT ALSO WHILE WE'RE ON THE TOPIC TO PLAN FOR THE FUTURE. I WANT TO PROVIDE A VEHICLE TO PUT THE CART BEHIND THE HORSE AND HAVE THE APPLICANT FILL OUT THAT AND HAVE THE PROCESS. I HAVE THE SIMILAR CONCERN IF YOU DO THAT AND WE'LL JUST BE MINDFUL AND A WORKSHOP MAYBE HELPFUL, YOU'RE NOT BOMBARDING THE STAFF AND P & Z AND PLANNING FOLKS WITH APPLICATION THAT ARE REALLY NOT FITTING WITHIN THE SPECIAL EXCEPTION BUT TRYING TO TEAR DOWN THE PROHIBITIONS. I THANK THE APPLICANT FOR BEING HERE. I WOULD ENCOURAGE THE APT CAN'T IF THEY HAVEN'T ALREADY TO LISTEN TO THE P & Z MEETINGS, BECAUSE YOU'LL HEAR ALL THE COMMENTS AND THEY'RE VERY GOOD ONES. AND WITH THAT, I THINK THIS IS AN OPPORTUNITY TO FIX THAT ISSUE.
>> OKAY. SO WE'RE CLEAR WE WILL LOOK AT THE CODE, DOESN'T MEAN WE'RE GOING TO CHANGE IT, WE'RE GOING TO LOOK AT THE CODE FOR THE USES, WE'RE GOING TO LOOK AT POTENTIALLY ADDING THAT LINE, WE'LL HAVE A WORKSHOP WHERE WE COULD DISCUSS YOU KNOW WHAT WE THINK AND THEN OBVIOUSLY PLANNING AN ZONING WILL BE HAVING THE SAME CONVERSATION BECAUSE AT THE NEXT MEETING THAT'S SOMETHING WE COULD START THAT CONVERSATION YOU KNOW WITH THEM ON SOME OF THIS STUFF. AGAIN, WHEN I SAY BROAD, I WANT TO BE MORE BROAD IN THAT I DON'T WANT TO NECESSARILY SAY IT'S GOT TO BE A SHOELACE PLACE, IT CAN BE A SHOE PLACE. WE DON'T NEED A SHOELACE PLACE AND A SOUL PLACE AND A HIGH-TOP PLACE.
BECAUSE WE HAVE THE SPECIAL EXCEPTION WE COULD ALWAYS COME BACK AND WE HAVE THAT VEHICLE TO MOLD AND MAKE SURE WHAT WE BELIEVE PARKLAND SHOULD BE IS IN THAT BECAUSE THE SPECIAL EXCEPTION GIVES US THAT AUTHORITY.
>> SO, JUST TO CLARIFY, IS THE DIRECTION, AT OUR LAST P & Z, THE ITEM WAS TABLED TO BE ON THE JUNE 10TH P & Z, IS THE DIRECTION TO -- ARE WE STILL DISCUSSING IT.
>> I DON'T KNOW IF WE COULD JUST AUTHORIZE.
>> I'M GOING TO SUGGEST A MOTION BECAUSE I THINK THE NATURAL COURSE WAS WE WERE GOING TO GO BRING IT BACK TO THEM FOR A VOTE OF RECOMMENDATION OR DENIAL, SO IF THIS IS THE DIRECTION YOU WANT TO GO I RECOMMEND YOU DO A MOTION TO STOP THAT PROCESS AND EVALUATE AS WAS DISCUSSED HERE.
SOMETHING LIKE A MOTION TO TABLE THE ITEM AND DIRECT STAFF TO LOOK AT THE COMMERCIAL USES, I DON'T KNOW IF IT'S LIMITED TO COMMERCIAL OR CONDUCT A WORKSHOP P IF THAT'S WHAT YOU WANT TO DO
ANIT THIS. >> AND LOOK AT ADDING THE
[02:30:05]
"LIKE", BECAUSE THAT WILL GIVE THE VEHICLE FOR THE APPLICANT TO SUBMIT WHICH WILL GIVE US THE OPPORTUNITY TO USE THE SPECIALEXCEPTION TO MONITOR. >> BUT WE MAY ALREADY HAVE A "LIKE" IF THE APPLICANT INTENDS TO COME IN AND BUILD THE RESTAURANT, WE HAVE RESTAURANTS IN OUR CODES, SO THEY ALREADY
HAVE ALIKE. >> BUT WE DON'T HAVE THE BREWING CAPACITY. THAT'S WHERE, SO IF, I DON'T THINK WE CAN ADD, CAN WE ADD THE "LIKE"? IS THAT SOMETHING WE COULD DO NOW?
>> NO, THAT'S AN ORDINANCE. >> I THINK MAYBE WE SHOULD HAVE AT THE NEXT PLANNING AN ZONING MEETING LET'S HAVE THAT DISCUSSION WITH THEM, AS FAR AS ADDING THE "LIKE", RIGHT, SO IF THEY BRING THAT TO US, IF THAT PASS TOSS THEM AND BRINGS IT TO US THAT PORTION CAN COME BACK TO US SOONER THAN LATER AND IN THE MEANTIME WE'RE HAVING A WORKSHOP WHERE WE COULD MAKE SURE WHAT'S LISTED AS PERMITTED IS WHAT PARKLAND NEEDS.
>> YOU'RE JUST LOOKING FOR LANGUAGE THAT ALLOWS AN APPLICANT FOR A PROHIBITED USE BU
>> THE QUESTION IS IN TERMS OF TIMING, DO YOU WANT THE WORKSHOP
BEFORE THE MEETING. >> I THINK WE SHOULD HAVE THE
WORKSHOP FIRST, RIGHT? >> IS THE WORKSHOP WE'RE GOING TO HAVE REPLACED BY THE DISCUSSION THAT P & Z WILL THEN
BRING FORWARD TO US? >> IT THEY'RE GOING TO BRING
FORWARD. >> WELL, THEY CAN BRING FORWARD. I GUESS IT GETS CONFUSING BECAUSE THEY COULD BRING FORWARD THE ORDINANCE TRYING TO SPEED UP THE PROCESS
FOR THE APPLICANT. >> CAN WE MAKE A MOTION TO DIRECT P & Z TO DO -- BECAUSE THEY HAVE A MOTION TO BRING IT FORWARD AT THEIR NEXT MEETING. CAN WE DIRECT P & Z TO RESCIND
THAT? >> YOU COULD, BUT YOU COULD JUST MOVE TO TABLE THE ITEM, SEND IT BACK TO STAFF FOR FURTHER REVIEW AND AMENDMENT IN ACCORDANCE WITH TODAY'S DISCUSSION AND JUST LET STAFF KNOW WHETHER YOU WANT YOUR WORKSHOP TO OCCUR BEFORE THAT P & Z DISCUSSION HAPPENS OR AFTER.
>> I THINK P & Z WAS EQUALLY FRUSTRATED AND THAT THERE AWASNT NUANCES WITHIN THE CONFINES OF A "LIKE USE" OR SPECIAL EXCEPTION.
MY THOUGHT WOULD BE LET'S HAVE WHETHER IT'S STAFF AND YOUR TEAM PUT TOGETHER SOME PROPOSAL TO HAVE P & Z DISCUSS THAT AND BRING IT TO US. I'M NOT SURE WHICH SHOULD COME BEFORE, BUT THE WORKSHOP THAT I'M ENVISIONING IS GOING TO BE AFTER
WE GET THAT LANGUAGE, RIGHT? >> YES. BECAUSE WE WANT TO MOVE THE APPLICATION FORWARD, YES. YOU ARE 100% RIGHT. WE WANT TO MOVE THE APPLICATION FORWARD SO IF THEY DISCUSS, REALLY, IT'S THE "LIKE", YOU KNOW, ADDING THE "LIKE BUSINESS" IN, BRING THAT BACK TO US, WE VOTE ON THAT PIECE AND THEN WE HAVE OUR WORKSHOP TO BE SURE OUR CODE BESIDE THAT PORTION IS NARROWED DOWN OR MAYBE WE DON'T HAVE TO. I MEAN, STAFF CAN DO
THAT OR YOU COULD DO THAT. >> SO THERE ARE INTERNAL AGENDA DEADLINES THAT WE'RE RUNNING UP AGAINST FOR THE NEXT P & Z MEETING AND ADVERTISING IF THE DIRECTION IS TO PRESENT A NEW ORDINANCE TO P & Z. IF THE DIRECTION IS TO HAVE DISCUSSION AND GET FEEDBACK TO SEE IF THEY LIKE THE ADDING OF THE LINE FOR THE SIMILAR IN KIND USES, THAT'S DIFFERENT THAT'S DOABLE.
>> BASED ON WHAT WE'RE SAYING, I THINK WE'RE ALL OKAY WITH
ADDING THE LIKE USAGE. >> I THINK THE FOCUS SHOULD BE ON FIXING THE MECHANISM FOR THE APPLICATION TO BE SUBMITTED.
>> WE NEED DIRECTION IF YOU ARE REQUESTING THAT WE BRING FORWARD THAT ORDINANCE OR BRING FORWARD TO THE DISCUSSION OF P & Z.
[02:35:03]
>> NO, I THINK IT'S THE ORDINANCE FOR THE AMENDMENT TO
HAVE THIS LIKE KIND TO BE IN. >> BUT IF WE'RE ALL IN AGREEMENT TO ADD THE "LIKE" PORTION, DO WE EVEN NEED TO GO BACK TO P & Z FOR THE LIKE PORTION? BECAUSE THEY'RE STILL GOING TO GET THE APPLICATION BEFORE IT COMES TO US.
>> I THINK THE LANGUAGE WILL IMPACT.
>> WELL, THE LANGUAGE IS GOING TO BE EXACTLY WHAT KAITLIN JUST
SAID. >> IT WOULD BE A DRAFT FOR US FOR THE NEXT ONE AND WHAT I'M SAYING. OR WE PUT THE AMENDMENT FORTH FOR THEIR DISCUSSION AND APPROVAL, BUT EITHER WAY THEY'RE GOING TO HAVE THE MEETING AND I THINK WE BUY MORE TIME AND PRODUCTIVITY TO GIVE THEM SOMETHING TO REVIEW. AND BEFORE AND PARALLEL WE HAVE THE WORKSHOP AND ADOPT THIS NEW AMENDMENT AND HAVE THE REVIEW OF THE APPROACH OF OUR REMAINING
CODE. >> IF WE'RE ALL OKAY WITH THE LIKE PORTION, DO WE EVEN NEED TO GO BACK TO P & Z. AND WE'RE NOT KICKING THEM OUT OF THE DISCUSSION BECAUSE THAT'S GOING TO ALLOW THEM TO HAVE THIS DISCUSSION.
>> I JUST WANT TO SET REASONABLE EXPECTATIONS HERE IN TERMS OF THE NEXT MEETING THAT WOULD REQUIRE US ADVERTISING THE TITLE IN THE NEXT TWO DAYS. I UNDERSTAND WHAT YOU ALL ARE SAYING, BUT I WANT TO MAKE SURE STAFF HAS TIME TO PREPARE IT.
>> WHY DON'T YOU GUYS HELP US WITH --
>> HERE'S MY QUESTION FROM A PROCEDURAL STAND POINT, P & Z TABLED IT TO ASK STAFF TO BRING BACK AN ORDINANCE, CORRECT?
>> THEY MADE A NUMBER OF DECISIONS, BUT YOU ARE THE FINAL DECISION, THEY GAVE A FINAL DIRECTION, AND BASICALLY WE WERE GOING TO BRING IT BACK TO SEE BASED ON THE COMMENTS GIVEN WHAT
WAS THERE. P>> AND THEN TO VO ORDINANCE? THAT'S THE ULTIMATE
DECISION FOR THEM TO DO? >> JUST SO IF WE'RE DIRECTING, I MEAN DO WE HAVE THE ABILITY TO DIRECT P & Z FROM THE STANDPOINT TO TABLE DIRECTION THAT THEY'VE ASKED STAFF TO DO?
>> WE'RE THE COMMISSION BUT I'M ASKING FROM A PROCEDURAL STAND
POINT. >> THIS ISN'T LIKE WE HAVE A FORMAL APPLICATION THAT WE'RE WORKING ON AND THERE'S QUASI POSITION. IF YOU DECIDE IF YOU DON'T WANT THIS TO GO FORWARD.
YOU CAN TABLE IT. >> BASED ON WHAT WE'RE SAYING THERE'S NO REASON FOR THEM TO LISTEN TO THAT ORDINANCE, BECAUSE IF WE PROPOSE AND PASS "LIKE BUSINESS" THEY WILL BE ABLE TO THEN SEE AN APPLICATION. FOR THEM TO SEE AN ORDINANCE, TO ME DOESN'T MAKE SENSE. IT WOULD JUST BE A MATTER OF HOW DO WE, IF WE WANTED TO, PASS THE "LIKE" FEATURE, WHENEVER THAT IS IF THAT'S TONIGHT OR NEXT MEETING OR WHENEVER, AND THEN FROM THAT POINT, THE APPLICANT CAN THEN SUBMIT THEIR APPLICATION TO
MICHELLE AND P & Z. >> IF YOU DON'T WANT THEM TO CONSIDER THAT ORDINANCE ANY FURTHER MAKE A MOTION TO TABLE IT AND DIRECT STAFF TO REVIEW THE ORDINANCE FURTHERER OH WORK ON THE ORDINANCE THAT YOU JUST DESCRIBED, MAYOR, BUT I WANT TO BE CLEAR IN TERMS OF THE TIMING WHAT IS NEEDED TO BE DONE TO EFFECT WAIT WHAT WAS DISCUSSED TONIGHT IS AN ORDINANCE WITH TWO READINGS, GENERALLY THAT ORDINANCE WOULD GO FIRST TO THE P & Z AND WHOEVER WANTS TO APPLY UNDER THAT WOULD STILL NEED TO SUBMIT A FORMAL APPLICATION. THAT ORDINANCE KNIGHTS TO PASS AND THAT THAT APPLICATION COULD BE CONSIDERED, POTENTIALLY THE COMMISSIONATION COULD BE CONSIDERED ON THE SECURE READING OF THAT ORDINANCE, BUT I ALSO HAVE TO SPEAK WITH STAFF TOO, I KNOW THEY NEED TIME TO PREPARE THOSE THINGS. WE HAVE LIKE TWO
DAYS TO PUT OUT AN AD. >> I WOULD LIKE IF YOU GUYS AGREE, HAVE THAT ORDINANCE READY WHENEVER YOU CAN, P & Z'S GOT TO LOOK AT IT, WHENEVER TIMING ALLOWS, OBVIOUSLY WE WOULD LIKE
[02:40:02]
IT SOONER THAN LATER, WHATEVER TIMING ALLOWS WE WOULD LIKE THE ORDINANCE CHANGE SO THAT IT RAIDS THAT TO GIVE THE OPPORTUNITY FOR THE APPLICANT TO APPLY MEANWHILE SCHEDULE OUR WORKSHOP AND MAKE SURE WE'RE DRILLED DOWN IN OUR PERMITTING USES. AND IF WE END UP CHANGING NOTHING, THAT'S FINE. I'M NOT SUGGESTING ANYTHING OTHER THAN WE LOOK AT THE PERMITTED USES.THAT'S ALL I'M SUGGESTING, I'M NOT SUGGESTING ADD OR SUBTRACT OR ANYTHING. I APPRECIATE THE SPECIAL EXCEPTION BECAUSE AGAIN WE'RE LOOKING TO GET A VEHICLE FOR APPLICANTS TO COME IN SO P &
Z IS DISCUSSING WHAT IS ACTUAL. >> IS THAT YOUR MOTION?
>> THAT'S MY MOTION. >> SO THAT'S MY MOTION.
>> DO I HAVE A SECOND TO THE MOTION?
>> SHOULD WE BREAK THAT DOWN A LITTLE BETTER?
>> YEAH, I THINK THE CLERK WOULD APPRECIATE THAT.
>> SO, MY MOTION IS TO TABLE THE ORDINANCE FOR PLANNING AND ZONING, SECOND WOULD BE TO ADD LANGUAGE TO OUR CODE AS KAITLIN
STATED "LIKE". >> IS IT BETTER TO SEPARATE THE
>> I WOULD LIKE TO MAKE A MOTION TO TABLE THE ORDINANCE.
>> SECOND. >> ALL RIGHT. IS THERE ANYBODY FROM THE PUBLIC THAT HAS A COMMENT ON IT?
>> SEEING NONE, ROLL CALL. (ROLL CALL)
>> PASSES UNANIMOUSLY. >> SECOND MOTION.
>> MY SECOND MOTION WOULD BE TO ADD THE "LIKE" PORTION THAT KAITLIN HAD STATED WHICH IS A BUSINESS LIKE BUT IT'S GOT TO GO THROUGH SPECIAL EXCEPTION, RIGHT? WHATEVER KAITLIN SAID,
THAT'S MY MOTION. >> DO WE HAVE A SECOND IN
>> I JUST WANT TO CLARIFY THE MOTION, WHAT WE'RE DOING IS WE'RE GOING TO REVIEW THE CODE AND AMEND IT RELATIVE TO ADDING THIS NEW LAPPING THAT WILL ALLOW US TO HAVE BUSINESSES THAT ARE SIMILAR TO THOSE ALREADY IN USAGE MAKE APPLICATION AND STILL
VIEWED BY SPECIAL EXCEPTION. >> AND IF THAT'S THE MOTION I
WILL SECOND IT. >> ALL RIGHT. MOTION BY MAYOR WALKER AND SECOND BY COMMISSIONER CUTLER, IS THERE ANY PUBLIC IMPUT? SEEING NONE, ROLL CALL.
(ROLL CALL) >> THIS ISN'T A MOTION BUT I
WOULD LIKE TO HAVE A WORKSHOP. >> SECOND.
>> WHENEVER WE COULD HAVE A WORKSHOP TO DISCUSS OUR BUSINESS
>> AND I GUESS MAYBE WE DISCUSS. WHATEVER WE DISCUSS AT THAT WORKSHOP AND WHENEVER WE COULD HAVE THAT WORKSHOP.
>> JUST FOR CLARITY I WANT TO UNDERSTAND THAT THE LANGUAGE WHERE WE'RE ADDING THE "LIKE" WILL THEN BE THE ORDINANCE AND WE'LL MOVE FORWARD WITH THAT AND WE'LL DO FIRST AND SECOND
READING? >> IT WILL GO TO P & Z FOR
DISCUSSION AND COMMENTS. >> RIGHT. SO THEN AFTER THAT WE'LL HAVE A WORKSHOP TO REVIEW ALL THE USES AND TALK THEN A
STRATEGY FOR THE HAIRING BAY? >> CORRECT.
>> IT COULD BE FOUR WEEKS LATER. BECAUSE YOU'RE NOT STOPPING THE PROCESS, YOU'RE MOVING IT FORWARD.
>> IT'S NOT A RUSH TO HAVE THE WORKSHOP, OBVIOUSLY WE WOULD LIKE IT SOONER RATHER THAN LATER.
>> IF IT'S A COUPLE OF MONTHS, OR AFTER BREAK, WHATEVER IT IS,
THAT'S FINE. >> ANTHONY, YOU ALL RIGHT?
>> MY ONLY CAVEAT THAT THAT, NANCY, IS IF THE AMENDMENT OF THE ORDINANCE AS IT EXISTS NOW AND THE DISCUSSIONS WITH P & Z AND STAFF AND OUR PLANNING DEPARTMENT, IF THAT IS GOING TO OPEN UP THE FLOOD GATES TO APPLICATIONS THAT ARE NOT DIRECTLY CONNECTED TO A PERMITTED USE AND BOMBARD CITY STAFF AND THE PLANNING DEPARTMENT, WE NEED TO KNOW THAT
BEFORE THE FIRST READING. >> BUT IT'S STILL HAS TO BE --
>> I AGREE, MY THOUGHT OF DOING THE WORKSHOP IN TANNED DUMB WITH
[02:45:01]
THAT. >> I THINK THE CERTAIN IS VALID, I BELIEVE THAT'S GOING TO BE PART OF THE DRAFTING PROCESS, THEY'RE GOING TO HAVE TO CONTEMPLATE MAKING SURE WHEN THEY PUT THE LANGUAGE IN AND I'M SURE THERE'S A LOT OF WAYS TO FIND A WAY THAT IT DOESN'T ALLOW TOO MUCH LEEWAY FOR SOMEONE TO SAY, I SEE YOU HAVE A RESTAURANT, I WANT TO OPEN A CASINO AND THAT WILL BE UP TO P & Z.
>> AS KAITLIN ALSO SAID THAT THE SPECIAL IF IT COMES THROUGH ON THE APPLICATION IT'S UP TO THE PLANNING AND ZONING TO DETERMINE THAT. NO WORK WILL BE DONE UNTIL THE PLANNING AN ZONING DIRECTOR GIVES IT THE OKAY.
>> YOU UNDERSTAND MY CONCERN, MY CONCERN IS WE'VE HAD THIS YOU CAN'T APPLY IF YOU DON'T MEET THESE QUALIFICATIONS. THERE'S GENESIS AND RATIONAL TO THAT, I DON'T WANT TO OBLITERATE THAT.
>> THE DIRECTOR WILL DETERMINE. >> RIGHT. AND OUR CODE IS NOT, THIS CHANGE IS NOT OUT OF WHACK WITH NEIGHBORING CITIES. THIS CHANGE WE'RE TALKING ABOUT IS NOT, I MEAN --
>> OR IS IT? >> IT'S A SMALLER PHILOSOPHICAL CHANGE IN PARKLAND WHEREAS WE'RE ALLOWING PEOPLE TO SUBMIT THEIR PLAN BUT IT'S NOT THAT OTHER CITIES DON'T USE.
>> THERE'S TWO SCHOOLS OF THINKING IT'S EITHER THE WAY WE HAVE IT CURRENTLY WHICH IS IF THAT'S NOT EXPRESSLY ADS THAT ADDITIONAL LINE ABOVE THE PERMITTED USE TABLE AND IT'S PROBABLY A COIN TOSS AND THERE'S JUST AS MANY CITIES THAT DO IT
THAT WAY AS NOT. >> AND WE ALWAYS HAVE THE SPECIAL EXCEPTION. GIVING PLANNING AND ZONING AN OPPORTUNITY TO DO WHAT THEY HAVE TO DO AND VICE VERSA THAN US.
>> MY ONLY COMMENT TO THAT IS I WANT TO MAKE SURE WE CONTINUE TO KEEP AS MUCH CONTROL OVER WHAT WE DO AND DON'T ALLOW WITHIN THE CITY. IF THERE'S A PHILOSOPHICAL DIFFERENCE, THAT'S CERTAINLY MY INTENTION AND I DON'T KNOW IF THE REST OF YOU SHARE THAT BUT I WANT TO KEEP PARKLAND IN CHARGE FIRMLY OF
WHAT COMES INTO PARKLAND. >> WE'VE ALL SAID THAT THAT'S WHAT WE WANT TO DO. WE'VE ALL BEEN CLEAR THAT WE WANT TO BE IN CHARGE AND THAT'S WHAT THE SPECIAL EXCEPTION IS.
>> I GO BACK TO THE BAKERY EXAMPLE. AGAIN, IF SOMEBODY WANTED TO OPEN UP A BAKERY, CURRENTLY THE WAY OUR CODE IS IS THAT IT'S NOT PERMITTED. IF SOMEBODY SAID I'M OPENING UP A RESTAURANT AND I HAVE ONE TABLE BUT THE REST OF IT IS A BAKERY, ARGUMENT COULD BE MADE, WELL THAT'S A "LIKE" USE. THAT WOULD GIVE US THE ABILITY. OR SOMEBODY CAN SAY, I'M OPENING UP A RESTAURANT AND AGAIN GO UNDER THAT PREMISE BUT WHEN THEY GO FOR THE LICENSE THERE MAYBE A DIFFERENT LICENSE THEY NEED TO GET FOR A RESTAURANT VERSUS A BAKERY, SO THEY'RE PROHIBITED NOT FROM OUR CODE BUT FROM THE STATE OR WHATEVER.
>> AND WE'RE ABLE TO USE THE SPECIAL EXCEPTION SAYING YOU HAVE TO HAVE A MINIMAL AMOUNT OF TABLES. BUT THAT'S OUR CONTROL IN THE PROCESS. SO WE'RE NOT GIVING UP ANY CONTROL
WHATSOEVER. >> THERE'S DEFINITELY A STRAIGHT FACED TEST THAT'S GOING TO BE DONE.
>> WE'RE ALL CLEAR NOW ON THIS ONE. SO COMMENTS BY THE BROWARD
SHERIFF'S OFFICE? >> CHRIS MULLIGAN CAPTAIN OF PARKLAND DISTRICT I'M HAPPY TO REPORT THAT I HAVE NOTHING TO REPORT. IT'S BEEN A QUIET COUPLE OF WEEKS AND THAT'S IT.
ANY QUESTIONS OR? >> NO, THANK YOU, GOOD JOB
